ES-45: KPC 2012-23 Complaint filed on 06/14/12 alleging that an officer of the County denied the complainant due process when the complainant tried to obtain a status report on stolen property. Chief Perry presented the Officers with a certificate in recognition of outstanding and exernplary service to the community, can behalf ofthe citizens of the County of Kauai, and the members of the Kauai Police Department, for their actions that resulted in the recovery of drugs and drug paraphernalia, and cash, which resulted in eighteen (I 8) federal charges. RePac2rt Mr. Iona questioned whether the budget is on track or below the target of expenditures. Chief Perry reported that on the financial side, the budget was target and that the d artment would more than likely have tea retaaraa the Kauai Police Comm-nission Regular Open Session June 22, 2012 Page 3 SUBJECT DISCUSSION ACTION money back which the department was not able to expend this year due to the vacancies in the Police Depart-trient. Chief'Perry provided the Commission with a copy of the final budget for FY 2012/13, lie reported that there was a significant decrease in overtime which Would be made up if the department exceeds the overtime budget from the vacant positions. In addition, there were two (2) other significant changes would affect qq the budget 1) transter of a personnel clerk position to the newly formed Human Resources Department and; 2) replacement of a secretary and records clerk to two (2) ID 'I'cchnicians positions. Mr. O'Connor noted that the overall percentages for FY 2012/13 are down 1.9 percent frorn the previous year, Chief Perry indicated that it was his understanding that after the Mayor and the Director of Finance reviewed the budget from last year and because of the projections, the department would be returning approximately 1.2 million dollars due to the vacant positions, Ile also stated that the department was not able to purchase new equipment in the amount of six hundred thousand dollars. Chief Perry stated that due to the decrease in the budget and based on the logic of the Administration, the department was informed that if more money was needed, the department could request for a money bill. tie added that, according to their projections, the department should be on budget if this process continues. Chief Perry reported that the department is accelerating their recruitment process and sonic of the vacant positions may not be available. However, in May 2013, the department would have to go in for a money bill to boost its budget. Kauai Police Commission Regular Open Session, June 22, 2012 Page 4 SUBJECT DISCUSSION Its regard to the Kawaihau substation, Mr. Iona indicated that the project was not listed in recent CIP report. Chief Perry stated that it was his understanding that the Mayor has committed to having the Kawaihau substation built within the next few years but, in the interim; the department is in the process of moving from the old Kapaa substation to the Kapaa Armory. He noted that although there were some mitigating circumstances on prohibited pesticides on the site such as the clean-up, and ADA compliance issues, the moving process should be completed by November 2012. With respect to the Kawaihau substation, it is not in the current CHIP budget and that the department has negotiated a lease from the Hawaii Health Systems for 50 years and that there is a timeframe in which construction needs to begin. Mr. Ckami voiced his concerns about the chemicals that were absorbed by the wood. He asked if there were tests being done to deem the area safe, Chief ferry stated that he does not have all the details but, lie believes that the chemicals that were found in the hound and certain materials were removed, Mr, Iona questioned which State or County agency gives the approval to occupy the building. Chief Perry stated that he would have to check with Civil Defense Administrator Teddy Dalidig to get a definitive answer. l Mr. Francisco asked how many officers would occupy the facility and would it be utilized for other purposes including training. Chief Perry stated about 28 to 29 officers would be occupying the facility and that it would also be used as a training facility to assist with the recruitment efforts, Mr. Nebre asked whether the whole facility would be utilized or just a portion. Chief Perry indicated that there are funds appropriated for training and that he would double check. Chief"s Announcement and Pertinent Y',A ates Chief Perry reported that classes are now being offered at the KCC (Kauai Community College) for the employees in the Police Department who wish to seek a higher education. The classes are associated or related to duties and responsibilities in the Kauai Police Department and those who would participate would be reimbursed. Mr. Francisco reported that the Kauai Chamber held an event at KCC and ChanccllorFlclen Cox indicated that there was significant number of scholarships available, 14c noted that one of his goals in tennis of being a Police Commissioner is to help with the advancement of education and professional development. Chief Perry announced that there are five (5) new positions in the Police Department, (3) dispatchers; (1) maintenance position; (1) maintenance supervisor. Deputy Chief of Police Contrades reported that Duty 11, 2012 is the start of a new initiative called the Citizens Police Academy. The CPA is an interactive program designed to educate the public about KPD policies and the criminal justice system. There is no cost to participate however, the participant must be a Kauai resident, at least 18 years of age, have a valid driver's license, and no prior felonies, petty misdemeanors over 5 years, DUI convictions, or domestic violence convictions. KPC 2012-13 Complaint tiled on 013/12/12, alleges that officers of the County and their superiors are charged with suppression and oppression of the native Indigenous