Attorney Guyot clarified for the record that Chair Morita was present but not feeling well and Vide chair Macrina would conduct the rneetin(y. Memorandum in Support of Appeal dated December h, 2011 from Attorney June C. Ikemoto b. County of kauaTs Position Statement dated December 1.2, 2011, from County attorney Marc Guyot in the Matter of Eric Rita v. County of Kaua'i Chair Morita moved to receive items a. and b. Ms. Adams seconded the motion. Motion ° carried 4.1 (reeusal-aranio) Attorney Gnyot informed the Commission that Deputy Attorney General Ilalvorson would be available to them by telephone iffthere was a need to consult further on questions they might have. Attorney Guyot excited the meeting at 2:07 p.m. to allow the Commission to review the two summaries they received, to deliberate on their findings and to ask questions of the Deputy Attorney General. A phone call was placed to Attorney I lalvorson to ask him to clarify what each of the attorneys, Ms. Ikemoto and Mr. Guyot, were arguing about in their briefs. Ms. Adams said the 3 things she was getting from Attorney Ikemoto's 1 document about the appeal was inappropriate testing, the award of veterans OWN! points was not according to testing procedure and something about `continues to keep a rule within a Rule of the Department of Personnel Services knowing that he will not fellow the rule'. The County was arguing that the eligible list was created and it was unnecessary to address the issue of veteran's preference. Attorney Halvorson did not recall seeing any citation to authority in Ms. Ikemoto's document and would be inclined to advise the Commission that Civil Service Commission Open Session December 20, 2011 Page 3 SUBJECT DISCUSSION AC'PION _ _. _._-_ . the County Personnel Office applied the veteran's preference correctly. Because Mr. Rita was found eligible,that becomes a moot point. Attorney Halvorson said the sense he got front the last month's meeting that absent Attorney Ikernoto coming up with some kind of authority to back up her allegations, the Commission was inclined to deny the appeal and lie would write tip the findings that way and forward a draft to the Commission for review and feedback. With the position open again, Attorney Halvorson advised the Commission to refrain from speculating on to the process to till the position. Ms. Adams moved to uphold the Director of Personnel's decision. Mr. de la Pena seconded Attorney f lalvorson said he would forward the Commission a draft of the the motion. Motion carried 4:1 (recusril Aranio) decision prior to the January meeting so the final document could be signed off on at the February meeting. Weekly Deport Finding December 11, 2011 Mr. Fernandez told the Commission that the discussion of an "off duty complaint" noted in the November 20 report was not a matter of concern for the Commission. Mr. Fernandez also reported that Ms. Karen Matsumoto, Personnel Program Analyst, would be retiring at the end of the month. An update on the IIR Task Force would be premature as they are still working on concepts. Ms. Adams moved to receive the Director's Report. Mr do la Pena seconded the motion.
