Excused Chair Charles Iona Absent SUBJECT DISCUSSION ACTION County Clerk Peter Nakamura administered the Oath of Office to Bradley Chiba prior to Vice-Chair Kanekoa welcomed Mr. the meeting being called to order. Chiba to the Kaua'i Police Commission. Call To Order Vice-Chair Kanekoa called the meeting to order at 9:02 a.m. Approval of Mr. Iannucci moved to approve the Agenda agenda as circulated; Mr. Nebre seconded the motion. Motion carried 5:0 Approval of Open Session Minutes of March 18, 2011 Mr. O'Connor moved to approve the Minutes minutes as circulated; Mr. Iannucci seconded the motion. Motion carried 5:0 Recognition and Employee (s) Recognition for the month of April Commendation Officers Amel Purisima and Troy Sakaguchi were present at the meeting. Not present Report but also recognized was Officer Nelson Gabriel. Lieutenant Richard Rosa, District Commander for the Waimea District commended the officers for their demonstration of integrity and teamwork during an incident that occurred on February 16, 2011. The officers responded to investigate a head on collision west of the Maluhia junction. While at the scene, the vehicle caught on fire Kaua'i Police Commission Open Session April 29, 2011 Page 2 SUBJECT DISCUSSION ACTION and the three officers used their fire extinguishers to keep the fire at bay. At the same time, an attempt was made to try and extract the operator of the vehicle but he was pinned within the vehicle. The officers were able to contain the fire just in time for the fire units to arrive and extinguish the flames. Because of their quick thinking and teamwork,the operator of the vehicle did not receive any fire related injuries and now has a second chance in life. Chief Perry presented Officers Amel Purisima and Troy Sakaguchi with a Certificate of Recognition for outstanding service to the community on behalf of the citizens of Kaua'i and members of the Kaua'i Police Department. Presentations by Captain Michael Contrades gave an After Action Review of the Department's response Representatives during the tsunami warning. The department's response consisted of the establishment of the Kauai of five (5) command posts, closure of twenty-seven (27) roadways, evacuation of areas Police within the inundation zones, response to calls for service and periodic visual checks of Department areas around the island. Captain Contrades included that although the execution of the department's response went well, the Administration felt that there was a need to develop an Improvement Plan that would be well defined, managed, controlled and verified. The plan would document the pre-determined locations for roadblocks; a current list of personnel; pre-planned staffing; training of all command staff in incident command systems; table top exercise; creation of a digital mapping system for EOC (Emergency Operating Center); development of an MOU (Memo of understanding) or MOA (Memo of agreement)with State Agencies; and a disaster recall directive. Deputy County Attorney Justin Kollar gave an overview of the Kaua'i Police Department's next generation CAD system(Computer Aided Dispatch) and RMS (Records Management System). Mr. Kollar stated that the procurement effort was a direct result of a tremendous volume of work by an entire team of dedicated personnel of the Police Department, with the assistance of the County's IT Department, Purchasing Division, the Fire Department and Finance Department. It also required the collaboration of the State's E911 Wireless Board. The upgrade of the CAD/RMS System will allow for the responsibility of the maintenance of all police records, as well as coordinating Kaua'i Police Commission Open Session April 29, 2011 Page 3 SUBJECT DISCUSSION ACTION information and managing the County's emergency response functions in conjunction with dispatch and police staff. The agency anticipates that the system will be online approximately one (1) year from the time of contract execution. The contract has been awarded to Vision Air who will provide the software applications. The software is designed to improve communications and make use of the known data to shorten response time and increase efficiency. Mr. Kollar included that the upgrade of the CAD/RMS Systems is a vital part to ensure public safety and a step forward in the de artment's quest for accreditation. Commendation Commendation Report for April 14, 2011 Report Sergeant Paul Applegate received a letter of commendation from Mr. Hugh Alexander III. He wrote the he appreciated of how Sergeant Applegate exhibited ways that one would expect of an excellent Officer of the law. Officer Darla Abbatiello-Higa received a letter of commendation from Captain Michael Contrades, Director of the Kaua'i Police Activities League (KPAL) Youth Center. He wrote to thank Officer Abbatiello-Higa and the Kaua'i Police Explorers for their assistance in preparing for the grand opening of the KPAL Youth Center. Chief's Monthly The Reports include the Administrative, Technical Services & Training & Quarterly Reports/Orders; Fiscal Report; Patrol Services Bureau& Traffic Report; April's COP Reports Reports; Investigative Bureau Report; Administrative Notices; and Personnel Orders Chief's Announcements Chief Perry announced that the department is assisting the State Department of Transportation