Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of
the Mayor and the powers of the Police Commission. (On-going)

and falsified statements just to issue the complainant a traffic citation.

Complaint filed on 06/14/12 alleging that an officer of the County denied the complainant due
process when the complainant tried to obtain a status report on stolen property.

Chief Perry presented the Officers with a certificate in recognition of outstanding and
exernplary service to the community, can behalf ofthe citizens of the County of Kauai,
and the members of the Kauai Police Department, for their actions that resulted in the
recovery of drugs and drug paraphernalia, and cash, which resulted in eighteen (I 8)
federal charges. Their efforts are a true reflection of their dedication and �r�1

On May 18, 20,12, Ms. Karen Taketa, Executive Director of the Contractors
Association of Kauai, wrote to thank Sergeant Roderick Careen for his participation in
the 20"'Annual CAA (Contractors Association of Kauai) Home Show,
On May 24, 2012, Ms. Irene Morgan wrote to commend Officers Phillip Bancluel and
Makana Rivera for their professionalism..

Mr. Iona questioned whether the budget is on track or below the target of
expenditures. Chief Perry reported that on the financial side, the budget was
target and that the d artment would more than likely have tea retaaraa the

money back which the department was not able to expend this year due to the
vacancies in the Police Depart-trient.
Chief'Perry provided the Commission with a copy of the final budget for FY
2012/13, lie reported that there was a significant decrease in overtime which
Would be made up if the department exceeds the overtime budget from the vacant
positions. In addition, there were two (2) other significant changes would affect qq
the budget 1) transter of a personnel clerk position to the newly formed Human
Resources Department and; 2) replacement of a secretary and records clerk to two
(2) ID 'I'cchnicians positions.
Mr. O'Connor noted that the overall percentages for FY 2012/13 are down 1.9
percent frorn the previous year,
Chief Perry indicated that it was his understanding that after the Mayor and the
Director of Finance reviewed the budget from last year and because of the
projections, the department would be returning approximately 1.2 million dollars
due to the vacant positions, Ile also stated that the department was not able to
purchase new equipment in the amount of six hundred thousand dollars.
Chief Perry stated that due to the decrease in the budget and based on the logic of
the Administration, the department was informed that if more money was needed,
the department could request for a money bill. tie added that, according to their
projections, the department should be on budget if this process continues.
Chief Perry reported that the department is accelerating their recruitment process
and sonic of the vacant positions may not be available. However, in May 2013,
the department would have to go in for a money bill to boost its budget.

Its regard to the Kawaihau substation, Mr. Iona indicated that the project was not
listed in recent CIP report. Chief Perry stated that it was his understanding that
the Mayor has committed to having the Kawaihau substation built within the next
few years but, in the interim; the department is in the process of moving from the
old Kapaa substation to the Kapaa Armory. He noted that although there were
some mitigating circumstances on prohibited pesticides on the site such as the
clean-up, and ADA compliance issues, the moving process should be completed
by November 2012. With respect to the Kawaihau substation, it is not in the
current CHIP budget and that the department has negotiated a lease from the
Hawaii Health Systems for 50 years and that there is a timeframe in which
construction needs to begin.
Mr. Ckami voiced his concerns about the chemicals that were absorbed by the
wood. He asked if there were tests being done to deem the area safe, Chief ferry
stated that he does not have all the details but, lie believes that the chemicals that
were found in the hound and certain materials were removed,
Mr, Iona questioned which State or County agency gives the approval to occupy
the building. Chief Perry stated that he would have to check with Civil Defense
Administrator Teddy Dalidig to get a definitive answer.

