JS SION ACTION Call To Order Chair Kanekoa called the niecting to order at to receive ,ijblic test' Public W Ken Taylor, a member of the public, stated that he supports the Testimony Commissions intentions to seek outside counsel to render an opinion as to who may discipline the Chief of Police. lie stated that the Police Com Ir'i ssion has the ethical and moral duty to inform the public on what the Chief of Police is being charged with. Mr. Taylor voiced his concern that the Commissiou should refrain from making any decisions until the issue regarding the Chief of Police is resolved, lie does not agree with the Mayor's decision to have the Chief of Police placed on Administrative leave and supports the Commission in returning him back to work. Mr. Okanii asked whether he believed that the County Attorney has the knowledge and the understanding to answer questions regarding the Charter and whether it would be a waste of taxpayer's money to bring in Counsel to re-anale what already has been determined by the Police Commission Special Open Session February 17, 2012 Page 2 SUBJEWT -DISCUSSION ACTION County Attorney, . ------------- Mr. Taylor first stated that he has no doubt that the County Attorney's Office can answer the questions but does not believe that the County Attorney's Office should deal with two masters, He questioned how the County Attorney can direct the Mayor and the Police Commission at the same time. That in itself is a direct conflict and supports the idea of obtaining outside counsel. Mr,,'—Thomas Ml. lannucci, a member of the public, read his testimony, which is attached hereto. Fle suggested that agenda items KPC 2012-05 and KPC 2012-06 be dismissed pursuant to Rule 5-8 of the KauWi Police Commission Rules on Administrative Practice and Procedure, which states that the Police Commission shall receive, consider and investigate charges brought by the public against the conduct of an officer or employee of the Police Department. l4e further explained that the Police Commission has no jurisdictiot,over complaints brought by employees or officers of the Police Department against another. These complaints should be directed to the appropriate authorities and the Chief should be questioned as to what had transpired or what actions were or were not taken. Additionally, Mr. lannucci stated that if any one ofthe items listed on the agenda pertained to the Chief being asked to step down came from an Outside source, as the appointing authority for the Chief, an immediate executive session should have been field. Mr. Iona asked for some background information on how the County Council came to a decision to grant the previous Police Commission funding for special counsel regarding the case involving a former Police Chief. Mr. lannucci suggested that the Commission review the previous records that pertained to that issue. Ile added that there was contention ................. At the end, the County Council granted the Police Commission's request to hire outside counsel to obtain an unbiased opinion relating to the powers and duties of the Police Commission. Mr. «kami stated that in regard to the leadership that is currently in place, he mentioned that acting Chief Contrades did send an email to the Mayor placing all parties in their current positions. Chair Kanekoa questioned whether during Mr. lannucCi'S tenure as a Police Coniixiissioner and when Mayor Baptiste was in office, did the Mayor appear before the Police Commission to voice his concerns against f'oriner Chief of Police K.C. Linn. Mr. lannucci stated that it was a long time ago but he re Baptiste coming before the Police Commission as an l -officio v share his concerns in regard to the situation at band. Again, he suggested that the Commission review the previous records. Mr. Francisco felt that Mr. lannucci's testimony was helpful and thanked Mr. lannucci for providing the background. Ile acknowledged his suggestion that the Commission review the previous Police Commission records. Darryl Perry, Chief of Police of the County of Kauai ^ , stated that he has _... .__..,. _ .. retained an attorney in which the Commission had previously been notified and that through the advice of his attorney, he was asked to refrain from making statements that might impact the current proceedings. fie thanked the Commission for their continuing support not only for himself but for the Police iw) t assured the Commission that the overridirig_ Police Commission Special open Session February 17, 2012 Page 4 SUBJECT ------- DISCUSSION ACTION issue regarding the lines of ruthorrty between the Mayor's Office and the Police Commission would be resolved as stated in the County Charter. Mr. Okarni expressed his appreciation for the Chief and offered his prayers during this time of adversity. Ile assured Chief Perry that the Commission would be looking very closely at this issue. Mr. long expressed his heartfelt feelings that as a former Police Officer he also found himself under scrutiny and although the issue was later resolved and he was cleared, it left a great impact on his family. He humbly asked (.',hict'Perry to hang in there