Audience Members: Mr. Henry Noa and Mr. Kekane Pa, Representatives of the Reinstated Hawaiian Government Excused Absent SUBJECT DISCUSSION ACTION Call To Order Chair Iona called the meeting to order at 9:00 a.m. Approval of Regular Open Session Minutes of June 24, 2011. Mr. O'Connor moved to approve the minutes Minutes as circulated; Mr. Nebre seconded the motion. Motion carried 7:0. Before moving on to the next agenda item, Chair Iona asked if any member of the audience wish to give testimony on any of the items that is listed on the agenda. No testimony was given. Recognition & Employee of the month for July: Sergeant Kenneth Cummings Commendation Report Sergeant Kenneth Cummings was recognized as the Officer of the Month for his accomplishments as a public servant and his superior performance in criminal investigations and traffic enforcement. The Waimea/Koloa district Kaua'i Police Commission Open Session July 22, 2011 Page 2 SUBJECT DISCUSSION ACTION squad, under Sergeant Cummings has made 314 arrests since the start of the year, 72 arrests for felony offenses, 233 misdemeanors and 9 OVUII arrests. In addition, his squad has issued 1,252 citations and was assigned 1,638 cases to investigate. They initiated 19-drug related search warrants, the most of any unit under the Patrol Services Bureau. Aside from their dedication to law enforcement, Sergeant Cummings's squad has participated in a number of community presentations at local schools and various neighborhood board meetings. Sergeant Kenneth Cummings was recognized by the Waimea District Commander, Lt. Richard Rosa. Chief Darryl Perry presented Officer Cummings with a Certificate of Outstanding and Exemplary Service to the community, on behalf of the citizens and the men and women of the Kaua'i Police Department. Mr. Iannucci thanked Officer Kenneth Cummings for his accomplishments as an officer in the Kaua'i Police Department and his dedication in keeping the community safe. Commendation Report There was one (1) letter of commendation received from Sergeant Kenneth Cummings recognizing the following individuals for their assistance and support during the 2011 Kaua'i DARE Day event: Chief Darryl Perry; Assistant Chief Roy Asher; Captain's Sherwin Perez, Michael Contrades; Sergeant's Trent Shimabukuro, Ezra Kanoho; and Darren Rose; Officer's Mark Ozaki, Lucas Hamberg, Barry DeBlake, David Banquel and Jason Overmyer. Ms. Jodi Hookano and Ms. Jessica Fletcher. Presentation Representatives from the Reinstated Hawaiian Government provided an Kaua'i Police Commission Open Session July 22, 2011 Page 3 SUBJECT DISCUSSION ACTION overview of their government's purpose and goals as a sovereign entity. Chair Iona introduced Mr. Henry Noa and Mr. KeKane Pa. A copy of the written presentation is on file with the Office of Boards and Commissions. Chiefs Monthly 1. Community Oriented Policing District Reports for Lihu'e, Hanalei and Waimea 6. Chief's Announcements: • The Kaua'i Police Department will be conducting special projects in the Nawiliwili area due to a series of criminal activity that have been occurring at night in that area. These special projects will not be announced and will be on a continuous basis throughout the coming weeks and months. • Operation Green Harvest was conducted as a three (3) day mission from July 11th through 13th. The mission was in collaboration with the Kaua'i Police Department; Department of Land and Natural Resources; Honolulu Police Department; State Narcotics Enforcement Division; Coast Guard; and the Hawai'i National Guard. During the three (3) day operation a total of 1.8 million dollars worth of marijuana was confiscated. Also recovered were three (3)booby traps. Communication KPC 2011-17 Communication received on 06/17/11 from Lieutenant Jon Takamura to Chief Darryl Perry regarding an Accreditation Progress Report Kaua'i Police Commission Open Session July 22, 2011 Page 4 SUBJECT DISCUSSION ACTION from February to May 2011. Mr. Iannucci asked what the status of the accreditation is. Chief Perry replied that progress is being made and currently there are two (2) officers that are going through all