Emergency Meeting—Open Session
February 24, 2012

The emergency meeting of the Kaua'i Police Commission of the County of Kaua'i was called to
order by Chair Ernest Kanekoa Jr., at 10:55 a.m. at the Mo'ikeha Building, in meeting room 2A-
2B. The following Commissioners were present:
Mr. Ernest Kanekoa Jr.
Mr. James O'Connor
Mr. Charles Iona
Mr. Alfredo Nebre Jr.
Mr. Bradley Chiba
Mr. Randall Francisco
Mr. Donald Okami Sr.
Also present: Jennifer Winn, Deputy County Attorney; Paula Morikami, Board and
Commissions Administrator; Mercedes Youn, Support Clerk.
CALL TO ORDER
Chair: The meeting is back to order in Open Session 10:55 p.m.
For the record,pursuant to section §92-8 (a), Hawai'i Revised Statutes, the Police Commission
calls an emergency meeting for Friday, February 24, 2012 at 9:00 a.m. or soon thereafter as can
be heard. The Kaua'i Police Commission finds that there is an imminent peril to the public
health, safety, and welfare of the community in that there is confusion, or least a dispute, as to
the leadership of the Kaua'i Police Department and that this has the potential to be disruptive
and/or unsafe to the people of Kaua'i. This is something that the Police Commission needs to
discuss as soon as possible. At least two-thirds of all members of the Police Commission is
entitled agree that the above-findings are correct and that an emergency exists.
All Commissioners' have agreed to this, Commissioner Okami, Commissioner Chiba,
Commissioner Iona, Commissioner Francisco, Commissioner Nebre, Vice-Chair O'Connor, and
myself. All agreed to have this meeting.
Is there anybody in the public that wants to give testimony at this time? Come forward and
please state your name and what testimony you would like to present. Seeing none, okay. At
this time, I need a motion to go into Executive Session...

Ms. Winn: You need to read the reason for the Executive Session.
Mr. Iona: Oh we did that.
Mr. Francisco: ES-10.
Ms. Youn: ES-10 on the agenda.
Mr. O'Connor: Okay. Pursuant to Hawai'i Revised Statutes, §92-4, §92-5 (a) (2) (4), and(6),
the purpose of this Executive Session is for the Commission to discuss and deliberate as to the
leadership of the Kaua'i Police Department. The purpose for this Executive Session is also for
the Commission to consult with its attorney as to its powers, duties,privileges, immunities, and
liabilities as they may relate to this agenda item and to take such action as the Commission
deemed appropriate.
Chair: Okay, we're going into Executive Session.
Ms. Winn: You need a motion.
Chair: Motion to go into Executive Session.
Mr. Okami: I make a motion to go into Executive Session.
Mr. Nebre: Second.
Chair: Commissioner Okami made a motion to move into Executive Session, Commissioner
Nebre seconded it. All in favor signify by saying aye, motion carries we are now going into
Executive Session.
On a motion made by Donald Okami, seconded by Alfredo Nebre, to move into Executive
Session, the motion passed unanimously by voice vote.
Chair: I'm sorry.
Mr. Tam: May I speak on an item?
Mr. O'Connor: That's what we asked before.
Chair: Jennifer.
Ms. Winn: If you want you can re-vote to go into open so you can.
Mr. Iona: I make a motion that since there's someone who wants to testify on this item that we
go back into Open Session.
Mr. Nebre: Second.
Chair: All in favor signify by saying aye, motion passes. Come on up, please state your name
for the record.

On a motion made by Charles Iona, seconded by Alfredo Nebre, to go back into Open
Session, the motion passed unanimously vote by voice vote.
Mr. Taylor: Chair, members of the Commission, my name is Ken Taylor, again on this issue, I
don't think that you should be discussing this item until you resolve the problem at
hand...whether or not the Mayor has the authority to do what he's done and I think that you
should, until you get outside counsel to direct you and help you with the decision-making on
what the Charter says. These kinds of issues should not be discussed until that is taken care of
and I just hope that you do the right thing for the community and I don't disagree that you
haven't been doing the right thing. I would like to see that you continue doing the right thing and
put this off until after the current major problem is addressed and dealt with. Thank

Mr. Francisco: Thank you.
Chair: Anyone else. Okay, I need a motion to go back into Executive Session.
Mr. Francisco: I motion to return into Executive Session.
Mr. Okami: Second.
Chair: We have a motion and a second, all in favor, motion passes. So, we're going into
Executive Session. Thank you, Mr. Taylor.
Mr. Francisco: Thank you.
On a motion made by Randall Francisco, seconded by Donald Okami, to enter into
Executive Session, motion carried unanimously by voice vote.
At 11:00 a.m. the meeting entered in Executive Session.
At 12:55 p.m. the meeting reconvened in Open Session.
Ratify the actions taken in Executive Session
Mr. Iona: I make a motion to ratify the actions taken in the Emergency Meeting Executive
Session.
Mr. O'Connor: Second.
Chair: All those in favor signify by saying aye, nays? Motion carried.
On motion by Charles Iona and seconded by James O'Connor, to ratify the actions taken
in the Emergency Meeting Executive Session, motion carried unanimously by voice vote.

On motion made by Alfredo Nebre Jr., seconded by Randall Francisco,to adjourn the
meeting, motion carried unanimously by voice vote.