and assured him that the Commission would be diligent ill resolving this issue. Ile thanked Chief Perry for the integrity brotl&to the common. and to the Police Department Mr. Glenn Mickens, rnember of the public, thanked the members of the Police Commission for their dedication and hard work. He stated that he hopes this issue gets resolved sooner rather than later and that it is his Opinion under the Charter that the Police Commission has the sole power to hire and fire the Chief of Police. CALL TO ORDER Chair. The meeting is back to order in Open Session 10:55 p.m. For the record, pursuant to section §92-8 (a), Hawaii Revised Statutes. the Police Commission calls an emergency meeting for Friday. February 24, 2012 at 9:00 a.m. or soon thereafter as can be heard. The Kaua'i Police Commission finds that there is an imminent peril to the public health, safety, and welfare of the community in that there is confusion, or least a dispute, as to the leadership of the Kaua'i Police Department and that this has the potential to be disruptive and/or unsafe to the people of Kaua'i. This is something that the Police Commission needs to discuss as soon as possible. At least two-thirds of all members of the Police Commission is entitled agree that the above-findings are correct and that an emergency exists. All Commissioners' have agreed to this. Commissioner Okami, Commissioner Chiba, Commissioner Iona, Commissioner Francisco, Commissioner Nebre, Vice-Chair O'Connor,and myself. All agreed to have this meeting. Mr. Tavlor: Chair, members of the Commission, my name is Ken Taylor, again on this issue,, I don't think that you should be discussing this item until you resolve the problem at hand...whether or not the Mayor has the authority to do what he's done and I think that you should, until you get outside counsel to direct you and help you with the decision-making on what the Charter says. These kinds of issues should not be discussed until that is taken care of and I just hope that you do the right thing for the community and f don't disagree that you haven't been doing the right thing. Motion carried 6:0 Recognition and Employee of the month for February: Officer Anthony Morita Commendation Report Acting Licutenant Trent Shiniabukuro presented the department's Officer of the Month recognition to Officer Anthony Morita. Officer Morita was assigned to investigate a specific group of individuals that were required by law to provide updated information on their whereabouts for tracking purposes. Officer Morita researched and prepared the legal documents, which allowed the Police Department's Fugitive Apprehension Strike team (FAST), to locate and arrest these violators. FAST focuses on identifying and locating individuals who threaten the satety of the community. See minutes Of meeting. RULE 6 CONTROL, TMANAGEMENT AND DIRECTION OF THE DEPARTMENT Rule 6-1 Powers, Duties and Responsibilities of the Police Commission. a. Goals and Aims of the Department. The Commission shall adopt such rules as it may consider necessary for the goals conduct of its business, b. Advisory Powers. The Commission may pass advisory resolutions concerning the matters exclusively within the authority of the Chief of Police. However, in such cases, the Chief of Police shall not be bound by any such advisory resolution. c. Administration. Except for purposes of inquiry, neither the Commission nor its individual members shall interfere in any way with the administrative affairs of the department administered by the Chief of Police. d. Commission and Commissioner inquiries. All Commission inquiries shall be initially submitted to the Chief, Deputy Chief or the appropriate Bureau Commander. Should an inquiry prove to require substantial departmental man-hours, the Chairman shall be informed of the inquiry by either the Chief or his designate so that the matter can be put on the floor for a vote as to whether this topic should be pursued. e. Performance of Duty. The Commission shall determine whether the acts of an officer, for which he or she is being prosecuted or sued, were done in the performance of duty, so as to entitle him or her to be represented by legal counsel provided by the County, f. Request for Legal Representation, I Procedure for Requesting Legal Counsel. If a police officer desires legal representation to be provided by the County of Kauai in civil or criminal proceedings initiated against the officer, he shall submit a written request to the Police Commission within thirty(30)calendar days of being either formally indicted in the pending criminal matter or served in the pending civil matter. The Commission may determine that good cause exists to extend the time to submit a written request. 2. Action by the Commission. Upon receipt of the police officer's written request,the Commission shall request that the Chief of Police or his authorized designee submit a written report to the Commission informing the Commission of the current status of the police department's investigation concerning the facts underlying the Page 1 0 of 22 matter in which the officer is seeking legal representation from the County. The written report shall include all relevant police report(s). The report shall be submitted to the Commission within thirty(3)d calendar days of the Comrnission's request. The Commission may determine that good cause exists to extend the time for submittal of the report. 