of the department's policy and procedures and updating all of the older ones dating back from the early 80's. Assisting the officers is Deputy County Attorney Justin Kollar. Business KPC 2011-18 Copy of the Honolulu Police Commission Annual 2010 Report. (On file with the Office of Boards and Commissions) Chair Iona stated that each Commission member received a copy the 2010 Honolulu Police Commission Annual Report at the Hawai'i State Police Commissioners Conference that was held on Oahu in May. KPC 2011-19 Public announcements for Kaua'i Police Commission notarized complaints filed against officers of the Kaua'i Police Department. For the record, Chair Iona read the public announcements for the following notarized complaints: o KPC/ES-19-2011-10 The Police Commission has completed its review and deliberation of the aforementioned complaint. The Complainant alleges that the officer provoked behavior that was unbecoming of an officer, lying and not revealing the name of his superior when asked. Based on the information provided, the Commission found insufficient evidence to prove the allegations. As a result, the Commission did not sustain the complaint and notified the Chief of Police of its findings. This officially concludes the Commission's review of complaint KPC/ES-19-2011-10. Kaua'i Police Commission Open Session July 22, 2011 Page 5 SUBJECT DISCUSSION ACTION o KPC/ES-21-2011-11 The Police Commission has completed its review and deliberations of the aforementioned complaint. The Complainant alleges that the officer obstructed the process of justice by being unfair in his decisions, and by not doing his job in sending his complaint and evidence to the Prosecutor's office. Based on the information provided, the Commission found that there was insufficient evidence to prove the allegations. As a result, the Commission did not sustain the complaint and notified the Chief of Police of its findings. This officially concludes the Commission's review of complaint KPC/ES-21-2011-11. Announcement Next meeting will be on August 26, 2011 at 9:00 a.m. in the Mo'ikeha Building Meeting Room 2 A/B. Executive Session to follow. Executive At 9:56 a.m. Vice-Chair Ernest Kanekoa Jr. cited the Hawai'i Revised Session Statues to take the meeting into Executive Session. Pursuant to Section §92-4, §92-5 (a) (2) (4) and §92-9 (a). The purpose of this Executive Session is to approve Executive Session meeting minutes and to consider and evaluate charges brought against an officer or employee where consideration of matters affecting privacy will be involved, provided that if the individual concerned requests an open meeting, an open meeting shall be held. The further purpose is to consult with its attorney on questions and issues pertaining to the Commission's and the County's powers, duties, privileges, immunities and liabilities as they may relate to these items, and to make a decision the Commission deems appropriate. ES-21: KPC 2011-11 Communication dated 07/05/11 from Chief Darryl Perry to Chairman Charles Iona and Commission Members, relating to complaint KPC 2011-11 that was filed against an officer of the Kaua'i Police Department. ES-22: KPC 2011-12 Complaint filed against an officer of the County alleging rudeness, physical abuse, and unprofessionalism towards the complainant. (Filed on 06114111) ES-23: KPC 2011-13 Complaint filed against an officer of the County alleging unprofessionalism by not complying with the Kaua'i Police Department's mission statement to embrace the values of Pono. (Filed on 06/17/11) ES 24: KPC 2011-14 Complaint filed against the Kaua'i Police Department alleging that no police report was filed after reporting a theft of the complainant's vehicle. (Filed on 06124111) Chair Iona called for a motion to enter into Executive Session. Mr. Iannucci moved to enter into Executive Session at 10:05 a.m. Mr. Nebre seconded the motion. Mr. Kanekoa seconded the Police Commission in Executive Session. motion. Motion carried 7:0 Adjournment Chair Iona called for a motion to adjourn the meeting. Mr. Iannucci moved to adjourn the meeting at 11:00 a.m. Mr. Kanekoa seconded the motion.
