NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING
Notice is hereby given that the Council of the County of Kauai will hold a
public hearing on Wednesday, October 5, 2011, at 1:30 p.m., or soon thereafter, at
the Council Chambers, 4396 Rice Street, Room 201, Historic County Building,
Lihu`e, on the following:
Bill No. 2414
A BILL FOR AN ORDINANCE TO AMEND ORDINANCE NO. B-2011-732,
AS AMENDED, RELATING TO THE OPERATING BUDGET OF THE
COUNTY OF KAUAI, STATE OF HAWAII FOR THE FISCAL YEAR JULY
1, 2011 THROUGH JUNE 30, 2012 BY REVISING THE SURPLUS AND
APPROPRIATIONS ESTIMATED IN THE GENERAL FUND (~5, 600.00 -

The purpose of this bill is to amend Ordinance No. B-2011-732, as amended,
relating to the Operating Budget of the County of Kauai, State of Hawaii for the
fiscal year July 1, 2011 through June 30, 2012, by revising the surplus and
appropriations estimated in the General Fund and appropriating $5,600.00 to the
Office of the County Clerk -Council Services Division. The appropriation will be
used to fund the costs associated with the County of Kaua`i's responsibility to host
the Western Interstate Region (WIR) Board of Directors Meeting scheduled for
October 5-7, 2011, and includes, but is not limited to, an off-site dinner reception,
site tours, and necessary transportation.
Bill No. 2415
A BILL FOR AN ORDINANCE AMENDING CHAPTER 5A, KAUA`I
COUNTY CODE 1987, AS AMENDED, RELATING TO EXEMPTIONS FOR
COMMERCIAL ALTERNATIVE ENERGY FACILITIES
The purpose of this bill is to create incentives for property owners in the
County of Kauai to invest in renewable energies such as solar, conversion of
biomass, and other clean alternatives, by providing a real property -tax exemption.
Unlike the Alternative Energy Improvement Exemption contained in
Section 5A-11.15, which is expressly designed for those properties that are engaged
in the commercial development of electricity for sale to the electric utility company.
This bill is intended to promote and otherwise encourage large-scale alternative
energy facilities by offering property tax relief for such ventures. Energy generation
improvements for qualifying commercial alternative energy facilities shall be 100%
exempt from real property taxation. Underlying land areas that are designated and
approved for commercial alternative energy facilities shall be annually assessed at
the market value of industrial land, regardless of the parcel's actual zoning, and
shall be 50% exempt from real property taxes.
All interested persons who wish to present their comments may do so at the
public hearing. Written testimonies prior to the hearing would be appreciated.
Copies of the proposed ordinance are available at the Office of the County Clerk,
Council Services Division.
(The Council Committee or Council may amend these Bills at its subsequent
meetings. Meeting notices are posted at least 6 days in advance at the County
Clerk's Office and the public may also testify at any of these meetings.)
