Pursuant to Hawaii Revised Statute §§92-4, 922-5 (a) (4), 92-9 (a) (1-4) and (b), the purpose of
this Executive Session is to receive and approve Executive Session minutes and to consult with
the Commission's legal counsel on issues pertaining to the Commission's and the County's
powers, duties,privileges, immunities, and/or liabilities as they may relate to this item,,
deliberate and take such action as appropriate:

Pursuant to Hawaii Revised Statutes §§92-4, 92-5 (a) (2) and (4), the purpose of this Executive
Session is to consider the evaluation, dismissal or discipline of an employee or officer of the
County where consideration of matter affecting privacy will be involved, provided that if the
individual concerned requests an open meeting, an open meeting shall be held; and to consult

alleging dereliction of duty by failing to render assistance during

alleging that the complainant's constitutional rights were violated
pursuant to the 14'h Amendment which prohibits state and local
governments from depriving a person's right to due process to
ensure fairness.

Firearms Training/Qualification for the Glock Pistol has been scheduled at the Kipii/Maluhia
Range for the below designated officers. Please refer to the date and time listed below for the
scheduled training/qualifications.
Scheduling of firearms qualifications for all sworn officers will be ongoing within the next
several weeks.
Items required at the range: Complete cleaning kit, Cap/Hat, Drinking water, Soft body
armor.
Officers will not be provided with any weapons cleaning equipment
Officers should be prepared to be placed in a position of lying on the ground and dress
accordingly.
Proficiency:
Pistol: Officers will qualify on a 50 round timed course of qualification fire, using the

department issued Glock Pistol, with a passing score of 80%.
Shotgun: Officers will qualify using the KPD authorized 12 gauge shotgun with a passing score

Knowledge: Officers must be able to show the ability to safely handle, clean, and maintain
their weapon with their own equipment. Any failure to show this ability will result in
a"Fail to pass" grade.

For the Period October 2U11
The Budget Status Report for October 2011 is submitted for your review and perusal. The
department's total expenditures plus encumbrances to date is 29%, right below the 33% budget
to date.
The breakdown Vf the ye8r-to-date expenditures for the department is Chief's Office Z9%,
Administrative and Technical Bureau 34%of budget expended, Investigative Service 8unseu
19% of budget expended and Patrol Service Bureau 27Y6of budget expended,
Chief Perry recently requested County Council to consider using approximately $1700 in Asset
Forfeiture funds to purchase fencing material to surround the rappel tower located at KPD
headquarters asa safety precaution.
In addition, on November 22, 2011 KPD attended the departmental 1"Quarter Budget Review
Meeting with Mayor Bernard Carva|ho,Jr, representatives from Purchasing Division, and
Finance were present. KPD reported that we are on task and within budget. The main
discussion is the departmental vacancies and what steps the department is taking to fill the
current vacancies.
KPD's back ground investigators are working diligently to keep the process moving. Lists have
been provided by Department ofPersonnel Services for Radio Dispatchers, School Crossing
Guards, and Police Service Officers, DPS has also scheduled Sergeants and Lieutenant
promotional tests for January.

