'~~=j ~ .~ ~: ~~ [[~~~'~~~ ~~~`~~ (.f~ '~' NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING Notice is hereby given that the Council of the County of Kauai will hold a public hearing on Wednesday, September 9, 2009, at 1:30 p.m., or soon thereafter, at the Council Chambers, 4396 Rice Street, Room 201, Historic County Building, Lihu`e, on the following: BILL NO. 2298 A BILL FOR AN ORDINANCE TO AMEND CHAPTER 8, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO THE COMPREHENSIVE ZONING ORDINANCE AND SINGLE-FAMILY TRANSIENT VACATION RENTALS This bill proposes to amend Chapter 8, Kauai County Code 1987, as amended, relating to the Comprehensive Zoning Ordinance (CZO) and Single Family Transient Vacation Rentals. The bill proposes the use of "enforcement agreements" for Transient Vacation Rental Operations on lands within the State Land Use District Agriculture with the intent of allowing them to continue operation while the County contemplates the Important Agricultural Lands Study (IAL). The proposed bill dictates that "enforcement agreements" would not diminish existing rights, create new rights, and will automatically terminate upon enactment of an ordinance designating Important Agricultural Lands or the owner has obtained a Special Permit under HRS Section 205-6, or March 15, 2011, whichever comes first. The Planning Commission, at its meeting held on June 23, 2009, failed to reach a majority vote on the proposed bill; therefore, pursuant to Section 8-22.5 (a), Kauai County Code 1987, proposed Bill No. 2298 is deemed automatically approved by the Planning Commission. All interested persons who wish to present their comments may do so at the public hearing. Written testimonies prior to the hearing would be appreciated. Copies of the proposed ordinances are available at the Office of the County Clerk, Council Services Division. (The Council Committee or Council may amend this Bill at its subsequent meetings. Meeting notices are posted at least 6 days in advance at the County Clerk's Office and the public may also testify at any of these meetings.)