Mr. Francisco asked how many officers would occupy the facility and would it be
utilized for other purposes including training. Chief Perry stated about 28 to 29
officers would be occupying the facility and that it would also be used as a
training facility to assist with the recruitment efforts,
Mr. Nebre asked whether the whole facility would be utilized or just a portion.
Chief ferry stated that at this point, the department would be utilizing only a
portion of the facility, However, if they need a larger area for physical fitness

Mr. Francisco voiced his concerns that the budget shows that there no funds for
training. Chief Perry indicated that there are funds appropriated for training and
that he would double check.
Chief"s Announcement and Pertinent Y',A ates
Chief Perry reported that classes are now being offered at the KCC (Kauai
Community College) for the employees in the Police Department who wish to
seek a higher education. The classes are associated or related to duties and
responsibilities in the Kauai Police Department and those who would
participate would be reimbursed.
Mr. Francisco reported that the Kauai Chamber held an event at KCC and
ChanccllorFlclen Cox indicated that there was significant number of
scholarships available, 14c noted that one of his goals in tennis of being a
Police Commissioner is to help with the advancement of education and
professional development.
Chief Perry announced that there are five (5) new positions in the Police
Department, (3) dispatchers; (1) maintenance position; (1) maintenance
supervisor.
Deputy Chief of Police Contrades reported that Duty 11, 2012 is the start of a
new initiative called the Citizens Police Academy. The CPA is an interactive
program designed to educate the public about KPD policies and the criminal
justice system. There is no cost to participate however, the participant must
be a Kauai resident, at least 18 years of age, have a valid driver's license, and
no prior felonies, petty misdemeanors over 5 years, DUI convictions, or

Complaint tiled on 013/12/12, alleges that officers of the County and their superiors
are charged with suppression and oppression of the native Indigenous aboriginal
Hawaiian human Rights, which is a violation of International Law.
Based on the information received, the Commission has determined not to sustain the
complaint and had forwarded the complaint to the Office of the Chief of Police for
further review and investigation if deemed necessary. This officially concluded the
Commission's review of complaint KPC 012-13
KPC 2012-14
Complaint filed on 013112/12,alleges that officers of the County illegally stole the
complainant's vehicle license plates and registration from the complainants Hawaiian
government registered vehicle. Based on the information received, the Commission
has determined not to sustain the complaint and has forwarded the complaint to the
Office of the Chief for further review and investigation if deemed necessary. This
officially concluded the Commission's review of complaint KPC 2012-1.4.

Complaint filed on 04/12/12, alleges that an officer of the County violated the
County of Kauai Policy Against Discrimination and Harassment, 20 10 Edition.
Based on the nature of the complaint, the Commission has found that the complaint is
not within the Police Commission's jurisdiction. The complaint has been forwarded
to the Office of the Chief for further review and investigation if deemed necessary.

Mr. Iona moved to accept the increase salary for
the Chief of Police and Deputy Chief of Police.
Mr. O'Connor seconded the motion.
Ms. Winn pointed out that although the agenda item states whether to
approve the salary increase for the Police Chief and the Deputy Police
Chief, the Police Commission only has the authority over the Police Chief
and can only set the salary for the Police Chief and not the Deputy Police
Chief.

$114,490 to be effective July 1, 2012, which is the maximum that this
appointing authority can grant the Police Chief.
.Ms. Winn also pointed out that in the original Resolution 2012-1
subsection (d) Requirements for salary increase the salary increase for any
non-elected officer or employee occupying and continuing in a position
listed in this resolution is contingent on the Director of Personnel's receipt
of the following:
1) A memo from the officer's or employee's appointing authority at
least thirty(30) days prior to the increase certifying that appointee's
performance has been evaluated pursuant to procedures established
by the Director of Personnel.
2) A copy of the officer's or employee's completed performance
evaluation evidencing that the appointee has met or exceeded job
requirements for the appraisal period.
3) Based on the evaluation results, the appointing authority's
recommendation on whether a proposed increase should be granted.
The appointing authority may recommend an increase for an
officer or employee occupying a position at a figure below the
proposed salary increase provided for this resolution,
Ms. Winn informed the Commission that Staff has contin-ned that the
Chief's performance evaluation was completed in October 2011 and that
no evaluation is needed at this point. Ms. Winn indicated that if the Police
Commission votes to approve the Chief's salary increase, the Director of
Personnel would need to receive the approval letter thirty(30) days prior to
the increase to become effective August 1, 2012.