DETECTIVE SECTION
SEXUAL ASSAULT
13 year old female reported she was sexually assaulted by a male family member who is
a minor. A forensic interview was conducted. The victim refused a SANE exam. No
evidence was recovered. The suspect was interviewed and denied the allegation. Case is
being referred to the Prosecutor's office.
17 year old female reported she had been sexually assaulted by a relative. The incidents
occurred when the victim was between the ages of 6-11. The suspect at the time was in
his teens. The suspect is now living on another island. An interview will be conducted
with the suspect at a later date and case will be referred to the Prosecutor's office.
13 year old female reported she was molested by a 12 year old classmate while on a
school bus in Waimea. The victim reported that the suspect forcibly held her, fondled her
chest area and attempted to remove her clothing. The suspect was questioned and then
detained for Sex Assault 3d. Case sent to Prosecutor's office.
17 year old female reported that she had been sexually assaulted by 2 unknov'm male
subjects who picked her up when she was hitchhiking. Her description of the suspects
was vague and the suspect vehicle was reportedly a white van. No other information was
provided for further follow up investigation. Investigation stalled due to lack of
cooperation by the victim.
Mother of a 14 month old female child. who is in a custody battle with the child's father.
reported he may have inappropriately touched the baby. This report is being made after
her TRO was dismissed. Mother reported that her 14 month old baby was able to
articulate the inappropriate touching. Investigation was conducted. SANE exam was
conducted and the results were negative. Investigation is ongoing.
TERRORISTIC THREAT:
24 year old male subject arrested after threatening an acquaintance with a knife. The
suspect was arraigned and currently being held at KCCC awaiting trial.
KPD SENSITIVE
During a domestic argument, 33 year old male subject reportedly took out a handgun and
threatened his 31 year old half sister. The suspect fled the scene but was stopped by
Patrol officers. Detectives initiated a Search Warrant and recovered a realistic-looking
air soft pistol that matched the witness description of the weapon used. Suspect currently
awaiting trial.
36 year old male subject got into a verbal argument with his neighbor. During the
argument the suspect threatened the neighbor with a metal pipe. The suspect was
arrested and refused to make a statement. Suspect balled out and is awaiting his court
date.
THEFT:
Kauai Palms personnel reported finding brand new merchandise in a room recently
vacated by a tenant. Upon investigation of receipts from the stores it was determined the
tenant had been using different names and credit cards to purchase the merchandise. The
suspect was apprehended, Search warrants initiated and the suspect was charged with
Identity theft, Credit card fraud and for Drug charges when drugs/paraphernalia was
found.
20 year old male subject, leaving a party in Anahola is arrested for stealing a vehicle and
subsequently being involved in 2 accidents on his way home. Investigation conducted

and the suspect was charged with OVt Jll and various crimes related to "Leaving the
Scene, "and UCPV.
DEATH REPORT:
34 year old male subject apparently took his life by hanging, as he was found by a family
member in the back yard. No evidence of foul play was uncovered and autopsy results
revealed that his death was consistent with suicide.
MISSING PERSON:
48 year old male subject was reported missing after family members had not heard from
him for 10 days. His home was checked and appeared in order, vehicle was in the
driveway and nothing was disturbed. After numerous man hours of attempting to locate
the subject on Kauai, it was determined that he had flown to Oahu and then onto New
Zealand. He was located safely in New Zealand and reportedly doing well. Case closed.
YOUTH SERVICES SECTION:

YSS conducted 2 Alcohol on premise compliance checks for the mouth ofNiovember. A
joint operation with the Cancer Research Center of Hawaii and the Kaua'i Liquor
Department to do on premise alcohol compliance checks. On Friday November 25, 2011
a total of 16 different establishments were entered with 2 purchases of alcohol made by
the minor, resulting in 4 citations issued. This accounts for a 13% failure rate.
On Saturday November 25. 2011 a total of 17 different establishments were entered with
I successful purchases of alcohol made by the minor, accounting for I issued citation.
This accounts for a 6%failure rate.
The percentage failure rate for the two day on-premise compliance checks is 9%

SEARCH WARRANTS
Executed a search warrant on a male subject and his vehicle. Recovered approximately
4.4 grams of cocaine. One adult detained and released,

Executed a search warrant on a vehicle. Recovered approximately 22-5 grams of
marijuana. Two adults were arrested.
Executed a search warrant on a male subject and his vehicle. Recovered from the vehicle
was approximately crystal methamphetamine, marijuana, and various drug paraphernalia.

Executed a search warrant on a male subject and his vehicle. Recovered from the vehicle
were crystal methamphetamine and various drug paraphernalia. One adult detained and
released.
Executed a search warrant on a male subject and his residence. Recovered were
approximately 18 grams of crystal methamphetamine. 8 oxvcodone pills, 6.4 grams of
marijuana,various drug paraphernalia and S 1,504.00 in UT S�currency. One adult male
arrested.
Executed a search warrant on a male subject and his vehicle. Recovered were
approximately 4.9 grams of crystal methamphetamine and various drug paraphernalia.
