Deputy County Attorney Jennifer Winn, Administrative Aide Paula Morikami and Boards and Commission Staff Mercedes Youn Excused Commissioner Rowena Tachibana Absent SUBJECT DISCUSSION ACTION Call To Order Chair Iona called the meeting to order at 9:04 a.m. Approval of Commissioner Agenda Chair Iona asked if there was anyone in the audience who wished to give testimony on any of the agenda items of lannucci moved to the Commission. There were none approved; seconded As a request from the viewing public, Chair Iona stated that he would like to recognize the following staff members: by Commissioner • Boards and Commissions Staff, Mercedes Youn Grady and the • Deputy County Attorney, Jennifer Winn motion was carried • Boards and Commissions Administrative Aide, Paula Morikami 6:0. Approval of Commissioner Minutes Regular meeting minutes of December 16, 2010. O'Connor moved to approve the meeting minutes of December 16, 2010, as circulated; seconded by Commissioner Nebre and the motion was carried 6:0. Recognition and Commendation Recognition of Officer of the month Report With his grandmother present, Officer Ray Takekawa was recognized by Officer Robert Gausepohl, as a skilled and diligent investigator in addition to his enforcement efforts. There is no doubt that he is good at his job. Officer Takekawa has dealt with the families of victims of tragic traffic crashes and treats them with dignity, respect and Kaua'i Police Commission Regular Meeting January 21, 2011 Page 2 SUBJECT DISCUSSION ACTION exceptional caring in their time of great loss. Officer Takekawa is committed to assisting people in his community especially children. He has taken them on bike rides and mentored them. Here is an example of Officer Takekawa's actions: On Thursday, December 9, 2010, there was a flood watch in effect for the island of Kaua'i; the island was experiencing heavy rains and wind. Officer Takekawa was responding to the Mayor's Office for an assignment and on his way to there, he observed a female senior citizen waiting at the crosswalk to cross Rice Street, during a time of heavy traffic. Officer Takekawa recognized that she was in distress due to the weather and traffic. He saw that she must have gone to Big Save Market to buy some groceries and was walking back in the bad weather. Officer Takekawa realized that the traffic may not see her trying to cross the street. As he came up to the intersection he stopped his police vehicle and activated the emergency lights. Officer Takekawa then got out of his vehicle and proceeded to walk towards the lady to offer his assistance. The lady expressed to Officer Takekawa that she was worried about slipping on the wet street; Officer Takekawa offered his arm and walked her across the street making sure she was safe. Officer Gausepohl commended Officer Takekawa for his act of thoughtfulness and kindness, noting that it is not part of his job description, but should be used as an example for all officers to follow. Chief Perry commended Officer Takekawa for his outstanding service in the community then presented him with a certificate of Recognition and Exemplary Service. Chief's Monthly and Quarterly Reports Include: Reports • Administrative, Technical Services &Training Reports/Orders Commissioner lannucci asked how often the Firearms Training takes place within a year. Chief Perry reported that the department does the training on a yearly basis to assure that the officers are qualified for liability issues. The trainers are Detective Randy Chong Tim and Sergeant Carl Oliver. Commissioner O'Connor had concerns about the report on Crime Trends which showed that there were 4, 026 incidents reported to the Records Management System, compared to 2,345 incidents the previous month, for an increase of 1,681 incidents or plus 71.6%. Commissioner O'Connor asked whether the increase was due because of the holidays. Chief Perry stated that he will look into the matter and will report back to Commissioner O'Connor. Chief Perry also noted that there was an error on the Personnel Report for December 30, 2010, is should state that there are 22 vacancies for sworn personnel. • Fiscal Report • Patrol Services Bureau &Traffic Report • Community Oriented Policing Report for January 2011 for districts of Lihu'e, Hanalei and Waimea • Investigative Report Kaua'i Police Commission Regular Meeting January 21, 2011 Page 3 SUBJECT DISCUSSION ACTION • Administrative Notices 2010-09 Notice to fill vacancy Police Inspector, EM-07 2010-10 Notice to fill vacancy Police Captain, EM-03 • Personnel Orders • General Orders • Chief's announcements: Chief Perry announced that since the graduation of the previous recruit class, the recruits have completed the Field Evaluation Training Program; this program lasted for three and a half months. The seven (7) officers will now be hitting the road (on their own) by the second week of February. Chief Perry noted that the whole process took about 2 years, from the time of applying to becoming a police officer, to the time of hitting the road on their own. Chief Perry announced the promotions of Captain Alejandre Quibilan to Assistant Chief of Patrol Services Bureau. Deputy Chief Mark Begley to Assistant Chief of Administrative &Technical Bureau. Promoted to Captains were Lt. Henry Barriga to Administration and Lt. Michael Contrades to Patrol and Lt. Kaleo Perez to Investigative Services Bureau. A Promotional Ceremony will take place at the Kaua'i Police Department at 11:00 a.m. today. Promotions to Sergeants and Lieutenants will be the next phase. Communication KPC 2011-01 Communication