with traffic enforcement during the closure of the Kapa`a bypass. The purpose is to ensure the public's safety during the repairs. Chief Perry announced that they will be meeting with the representatives of the cruise ship NCL and the local businesses within the Nawiliwili area. The purpose of the meeting is to address the problems that are occurring at night between the locals and eo le from the cruise ship. Also, Accreditation Manager Lieutenant Jon Takamura is Kaua'i Police Commission Open Session April 29, 2011 Page 4 SUBJECT DISCUSSION ACTION meeting with the CALEA (Commission on the Accreditation of Law Enforcement Agencies)representative today, to conduct an assessment of the department's facilities. The purpose of the visit is to recognize if the department meets the standards needed for Accreditation. Lastly, Chief Perry announced that Police Week is from May 15-21. A Proclamation will be presented to the department on Monday, May 16th at 8:00 a.m. at the Mo'ikeha Building (Rotunda)by Mayor Carvalho, Jr. in honor of the men and women of law enforcement who have made the ultimate sacrifice. Also, on May 21St at the Kukui Grove Shopping Mall, the department will have on display the Mobile Command Center and will be issuing Keiki identification cards. Business KPC 2011-09 Public Announcement for Complaint KPC 11-07 The Commission has completed its deliberation of complaint KPC 11-07. The complainant alleges that he was contacted by 911 Dispatch to pick up an accident vehicle at the request of the owner. While en route to the accident scene he became stuck in traffic. The complainant contends that he should have been contacted by dispatch in a timely manner to inform him that another towing company was removing the vehicle. Based on the information provided, the Commission has upheld the complaint and forwarded it to the Office of the Chief for further review and to investigate if deemed necessary. This officially concludes the Commission's review of complaint KPC 11-07. KPC 2011-10 Discussion on the upcoming 2011 Hawai'i State Commissioner's Conference scheduled for May 26 & 27 on Oahu. This year, the conference will be hosted by the Honolulu Police Commission. Attendance of Commissioners Commissioners Kanekoa; Iannucci; Nebre; O'Connor; and Chiba have confirmed that Kaua'i Police Commission Open Session April 29, 2011 Page 5 SUBJECT DISCUSSION ACTION they will be attending the 2011 Hawai'i State Police Commissioner's Conference on May 26 &27, 2011, on Oahu. Suggestions on topics to be discussed during the roundtable portion of the conference Mr. Iannucci stated that because the conference is just weeks away the Commissioners should submit their ideas directly to staff by email. All five (5) Commissioners agreed. Upon receiving the suggestions, staff will forward it to the Honolulu Police Commission. Change of meeting date in May It was the consensus of the Commission to change the meeting date from May 27, 2011 to May 20, 2011. Announcements Vice-Chair Kanekoa Jr. announced that the next Police Commission meeting will on Friday, ay 20, 2011, at the Mo'ikeha Building, Meeting Room 2 A/B. Executive At 10:00 a.m. Mr. O'Connor cited the Hawai'i Revised Statutes to bring the meeting Session into Executive Session. Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7(a), the Commission may, when deemed necessary, hold an Executive Session on any agenda item without the written public notice if the Executive Session was not anticipated in advance. Any such Executive Session shall be held pursuant to H.R.S. §92-4 and §92-9 and shall be limited to those items described in H.R.S. §92-5(a). Discussions held in Executive Session are closed to the public. The purpose of this Executive Session is to approve the Executive Session minutes of March 18, 2011. KPC/ES-15, Pursuant to the Hawai'i Revised Statutes §92-5(a)(2)(4), the purpose of this Executive Session is to review the Department's Quarterly Report dated 04/15/11 from Chief Perry on the disposition of referred Police Commission complaints and to consult with Counsel on questions and issues pertaining to the Commission's powers, duties, rivile es, immunities, and liabilities. Kaua'i Police Commission Open Session April 29, 2011 Page 6 SUBJECT DISCUSSION ACTION KPC/ES-16, Pursuant to the Hawai'i Revised Statutes §92-5(a) (2) (4), the purpose of this Executive Session is to receive a copy of a communication dated 03/14/11 from Chief Perry relating to complaint KPC 11-01 that was filed against an officer of the Kaua'i Police Department and to consult with Counsel on questions and issues pertaining to the Commission's powers, duties, privileges, immunities, and liabilities. KPC/ES-17 2011-08, Pursuant to the Hawai'i Revised Statutes 92-5) a) (2) (4), the purpose of this Executive Session is to consider charges brought against an officer or employee where consideration of matters affecting privacy will be involved, provided that if the individual concerned requests an open meeting, an open meeting shall be held, and to consult with Counsel on questions and issues pertaining to the Commission's powers, duties, privileges, immunities, and liabilities. Mr. Iannucci moved to enter into Executive Session; Mr. Chiba At 10:05 a.m. Vice-Chair Kanekoa called for a fifteen (15) minute recess. seconded.
