PLANNING CONIIVIITTEE
February 10, 2010
A meeting of the Planning Committee of the Council of the County of
Kauai, State of Hawaii, was called to order by Councilmember Jay Furfaro, Chair,
at the Historic County Building, Room 201, Lihu`e, Kauai, on Wednesday,
February 10, 2010, at 12:15 a.m., after which the following members answered the
call of the roll:

Minutes of the January 13, 2010 Planning Committee Meeting.
Upon motion duly made by Councilmember Bynum, and seconded by
Councilmember Kawakami, and unanimously carried, the Minutes of the
January 13, 2010 Planning Committee Meeting was approved.
The Committee proceeded on its agenda items, as shown in the following
Committee reports which are incorporated herein by reference.
Bill No. 2298 A BILL FOR AN ORDINANCE TO AMEND CHAPTER 8,
KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO
THE COMPREHENSIVE ZONING ORDINANCE AND
SINGLE-FAMILY TRANSIENT VACATION RENTALS
[This item was deferred.]
JAY FURFARO (COMMITTEE CHAIR): As mentioned earlier as a
courtesy, we do have a request from the County Attorneys also to defer this item.
Before I ask for a deferral, is there anyone in the audience who would like to speak?
There's no one in the audience. I am looking for that deferral.
DEREK S. K. KAWAKAMI (COMMITTEE MEMBER): Move to defer.
DARYL W. KANESHIRO (COMMITTEE MEMBER): Second the motion.
Mr. Furfaro: All those in favor please say "aye."

Upon motion duly made by Councilmember Kawakami, and seconded by
Councilmember Kaneshiro, and unanimously carried, Bill No. 2298 was

Mr. Furfaro: Thank you. Now we'll go to Bill No. twenty-
three, thirty-nine (2339).
Bill No. 2339 A BILL FOR AN ORDINANCE AMENDING ARTICLE 8 OF
CHAPTER 8 OF THE KAUAI COUNTY CODE 1987, AS
AMENDED, RELATING TO DEVELOPMENT STANDARDS IN
THE OPEN DISTRICT

Mr. Furfaro: There has been some thought on perhaps
scheduling a workshop on this bill as well. Reason being we also have a bill twenty,
zero, twenty-two (2022) which has been dormant and I would like to see about
anyone requesting to bring that out for discussion and a workshop along with this
bill. Is there anyone that would like to comment on that possibility or not having a
workshop on it?
TIM BYNUM (COMMITTEE MEMBER): Yeah regarding this bill, I
would hope we would have a amendment today to clarify those subdivisions having
tentative approval, me included. Apparently that's not ready and I concur with you
that the other bill is worth reexamining. I don't know that they're that interrelated
anymore, so but I would really welcome a workshop on the other bill or at the
judgment of our Planning Chair, but you know for myself with that one (1)
amendment I'm ready to move on this bill, but on the other bill, a workshop would
be great.
Mr. Furfaro: Okay. That bill was deferred pending a
workshop.
Mr. Bynum: Yes it was.
Mr. Furfaro: But (inaudible) come to that conclusion yet
but a great portion of this open section actually came out of that portions of that
bill. Although that bill covers Ag areas as well. So I will not pursue that subject
right at the moment but on twenty-three, thirty-nine (2339), we did have some
questions that were sent over to the County Attorney as well.
Mr. Bynum: And I...
Mr. Furfaro: And we have not gotten back answers.
Mr. Bynum: Yeah I was hopeful that we would have that

Mr. Furfaro:

Well without it, may I have a deferral then

Mr. Furfaro: Do I have a seconded?

LANI KAWAHARA (COMMITTEE MEMBER): Seconded.
Mr. Furfaro: Thank you. Any further discussion? All
those in favor... oh no discussion I'm sorry it's been a long day Mr. Kaneshiro, and
it's not even lunch yet. All those in favor of the deferral please say "aye."

Councilmember Kawahara, and unanimously carried, Bill No. 2339 was
deferred.
Bill No. 2342 A BILL FOR AN ORDINANCE ESTABLISHING
REGULATIONS, PROCEDURES, ZONING AND
DEVELOPMENT PLANS FOR THE LIHU`E TOWN CORE
AREA AND ESTABLISHING EXCEPTIONS, MODIFICATIONS
AND ADDITIONS TO CHAPTER 8 AND CHAPTER 10 OF THE
KAUAI COUNTY CODE 1987
[This item was deferred.]
Mr. Furfaro: This bill does have a scheduled workshop for
February 16 at 9:00, I have to look to the Clerk's Office on a question here, is that
notice going to be posted today for this workshop?
Yes? Okay and so that notice will be posted and I would like to ask that we
consider deferring this until February 24~ I believe is the next Committee Meeting,
until such time that we've completed the workshop. Do I have the right date there
Mr. Watanabe? Yes, I do, okay.
Mr. Bynum: So moved.
Ms. Kawahara: Seconded.
Mr. Furfaro: Thank you very much. This will be deferred
date specific to February 24. I had a question there because we are moving in that

week, is that? Oh okay tentative then. Okay, okay. All those in favor of the
deferral please?
Committee Members: Aye.
Upon motion duly made by Councilmember Bynum, and seconded by
Councilmember Kawahara, and unanimously carried, Bill No. 2342 was
deferred.
Mr. Furfaro: That will end the scheduled activity in the
Planning Committee for today, thank you so much.
There being no further business, the meeting was adjourned at 12:20 p.m.
