KPC 2011-12 Discussion on the County's Helicopter Use and Reimbursement Policy.

Iona, to Fire Chief Robert Westerman, requesting a representative from the
Fire Department to be present at the Police Commission meeting to discuss
the procedures and policies for usage of the County's helicopter by the Police
Department.

Pursuant to Hawaii Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when
deemed necessary,hold an Executive Session on any agenda item without the written public
notice if the Executive Session was not anticipated in advance. Any such Executive Session
shall be held pursuant to H.R.S. §92-4 and §92-9 and shall be limited to those items described
in H.R.S. §92-5(a). Discussions held in Executive Session are closed to the public.

• The purpose of this Executive Session is to approve the Executive Session minutes of
May 20, 2011.
■ KPCiTS-19-201 1-10, Pursuant to Hawaii Revised Statutes §92-5(a)(2)(4), the purpose
of this Executive Session is to consider charges brought against an officer or employee,
where consideration of matters affecting privacy will be involved; provided that, if the
individual concerned requests an open meeting, an open meeting shall be held, and to
consult with Counsel on questions and issues pertaining to the Commission's powers,
duties, privileges, immunities, and liabilities.
■ KPOES-20, Pursuant to Hawaii Revised Statutes §92-5(a) (2) (4), the purpose of this
Executive Session is to discuss and deliberate regarding a copy of a communication
dated 05/26111 from Chief Darryl Perry, pertaining to a complaint filed with the Kaua'i
Police Department on February 12 2011, and to consult with the Counsel on questions
and issues pertaining to the Commission's powers, duties, privileges, immunities, and
liabilities.

For the Period April 2Q11
The Budget Status Report for April 2011 is submitted for your review and perusal. The
department's total expenditures plus encumbrances to date is 77%, slightly below the 83%
budget todate.
The year-to-date expenditures for the Chiefs Office is 79%, Administrative and Technical
Bureau is reflecting 56%, Investigative Service Bureau is reflecting 56%and Patrol Service
Bureau is reflecting 8796of budget expended.
KPD is recruiting,training, and participating in other activities such as National Police Week.
Through continued community outreach and education, KPD has had positive feedback from
the public.
Also, throughout this month the Vice Unit and Traffic Safety Unit took advantage of their
recurring grant funds awarded to complete special projects such as marijuana eradication, seat
belt checks, speed traps, and car seat checks. The most recent grant awarded toKPDisthe
distracted driver grant which supports the enforcement of prohibiting the use of electronic
devices while driving.
The fiscal year is coming to a close; therefore, Purchasing and Finance deadlines have set our
priorities for the next few months. Purchasing Division's final deadline for small purchases is
June 8th. Acceptance uf requisitions for the next fiscal year will begin]u|y5 m. And in
preparation for the County of Kauai annual audit, year-end processing will take place through
the end of July.

and fights that occur when personnel from a cruise ship

H. POLICY
It is the policy of this Department to provide guidelines to members of this Department to inform

services are offered freely and without pressure,coercion, direct or implied by the
Department.
IV. GENERAL GUIDELINES
A- In general,civilian employees may engage in voluntary service during their meal periods
and other breaks. Civilian employees may also engage in voluntary service during hours
spanning their scheduled workday as long as the employee is granted vacation leave or
compensatory time off

Commission meeting is scheduled for Friday.. June 24, 2011 at 9:00 a.m. at the Mo'ikeha
Building in Meeting Room 2A/B.

In 2010, the County of Kauai took a significant step forward in our effort to
provide for the safety and welfare of residents and visitors alike through the
purchase of a helicopter. The helicopter is to be primarily used for search and
rescue operations, however, it will be useful to us in other ways as well.
This policy covers the use and establishes the priority and reimbursement rates for
the County of Kaua'i Helicopter.
Please familiarize yourself with this policy and ask your supervisor if you have any
questions or concerns. This document supersedes all previous policies on this
matter.

POLICY: The Kauai Fire Department will manage, operate, schedule and budget for the safe
operations 0f the county helicopter.

Use of the helicopter will be managed through the Deputy Fire Chief and scheduling of flights

All Priority One and Two operations will be considered om notice immediate flights and will hc
arranged and approved without delay through the Deputy Fire Chief and io his absence the
Battalion Chief ooDuty.
All Priority Three operations are considered pre-notice flights and will hearranged through the
Deputy [i/c Chief and in his absence the Battalion Chief on Doty.
All Priority Four operations are considered pre-notice flights and will be arranged through the
Deputy Fire Chief and in his absence the Battalion Chief on Duty and require a one week notice.
All Priority Five and Six operations will be made by the requesting Department Head or Deputy
via an ccnoi}request to the Deputy Fire Chief with at least 2 weeks' prior notice.
Some operational costs will be home bythe department requesting the use. Operating costs are
percentage for replacement parts as established by the manufacturer,maintenance costs, cost of
5ucL and any overtime nc additional contract costs incurred. All ubucgeo, vvbcre pre notice is
required, will be preapproved to ensure the departments are aware of costs and funding is
available.

With the exception of Fire and Police missions no department will fly with any personnel or
equipment external or suspend to the aircraft a1 any time without prior approval of the Fire Chief.
All Fire and Police personnel will attend a helicopter familiarization program toensure safety of
flight prior to flight operations.
All Priority Three, Four, Five and Six flights will be immediately interrupted to support priority
one and two operations. Depending ou operations personnel may bc left oo site or dropped off to
ensure a rapid response to save lives. Depending on operations, call data, or weather conditions
the backup helicopter may be deployed to retrieve stranded users or finish the surveillance
operations resulting io increased costs.
All Priority Four, Fire and Six flights may or may not bc iotcnn[ued to support priority three
flights depending oothe enuecgeutnauzrcoftbeoperaoionmuodvvil/ be determined hy the Deputy
Fire Chief mrio his absence the Battalion Chief on Duty.
Any discrepancies in priority mf flight determination will be immediately brought tV the attention
of the Fire Chief for immediate determination.

approval of the Mayor, except for patients, rescued persons, or exempted persons.

PUBLIC ANNOUNCEMENT
Complaint KPC/ES-18-2011-09
The Police.Commission has completed its review and deliberation of the
aforementioned complaint. The Complainant alleged that the Police Department was
inefficient in following up on his complaint of theft of his tires.
Based on the information provided, the Commission found that there is
insufficient evidence to prove the allegation. As a result the Commission did not
sustain the complaint and notified the Chief of Police of its findings.
This officially concludes the Commission's review of complaint KPC/E5-1 8-2011-09.
