IC'hicf Perry, along with the Police Commission,recognized Officer Darin
' Irimata. Can January 4,2012, Officer Irimata assisted Officers Jonathan
Bonachita and Marnic Fernandez in a robbery case that occurred in the
early morning hours at the K61oa Chevron gas station. During his
interview with the victim it was found that the male suspect was
recognized as a trequent customer who drove an older niodel 'Toyota sedan.
Officer Irimata had a keen sense of who the male suspect was and where lie
lived. Capon his search of the Koloa area the vehicle was found and the
suspect was arrested, In another unrelated incident in May 2011,Officer
Iritriata assisted Officer Daniel Malloy in the apprehension and arrest of a
jewelry thief This incident also occurred in the K61oa area. Officer Irimata.
was recognized by Sergeant Kenneth Cummings.

Chief Parry presented Officer Irimata with a Certificate of recognition for
has outstanding and exemplary service to the County and for has diligence
in the two cases of robbery and theft which resulted in the arrest of two
male suspects.
Assistant Chief Roy usher recognized Officer Ginny Pia who is a member
of the Kaua'i Police Department Vice Unit. Officer I-lia was recognized for
tier work in a high profile federal case which resulted in the arrest of three
individuals and the seizure of over twenty-four thousand dollars in cash.
Due to the nature of Officer Pia's work she was unable to attend the
meeting.
Mr. Francisco extended his appreciation to Officer's Darin lrimata and
Crinny Pia for being at the forefront and for keeping the business
community moving forward and safe.
.Deputy Chief Michael Comrades recently returned from attending the 247'x'
FBI,(federal Bureau of Investigation)National Academy. Ile expressed.
leis gratitude to Chief Darryl Perry and presented him with a plaque for
nominating him to the academy; lie indicated that without it he would not
have been able to attend the academy.
Mr. Iona mentioned that it gives hitna great honor and pride. to say that out
of 257 top law enforcement members throughout the entire nation who
attended the 2411'1'class, Deputy Chief of Police Michael Contraries took
top honors and was voted number one by his leadership class for having

informative presentation to branch managers on workplace violence.
Chief Perry announced that Lieutenant Eric Shibuya,of the Internal Affairs
Unit and polygraph expert retired after 25 years or service at the Kaua'i
Police Department. Also on April 1, 2012. Sergeant Ezra"Kanam"
Kanotao will also retire.

(whief Pewrry reported that they met with the Administration to review the
Department's budget for FY 2013. Due to the economic downturn the
Department is looking at the cuts where the Department felt it is necessary.
Although the Department sent a priority List to the County Council asking
for two new heats and positions for the Internal Affairs Unit and to make it
a permanent unit, the Department would not get all of those positions. `Fhe
Department will be getting two Ili"I°echnicians whose job is to recover
evidence from the scene. Oil April 12'x'the Department will be going
before the County Council to review the budget.
Ir. Francisco asked what the Commission can do to advocate for more
funning because as much as it is a tight economy we need to remember
what we consider our philosophy and priorities oil behalf of the Police
Iepartment and our community, fie asked that the Commission in unison
go to Council to provide testimony in support of the Department's requests.
Mr. long asked for clarification for business item.KPC 2012-02 which
holds the same item number as notarized complaint KPC 2012-02. Staff
acknowledged the error and will make the necessary corrections,

discriminatory, derogatory, inappropriate, disparaging,and made bullying
remarks. Pursuant to Rule 5-8, of the Kauai Police. Commission Rules on
Administrative Practice and Procedure, the Commission shall receive,
consider, and investigate charges brought by the public against the conduct
of all officer. Based on the nature of the complaint, the Commission found
that the complaint is out of'the jurisdiction of the Commission and
therefore did not accept the complaint. The complaint has been forwarded
to the Office of the Chief of Police for further review and to investigate if
deemed necessary. This officially concluded the Commission's review of
complaint KPC 2012-05.

