EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when
deemed necessary, hold an Executive Session on any agenda item without the written public
notice if the Executive Session was not anticipated in advance. Any such Executive Session
shall be held pursuant to H.R.S. §92-4 and §92-9 and shall be limited to those items described
in H.R.S. §92-5(a). Discussions held in Executive Session are closed to the public.
• The purpose of this Executive Session is to approve the Executive Session minutes of
March 18, 2011.
■ KPC/ES-15, Pursuant to Hawaii Revised Statutes §92-5(a)(2)(4), the purpose of this
Executive Session is to review and discuss the Department's Quarterly Report dated
04/15/11 from Chief Perry on the disposition of referred Police Commission
complaints. And to consult with Counsel on questions and issues pertaining to the
Commission's powers, duties, privileges, immunities, and liabilities.

KPC/ES-16, Pursuant to Hawaii Revised Statutes §92-5(a)(2)(4), the purpose of this
Executive Session is to receive a copy of a communication dated 03/141111 from Chief
Darryl Perry, relating to complaint KPC 11-01 that was filed against an officer of the
Kaua'i Police Department. And to consult with Counsel on questions and issues
pertaining to the Commission's powers, duties, privileges, immunities, and liabilities.
■ KPC'/ES-17-2011-08, Pursuant to Hawaii Revised Statutes §92-5(a)(2)(4), the purpose
of this Executive Session is to consider charges brought against an officer or employee,
where consideration of matters affecting privacy will be involved. provided that, if the
individual concerned requests an open meeting, an open meeting shall be held. And to
consult with Counsel on questions and issues pertaining to the Commission's powers,
duties, privileges, immunities, and liabilities.

KAUAI POLICE DEPARTMENT
Notes to Budget Summary
For the Period February 2011
The Budget Status Report for February 2011 is submitted for your review and perusal. The
department's total expenditures plus encumbrances to date is 62%, slightly below the 67%
budget tVdate.
Chiefs Office
The year-to-date expenditures for the Chiefs Office are 63%, mainly due tn Payroll and Fringe
Benefits. Salaries are at 59%and overtime is running about 99%,therefore, funds will be
transferred from unexpended salaries to sufficiently cover the budget deficit in the overtime
account through the end of the fiscal year.
Administrative and Technical Bureau
Administrative and Technical Bureau is reflecting 49%of budget expended. The Bureau's main
concentration has been and will continue to be recruitment for the department. It is apparent
that the vacancies are a large contributing factor in the overtime dollars we see above in the
Chief xOffice expenditures. Recruitment will continue in order tQ fill vacancies inthe
department.
In addition to recruitment,the bureau is securing funds in the upcoming months by working on
IFB specifications for uniform and equipment contracts for the department. These contracts
will result inalarge encumbrance in the next report period. Othersignificantspondingvvi|/ be
from the fund clearance for the next generation CAD systems contract, scheduling of training,
and psychological exams for police applicants.
Investigative Services Bureau
Investigative Service Bureau is reflecting 46%of budget expended. The Bureau hosted two local
training sessions here on Kaua'/ in March and April. The training in March is titled "Crime Scene
DNA Collection" and the April training is titled "Homicide Investigation".
Patrol Services Bureau
Patrol Service Bureau iS reflecting O296of budget expended. |n addition to daily operations, the
Bureau was faced with bomb threats at the local schools and assisted with security and traffic
control for the annual Waimea Town Celebration.

