REQUEST FOR AN ADVISORY OPINION
RAO 11-008 Letter dated November 3, 2011 from Mayor Bernard P. Carvalho, Jr.,
requesting an advisory opinion from the Board of Ethics stating that there
is no violation of the Code of Ethics in his accepting a complimentary
ticket to attend the 2011 Asia-Pacific Economic Cooperation (APEC)
CEO Summit. Government officials receiving comp tickets for the CEO
Summit are being requested by the National Center for APEC to produce a
letter certifying that the acceptance of the comp ticket does not constitute a
violation under the governmental body's ethics rules.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes §§92-4 and 92-5 (a) (4), 92-9 (a)(1-4) (b), the purpose of
this executive session is to receive and approve Executive Session minutes and to consult with
the Commission's legal counsel on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and/or liabilities as they may relate to this item, deliberate
and take such action as appropriate.

APEC 2011 CEO Summit
Dear Chair Weil and Members of the Board of Ethics:
APEC 2011 Hawaii, a nonprofit corporation, also referred to as the "Hawaii Host
Committee", has invited the mayors of counties of Kaua'i, Maui, Honolulu, and Hawaii
to attend the APEC CEO Summit 2011, a series of private-sector meetings, consisting
of following events:
• A welcome reception hosted by the Hawaii APEC Host Committee (November
10, 2011);
• The CEO Summit consisting of the presentations set forth in the attached
program brochure.
The cost to attend the program as a delegate is Three Thousand Eight Hundred Dollars
($3,800.00). The Hawaii Host Committee is waiving the delegate fee for the mayors, as
well as other government officials, to attend. The National Center for APEC requires
that government officials obtain clearance that acceptance of the comp ticket is in
compliance with the applicable governmental body's code of ethics.
I believe this is an exciting opportunity to present Kaua'i's natural resources,
facilities, visitor industry and diverse cultural heritage and talents to representatives
from throughout the region. APEC 2011 Hawaii was organized to advance HawaiTs
business agenda in the Asia-Pacific region and to create high quality opportunities for
private-sector engagement during the APEC forum. The APEC forum will include the
Leaders Meeting (a two-day meeting of the heads of the 21 APEC member economies
on November 12-13, 2011) as well as meetings of the APEC Senior Officials, Ministers,
the APEC Business Advisory Council, and the APEC CEO Summit. Participation in the
CEO Summit will allow me to network with delegates from other countries and obtain
relevant information about trade, commerce, social, economic and other initiatives in the
Asia-Pacific region. Participation in the CEO Summit provides an opportunity to

dialogue and for direct, focused, interaction between business, government and though-
leaders from around the region, including a discussion of key commercial and trade
issues. It is a unique opportunity to promote Kaua'i to delegates from throughout the
Asia-Pacific region.
Though the Code of Ethics contained in the Charter and Kaua'i County Code
places restrictions on the acceptance of gifts when they are given to obtain preferential
treatment, I do not believe that the provisions are intended to limit my attendance at an
event which provides a unique opportunity to promote Kaua'i's interests. The source of
the invitation, the Hawaii Host Committee, is an entity whose purpose involves the
advancement the interests of the State of Hawaii as the host of the forum. Therefore, I
believe that my attendance at the APEC 2011 CEO Summit will be beneficial to the
County. Therefore, I request that you render an advisory opinion that there is no
violation of the code of Ethics in my acceptance of a comp ticket to attend the APEC
CEO Summit.