For the Period February 2012
The Budget Status Report for February 2012 is submitted for your review and perusal. The
department's total expenditures plus encumbrances to date is 59%, below the 6796 budget to
date.
The breakdown of the year-to-date expenditures for the department is Chief's Office 5896,
Administrative and Technical Bureau 65%of budget expended, Investigative Service Bureau
43%of budget expended and Patrol Service Bureau 69Y6of budget expended.
Kauai Police Department (KPD) is scheduled for Budget Hearing with County Council on April 12,
ZO12 from 9arn— l2pnm. The department is prepared to deliver the proposal for its Fiscal Year
2013 Budget request.
Chief of Police Darryl Perry and Deputy Chief of Police Michael Contrades presented to County
Council at the April 4, 2D12 Council Meeting the changes in the department's intent for the
Kavxaihau Substation and its future plans to move forward, County Council was very receptive
to the current research completed this far.
In addition to KPD's day to day operations, Purchasing Division's next deadline approaching is

SEXUAL ASSAULT:
19 year old female reported being Sexually Assaulted by a mate acquaintance in her
home. The victim reported the male suspect gained entry to her home uninvited. The
male suspect was arrested and held in Cellblock on$50,000 Bail.
26 year old female reported that as a child she was Sexually Assaulted by her uncle.
Investigation was conducted and forwarded to the Office of the Prosecuting Attorney for
review and disposition.
14 year old female reported being Sexually Assaulted by an unknown male subject at
Kapalu Park. Investigation was conducted and the identity of the suspect was
determined. Suspect refused to make a statement. Contradictory witness statements were
also received. Case sent to the Prosecutor's office for review and disposition.
Father of a year old girl reported that his daughter had been Sexually Assaulted by her
18 year old half brother while she was in Florida. SANE exam was conducted and the
results were negative for trauma. Case is still under investigation.
Mother of a 6 year old boy reported that he may have inappropriately touched another 6
year old boy at school. The victim was brought in for a Forensic Interview and there were
no disclosures. The school has set up counseling for the 2 boys.
28 year old homeless female,reported she may have been Sexually Assaulted by a 59 year
old male friend. The victor,reported waking up partially undressed next to the suspect
after a night of drinking, A SANE exam was conducted with negative results. Since
then, the victim has been uncooperative and has not returned any of the Detective's calls.
8 year old female reported to her Grandmother that she had been Sexually Assaulted by
her uncle while in Alaska. A Forensic interview was conducted and disclosure was made.
Case is still being investigated a 2`1 interview being scheduled. The victim has

apparently remembered more incidents.

A 45 year old female reported she had been Sexually Assaulted by a 34 year old
acquaintance. The female reported the suspect sexually assaulted her with a 2' x,4' and
rebar, A SANE exam was conducted and no signs of trauma were discovered. Further
statements by the victim led Detectives to believe she may have mental issues. Findings
by the Detective were reported to the female's psychiatrist for further action.
DEATH REPORT
A male sub'Ject working in the Waipa, Hanalei area reported finding human bones in a
stream. The bones may have surfaced from a burial site ,after the recent heavy rains. A
State archeologist was called to the scene and the bones were recovered for examination.
At this time, no foul play is suspected. The bones are being sent to Honolulu for
examination and aging.
41 year old rnale subject was found dead in his home in Kalaheo. The man apparently
died of a single gun-shot wound to the head. The male subject was reportedly despondent
over his recent breakup with his girlfriend. Investigation was conducted and autopsy
performed. It was determined that the male died of a self inflicted gunshot wound.
The body of a 58 year old female was found in the ocean in the vicinity of the Kalalau
Valley. Witnesses reported her being swept out to sea by torrential water while
attempting to cross the Hanakapiai stream during the recent rains. An autopsy was
performed and the case was ruled an accidental death.
ASSAULT 2nd:
A 24 year old male reported being stabbed in the arm with an unknown type object. The
23 year old male suspect is reportedly the victim's girlfriend's ex. The suspect fled the
scene and has not been located. : BOLO for the arrest of the suspect was issued.
PROPERTY CREMES:
Kilohana Gem Store reported the theft of a$4000 necklace from a display. From
watching surveillance video the suspect was identified as the host of a luncheon that was
being held- at Kilohana. The suspect was arrested for Theft 2nd and the necklace was
returned to the store.
A female subject reported theft of handbags by her friend. The suspect was located,
questioned by Detectives 4,Lid admitted to the theft. The suspect was charged with Theft

ioLibue. Investigation revealed that one of the suspects was aformer employee. The
suspects were apprehended uodquestioned. The suspects refused to make statements and
the money aio}co from the establishment was not recovered.
A Kapaa Hotel reported a guest's roont was entered and a Mac Laptop had been stolen.
The Detective assigned to this case followed tip with the"Mae Made Easy" store who
reported ucuole subject tried to sell them o similar computer undermospioious
circumstances. The male suspect was identified and the stolen computer was recovered.

