Special Executive Session Meeting

OPEN SESSION (Approved as circulated on 08/24/12)
The Special Executive Meeting of the Kauai Police Commission of the County of Kauai was
called to order by Chair Ernest Kanekoa, Jr., at 9:05 a.m., at the Lihue Civic Center, Mo'ikeha
Building, in meeting room 2A-2B. The following Commissioners were present:
Ernest Kanekoa, Jr., Chairman
James O'Connor, Vice-Chair
Bradley Chiba
Randall Francisco (Arrived at 9:10 a.m.)
Charles Iona
Donald Okami, Sr.
Alfredo Nebre, Jr.
Also present: Mayor Bernard P. Carvalho Jr., Ex-Officio, Deputy County Attorney Jennifer
Winn; G. Todd Withy, Esq.; Boards and Commissions Administrator, Paula
Morikami; Teresa Tamura, Administrative Aide; and Support Clerk Mercedes
Youn.
CALL TO ORDER
Chair: I would like to call the meeting to order, it's is now 9:05 a.m. Good morning.
Commissioners: Good morning.
Chair: Can I have a roll call please?
Ms. Youn: Commissioner O'Connor; Commissioner Chiba; Commissioner Francisco;
Commissioner Iona; Commissioner Nebre; Commissioner Okami; Chair Kanekoa; and Ex-
Officio Mayor Bernard Carvalho.
Ms. Youn: There are seven Commissioner's present, and one (1) Ex-Officio member, Mr. Chair.
Chair: Thank you. Since nobody is here from the public to testify, let's take us into Executive
Session.
Mr. O'Connor: Executive Session forty-one (41) pursuant to the Hawaii Revised Statutes §92-
4, §92-5 (a) (4)the Commission requests an Executive Session for a briefing by G. Todd Withy,
Esq. to the Police Commission regarding the Report of Investigation on Issues in the Kauai
Police Department for the County of Kauai, dated June 28, 2012 written by G. Todd Withy, Esq.
The purpose of this Executive Session is to consult with the Commission's attorney on questions

and issues pertaining to the Commission's powers, duties,privileges, immunities, and liabilities
as they may relate to this agenda item, and to take such action the Commission deems
appropriate.
Chair: Okay, Mr. Todd?
Ms. Winn: You need to vote Chair.
Chair: I'm sorry.
Ms. Winn: You need to move and vote.
Mr. Okami: I make a motion to go into Executive Session.
Mr. Chiba: Second.
Chair: All those in favor say aye, motion passes, and we're going into Executive Session.
On a motion made by Mr. Okami and seconded by Mr. Chiba,to enter into Executive
Session, motion carried unanimously by voice vote.
At 9:07 a.m. the Commission entered into Executive Session.
The Commission voted in Executive Session to continue its meeting on Monday, July 16,
2012 at 9:00 a.m. in the Mo'ikeha Building in Meeting Room 2 A/B.
