HomeMy WebLinkAboutminutes07-01-10 MINUTES July 1 , 2010 The Kauai Liquor Control Commission held a regular meeting on Thursday, July 1 , 2010, at 4:00 p.m. in Meeting Room #3 of the Lihue Civic Center, Mo'ikeha Building, 4444 Rice Street, Lihue, Kauai, Hawaii, to transact business as did properly come before the meeting as follows: ROLL CALL: In response to roll call, Chair Gerald Matsunaga, Vice Chair Shirley Akita and Commissioners Clifford Nakea, William Gibson and Gary Pacheco were present. APPROVAL OF AGENDA: Vice Chair Akita made a motion, which was seconded by Commissioner Pacheco, and unanimously carried, to approve the hearings and regular meeting agendas as prepared by the Director. PUBLIC HEARING: CASA DI AMICI RESTAURANT: Application No. 2010-106 was filed on May 13, 2010 for transfer of Restaurant General License No. 2G-053 (live entertainment but no dancing, with conditions) from Dikilato L.L.C. dba Casa di Amici to Keahi Yates, LLC dba Casa di Amici Restaurant located at 2301 Nalo Road, Koloa, Kauai, Hawaii. The Commission accepted Application No. 2010-106 for publication and public hearing on June 3, 2010 and ordered to print notice of public hearing in The Garden Island newspaper on Wednesday, June 9, 2010, scheduling the public hearing on Thursday, July 1 , 2010 at 4:00 p.m. or shortly thereafter in Meeting Room #3 of the Lihue Civic Center, Mo'ikeha Building, 4444 Rice Street, Lihue, Kauai, Hawaii. The Director reported that all legal requirements for today's public hearing have been met and up to the time of this public hearing, the department has not received any letters objecting to or supporting this application. Chair Matsunaga opened the public hearing and asked if they've received the Investigator's Report. Mr. Randall Yates and Ms. Joanna Keahi, Members of the limited liability company, represented the applicant. Mr. Yates stated that he's received and read the Investigator's Report and he did not see anything that was concerning to him. Chair Matsunaga asked for anyone who wished object to this application. Seeing none, Chair Matsunaga asked for anyone who wished to speak in favor of this application. Mr. Yates stated that he'd be delighted to answer any questions the commission may have. Since there were no questions, Chair Matsunaga closed the public hearing on Application No. 2010-106. 1 MINUTES July 1 , 2010 Commissioner Nakea made a motion, which was seconded by Commissioner Gibson, and unanimously carried, to approve Application No. 2010-106 for transfer of Restaurant General License No. 2G-053 from Dikilato LLC dba Casa di Amici to Keahi Yates, LLC dba Casa di Amici Restaurant. (2) NANI MOON MEAD: Approval of Application No. 2010-206 filed on June 17, 2010 by Nani Moon Mead, LLC dba Nani Moon Mead for a Special Beer & Wine license on June 19, 2010 at the Kilohana Luau Pavilion, 3-2087 Kaumualii Highway, Lihue, Kauai, Hawaii. (3) FRIENDS OF DICKIE CHANG: Approval of Application No. Free 2010-34 filed on June 22, 2010 by the Friends of Dickie Chang for a Free One-Day Special Dispenser Beer & Wine license on June 27, 2010 at the Kilohana Luau Pavilion, 3-2087 Kaumualii Highway, Lihue, Kauai, Hawaii. 2 MINUTES July 1 , 2010 (e) ACTIONS OF THE DIRECTOR: (Cont'd.) (4) KILOHANA: Approval of special requests for temporary decrease of premises by excluding the Luau Pavilion on June 19, 2010 from 10:00 a.m. to 6:00 p.m. and on June 27, 2010 from 2:00 p.m. to 9:00 p.m. (5) DA KINE WINE: Approval of special request to conduct wine tastings, per list, on June 19, 2010 and June 26, 2010 from 4:00 p.m. to 7:00 p.m. (6) THE ST. REGIS PRINCEVILLE RESORT: Approval of special request for temporary increase of premises to include Fort Alexander, per diagram submitted, on June 14, 2010 from 6:30 p.m. to 7:30 p.m. and on June 26, 2010 from 7:00 a.m. to 11 :00 p.m. (7) TIMES SUPER MARKET: Approval of special request to conduct wine and distilled spirit tastings, per list and diagram submitted, on July 2, 2010 from 3:30 p.m. to 6:30 p.m. and on July 3, 2010 from 1 :00 p.m. to 4:00 p.m. (f) INFORMATIONAL MATTERS. Commissioner Gibson made a motion, which was seconded by Commissioner Pacheco, and unanimously carried, to approve the above Director's Report. 