Approval of Regular Open Session Minutes of November 18, 2011. Mr. lannucci moved to approve the minutes as

Recognition Officer of the month for December: Lieutenant Richard Rosa
Police Chief Darryl Per►y, along with the Police Commission, recognized
Officer of the Month Lt. Richard Rosa, commander of the Waimea District.
During the month of November the Waimea District has issued a total of
1064 citations, Since receiving command of this district in September
2010, the district has seen drastic improvement in enforcement efforts,
community participation, arrests, and quality investigations.

Because of Lt. Rosa's commitment to traffic safety and leadership the
Waimea District is doing an outstanding job in all facets of law
enforcement. Lieutenant Rosa was recognized by Captain Michael
Contrades.
Drug Etift.)rcement Star Medal Nominations: Officers Anthony Abalos and
Colin Nesbit,
Officer Colin Nesbitt has been an Officer of the Kaua'i Police Department
since September 2006, After graduating from the police academy, he was
assigned to the Patrol Services Bureau in Waimea 2007. From 2007 to
April 2011, Officer Nesbitt has initiated a total of 17 search warrants and
of the aforementioned search warrants, 10 resulted in the seizure of drugs
and drug paraphernalia,which led to 9 indictments and 66 arrests.
Officer Anthony Abalos has been an Officer of the Kaua'i Police
Department since February of 2009. A graduate from the police academy,
he was assigned to the Patrol Services Bureau in Waimea in 2010.
Between February 2010 and June 2011, Officer Abalos initiated a total of
11 search warrants that resulted in the seizure of drugs and drug
paraphernalia what led to 6 indictments and 87 arrests.
Chief Darryl Perry awarded the Drug Enforcement Star Medal to Officers
Abalos and Nesbitt for their exemplary service in the fight against drugs oil
Kaua'i. "I'his is the department's highest award that is given to officers who
distinguish themselves above and beyond their normal demands ot'duty.
The Commission congratulated all three awardees for a job well done in
keeping the community safe.

an overview of how liquor is sold here on Kaua'i and some of the
problems they are facing,
• Officer Darla Abbatiello provided a recap of the Kaua'i Police
Explorer Post 2094 Promotion and Awards ceremony that was held

Mr. 0 (-'onnor asked about the status of the recruitment process. f le noted
that the target date for hire of the 82nd Police Services Officer recruit class
is April 16, 2012. Chief Perry stated that so far, the department is on track
and if everything goes well, the department is looking at 15 to 20 new
recruits which would significantly fill the vacancies. Chief Perry credits
Assistant Chief Mark Begley for his hard work and diligence in getting
new people.

A meeting was held on December 2, 2011, at the Kaua'i
Community College to discuss the higher education incentive
program for the police department's employees. Still in its infancy
stage, the progran-i's purpose is to provide the employees with all
opportunity to seek career advancement and obtain a degree in
higher education.
• Chief Perry announced the retirement of Sergeants Eric Kaui, Carl
Oliver, and Lieutenant Mark Scribner with 25 years of service each.
All three officers will retire at the close of business on December
30,
Lastly, Chief Perry proudly announced the appointment of Captain
Michael Contrades to the position ofl)eputy Chief of Police
effective on December 18, 2011.

Communications KPC 2011-37 Communication dated 11/10/11, from Chief of Police
Darryl Perry to Chair Iona and Members of the Police Commission,
concurring with the findings of the Police Commission that there was
insufficient evidence to prove the allegations relating to complaint KPC

Jennifer Winn regarding amendments to the Kauai Police Commission
Rules on Administrative Practice and Procedure by defining"Officially
received" in Rule 6-1 Subsections g, 3f.
Deputy County Attorney Winn pointed out that because the item is listed in
open session, the Commission would need a motion to discuss the agenda
item in executive session.
Chair Iona confirmed that the Commission had some questions for counsel
that pertain to the item and there ore wished to discuss the matter in
executive session.
Ms. Winn advised the Commission to defer the item to the end of open
session and then make a motion to hold in executive session after she cites
the f lawai'i Revised Statutes. Ms. Winn then advised the Commission that
they would need to return back into open session to continue its discussion.
KPC 2011-35 Discussion on the Raua'i Police Department's Goals and

Chief Perry informed the Commission that he has just received a list of
goals from his Assistant Chiefs and is in the process of reviewing the list.
After lie selects the department's goals, he will forward the list to the
Police Commission.