In regard to the salary of the Deputy Chief of Police, Mr. Iona questioned
whether it would be appropriate to make a motion that would give the
Chief of Police the authority to increase his salary.

Mr. Iona questioned whether it would be appropriate to change the
performance evaluation period for the Police Chief to a calendar year or
leave it as it currently stands.
Ms. Winn pointed out that the Chief s performance evaluation period
should done at the time of the budgetary process because the Mayor needs
to submit his budget to the County Council by May 1St'' and that lie needs
to know whether or not raises have to be factored into the budget.
Mr. Iona moved to change the Chief ofPolice's
performance evaluation period to align with the
calendar year. Mr. O'Connor seconded the
motion.

After further discussion, the Commission determined not to change the
Chief s performance evaluation period, and would leave it as
recommended by the Dircctor of Personnel Services that all performance
evaluations be completed before the October 30tr' deadline. Mr. Iona withdrew his orignial motion. Mr.

ENNESTIGATIVE SECTION
DEATH REPORT
30 year old female, camping in Kalalau Valley, fell approximately 15 feet from the top of
her campsite. She had been sitting on a makeshift bench which apparently collapsed
causing her to fall backwards. Investigation revealed no foul play and death was ruled as
accidental.
47 year old male subject, visiting from Utah,was found unresponsive by maid sent to
clean his rental unit. Autopsy was conducted and no signs of foul play were observed or
suspected. The male subject was suffering t,from numerous ailments. Toxicology
screening will be conducted, final disposition pending Coroner's report.
THEFT
16 year old male subject was detained for stealing a camera worth $5000 from a parked
vehicle. The suspect attempted to sell the camera on Craigslist. A detective,posing as a
potential'buyer, made contact with the suspect. Upon confirmation that the camera was
indeed the stolen camera, the juvenile was detained.
26 year old male subject stole a purse from his 91 year old grandmother while visiting her
at the Regency at Puakea. The male subject was questioned by Detectives and
subsequently admitted to stealing the purse. lie then led the Detectives to the purse and
most of her possessions were recovered, including the victim's morphine medication.
MAJOR CRJMES
52 year old male subject, living in Kapaa, in anger stepped out of his home and
discharged a firearm several times. The subject was arrested and a search was conducted
of his home. Several mare weapons were recovered. The male subiect, being a
convicted felon, was charged xvith additional firearm violations,

1 year old Kalaheo man upon being arrested for Disorderly conduct threatened the
Police officer and attempted to resist. Subsequent to arrest. the suspect's vehicle Nvas
seized when it was learned the male subject was brandishing a firearm prior to Police
contact and hid it in his vehicle. Search warrant was obtained, vehicle searched and a
loaded firearm, illegal knives and animunition were recovered.

WARRATNTS SERVED:
The Vice Narcotics it initiated 6 Search warrants during the Month of June. 6 Adult
males and I Adult female were detained for numerous drug charges. Officers recovered
Methamphetarnine, Hash, Pills, Illegal Firearms, Marijuana and Cash. All the cases
generated from these warrants will be sent to the Prosecutor's office for Prosecution.

DRUG BUYS:
Vice officers conducted 21 "Controlled Buys"-from known suspects during the month of
June. Recovered in all the purchases was Crystal Meth Amphetamine. During
subsequent months, Officers will apply for Search-i'Arrest Warrants to Arrest the
individual sellers as well as seize drugs, currency and paraphernalia.
VICE SPECIAL OPERATIONS:
Greorory Perreira Jr. was arrested on a Federal warrant. Perreira gave consent to have his
vehicle searched. Vice Officers recovered 11.5 grams of crystal methamphetamine and
drug paraphernalia. Gregory Perreira will be tried in Federal Court.
From June 21-22, 2012,Narcotics officers conducted Marijuana eradication flights over
the island of Kauai. 583 Plants were recovered from State and Private lands,
K9 SEARCH WARRANT:
A search warrant was obtained for a FedEx box based on a canine alert. No illegal drugs
were recovered.

