HomeMy WebLinkAboutKauai Police Commission_072312 OPEN SESSION APPROVED_1m Kauai Police Commission Special Executive Session Meeting Minutes of July 23, 2012 Open Session Approved on 08/24/12 The Special Meeting of the Police Commission of the County of Kauai was called to order by Chair Ernest Kanekoa, Jr., at 9:00 a.m., at the Lihue Civic Center, Mo'ikeha Building, in meeting room 2A-2B. The following Commissioners were present: Ernest Kanekoa, Jr., Chair James O'Connor, Vice-Chair Bradley Chiba Randall Francisco Charles Iona Donald Okami, Sr. Alfredo Nebre, Jr. Also present: Mayor Bernard P. Carvalho., Jr., Ex-Officio; Deputy County Attorney Jennifer Winn; Boards and Commissions Administrator Paula Morikami; Administrative Aide Teresa Tamura; Support Clerk Mercedes Youn; and Police Chief Darryl Perry. CALL TO ORDER Chair: Good morning, it's exactly 9:00 a.m. right now so, we'll call the meeting to order. Chief, we will have to confer with our attorney for a little bit, would you mind just stepping out for a second. Chief Perry: Okay, no problem. Chair: We will call you right back, thank you. Ms. Winn: Chair, would you bring us into Executive Session. Chair: If you wouldn't mind reading it. Mr. O'Connor: ES-46: Pursuant to the Hawaii Revised Statutes §92-4, §92-5 (a) (2) (4) this executive session is to obtain clarification and/or further information regarding events as described by Report of Investigation on Issues in the Kauai Police Department for the County of Kauai, dated June 28, 2012 written by G. Todd Withy, Esq., and take such action the Commission deems appropriate. The purpose of this Executive Session is to consider the hire, evaluation, dismissal, or discipline of an officer or employee or of charges brought against the officer or employee, where consideration of matters affecting privacy will be involved, provided that the individual concerned request an open meeting, an open meeting shall held. The further purpose Page 1 of 2 of this executive session is for the Commission to consult with the Commission's attorney on questions and issues pertaining to the Commission's and the County's powers, duties,privileges, immunities, and liabilities as they may relate to this agenda item. Chair: Thank you, Mr. Chair. Ms. Winn: Chair, you still need to vote to go into Executive Session. Chair: I need a motion. Mr. Okami: I make a motion that we go into Executive Session. Mr. Nebre: Second. Chair: All in favor signify by saying aye, motion passes. On a motion made by Mr. Okami and seconded by Mr. Chiba, to enter into Executive Session, motion carried unanimously by voice vote. At 9:15 a.m. the meeting entered into Executive Session. The Commission called for a recess in Executive Session and will reconvene the meeting on July 27, 2012, at 9:00 a.m. at the Mo'ikeha Building in Meeting Room 2 A/B.