• KPC`, 2011-21: The complainant alleged that a Police Officer used
excessive force in his attempt to detain her son. The Commission
after careful review and consideration found that there was
insufficient evidence to sustain the complaint and forwarded the
complaint to the Office of the Chief for further review and
investigation if deemed necessary. This officially concluded the
C:`otnmission's review of complaint KPC 2011-21.

• KPC 2011-26: The complainant alleged that an unknown Police
Officer ran them out of the county park. Based on the information
received, the Commission found that there was insufficient
evidence to prove the complainant's allegations and forwarded the
complaint to the Office of the Chief for further review and
investigation if deemed necessary. This officially concluded the
Commission's review of complaint KP(.7 2011-26.
• KPC 2011-27: Tho complainant alleged that a Police Officer took a
picture of her child sitting in a car seat without her consent. Based
on the information received, the Commission found that there was
insufficient evidence, to find that the officer's actions were
inappropriate, Therefore, the Commission did not sustain the
complaint and forwarded the complaint to the Office of the Chief
I'or further review and investigation if deemed necessary. This
officially concluded the Commission's review of complaint KPC
2011-27.
KPC 2011-28 The complainant alleged that he witnessed a Police
Officer talking on a cell phone while he was driving. 1-le is
Breaking the same law that he is supposed to enforce. [lased on the
information received, the Commission found that there was
iIISLIfficient evidence to sustain the complaint and forwarded the
complaint to the Office of the Chief for further review and
investigation if deemed necessary. This officially concluded the
Commission's review of complaint KPC 2011-28.

M1. lannucci announced that today is his last Police Commission meeting
and although it is hard for him to leave, he leaves with great confidence
knowing that Police Department is moving in a positive direction. fle
thanked and reminded his fellow Commissioners not to let go of the
outside training conferences that the Commission is privileged to have. lie
thanked Chief Darryl Perry and the men and women of the Police
Department and also expressed his appreciation to John Isobe and his Staff
at the Office of Boards and Commission for the training they provided for
the Commissioners,
Mr. Kanekoa thanked Mr. lannucci for his help during his tenure as Vice-
Chair of the Police Commission.
Chair Iona thanked his :fellow Police Commissioners and the Kaua'i Police
Department for their support during his tenure as Chair of the Police
Commission. Ile expressed his gratitude to the people of Kaua'i for
supporting the Police Department and the Police Commission.

they rnay relate to this item and to deliberate and take such action as
appropriate:
FS-49: KIT 2011-29 Complaint tiled on 11/08/11, against an Officer of
the County alleging dereliction of duty by failing to render assistance
during an altercation with a neighbor.
ES-50: KPC 2011-30 Complaint filed on I I/18/11, against an Officer of
the County alleging that his constitutional rights were violated pursuant to
the 14"' Amendment which prohibits state and local government from
depriving a person's right to due process to ensure fairness.
Before moving forward, Chair Iona called upon Deputy County Attorney
Winn to say a few words.
Ms. Winn stated that based on what she heard in open session regarding
KPC 2011-34, it was her understanding that the Commission had legal
questions for her regarding agenda item KPC 2011-34 and would like to go
into executive session. Ms. Winn stated it was permitted because it was
unanticipated and according to 1I.R.S. §92-5 (a) (4) that the Commission
may go into executive session when deemed necessary to consult with the
Commission's legal counsel on issues pertaining to the Commission's
powers, duties, privileges, immunities, and or liabilities as they may relate
to item KPC 2011-34.