2. RENEWAL OF LIQUOR LICENSES: See Attachment "B" A motion was made by Vice Chair Akita, seconded by Commissioner Pacheco, and unanimously carried, to approve applications for renewal of liquor licenses as listed on Attachment "B". 3. RENEWAL OF PERMITS: See Attachment "C" Commissioner Pacheco made a motion, which was seconded by Vice Chair Akita, and unanimously carried, to approve the renewal of permits listed on Attachment "C". 4. REQUEST FOR EXTENSION IN TIME TO SUBMIT TAX CLEARANCES FOR RENEWAL OF LIQUOR LICENSES. The Director stated that there are 6 licensees, Lihue Bowling Center, 1 sc Tee Mini Bar, Bali Hai Restaurant, Makai Golf Course, Market Street Diner, and Simply Sundry, trying to clear their State and IRS liabilities. During the extension period, no alcohol can be sold but the licensees are given time to obtain their tax clearances. A motion was made by Vice Chair Akita, seconded by Commissioner Pacheco, and unanimously carried, to approve the requests from the above 6 licensees for extension in time to submit tax clearances for renewal of liquor licenses. 3 MINUTES July 1 , 2010 5. CHANGE INCORPORATE OFFICERS: (a) KMART CORPORATION: Election/appointment of Alfred Herbert Jasser, Vice President &Treasurer; removal of Allen Robert Ravas, Senior Vice President, Finance. (b) KAUAI KILOHANA PARTNERS: Gregg Solomon replacing Courageous Kauai Ltd. as limited partner. (c) KIM CHEE RESTAURANT #9, LLC: Addition of Dong Kyung Chun, member. (d) KOLOA RUM CORP.: Addition of John Stein, Secretary/Director, and Robert Weist, Rita Gregory, Christopher Wolf and Michael Bacco as Directors; resignation of J. Gregory Schredder as Secretary/Treasurer and Director. (e) THE LODGE AT KOKEE: Addition of Elizabeth K. Faye and Gail Morgan as Directors; removal of Alexander L. Commissioner Pacheco made a motion, which was seconded by Commissioner Gibson, and unanimously carried, to approve the above change in corporate officers, (a) through (g), inclusive. 6. SALE OF 25% OR MORE OF OUTSTANDING CAPITAL STOCK: KOLOA RUM CORP.: Transfer of stock from J. Gregory Schredder to Robert Weist, resulting in Robert Weist holding 39% of the outstanding shares. A motion was made by Commissioner Pacheco, seconded by Commissioner Gibson, and unanimously carried, to approve the above transfer of stock of Koloa Rum Corp. 7. ALCOHOL PURCHASE PERMIT: NATIONAL TROPICAL BOTANICAL GARDEN: Request for permit to purchase absolute and diluted alcohol solutions. The Director explained that these alcohol solutions are used for scientific research and to sanitize their equipment. A motion was made Commissioner Pacheco, seconded by Commissioner Gibson, and unanimously carried, to approve the above request for a permit to purchase absolute and diluted alcohol solutions. 4 MINUTES July 1 , 2010 8. CANCELLATION OF TEMPORARY LICENSE: KAPAA LIQUOR & WINE CO. LLC: Effective June 18, 2010, cancellation of Temporary License No. T 2010-08 issued to Kapaa Liquor & Wine Co. LLC dba same. Commissioner Nakea made a motion, which was seconded by Commissioner Pacheco, and unanimously carried, to accept the cancellation of Temporary License No. T 2010-08. The Director distributed the furlough schedule and explained that the Fridays in green on the calendar indicate days when the office will be closed. The investigators will be on staggered furlough schedules, similar to trash collectors and lifeguards.