aboriginal Hawaiian human Rights, which is a violation of International Law. Based on the information received, the Commission has determined not to sustain the complaint and had forwarded the complaint to the Office of the Chief of Police for further review and investigation if deemed necessary. This officially concluded the Commission's review of complaint KPC 012-13 KPC 2012-14 Complaint filed on 013112/12,alleges that officers of the County illegally stole the complainant's vehicle license plates and registration from the complainants Hawaiian government registered vehicle. Based on the information received, the Commission has determined not to sustain the complaint and has forwarded the complaint to the Office of the Chief for further review and investigation if deemed necessary. Mr. O'Connor seconded the motion. Ms. Winn pointed out that although the agenda item states whether to approve the salary increase for the Police Chief and the Deputy Police Chief, the Police Commission only has the authority over the Police Chief and can only set the salary for the Police Chief and not the Deputy Police Chief. Ms, Winn further indicated that Resolution 2012-2 as developed by the 4 1 11 es the ceiling ry'C ormilissim v v _ jo the Police Chiefs salary of Kauai Police Commission Special Meeting - Open Session June 28, 2012 Page 2 SUBJECT DISCUSSION ACTION $114,490 to be effective July 1, 2012, which is the maximum that this appointing authority can grant the Police Chief. .Ms. Winn also pointed out that in the original Resolution 2012-1 subsection (d) Requirements for salary increase the salary increase for any non-elected officer or employee occupying and continuing in a position listed in this resolution is contingent on the Director of Personnel's receipt of the following: 1) A memo from the officer's or employee's appointing authority at least thirty(30) days prior to the increase certifying that appointee's performance has been evaluated pursuant to procedures established by the Director of Personnel. 2) A copy of the officer's or employee's completed performance evaluation evidencing that the appointee has met or exceeded job requirements for the appraisal period. 3) Based on the evaluation results, the appointing authority's recommendation on whether a proposed increase should be granted. The appointing authority may recommend an increase for an officer or employee occupying a position at a figure below the proposed salary increase provided for this resolution, Ms. Winn informed the Commission that Staff has contin-ned that the Chief's performance evaluation was completed in October 2011 and that no evaluation is needed at this point. Ms. Winn indicated that if the Police Commission votes to approve the Chief's salary increase, the Director of Personnel would need to receive the approval letter thirty(30) days prior to the increase to become effective August 1, 2012. .......... Based on the information provided by Deputy County Attorney Winn, Mr. Iona moved to approve the maximum salary cap of$114,490 as indicated in Resolution 2012-2 for the Chief of Police. Mr. Iona questioned whether it would be appropriate to change the performance evaluation period for the Police Chief to a calendar year or leave it as it currently stands. Ms. Winn pointed out that the Chief s performance evaluation period should done at the time of the budgetary process because the Mayor needs to submit his budget to the County Council by May 1St'' and that lie needs to know whether or not raises have to be factored into the budget. Mr. Iona moved to change the Chief ofPolice's performance evaluation period to align with the calendar year. Mr. O'Connor seconded the motion. At 9:20 a.m. Mr. Chiba entered the meeting. After further discussion, the Commission determined not to change the Chief s performance evaluation period, and would leave it as recommended by the Dircctor of Personnel Services that all performance evaluations be completed before the October 30tr' deadline. Fort K-I JUNE 2012 ENNESTIGATIVE SECTION DEATH REPORT 30 year old female, camping in Kalalau Valley, fell approximately 15 feet from the top of her campsite. She had been sitting on a makeshift bench which apparently collapsed causing her to fall backwards. Investigation revealed no foul play and death was ruled as accidental. 47 year old male subject, visiting from Utah,was found unresponsive by maid sent to clean his rental unit. Autopsy was conducted and no signs of foul play were observed or suspected. The male subject was suffering t,from numerous ailments. Toxicology screening will be conducted, final disposition pending Coroner's report. THEFT 16 year old male subject was detained for stealing a camera worth $5000 from a parked vehicle. The suspect attempted to sell the camera on Craigslist. A detective,posing as a potential'buyer, made contact with the suspect. Upon confirmation that the camera was indeed the stolen camera, the juvenile was detained. 26 year old male subject stole a purse from his 91 year old grandmother while visiting her at the Regency at Puakea. The male subject was questioned by Detectives and subsequently admitted to stealing the purse. lie then led the Detectives to the purse and most of her possessions were recovered, including the victim's morphine medication. MAJOR CRJMES 52 year old male subject, living in Kapaa, in anger stepped out of his home and discharged a firearm several times. The subject was arrested and a search was conducted of his home. Several mare weapons were recovered. The male subiect, being a convicted felon, was charged xvith additional firearm violations, I 0 0 1 year old Kalaheo man upon being arrested for Disorderly conduct threatened the Police officer and attempted to resist. Subsequent to arrest. the suspect's vehicle Nvas seized when it was learned the male subject was brandishing a firearm prior to Police contact and hid it in his vehicle.