Background Investigations are currently being done on the remaining 14 PSO applicants. Targeted
completion date of the background investigations is January;20, 2011.
Following the required review procedures, conditional job Qffers are slated to be given in early-mid

The Budget Status Report for November 2011 is submitted for your review and perusal. The
department's total expenditures plus encumbrances to date is 37%, right below the 42% budget
to date.
The breakdown of the year-to-date expenditures for the department is Chief s Office 3796,
Administrative and Technical Bureau 42%of budget expended, Investigative Service Bureau
2896of budget expended and Patrol Service Bureau 28Y6of budget expended.
Chief Perry recently requested County Council to consider using approximately$140,000 in
Asset Forfeiture funds to purchase a replacement Evidence Collection Vehicle that will be
equipped tn assist in evidence collection and evidence preservation.
Currently County Agencies are diligently working to prepare FY2013 budgets for submittal to
Department of Finance by January 1I2OlI Review will begin January ZG, 2O12and

DETECTIVE SECTION
MAJOR CRIMES
MURDER
Detectives responded to a report of a stabbing incident in the Waimea Valley. It was
learned that a 21-year old male attacked and stabbed three people in the neighborhood.
The male subject, in his rampant spree, killed a 68 year old female neighbor. The subject
also seriously injured his own 83 year old Grandfather and two others in the
neighborhood, a 63 year old man and his 50 year old girlfriend.
A Patrol officer responding to the incidents utilized deadly force when stopping the
suspect. The suspect succumbed to his injuries and was pronounced dead at the scene.
SEXUAL ASSAULT
17 year old female visitor staying at the Marriott Hotel in Libue reported being sexually
assaulted by 3 male subjects who she met in the Nawiliwili area. The male subjects
reportedly gave her alcohol. She was found in the early morning hours passed out in a
building on the Marriott grounds. At that time she announced that she may have been
assaulted. A forensic exam was conducted and the case is still being investigated. At this
tirne the suspects are unknown but possibly crew members from the Aloha Cruise Line.
42 year old female reported she was sexually assaulted by a co worker. Investigation was
conducted and a 43 year old male subject was arrested. The subject posted bail and is
awaiting trial.

worker in the past. The case is still under investigation and is pending.
DEATH REPORTS
23 year old male subject reported to Mahe lona,Hospital complaining,of dizziness and

slurred speech. The subjects' condition worsened and he subsequently passed away.

60 year old female visiting from Arizona was found unresponsive in her rented condo. It
was found that the female was suffering from terminal Cancer. No foul play suspected
but autopsy to determine cause of death will be conducted.
PROPERTY CRITNIES:
A south shore resort property reported several of their rental units over a short period of
time had been burglarized. In all of the burglaries. I-Pads or I-Macs were stolen.
Management had determined that a possible suspect might be an employee. The assigned
detective conducted a thorough investigation.
The detective reviewed Craig's list ads and found a seller of an IMac. The detective's
investigation led to the recovery of two I-Macs and the arrest of the suspect who turned
out to be an employee. Suspect posted ball and is awaiting trial.
YOUTH SERVICES SECTION:
SPECIAL PROJECTS:
The Youth Services Section conducted two Alcohol on premise compliance checks for
the month of December. The results of the alcohol compliance checks are listed below.
The Kaua'i Police Department conducted a joint operation with the Cancer Research
Center of Hawai'i and the Kaua'i Liquor Department to do on prernise alcohol
compliance checks. On December 16, 2011, 14 different establishments were entered
with 3 purchases of alcohol made by a minor,accounting for 3 citations issued and one
detainment.
On Saturday December 17, 2011, 14 different establishments were entered with 3
purchases of alcohol made by a minor, accounting for 3 issued citations.
The percentage failure rate for the two day on premise compliance checks is 21
This compliance checks were funded by a grant frorn the State of Hawaii Department of
Health.

