HomeMy WebLinkAboutBOR Minutes 5.03.10 COUNTY OF KAUAI Minutes of Meeting OPEN SESSION APPROVED 6/14/10 Board/Committee: BOARD OF REVIEW Meeting Date May 3, 2010 Location Meeting Room 2, Moikeha Building Start of Session: 1:06 p.m. End of Session: 1:30 p.m. Present Chair Benjamin Lizama, Craig De Costa, Cayetano Gerardo, Russell Kyono, Lisa Wilson Staff: Steven Hunt, Kris Nakamura Excused Absent SUBJECT DISCUSSION ACTION Prior to the meeting, new Board of Review members Russell Kyono&Lisa Wilson were sworn in by County Clerk Peter Nakamura. Mayor Bernard Carvalho was in attendance to congratulate the new members. Call To Order Chair Lizama called the meeting to order at 1:06 p.m. Approval of Mr. Gerardo made a motion to approve the Agenda agenda. Mr. De Costa seconded the motion. Motion carried 5:0. Approval of July 27, 2009 August 11, 2009 August 24, 2009 Mr. Gerardo made a motion to approve the Minutes September 21, 2009 October 5, 2009 October 19, 2009 minutes. Mr. De Costa seconded the motion. November 2, 2009 November 16, 2009 November 30, 2009 Motion carried 5:0. December 14, 2009 Election of Chair Chair—Benjamin Lizama, Jr. Mr. De Costa made a motion to elect the Chair &Vice Chair for Vice Chair—Craig De Costa and Vice Chair for 2010. Mr. Gerardo seconded 2010 the motion. Motion carried 5:0. Appeals Scheduled Appeal Case No. 10-8850 - HOH Utilities—TMK 2-8-017-027-0000 Moana Kinimaka Palama was in attendance representing HOH Utilities to provide evidence for their appeal. Steve Hunt was in attendance and presented the facts to the Board. Mr. Gerardo made a motion in the matter of tax appeal 10-8850, he recommended that the Board sustain the County's denial of exemption. Mr. Kyono seconded the motion. Motion carried 5:0. Appeal Case No. 09-7367—Consolidated Maui. Inc. —TMK 4-3-002-012-0000 The appellant or their representative was not in attendance to provide evidence for their appeal. Steve Hunt was in attendance and presented his report to the Board. Mr. De Costa made a motion in the matter of tax appeal 09-7367, he recommended that the Board sustain the County's assessment. Mr. Gerardo seconded the motion. Motion carried 5:0. County's assessment sustained. Appeal Case No. 09-7804—Walmart Stores, Inc. —TMK 3-7-001-036-0000 Taxpayer withdrew appeal. County's assessment sustained. Appeal Case No. 09-7807 —Wilcal Kauai. LLC—TMK 4 The appellant requested a continuance and this case will be scheduled at a later date. Appeal Case No. 09-7808—Canpartners Realty Holding Co. IV—TMK 4-3-007-027-0000 Taxpayer withdrew appeal. County's assessment sustained. Stipulations Appeal Case No. 09-7802—Greg L.