3. Consultation with the County,Attorney. Before making a determination of whether an act, for which the officer is being sued or prosecuted, was done in the performance of duty, the Commission shall consult with the County Attorney and ask for a recommendation to the Commission. 4. Decision of Commission. The Commission may allow the police officer to appear before the Commission and discuss his request for representation, so long as the officer is made aware that any comments he makes can be used against him in a legal proceeding. The Commission shall subsequently inform the officer of its decision in writing. All discussions concerning the officer's request for legal representation shall be discussed in executive session. 5. Contested Case Hearing. Any police officer aggrieved by the Commission's decision may, within fifteen(15) calendar days of the issuance of the Commission's decision, request in writing that the Commission reconsider its decision. The Commission may determine that good cause exists to extend the time for submittal of the request. When requesting reconsideration, the police officer may submit a written statement setting forth the specific reasons why the actions were done in the performance of duty as a police officer, thus entitling him to representation by counsel provided by the County. The Commission shall subsequently hold a contested case hearing pursuant to the procedures set forth in Rules 7-2 through 7-8 and Hawaii Revised Statutes, Chapter 91. 9- Public Cligges Against the Conduct of the Department or Any of its Members. 1. Filing of Charges. Any and all charges shall be in writing on such form as the Commission may designate and shall be notarized. a) Charges shall be filed with the Office of Boards and Commissions no later than thirty(30)calendar days after the date of occurrence. Charges filed after the thirty (10)day period will not be investigated unless the Commission finds good cause for an extension of time. However in no event may Page I I of 22 the Commission consider a complaint filed more than 180 calendar days after the date of the occurrence. b) The date the Office of Boards and Commissions receives the charge shall be noted on the first page of the form in the space provided and signed for by the recipient. c) Any charges received informally by an individual Commissioner or by Department personnel shall be referred to the Office of Boards and Commissions for proper filing and processing. d) When all requirements stated above have been met charges shall be officially received [when all requirements stated above have been met.] the date of the next Commission meetin g. as permitted by law. All such officially received charges shall be reviewed and investigated by the Commission. e) The Commission Chairman shall provide written acknowledgment of the receipt and status of such charges to the Commission members, the Commission Investigator, the Chief of Police and the complainant. 1) The Chief of Police shall notify the employee in question of the charges according to department rules and regulations. 2) The Commission Investigator shall not commence the investigation of such charges until after the employee in question has been notified of the charges. The restriction shall not apply in circumstances where, despite good faith efforts, the employee cannot be notified. 2. Confidentiality. The Commission shall keep any and all discussions concerning charges confidential and discuss them only in Executive Session. 3. Investigation of Charge. The Commission may use an Investigator, or such other persons as may be necessary, to investigate any and all charges referred to the Commission. The Investigator may be a member of the department specially assigned by the Chief of Police to the Commission. In cases where the Commission hires or contracts the services of an Investigator, that person shall have a minimum of three(3)years of active experience in general investigative work, be licensed as private detective in accordance with the provisions of Page 12 of 22 Hawai'i Revised Statutes, Chapter 463, have a high school diploma, have a current driver's license and a vehicle for use on the job, be familiar with the Kaua`i community and the procedures of the Kaua'i Police Department or have the ability to acquire such, be readily available on short notice to perform investigative tasks for the Commission, possess a character above reproach.