• Participated in taser re-cent instructor training and tappet re-cert training
• Attending meetings for drug prevention and K-PAL Board
• Assisted in Waimea stabbing/shooting incident for peer support,traffic control
and transporting of the Command Vehicle.

Executed a search-warrant on a residence. Recovered various drug paraphernalia with
crystalline residue and marijuana type residue. Two adults arrested for drug offenses.
Executed a search warrant ou a vehicle. Recovered froth vehicle were a glass pipe with
ervstalline residue, methadone pill and oxvcodODe pills. One adult male arrested for various drug
offenses.
Executed a search warrant on a residence. Recovered from the residence were marijuana
and cocaine. One adult male arrested for various drug offenses.
Executed a search warrant on a residence. Recovered from the residence were crystal
methainphetamine, oxycodone pills, hydrocodon pills,marijuana plants,processed
marijuana, various drug paraphernalia and 2 firearms. One adult male and one adult
female were arrested for various drug related offenses.
Executed a search warrant on a vehicle. Recovered crystal methamphetamine, marijuana
and various drug paraphernalia. Case forwarded to prosecutors for review.
Conducted an investigation into the transportation and delivery of peyote cacti to a
residence. A search warrant on the residence was executed. Recovered during the
search of the residence were numerous additional peyote cacti, dried peyote cacti buttons,
peyote cacti powder and processed marijuana. One adult male arrested for various drug
offenses.

Executed a search warrant on a vehicle. Recovered crystal methaniphetanrine and
various drug paraphernalia. One adult male arrested for drug otTenses.
Executed a search warrant on a residence. Recovered from the residence were processed
marijuana,crystal methamphetamine, vicodin pills and various drug paraphernalia. One
adult male and one adult female arrested for various drug offenses.
K9 SEARCH WARRANTS:
Canine sniff on vehicle resulted in a search warrant being obtained, crystal
methamphetamine recovered.
Canine sniff on a fanny pack resulted in a search warrant being obtained; crystal
methamphetamine recovered.

Dear Chairman Kanekoa and Commission Members:
Attached please find the Kauai Police Department's 2012 Goals.
The identified goals are our priorities, but are not exhaustive, as there are numerous other areas
that require our attention.
For 2012 we continue to focus on our recruitment efforts for police officers, community outreach
efforts with the implementation a Citizens' Police Academy, establishment of two (2) new
beats—one in Lilme and the other in the Kawaihau district, making permanent our Internal
Affairs Section, adopt the K-PAL program to assure continuity of youth crime prevention
programs island-wide, and submission of our application toward accreditation.
Again, these goals are measurable and attainable, while being in alignment with KPD's mission
and vision statements.

1. Recruitment to fill 20 vacant sworn positions by having 2 recruit classes.
2. Implement a Citizens' Police Academy and have a minimum of 3 graduating classes for
the year.
3. Establish a minimum of 2 new beats—one in Lihue and one in the Kawaihau Districts.
4. Make permanent the Internal Affairs Section along with necessary staffing of 1
Lieutenant, and 2 Detectives/Sergeants.
5. Adopt the K-PAL Program into the Kauai Police Department with staffing of 2 officers
to fall under the Youth Service Section of the Investigative Bureau.
6. Submit KPD**s application for accreditation in early 2012 to the Commission on
Accreditation of Law Enforcement Agencies (CALEA).

PUBLIC ANNOUNCEMENT for KPC 2011-30
The complaint alleged that an Officer of the Kaua'i Police Department violated the
complainant's Constitutional Rights pursuant to the 14th Amendment that guarantees a
person due process.
Based on the information received, the Commission found that the complaint
was not within the Commission's jurisdiction and therefore did not sustain the
complaint. The complaint has been forwarded to the Office of the Chief for further
review and investigation if deemed necessary.
This officially concludes the Commission's review of complaint KPC 2011- 30.
