ES-46 Discussion and deliberation regarding hearing procedure for Report of Investigation on Issues in the Kauai Police Department for the County of Kauai, dated June 28, 2012. ES-47: KPC 1012-214 Complaint filed on 08/01"12 alleging that officers of the County used excessive force, abused authority, and did an invalid search without a search warrant. Report Sergeant Scott Williamson read the Recognition Report for Officers Abalos and Irimata. Officers Abalos and Irimata,were recognized for their dedication and due diligence to public safety when they executed a search warrant and recovered over thousand dollars in cash, electronic scale, distribution supplies, marijuana, drug paraphernalia, and over rams of i4nipbettuniu�with an estimated street value of tweiltv- g� _ _TqI _ __ _ _ Kauai Police Commission Regular Open Session June 22, 2012 Page 2 SUBJECT DISCUSSION ACTION five hundred dollars. Chief Perry presented the Officers with a certificate in recognition of outstanding and exemplary service to the community, on behalf of the citizens of the County of Kauai, and the rnernbers of the Kauai Police Department, for their actions that resulted in the recovery of drugs and drug paraphernalia, and cash, which resulted in eighteen (1 S) federal charges. Their efforts are a true reflection of their dedication and i and commitment in kee corranauni safe. 11VV Commendation There were two (2) letters ot commendation,that were received: Report On May 18, 2012, Ms. Karen Taketa, Executive Director of the Contractors Association of Kauai, wrote to thank Sergeant Roderick Green for his participation in the 20'h Annual CAK (Contractors Association of Kauai) Home Show, On May 24, 2012, Ms. Irene Morgan wrote to commend Officers Phillip Banquel and Makana Rivera for their professionalism, Chief's Morithly I. Chief Perry reported that on the financial side, the budget was below tarfet and that the dep _T-traeLit_would more than I ke larave to return the Kauai. Police Commission Regular Open Session June 22, 2012 Page 3 SUBJECT DISCUSSION ACTION money back which the department was not able to expend this year clue to the vacancies in the Police Department. Chief ferry provided the Commission with a copy of the final budget t6r FY 2012/13. He reported that there was a significant decrease in overtime which would be jade up if the department exceeds the overtime budget from the vacant positions. In addition, there were two (2) other significant changes would affect the budget 1) transfer of a personnel clerk position to the newly formed. Human Resources Department and; 2) replacement of a secretary and records clerk to two ( ) ID 'Technicians positions. Mr. O'Connor noted that the overall percentages for FY 2012/13 are down 1.9 percent from the previous year. Chief ferry indicated that it was his understanding that after the Mayor and the Director of Finance reviewed the budget from last year and because of the projections, the department would be returning approximately 1.2 million dollars due to the vacant positions. Fle also stated that the department was not able to purchase new equipment in the amount of six hundred thousand dollars. Chiel"ferry stated that dole to the decrease in the budget and based on the logic of the Administration, the department was informed that if more money was needed, the department could request for a money bill, He added that, according to their projections, the department should be on budget if this process continues. Chief ferry reported that the department is accelerating their recruitment process and some of the vacant positions may not be available. However, in May 2013, the department would have to go in for a money bill to boost its budget. Kauai Police Commission Regular Open Session June 22, 2012 Page 4 SUBJECT DISCUSSION In regard to the Kawaihau substation, Mr. Iona indicated that the project was not listed in recent CIP report. Chief Perry stated that it was his understanding that the Mayor has comillitted to having the Kawaihau substation built within the next few years but, in the interim, the department is in the process of moving from the old Kapaa Substation to the Kapaa Armory. He noted that although there were some mitigating circumstances on prohibited pesticides on the site such as the clean-up, and AIWA compliance issues, the moving process should be completed by November 2012. With respect to the Kawaihau substation, it is not in the current CIP budget and that the department has negotiated a lease from the Hawaii Health Systems for 50 years and that there is a timefrarne in which construction needs to begin. Mr. Okarni voiced his concerns about the chemicals that were absorbed by the wood. He asked if there were tests being done to deem the area safe. Chief Perry stated that he does not have all the details but, he believes that the chemicals that were tound in the ground and certain materials were removed. Mr. Iona questioned which State or County agency gives the approval to occupy the building. Chief Perry stated that fie would have to check with Civil Defense Adnimistrator Teddy Dalidig to get a definitive answer. Mr. Francisco asked how many officers Would occupy the facility and would it be utilized for other purposes including training. Chief Perry stated about 28 to 29 officers would be occupying the facility and that it would also be used as a training facility to assist with the recruitment ettotts. Mr. Nebre asked whether the whole facility would be utilized or just a portion, Chief Perry stated that at this point, the department would be utilizing only a portion of the facility. Chief Perry indicated that there are funds appropriated for training and that he would double check. Chief s Announcement and Pertinent Chief Perry reported that classes are now being offered at the KCC (Kauai Community College) for the employees in the Police Department who wish to seek a higher education. 