II . SPECIAL OPERATIONS
A. 03/01/11 to 03/15/11 - The Hanalei District Officers are
participating in the Operation Beach Comber Project.
The project is addressing the complaints from the
Hanalei Community about the proper use of the beach
parks along Weke Road in Hanalei . Officers from the
Hanalei District have been tasked with making periodic
checks of the parks for violation of park rules . One
subject Was arrested for an outstanding bench Warrant.
One driver Was issued two citations for observed
violations (expired safety and provisional license
violation) . Another vehicle was cited for parking in a
handicap stall Without the appropriate placard on
display, expired safety and expired weight-tax. Two
drivers Were cited for cellular phone use violations .
Another vehicle Was cited for expired safety.
B. 03/23/11 to 03/24/11 -- Officers from Platoon 1 and 3
Participated in operation "Come Get Me" a bench Warrant
detail . Altogether, 33 bench Warrants were served for
the month.
C. Speed Enforcement project Were conducted on Kahiliholo

DETECTIVE UNIT
SEXUAL ASSAULT
The 17 year old was detained for Sexual Assault I"and released back to the custody of
his parents. The father of the 13-year old female victim was the reporting party, and the
victim disclosed she did have sexual relations with the 17-year old teenager.
Maternal Grandmother of a 6 year old girl reported the child might possibly have been
sexually assaulted based on unusual behavior. The child was interviewed by Dr. Gerard
and NO disclosure of a Sexual assault was made. There was no evidence that the child
was sexually assaulted.
20 year old female living in Lawai reported she was drugged and sexually assaulted.
Search Warrants were executed on the suspect's vehicle and home whereby evidence was
collected. The suspect was arrested and released pending investigation. Case pending
evaluation of evidence and will be forwarded to the Prosecutor's office.
DEATH REPORT
A decomposed body of a male subject was found in the Hanalei National Wildlife
Refuge. An autopsy was conducted but was inconclusive as to the cause of death. At
this time the male subject is still unidentified, but there are some leads that are being
followed up on.
TERRORISTIC THREAT
During the first two weeks of March, Kauai High School, Chiefess Kamakahelei Middle
School and King Kaumualii Elementary Schools received "bomb"threats via handwritten
notes or graffiti on campus. There were five of these bomb threat incidents, of which 3
have been solved and 2 cases remain unsolved. Four juveniles in total were detained.
An 11 year old boy and 13 year old girl for the first incident at Chiefess Kamakahelei, a
13 year old girl for the second incident at Chiefess Kamak-ahelei. and an 18 year old male
for one of the Kauai High incidents.

,,,chicle were various drugs and paraphernalia. One adult male arrested and booked for
various drug offenses.
Executed a search warrant on a parcel and recovered marijuana. No arrest made.
Executed a search warrant on a person,'vehicle in the Kawaihau District. Recovered from
the vehicle was marijuana and drug paraphernalia. One adult male cited on a complaint
and summons.

VICE SEARCH WARRANTS
Executed a search warrant on a person/vehicle in the Ka'%raihau District. Recovered from
the vehicle were two firearms and various drugs and paraphernalia. One adult male
arrested and booked for various drug and firearms offenses.
Executed a search warrant on a person/vehicle in the Koloa District, Recovered from the
vehicle were various drugs and paraphernalia. One adult male arrested and booked for
various drug offenses.
Executed a search warrant on a parcel and recovered marijuana. No arrest made.
Executed a search warrant on a person/vehicle in the Ka-,vaihau District. Recovered from
the vehicle was marijuana and drug paraphernalia. One adult male cited on a complaint
and summons.
Executed a search warrant on a person/vehicle in the Kawaihau District. Recovered fi-om
the person/vehicle were various drugs and paraphernalia. One adult male arrested for
various drug offenses.
BENCH WARRANT OF ARREST
3 bench warrants/grand jury indictments were served by the vice unit during the month
of March.

PUBLIC ANNOUNCEMENT
Complaint KPC 11-07
The Police Commission has completed its review and deliberation of the aforementioned
complaint The Complainant alleges that he was contacted by a 911 dispatch to pick up an
accident vehicle at the request of the owner. While enroute he became stuck in traffic and
contends that he should have been contacted by dispatch in a timely manner informing him that
another towing company was removing the vehicle.
Based on the information provided, the Commission has upheld the complaint and has forward
the complaint to the Office of the Chief for further review and to investigate as deemed
necessary.
This officially concludes the Commission's review of complaint KPC 11-07.
