Nakamura, Chair, Planning Committee, on Wednesday, October 24, 2012, at 1:49 p.m., at the Council Chambers, 4396 Rice Street, Room 201, Historic County Building, Lihu`e, and the presence of the following was noted: Honorable Dickie Chang - Honorable KipuKai Kuali`i Honorable Nadine K. Nakamura Honorable Mel Rapozo Honorable JoAnn A. Yukimura Honorable Jay Furfaro, Council Chair Excused: Honorable Tim Bynum The Deputy County Clerk rk read the notice of the public hearing on the following: BILL NO. 2450 — AN ORDINANCE AMENDING CHAPTER 8, KAUAI COUNTY CODE 1987, RELATING TO THE ZONING DESIGNATION IN LIHU`E, KAUAI, which was passed on first reading and ordered to print by the Council of the County of Kaua`i on September 26, 2012, and published in The Garden Island newspaper on October 8, 2012. The hearing proceeded as follows: Chair Furfaro: I would like to get some clarity. This zoning request is...no, they are asking for R-1 but the other parcel next to it, that is currently the home of the Department of Water, is R-1, ST-Open. So what zoning application are they really pursuing? Special Treatment Open? JADE K. FOUNTAIN-TANIGAWA, Deputy County Clerk: I believe it is Special Treatment Public District. Chair Furfaro: Let me show you here. R-1/ST-P, Special Treatment Project (S.T.P.). But they are only requesting residential here? Could they answer me why they are not pursuing? PUBLIC HEARING 2 OCTOBER 24, 2012 Ms. Nakamura: That is fine. Chair Furfaro: I am sorry, it is Special Treatment Project, but as you look at this, there is Public, there is Open Space, there is Special Treatment Historic. But that is not my question. My question is the project site is the one next door. Why are we not going with R-1/ST for project status? DAVID CRADDICK, Manager for the Department of Water: I think this one is limited. I do not know if it is R-1 that restricts it to thirty (30) feet, but the restriction is to allow us go up to thirty (30) feet. That is why they have the Special Treatment there. Chair Furfaro: We will send that question over to the County Attorney because currently where your home is you are Special Treatment for projects? But this one does not reference a project for public use. It is just getting R-1 Zoning. Ms. Nakamura: Thank you, Mr. Craddick. Is there anyone else? Chair Furfaro: I hope the Committee Chairwoman understands what I am asking for. Ms. Nakamura: We will discuss it in the Committee Meeting. Chair Furfaro: I will send the question over in advance to the County Attorney. Ms. Nakamura: Would you also like to testify? DUSTIN MOISES, Project Manager for the Department of Water: I just wanted to touch on that. As far as S.T.P. it is actually Special Treatment Public. I believe our existing facility is also S.T.P. right now. Chair Furfaro: Your existing facility is that? Mr. Moises: Yes. Chair Furfaro: Your application for the new facility is not. That is how I read the map. I would like t o g et some clarification. Mr. Moises: We can get clarification on that. Our intent, the existing triangle is Open...zoned Open and we are looking to get the same zoning as our existing facility which would be... PUBLIC HEARING 3 OCTOBER 24, 2012 Chair Furfaro: That is not what this says on the map. Mr. Moises: ...R-1 S.T.P., but we can get clarification for you. Ms. Nakamura: If there is no one else here to testify on this matter, this public hearing is closed.