'I'lie classes are associated or related to duties and responsibilities in the Kauai Police Department and those who would participate would be reimbursed, Mr. Francisco reported that the Kauai Chamber held an event at KCC and Chancellor Helen Cox indicated that there was significant number of scholarships available. He noted that one of his goals in terms of being a Police Commissioner is to help with the advancement of education and professional development. Chief Perry announced that there are five(5) new positions in the Police Department, (3) dispatchers; (1) maintenance position; (F) maintenance supervisor. Deputy Chief of Police Contrades reported that July 11, 2012 is the start of a new initiative called the Citizens Police Acaderny. The CPA is an interactivc Program designed to educate the public about KPD policies and the criminal justice system. There is no cost to participate however, the participant must be a Kauai resident, at least 18 years of age, have a valid driver's license, and no prior felonies, petty misdemeanors over 5 years, DUI convictions, or domestic violence convictions. The appointing authority may recommend an increase for an officer or employee occupying a position at a figure below the proposed salary increase provided for this resolution. Ms. Winn informed the Commission that Staffhas confirmed that the Chief's performance evaluation was completed in October 2011 and that no evaluation is needed at this point, Ms. Winn indicated that if the Police Commission votes to approve the Chief's salary increase, the Director of Personnel Would need to receive the approval letter thirty (30) days prior to the increase to become effective August 1, 2012. Ms. Wine pointed out that the Chiefs performance evaluation period should clone at the time of the budgetary process because the Mayor needs to submit his budget to the County Council by May 15th and that he needs to know whether or not raises have to be factored into the budget. Mr. Iona moved to change the Chief of Police's performance evaluation period to align with the calendar year. Mr. O'Connor seconded the motion. At 9:20 a.m. Mr. Chiba entered the meeting. Investigation revealed no foul play and death was ruled as accidental. 47 year old male subject, visiting from Utah, was found unresponsive by maid sent to -e clean his rental unit. Autopsy was conducted and no signs of foul play were obsetv d or suspected. The male subject was suffering from numerous ailments, Toxicology screening will be conducted,final disposition pending Coroner's report. The 67yr. old suspect then took his own life. SEX ASSAULT: 21 yr. old female reported being sexually assaulted by an unknown male subject about I Syrs. old. SANE exam showed trauma to the victim. No arrests have been made at this time. The investigation is still ongoing, DEATH RELATED: A 24NT. old homeless male was found floating in the waters in the vicinity of Shipwreck Beach,Poipu. Investigation and autopsy showed no signs of foul play and the preliminary findings of cause of death is drowning due to an accidental fall. The final report is pending toxicology results. A 24yr, old homeless male was found unresponsive at his campsite in the Lihue area and. Nvas later pronounced dead. Investigation showed that subject consumed alcoholic beverages on a daily bases and was displaying respiratory problems for about a week prior to and just before the incident. Subject also had pancreatic issues. Preliminary cause of death was fluid in the lungs possibly from bronchitis/pneumonia. Final determination report is pending toxicology results. KPD SENSITIVE PLACE TO KEEP: A 4 1 yr. old male was arrested for"Unlavvful Place to Keep"after a firearm was found in his backpack. Investigation revealed that the suspect was in the process of moving and had forgotten about the gun in his bag. Suspect was charged for the stated offense and case referred to the OPA. Officers recovered Methamplictamine, Hash, Pills, Marijuana and Cash. All the cases generated from these warrants will be sent to the Prosecutor's office for Prosecution. DRUG BUYS: Vice officers conducted 15; "Controlled Buys" from known suspects during the month of tamine.marijuana synthetic etic June. Recovered in the purchases was Crystal Meth Amphe th cocaine and synthetic marijuana. Search and Arrest warrants will be prepared based on the purchases and information acquired, KPD SENSITIVE VICE SPECIAL OPERATIONS: A controlled purchase of 86.5 grams of Crystal Methamphetamine from a drug dealer allowed Vice Officers to apply and receive a Search Warrant for the suspect's residence. Recovered during the search were an additional 84 grams of cocaine and 528,440. The suspect, an adult male was arrested on Federal drug trafficking charges and will be tried in Federal court. Vice officers assisted agents of the ATF in the arrest of a local male subject on a Federal Arrest Warrant. Recovered in the arrest were 31 firearms and 23,000 rounds of ammunition. STATE FORFEITURES: 4 vehicles with a combined value of$20, 975 were seized by the Asset Forfeiture Sergeant. Also seized was approximately $2,000 in U. S. Currency A/Capt. SPECIAL OPERATIONS A. 07/20/2012 - Platoon 1 officers conducted parking enforcement on Inia Street due to a complaint from the public. Four citations were issued for various parking violations . Compliance was gained after the citations were issued. B. 07/0412022/ - Platoon 2 officers assigned to assist with traffic control at the Kauai Hospice fireworks display at the Vidinha Stadium. C. 7/20/12-7/21/12 : Platoon 2 officers have been conducting traffic enforcement in the area of inia St. and Lehua St . Three citations were issued for parking violations . D. 071/25/2012 - Platoon 2 officers held over to stand-by while C of K officials take possession of the Michael Sheehan Hanalei Boat Yard. Transition occurred without incident. E. 07/24/2012 - Platoon 3 officers participated in a surveillance operation located at the Kilauea Post Office during the night time hours. The operation was Page I of 2 conducted due to past crimes at the Federal Post Office in which the mail vehicles were damaged. Kauai Police Commission From: Chief Michael Floe Re Letter of Commendation On 07118/12 I was visiting the Island of Kauai. This was nay forth visit to Kauai and hope to live there some day. While traveling,in the Wailua area I lost my wallet which contained my drivers License, Credit Card. and about $200 cash. I was due to leave the Island in two days so you can imagine my concern over not having photo Id to get on the plane_ When I discovered the Wallet missing I retraced my travels but did not locate it. I returned to the Kauai Beach Resort and had a message on my= phone stating my wallet had been found. I contacted Kauai PIS main station and was directed to respond to the Wailua Substation where i was met by Officer Hanson Hsu. Officer Hsu was very professional and respectful and returned my wallet which contained all the contents including the 5200 cash. I have been in Law Enforcement for 36 years and have worked in three different California counties. In my present role I investigate Officer Involved incidents and misconduct, It was foreign and embarrassing for me to be contacting Law Enforcement as a victim. It is my intent with this letter to commend the swift, professional and courteous service I received by Kauai police Department from the Phone Dispatcher to the Property Tech to Officer Hanson Hsu.
