HomeMy WebLinkAbout11-17-2010-Doc15844! ..~. `` • ~ 1.. . ~ ~ .. • SPECIAL COUNCIL MEETING November 17, 2010 The Special Council Meeting of the Council of the County of Kauai was called to order by the Council Chair at the Council Chambers, 3371-A Wilcox Road, Lihu`e, Kauai, on Wednesday, November 17, 2010 at 9:33 a.m., after which the following members answered the call of the roll: Honorable Tim Bynum Honorable Dickie Chang Honorable Jay Furfaro Honorable Daryl W. Kaneshiro Honorable Lani T. Kawahara Honorable Derek S.K. Kawakami Honorable Bill "Kaipo" Asing, Council Chair APPROVAL OF AGENDA. Chair Asing: Can I have a motion to approve the agenda? Mr. Kaneshiro: So moved. Mr. Furfaro: Second. Chair Asing: Any discussion? (Silence) All those in favor, say aye. Councilmembers: Aye. Chair Asing:- Opposed, say no. (Silence) Motion carried. Mr. Kaneshiro moved for approval of the agenda as circulated, seconded by Mr. Furfaro, and unanimously carried. Chair Asing: With that, I'd like to now turn it over to the county attorney's office. EXECUTIVE SESSION: There being no objection, the rules were suspended. MAUNA KEA TRASK, Deputy County Attorney: Thank you, Chair. and County of Kauai and Kauai Police Department, Case ID CAAP-10-0000077 (Intermediate Court of Appeals) and related matters. This briefing and consultation involves consideration of the powers, duties, privileges, immunities and/or liabilities of the Council and the County as they relate to this agenda item. Chair Asing: Thank you. With that, I'd like to call the meeting back to order and have a motion to move into executive session. ES-473 Pursuant to Haw. Rev. Stat. sections 92-4 and 92-5(a)(4), and Kauai County Charter section 3.07(E), the purpose of this executive session is to provide Council with a briefing and to request authority for a possible settlement proposal in the case of In the Matter of the Grievance Arbitration Between: SHOPO ...~~s SPECIAL COUNCIL~ETING - 2 - ~ovember 17, 2010 The Chair called the meeting back to order and proceeded as follows: Mr. Chang: So moved. Mr. Kaneshiro: Second. Chair Asing: Any discussion? (Silence) All those in favor, say aye. Councilmembers: Aye. Chair Asing: Opposed, say no. (Silence) Motion carried. We are now going to move into executive session. Mr. Chang moved to convene in executive session on ES-473, seconded by Mr. Kaneshiro, and unanimously carried. There being no objection, the Chair recessed the meeting at 9:35 a.m. to convene in executive session. ADJOURNMENT.