WARRANTS SERVED:
A Search Warrant on a vehicle in the Lihue District was executed. Officers recovered
142 grams of processed inarinizina�%ith an approximate street value of$1200. The
suspect was detained and released"Pending Further Investigation." Case�Nrill be
forwarded to the Prosecutor's office.
Vice Officers executed a Search warrant on a house in the Hanalei District. Recovered
from the search was cash totaling$24, 820.
A controlled delivery of a parcel was conducted in the Hanalei District. A Search
Warrant was issued to allow Officers to search the residence
when the parcel is opened. Officers recovered 250 pills of a steroid called Oxanerone
from the package and additional 245 pills from within the house. Also recovered was -50
ml if Testosterone. The mate subject was arrested and charged.
DRUG BUYS:
Vice officers conducted 10"Controlled Buys"from known suspects during the month of
March. The information and drugs purchased are used to further ongoing investigations
and to apply for Search Warrants.
VICE SPECIAL OPERATIONS:
Vice officers conducted marijuana eradication missions on the island of Kauai.
Approximately 622 marijuana plants were recovered and destroyed. The Plants were
recovered on State and Private Lands,

Sir, Please find enclosed a petition signed by 24 retired Kauai Police Officers urging
Mayor Bernard Carvalho and the Kauai County Police Commission Members to act now
to have Chief Darryl Perry issue all retired police officers,who have retired in good
standing,a Retired Police Officer Photographic Identification.
The petition is a result of retired KPD officers being denied this identification, which is
required by the State of Hawaii Attorney Generals Department in order to comply with
the Federal requirements necessary to obtain a LEOSA permit. to carry a concealed
firearm.
Enclosed are the following documents:

We feel the need to address the Kauai Police Commission and the Mayor of Kauai
regarding this matter, as Kauai Police Department is the only County Police Department
in the State, not issuing these photographic identifications at this time.
It is our understanding that Chief Daryl Perry has concerns about the County's liability in
issuing these cards. We would like to bring to your attention, however,that three other

problem with liability-. The Hawaii State Attorney General's Department already has
requirements in place that hold retired police officers to a higher standard than active
police officers, which include a harder qualification course than active police officers, a
yearly physical examination and signing a waiver to obtain the officers' mental health
records, the fact that the Kauai Police Department has already issued previous retired
police officer's retirement photographic identifications and badges(under former Chiefs
of Police).
It is also our understanding that Chief Perry is proposing to issue a photographic
identification, however, the identification will only be valid for 2 (two)years and retired
officers will have to provide him with a psychological examination every 2 years, at their
own expense. We find this totally unacceptable considering the already higher standards
imposed by the Attorney Generals Department, which includes a waiver to obtain mental
health records.
Many of Kauai's retired police officers work at the Lihue Airport and carry a firearm
daily,among hundreds, perhaps thousands of passengers, as do many other retired police
officers in the State. There is no psychological test required for this position, only that
officers pass a background investigation by the State.
We feet that the Kauai Police Departments attempt to deny issuing retired officers a
retirement photographic identification or add additional burdensome and unnecessary
requirements to obtain such identification, to be unfair, discriminatory, and also prevents
those qualified retired police officers from exercising their Federal right to carry a
concealed firearm under the existing LEOSA law.
This is not fair to our retired officers, who have spent a career risking their lives to serve
and protect the residents and visitors of Hawaii. We ask that you please take whatever
action necessary, to have this photographic identification issued in a timely manner.

RULE 6
CONTROL, .-VIANAGE.-VIENT AND DIRECTION OF THE DEPARVVIENT
Rule 6-1 Powers. Duties and Responsibilities of the Police Commission.
a. Goals and Aims of the Department. The Commission shall adopt such rules
as it may consider necessary for the goals conduct of its business.
b. Advisory Powers. The Commission may pass advisory resolutions concerning
the matters exclusively within the authority of the Chief of Police. Hovvever,
in such cases, the Chief of Police shall not be bound by any such advisory
resolution.
c. Administration. Except for purposes of inquiry, neither the Commission nor
its individual members shall interfere in any way -with the administrative
affairs of the department administered by the Chief of Police.
d. Commission and Commissioner Inquiries. All Commission inquiries shall be
initially submitted to the Chief, Deputy Chief or the appropriate Bureau
Commander. Should an inquiry prove to require substantial departmental
man-hours, the Chairman shall be informed of the inquiry by either the Chief
or his designate so that the matter can be put on the floor for a vote as to
whether this topic should be pursued.
e. Performance of Duty. The Commission shall determine whether the acts of an
officer, for which he or she is being prosecuted or sued, were done in the
performance of duty, so as to entitle him or her to be represented by legal
counsel provided by the County.
f. Request for Legal Re-presentation.
I Procedure for Requesting Legal Counsel. If a police officer desires
legal representation to be provided by the County of Kauai in civil or
criminal proceedings initiated against the officer, he shall submit a
written request to the Police Commission within thirty(30)calendar
days of being either formally indicted in the pending criminal matter
or served in the pending civil matter. The Commission may
determine that good cause exists to extend the time to submit a
written request.
1 Action by the Commission, Upon receipt of the police officer's
written request, the Commission shall request that the Chief of
Police or his authorized designee submit a written report to the
Commission informing the Commission of the current status of the
police department's investigation concerning the facts underlying the