- and have no felony or misdemeanor convictions. a) The Investigator shall conduct all investigations in a proper and ethical manner; shall obtain all information pertinent to the charges-, and shall upon completion of the investigation, submit a written report to the Commission. b) Communications between the Investigator and the Commission or individual Commissioners shall be through the Chairman or his or her designate. c) Details of the investigation shall be considered confidential and shall not be released or discussed with any persons other than the Commission. d) The Investigator shall be authorized to obtain from the department on behalf of the Commission any such information as may be needed for the investigation subject to the prior approval of the Chief of Police. Such information may include copies of police reports or statements from department personnel. e) The Investigator's report shall contain a detailed report of all investigative findings, and a summary of all interviews. f) The Investigator shall submit the report within sixty(60)days of the date the charges were officially received. The report shall be submitted to the Commission Secretary for duplication and immediate distribution to the Commission. g) Upon review of the investigative report,the Commission may conduct further investigation,including interviews of the Investigator and/or any other person involved in the case. In addition the Commission may resubmit the report to the Investigator for her investigation. 4. Commission Decision. After the charge has been fully investigated, the Commission shall enter a decision finding that there is either sufficient or insufficient evidence to prove the charge. The Commission shall thereafter submit a written report of its decision to Page 13 of 22 the Chief of Police, in no case longer than sixty(60 days after the Commission concludes its investigation. The Commission may inquire with the Chief of Police as to any departmental action taken following the Commission's decision. a. The Commission shall notify the complainant of its decision in writing. b. Every Commission decision shall be made public during a regularly scheduled meeting. Names of individuals complainants and the subject employee shall be made public. The charges and circumstances surrounding the charge and its findings shall be greatly stated. C. In cases where discipline has been imposed by the Chief of Police based on a Commission decision there shall be no additional or subsequent investigation imposed on the subject employee for the same incident. Rule 6-2 Powers, Duties and Responsibilities of the Chief of Police. In accordance with the laws of the State of Hawaii and Charter of the County of Kaua'i, the Chief of Police shall: a. Act as administrative head of the department. b. Appoint the necessary staff for the department for which appropriations have been made. c. Supervise, manage and control all employees and officers of the department. d. Discipline or remove any officer or employee of the Department pursuant to all applicable laws. e. Assign and reassign the duties of any of or employee of the department. f. Make all personnel actions concerning officers or employees of the department as provided by law. g. Train, equip, maintain and supervise the officers and employees of the department. h. Preserve the public peace, prevent crime,detect and arrest offenders, protect personal property rights and enforce and prevent violations of law. Officers attempted to negotiate with the man to give himself up,but the main ignored the officers'commands. The man subsequently made it to the roof of his residence where he began to attack a police officer with a dangerous object/weapon. The officer utilized his firearm to stop the attack. The male subject subsequently expired. The investigation is ongoing. SEXUAL ASSAULT: A 5 year old female child reported to a school employee that she was sexually assaulted by a relative. The child was interviewed at the Children's Justice Center. The relative was interviewed by detectives and denied the allegations made against him. The case was forwarded to the Prosecutor's Office for review. A 16 year old male was detained for sexually assaulting a 17 year old female. BURGLARY: A 15 year old female and her 18 year old boyfriend were arrested for Burglary I't Degree, The couple entered a residence without permission and remained inside of the residence until the owners of the residence found out and called the police. TERRORISTIC THREATENING: A 40 year old male subject was arrested for Terroristic Threatening and Harassment after the subject threw beer in the face of the victim and threatening two other victims while brandishing a weapon, ASSAULT: KPO SENSITIVE A 38 year old male subject was arrested for criminal property damage and assault following an altercation with his girlfriend, KAPAA.HIGH SCHOOL TASER INCIDENT: An 18 year old male subject/student at Kapaa High School was arrested for Unauthorized Entry into a Motor Vehicle,Robbery, Terroristic Threatening and Resisting Arrest. While attempting to arrest the subject, the subject resisted arrest and threatened to cause bodily injury to police officers. The subject-was tared by a police officer after repeated commands by officers to give himself up and stop resisting arrest. THEFT: A 34 year old female subject was arrested for Theft and False Reporting after the subject stole a purse from a female victim. Detectives investigated a theft of a large sum of money taken from a bank deposit box in Lihue. This investigation is ongoing.