dated 12/21/10, from Mr. Cabot Budlong to the Office of Boards and Commissions requesting access to a government record relating to complaint No. KPC 08-21. (a) Response dated 12/22/10, from the Office of Boards and Commissions relating to Mr. Cabot Budlong request for a government record for complaint No.KPC 08-21. Business KPC 2011-02 Discussion on the Kaua'i Police Department budget for FY 2011/2012. (a) Review current FY 2010/2011 budget Chief Perry informed the Commission that the deadline for the department to submit their initial budget to the Mayor's office is on January 24, 2011. Commissioner lannucci stated that the Commission needs to assure that the travel budget will remain intact because it allows for all seven (7) Commissioners to attend the conferences that have been proved a valuable learning tool for present and future Commission members. Another point for discussion which Commissioner lannucci noted was the line item for training purposes has not been utilized and suggested that it should be utilized for travel. Kaua'i Police Commission Regular Meeting January 21, 2011 Page 4 SUBJECT DISCUSSION ACTION Commissioner Grady agreed with Commissioner lannucci and stated that because of the time restraints he recommended that the Commission submit their proposals to the Chief as soon as possible, or have Chair Iona meet with Chief Perry to review the current budget and discuss the potential changes to the Police Commission's budget for FY 2011/2012. Chair Iona stated that he wants to be assurance that the Police Commission's budget is in sync with the Police Department's budget, and agreed with Commissioner lannucci that there are certain line items within the Commissions budget that he would like to see preserved (particularly the travel budget). As requested by the members, Chair Iona stated that he would meet with Chief Perry to review the budget before submitting it to the Administration for review. KPC 2011-03 Discussion and possible decision making on the 2011 Kaua'i Police Department Goals. Chief Perry informed the Commission that the department has been working on its goals and objectives with since December 2010 and that he has received some reports but needed to fine tune it, to assure that the goals were measurable. Chief Perry added that he wants his goals be in sync with the department goals and to avoid the setting of different goals. Chief Perry stated that he wants to choose one (1)goal from each bureau and ultimately achieve three (3) major goals. Chief Perry invited the Commission to submit input on what they felt the department's goals and the Chief's goals should be. Chief Perry informed the Commission that when he receives all of the reports he would submit them to the Commission for review and discussion at the next meeting. Commissioner O'Connor questioned whether the goals should be in conjunction with the current fiscal year or is the goals traditionally set for the calendar year. Commissioner lannucci stated that one of the Commission's duties is to monitor the department's annual budget and should the goals require monetary contribution to achieve them, the Commission would then take it into consideration. Chief Perry added that it is statutory that the department submits an annual report by calendar year and not by the fiscal year so the department sets its goals by calendar year that reflects the department's reports. Commissioner Grady recommended to the members to come prepared, with their suggestions at the next meeting. Chair Iona expressed that whatever goals the Chief chooses to implement or strives for, he does not want the Commission to be in a position of micromanaging. KPC 2011-04 Public announcement for Kaua'i Police Commission notarized complaint filed against two (2) officers. Kaua'i Police Commission Regular Meeting January 21, 2011 Page 5 SUBJECT DISCUSSION ACTION • No. KPC 10-38, The Police Commission has completed its review and deliberation of the aforementioned complaint. The complaint alleges that the officer provided the complainant with the wrong information, and failed to return the complainants bail papers upon her release from the cell block. Based on the information provided, the Commission found that due to the lack of sufficient evidence, the complaint was not upheld. The complaint will be forwarded to the Office of the Chief of Police for further review and/or to investigate if deemed necessary. Announcements Chair Iona announced that the Police Commission's next meeting will be held at the Mo'ikeha Building in meeting room 2 A/B, on Friday, February 25, 2011, at 9:00 a.m. or shortly thereafter with an executive session to follow. Executive At 9:32 a.m. Vice-Chair Kanekoa cited the Hawai'i Revised Statues to bring the meeting into executive session on Session matters pursuant to §95-5 (a) (b), subsections (2), and (4), to consider charges brought against an officer or employee, where consideration of matters affecting privacy will be involved; and to consult counsel on the Commissions powers, duties, privileges, immunities, and liabilities. • ES-01 Executive Session meeting minutes of December 16, 2010. • ES-02 Quarterly Report dated 01/21/11, from Chief Perry regarding the disposition of Police Commission and Police Department complaints. • ES-03 Notarized complaint KPC No. 10-39, filed on 12/22/10, against on-duty officers of the Kaua'i Police Department. • ES-04 Notarized complaint KPC No. 10-40, filed on 12/22/10, against an off-duty officer. • ES-05 Notarized complaint KPC No. 11-01, filed on 01/03/11, against an on-duty officer.