matter in which the officer is seeking legal representation from the
County. The written report shall include all relevant police report(s).
The report shall be submitted to the Commission within thirty {3)d
calendar days of the Commission's request. The Commission may
determine that izood cause exists to extend the time for submittal of
the report.
3. Consultation with the County Attorney. Before making a
determination of whether an act, for which the officer is being sued
or prosecuted, was done in the performance of duty, the Commission
shall consult with the County Attorney and ask for a
recommendation to the Commission.
4. Decision of Commission. The Commission may allow the police
officer to appear before the Commission and discuss his request for
representation, so long as the officer is made aware that any
comments he makes can be used against him in a legal proceeding,
The Commission shall subsequently inform the officer of its decision
in,kvriting. All discussions concerning the officer's request for legal
representation shall be discussed in executive session.
5. Contested Case Hearing. Any police officer aggrieved by the
Commission's decision may, -within fifteen(15) calendar days of the
issuance of the Commission's decision, request in writing that the
Commission reconsider its decision. The Commission may
determine that good cause exists to extend the time for submittal of
the request. When requesting reconsideration, the police officer may
submit a written statement setting forth the specific reasons why the
actions were done in the performance of duty as a police officer, thus
entitling him to representation by counsel provided by the County.
The Commission shall subsequently hold a contested case hearing
pursuant to the procedures set forth in Rules 7-2 through 7-8 and
Hawaii Revised Statutes. Chapter 91.
Public Charges Against the Conduct of the Department or Any of its
Members.
1, Filing of Charges, Any and all charges shall be in writing on such form
as the Commission may designate and shall be notarized.
a) Charges shall be filed with the Office of Boards and
Commissions no later than thirty(30') calendar days after the
date of occurrence. Charges filed after the thirty -1

period will not be investigated unless the Commission finds
good cause for an extension of time. However in no event may

the Commission consider a complaint filed more than 180
calendar days after the date of the occurrence.
b) The date the Office of Boards and Commissions receives the
charge shall be noted on the first page of the form in the space
provided and signed for by the recipient.
c) Any charges received informally by an individual
Commissioner or by Department personnel shall be referred to
the Office of Boards and Commissions for proper filing and
processing.
d) When all requirements stated above have been met, charges
shall be officially received [when all requirements stated above
have been met.] the date of the next Commission meeting, as
permitted byjg3L. All such officially received charges shall be
reviewed and investigated by the Commission.
e) The Commission Chairman shall provide written
acknowledgment of the receipt and status of such charges to
the Commission members, the Commission Investigator, the
Chief of Police and the complainant.
1) The Chief of Police shall notify the employee in
question of the charges according to department rules
and regulations.
2) The Commission Investigator shall not commence the
investigation of such charges until after the employee in
question has been notified of the charges. The
restriction shall not apply in circumstances where,
despite good faith efforts, the employee cannot be
notified.
2. ConfidentiglitL The Commission shall keep any and all discussions
concerning charges confidential and discuss them only in Executive
Session.
3. Investigation of Charge. The Commission may use an Investigator, or
such other persons as may be necessary', to investigate any and all
charges referred to the Commission. The Investigator may be a
member of the department specially assigned by the Chief of Police to
the Commission. Inc es where the Commission hires or contracts
the services of an Investigator, that person shall have a minimum of
three(3) years of active experience in general investigative work; be
licensed as private detective in accordance with the provisions of