The Traffic Safety Unit conducted Speed enforcement on the
Wailua Stretch and in the Lihue Construction area.
TSU continued to work on forensic sketches for ongoing
investigations . In addition we continue to work on
investigating cases of Negligent Homicide.
TSU began recruit training with the 82`d Police Recruit
Class.
The Traffic Safety Unit conducted one (l) Nighttime
Seat-belt Enforcement Project for a total of four (411 hours .
A total of 45 citations were issued.

I. PURPOSE:
This program is designed to prevent the high cost of a college education from denying KPD
employees access to college degrees that will help them deal wit!the latest developments in
management and technology.
II. PROGRAINI:
The Kauai Police Department has a limited amount of funding to Delp interested employees and
staff pay for their college tuition and related college expenses.
TH. REE U'IRFWNI TS:
A. The following requirements must be met to be eligible for tuition assistance:
1. The program is available to all full-time, non-probationary employees and staff of the Kauai
Police Department.
2. The courses or degrees must be related to the employee's work or potential work assignment
in the police department:
3. The college or university must be an accredited institute of higher learning.
4. All applicants must follow the guidelines set forth in this Administrative istrative hTotice.
IV, APPLICATION:
A. Employees who are interested in participating in this program roust send a memorandum
(TwTrom)to the office of the Chief of Police. The memorandum should include the following.
1. Name of college or university
2, Course and degree being pursued by the applicant
3. Cost of Tuition.and any other related fees
4. How the course relates to the employee's work or possible future work assi ent

A. All applications will be reviewed by the bureau commander of the applicant's
Chief of Police. The Chief of Police will make the final deterniination on whether to fu d-die
request or not. The decision to honor the application w1il be based on the available funds.

VI. FUNDING OF COURSES
A. Upon receiving approval from the Chief of Police,the applicant must check with the
department's fiscal personnel to verify that adequate Binding for the request is still available. If
funding is available, he/she must then register for the course(s) and make arrangements for the
payment of the course(s) and any other associated costs. (i.e.books,technology fees,etc.).
Employees shall not prepay the cost of any course with the expectation of reirribursernent. The
County of Kaua'i will not reimburse any employee for any prepayment.
B. The applicant should take no more than 6 months to complete the course. Extensions to the 6
months may be granted only for valid reasons approved by the Chief of Police.
C. Upon completion of the,course,the applicant must then submit a copy of the final course grade
to the Training office, Applicants scoring lower than a"C"grade will be required to pay back
the Kaua'i Police Department the amount furnished for the course(s). The arnount owed back by
the applicant may be deducted from the applicant's pay. All applicants Will be required to sign
the"Agreement Regarding Repayment of Tuition Assistance"prior to the receipt of funds.

HOTEL ROOM RATES: The Sheraton Waikiki Resort will provide guest rooms at a rate of $210.00 a day, which includes self
parking. This rate is for single/double occupancy and does not include applicable state and local taxes. Additional persons in
room, up to four, are at$90.00 a night. Children 17 and under stay for free with existing bedding. Rates will be available three
(3) days prior to and three (3) days after the event and is subject to availability at the time of reservation. Check-in time is 3:00
prn and check-out time is 11:00 am. Guests arriving before check-in shall be accommodated as rooms become available. A
deposit equal to one (1) night's stay is required to hold each individual reservation. This deposit is refundable if notice is
received at least seventy-two (72) hours prior to arrival. Individual attendees may make reservations by calling the Sheraton
Waikiki Resort at (808) 921-4611 and making reservations on their own. Please mention you are with the HSLEOA to receive
this special rate. The cut off date for reserving rooms is 5,00 pm local time on August 19, 2012,
