NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING
Notice is hereby given that the Council of the County of Kauai will hold a
public hearing on Wednesday, October 21, 2009, at 1:30 p.m., or soon thereafter, at
the Council Chambers, 4396 Rice Street, Room 201, Historic County Building,
Lihu`e, on the following:

A BILL FOR AN ORDINANCE AMENDING ORDINANCE NO. PM-227-91,
RELATING TO STATE LAND USE DISTRICT BOUNDARY IN KILAUEA,

This bill proposes to amend Ordinance No. PM-227-91, relating to the State
Land Use District boundary in K-lauea, Kauai, as follows: •~

PROPOSED USE: Downzoning
Pursuant to Condition No. 4 of Ordinance No. PM-229-91, the Planning
Department has determined that substantial construction (as required by
Ordinance No. PM-229-91) has not occurred on the parcel, and as a result, the
Planning Department has initiated proceedings to redesignate the property to its
prior land use designation.

A BILL FOR AN ORDINANCE AMENDING ORDINANCE NO PM-228-91,
RELATING TO GENERAL PLAN DESIGNATION IN KILAUEA, KAUAI
(County of Kauai, Applicant)
This bill proposes to amend Ordinance No. PM-228-91, relating to General
Plan designation in Kilauea, Kauai, as follows:
FROM: General Plan "Residential Community" Designation
TO: General Plan "Agriculture" and "Open" Designations
APPLICANT: County of Kauai
LOCATION: Kilauea, Kauai
TMK Number: 5-2-017: 028
APPROXIMATE AREA: 6.55 acres of a 15.17 acre parcel
EXISTING USE: None
PROPOSED USE: Downzoning
Pursuant to Condition No. 4 of Ordinance No. PM-229-91, the Planning
Department has determined that substantial construction (as required by
Ordinance No. PM-229-91) has not occurred, and as a result, the Planning
Department has initiated proceedings to redesignate the property back to its prior
land use designation.

All interested persons who wish to present their comments may do so at the
public hearing. Written testimonies prior to the hearing would be appreciated.
Copies of the proposed ordinances are available at the Office of the County Clerk,
Council Services Division.
(The Council Committee or Council may amend these Bills at its subsequent
meetings. Meeting notices are posted at least 6 days in advance at the County
Clerk's Office and the public may also testify at any of these meetings.)