Hawaii Revised Statutes, Chapter 463; have a high school diploma;
have a current driver's license and a vehicle for use on the job; be
familiar with the Kaua'i community and the procedures of the Kaua'i
Police Department or have the ability to acquire such; be readily
available on short notice to perform investigative tasks for the
Commission, possess a character above reproach; and have no felony
or misdemeanor convictions.
a) The Investigator shall conduct all investigations in a proper and
ethical manner; shall obtain all information pertinent to the
charges; and shall upon completion of the investigation, submit
a written report to the Commission.
b) Communications between the Investigator and the Commission
or individual Commissioners shall be through the Chairman or
his or her designate.
c) Details of the investigation shall be considered confidential and
shall not be released or discussed with any persons other than
the Commission.
d) The Investigator shall be authorized to obtain from the
department on behalf of the Commission any such information
as may be needed for the investigation subject to the prior
approval of the Chief of Police. Such information may include
copies of police reports or statements from department
personnel.
c) The Investigators report shall contain a detailed report of all
investigative findings, and a summary of all interviews.
f) The Investigator shall submit the report within sixty (60) days
of the date the charges were officially received. The report
shall be submitted to the Commission Secretary for duplication
and immediate distribution to the Commission.
g) Upon review of the investigative report, the Commission may
conduct further investigation. including interviews of the
Investigator and/or any other person involved in the case. In
addition the Commission may resubmit the report to the
Investigator for her investigation.
4. Commission Decision. After the charge has been fully investigated,
the Commission shall enter a decision finding that there is either
sufficient or insufficient evidence to prove the charge. The
Commission shall thereafter submit a written report of its decision to

the Chief of Police; in no case longer than sixty(60 days after the
Commission concludes its investigation. The Commission may
inquire with the Chief of Police as to any departmental action taken
following the Commission's decision.
a. The Commission shall notify the complainant of its
decision in writing.
K Every Commission decision shall be made
public during a regularly scheduled meeting. Names of
individuals complainants and the subject employee shall
be made public. The charges and circumstances
surrounding the charge and its findings shall be greatly
stated.
C. In cases where discipline has been imposed by the Chief of
Police based on a Commission decision there shall be no
additional or subsequent investigation imposed on the
subject employee for the same incident.
Rule 6-2 Powers. Duties and Responsibilities of the Chief of Police.
In accordance with the laws of the State of Hawaii and Charter of the County of
Kaua'i,the Chief of Police shall:
a. Act as administrative head of the department.
b. Appoint the necessary staff for the department for which appropriations have
been made.
c. Supervise, manage and control all employees and officers of the department.
d. Discipline or remove any officer or employee of the Department pursuant to
all applicable laws.
e. Assign and reassign the duties of any officer or employee of the department.
f. Make all personnel actions concerning officers or employees of the
department as provided by law.
g. Train, equip, maintain and supervise the officers and employees of the
department.
It. Preserve the public peace, prevent crime, detect and arrest offenders, protect
personal property rights and enforce and prevent violations of law.

j. Make annual reports to the Commission as to the state of affairs and condition
of the department as well as such other reports as the Commission shall
request, within its authority.
k. Exercise such other powers or duties as may be provided by law, contained
within the Charter of the County of Kaua'i or assigned by the Commission.
1. Adopt rules and regulations necessary to implement the powers, duties and
responsibilities of the Chief of Police set forth in Rule 6-2.
Rule 6-3 Collective Bargaining Agreements. All of the powers, duties and responsibilities
of the Police Commission and the Chief of Police enumerated in these rules shall
be subject to and in conformity with any collective bargaining agreements
existing between the officers or employees of the department and/or the County of
Kaua'i.
RULE 7
RULES OF PRACTICE, HEARINGS
Rule 7-1 Informal Hearing. The Commission may, in its discretion, on its own motion, or
upon petition filed with the Commission at least fifteen 15 days prior to the date
of the regular meeting hold an informal hearing on matters within its jurisdiction.
The petition need not be in any form but shall, where applicable, include:
a. Nature of the petitioner's interest and the reasons for requesting an informal
petition.
b. A complete statement of the relevant facts.
c. Position or contention of the petitioner.
d. Name, address and telephone number of petitioner.
In an informal hearing the Commission shall determine the manner and procedure
in which the hearing shall be conducted.
Rule 7-2 Contested Case Hearin. A formal hearing shall be conducted upon motion by
the Commission in accordance with Hawaii Revised Statutes, Chapter 91.
Persons aggrieved by actions of the Commission, may petition for a formal
hearing before the Commission.
Rule 7-3 Petition. The petition shall be filed with the Chairman of the Commission and
