HomeMy WebLinkAbout1-20-2011 COW MINUTES COMMITTEE OF THE WHOLE January 20, 2011 A meeting of the Committee of the Whole, of the Council of the County of Kauai, State of Hawaii, was called to order by Councilmember Jay Furfaro, Chair, at 3371-A Wilcox Road, Lihu`e, Kauai, on Wednesday, January 20, 2011 at 10:38 a.m., after which the following members answered the call of the roll: Honorable Jay Furfaro Honorable Derek S.K. Yukimura The Committee proceeded on its agenda items, as shown in the following Committee Reports which are incorporated herein by reference: CR-COW 2011-06: on Bill No. 2389 AN ORDINANCE AMENDING ORDINANCE NO. B-2010-705, AS AMENDED, RELATING TO THE OPERATING BUDGET OF THE COUNTY OF KAUAI, STATE OF HAWAII, FOR THE FISCAL YEAR JULY 1, 2010 THROUGH JUNE 30, 2011, BY REVISING THE SURPLUS AND APPROPRIATIONS ESTIMATED IN THE VARIOUS FUNDS AND MAKING THE APPROPRIATE TEXT CHANGES AS IT RELATES TO FURLOUGHS (.$2,328,554.00) [Approved.] There being no objections, the Committee recessed at 12:00 p.m. The Committee reconvened at 12:10 p.m., and proceeded as follows: CR-COW 2011-07: on Bill No. 2392 A BILL FOR AN ORDINANCE TO AMEND ORDINANCE NO. B-2010-705, AS AMENDED, RELATING TO THE OPERATING BUDGET OF THE COUNTY OF KAUAI, STATE OF HAWAII FOR THE FISCAL YEAR JULY 1, 2010 THROUGH JUNE 30, 2011 BY REVISING THE SURPLUS AND APPROPRIATIONS ESTIMATED IN THE GENERAL FUND (.$325,000.00 — County Auditor) [Approved.] Page 1 of 5 Minutes of the January 5, 2011 Committee of the Whole Meeting. Upon motion duly made by Councilmember Rapozo, seconded by Councilmember Chang, and unanimously carried, the minutes of the January 5, 2011 Committee of the Whole meeting was approved. CR- COW 2011-08: on Bill No. 2393 A BILL FOR AN ORDINANCE AUTHORIZING THE COUNTY AUDITOR TO PROCURE THE SERVICES OF A CONTRACT AUDITOR AND APPROVING A CONTRACT FOR A CONTRACT AUDITOR FROM APPROPRIATIONS OF A LATER FISCAL YEAR AND FOR MORE THAN ONE FISCAL YEAR [Approved.] Bill No. 2388 AN ORDINANCE AMENDING ORDINANCE NO. B-2010-705, AS AMENDED, RELATING TO THE OPERATING BUDGET OF THE COUNTY OF KAUAI, STATE OF HAWAII, FOR THE FISCAL YEAR JULY 1, 2010 THROUGH JUNE 30, 2011, BY REVISING THE SURPLUS AND APPROPRIATIONS ESTIMATED IN THE GENERAL FUND ($62,719.00- Golf Fund and $2,704,873.00 —Sewer Fund) [This item was deferred.] JAY FURFARO, Council Chair: We're going to go back down to the top bill and I will give you the number as I see it in my glasses, 2388. LAURIE CHOW, Senior Clerk Typist: Bill No. 2388 an ordinance amending ordinance No. B-2010-705, as amended, relating to the operating budget of the county of Kauai, State of Hawaii for the fiscal year July 1, 2010 through June 30, 2011, by revising the surplus and appropriations estimated in the general fund ($62,719.00- Golf Fund and $2,704,873.00—Sewer Fund) MEL RAPOZO: Move to approve. JOANN YUKIMURA: Seconded. Mr. Furfaro: Excuse me. I wanted to share with you folks that I have had discussions on these two money bills, with the Administration in particular, regarding the golf fund. I have asked them if they could commit some time on the questions that I raised with them, especially in the golf area, and they have taken some comments there that need to actually submit a new bill on this. So I am asking for a deferral here after my discussion with them. TIM BYNUM: To receive the bill or defer? Mr. Furfaro: I'm asking for a deferral. Let me say that again. I have Page 2 of 5 raised some questions with them on the numbers that in my opinion doesn't make this request correct. They have concurred and are willing to work on a new bill. The new bill, whether it gets introduced after I see it, will require maybe some changes here, so I'm asking for a deferral? JOANN YUKIMURA: Mr. Chair? Mr. Furfaro: Yes. Ms. Yukimura: That's not a problem as far as I'm concerned, but it could also just be an amendment to this bill as well. So we would wait to see what the exact results are? Mr. Furfaro: That's correct, but for right now I'm just asking for a deferral. Ms. Yukimura: Yes. Mr. Bynum: Ready for a motion? Mr. Furfaro: Yes. Mr. Bynum: Move to defer. I'm sorry. Ms. Yukimura: So knowing anyway what your intention is, I just wanted to say that I too sent a request in about intention or the long range goal of the Administration with respect to these two basically enterprise funds and haven't received an answer back. I don't know that I have to get an answer by the time we move on this particular proposal, but I do hope it will be a matter of discussion at least in the upcoming budget because it's about the self sufficiency of the funds. Mr. Furfaro: Understood. We have a deferral and we have a second and I'm just asking... DICKIE CHANG: We don't have a second yet. Mr. Furfaro: Oh I thought I heard a second here. Let me go back; hold on. We have a motion and a second and perhaps I shouldn't have bent that for you... Ms. Yukimura: I thought the motion had died, sorry. Mr. Furfaro: Excuse me, there seems to be some discussion about the second being withdrawn and so forth. I have asked the Administration to come up with a new bill because I don't feel comfortable with the numbers. Page 3 of 5 Ms. Yukimura: Could we just have for clarity of record maybe Council member Bynum withdraw his motion? Mr. Bynum: Yes, I withdraw my motion. Ms. Yukimura: And the second so that we can comfortably discuss... Mr. Furfaro: Let me clarify upfront what I'm going to get to then I will go to Mr. Bynum. Do you have a problem removing your motion? Mr. Bynum: Not at all. Mr. Furfaro: Thank you. Ms. Yukimura: Thank you. Mr. Furfaro: Does everybody understand my narrative that I've asked them to correct the numbers in the bill? Ms. Yukimura: Yes. Mr. Furfaro: And you were the second? DEREK KAWAKAMI: Yes, but I took mine away. Mr. Furfaro: And he took his away, okay. So Mr. Rapozo you called for the question? Mr. Rapozo: The original motion was to approve, so if we're going to defer it and there's no more discussion then somebody would need to make that motion, and that motion would trump the motion to approve, and then we can go to lunch. Mr. Furfaro: I understand the rules, and the Chairman is asking for a deferral. Will someone make a motion? Mr. Bynum: May I make a motion? I would like to make a motion to defer this bill until such time as a new bill comes to committee. NADINE NAKAMURA: Second. Mr. Furfaro: All those in favor? All Council members: Aye. Mr. Furfaro: Thank you. We are now on lunch. There being no objections, the Committee recessed at 12:00 p.m. The meeting was called back to order at 12:44 p.m., and there being no further business, the meeting was adjourned.
