COMMITTEE OF THE WHOLE
April 11, 2012
A special meeting of the Committee of the Whole of the Council of the County
of Kaua`i, State of Hawai`i, was called to order by Councilmember Jay Furfaro,
Chair, at the Historic County Building, Room 201, Lihu`e, Kaua`i, on Wednesday,
April 11, 2012, at 8:33 a.m., after which the following members answered the call of
the roll:
Honorable Tim Bynum (present at 8:36 a.m.)
Honorable Dickie Chang
Honorable KipuKai Kuali`i
Honorable Nadine K. Nakamura
Honorable Mel Rapozo
Honorable JoAnn A. Yukimura
Honorable Jay Furfaro, Chair
The Committee proceeded on its agenda items out of order, and as follows:
ES-537 Pursuant to HRS section 92-5(a) (2), (4) and (6), and Kaua'i County
Charter section 3.07(e), the purpose of this executive session is to
provide council with a briefing on the Prosecuting Attorney's request
for approval to apply and receive technical assistance from the Bureau
of Justice Assistance and the Vera Institute of Justice's national Cost-
Benefit Knowledge Bank for Criminal Justice and related matters.
This briefing and consultation involves consideration of the powers,
duties, privileges, immunities, and/or liabilities of the Council and the
County as they relate to this agenda item.
There being no objections, the rules were suspended.
ALFRED B. CASTILLO, JR., County Attorney: Good morning, Council Chair
and Councilmembers. Al Castillo, County Attorney. This morning's matter for your
consideration is ES-537.
Chair Furfaro: I would like to share with the group that I had
received an email from the Prosecutor's Office. It is requesting that both items set
for the Special Committee of the Whole Meeting be received today. "We were sent
communications last night from both the County Attorney and the Mayor's Office,
and that we would like to review those items before proceeding on this matter.
Given our request, I will not be present at today's Council Meeting unless we
receive further communication from the Chair or his designee. Please send me
confirmation that you have received this message." I have sent the confirmation,
Al, and I would still want to have the briefing by the County Attorney's Office and
then we will be able to take the requested action when we come back into open
session.
Mr. Castillo: Understood.
The meeting was called back to order and proceeded as follows:
Chair Furfaro: May I have a roll call vote to go into executive
session?
Ms. Nakamura moved to convene in Executive Session for ES-537, seconded
by Ms. Yukimura, and carried by the following vote:
FOR EXECUTIVE SESSION: Bynum, Chang, Kuali`i, Nakamura, TOTAL – 7,
Rapozo, Yukimura, Furfaro
AGAINST EXECUTIVE SESSION: None TOTAL – 0,
EXCUSED & NOT VOTING: None TOTAL – 0.
There being no objections, the Committee was recessed at 8:37 a.m.
The Committee was called back to order at 9:24 a.m., and proceeded on its
agenda item as shown in the following Committee Report which is incorporated
herein by reference:
CR-COW 2012-11: on C 2012-91 Communication (03/01/2012) from the Prosecuting
Attorney, requesting Council approval to apply and
receive Technical Assistance from the Bureau of
Justice Assistance and the Vera Institute of
Justice's national Cost-Benefit Knowledge Bank for
Criminal Justice, which will allow the OPA to find
innovative programs and develop procedures to
ensure that the community is served in the most
cost efficient manner and in the best way possible.

There being no further business, the meeting was adjourned at 9:24 a.m.
