HomeMy WebLinkAboutMinutes of 5-17-11 MINUTES OF MAY 17, 2011 CALL TO ORDER: While waiting for the arrival of Chairman Ryan de la Pena,the regular meeting of the Civil Service Commission was called to order by Vice Chairman Roy Morita on Tuesday, May 17, 2011, at 3:08 p.m. in the Liquor Control Commission Conference Room, Lihue, Kauai. ROLL CALL: Ms. Catherine Adams Ms. Lam Aranio Mr. John Low Mr. Gilbert Maerina Others: Mr. Thomas Takatsuki, Personnel Services Manager Ms. Joyce Schuierer, Personnel Management Specialist Mr. Dale Shimomura, HGEA, Union Agent Ms. Verna Bacarro, Civil Service Secretary Mr. Marc Guyot, Deputy County Attorney APPROVAL OF AGENDA: On motion of Ms. Adams, seconded by Ms. Aranio and carried,the Agenda was approved as circulated. APPROVAL OF MINUTES: Vice Chair pointed out that Ms. Adams was present at the April 19, 2011 meeting, so she should be listed under ROLL CALL. Hearing no further corrections and additions to the Minutes of April 19, 2011,the Minutes were approved as corrected on motion of Mr. Low, seconded by Ms. Adams. The motion was carried unanimously. CORRESPONDENCE: a. Appeal to the Civil Service Commission/Merit Appeals Board regarding adverse action taken: The document was received and acknowledged on motion of Ms. Adams, seconded by Ms. Aranio. The motion was carried unanimously. b. Letter dated April 27, 2011, Request to Appeal regarding non-selection: On motion of Ms. Aranio, seconded by Ms. Adams,the letter was received and acknowledged. The motion was carried unanimously. C. Appeal to the Civil Service Commission/Merit Appeals Board regarding Termination: On motion of Ms. Aranio, seconded by Ms. Adams, the request to appeal termination was received and acknowledged. The motion was carried unanimously. Mr. Dale Shimomura, HGEA, Union Agent, introduced himself to the Commissioners and distributed a letter dated May 17, 2011, requesting the presence of the Executive on Aging at the appeal hearing and requesting background information regarding qualifications of certain individuals. On motion of Ms. Adams, seconded by Mr. Macrina, and carried, the May 17, 2011 letter was received and acknowledged. (Note: Chairman Ryan de la Pena appeared at the meeting at 3:15 p.m.) The Commissioners scheduled the appeal hearing for Tuesday, June 21, 2011, beginning at 3:00 p.m. Mr. Shimomura thanked the Commission for their prompt action. NEW BUSINESS: a. Classification Appeal Hearing regarding Effective Date of Reallocation: Deputy Attorney Marc Guyot apprised the Commissioners that a letter dated May 13, 2011 was received from Ms. Gausepohl-White informing them that she is withdrawing her appeal. UNFINISHED BUSINESS: There was no unfinished business to discuss. DIRECTOR'S REPORT: In the absence of the Director, staff distributed weekly reports to the Commissioners for their review. NEXT MEETING: The next meeting is scheduled for Tuesday, June 21, 2011, beginning at 2:00 p.m. On motion of Ms. Adams, seconded by Ms. Aranio, the appeal hearing on the non- selection will be scheduled for Tuesday, June 21, 2011, beginning at 2:00 p.m., and the appeal hearing on the adverse action taken will be scheduled for the July 19, 2011 meeting beginning at 2:00 p.m. The motion was carried unanimously. Staff was instructed to inform the parties as applicable. On motion of Ms. Aranio, seconded by Mr. Morita, staff was instructed to include discussion on the Commission's legal liabilities and obligations on the June 21, 2011 Agenda, under Executive Session. The motion was carried unanimously. On motion of Ms. Adams, seconded by Ms. Aranio, the regular meeting was adjourned at 3:39 p.m. The motion was carried unanimously. EXECUTIVE SESSION: At 3:39 p.m., Chairman de la Pena called for an Executive Session meeting. ADJOURNED: There being no further business to come before the Commission, on motion of Ms. Adams, seconded by Mr. Low, the meeting was adjourned at 4:06 p.m. The motion was carried unanimously.
