HomeMy WebLinkAboutAugust 3, 2012_Special Executive Meeting OPEN SESSION Approved 1m Kauai Police Commission Special Executive Session Meeting Minutes of August 3, 2012 OPEN SESSION Approved on 08/24/12 The Special Executive Session Meeting of the Kauai Police Commission of the County of Kauai was called to order by Chair Ernest Kanekoa, Jr., at 1:02 p.m. at the Mo'ikeha Building, in meeting room 2A-213. The following Commissioners were present: Ernest Kanekoa, Jr., Chairman James O' Connor, Vice-Chair Bradley Chiba Randall Francisco Charles Iona Donald Okami, Sr. Alfredo Nebre, Jr. Also present: Mayor Bernard P. Carvalho, Jr.; Deputy County Attorney Jennifer Winn; Boards and Commissions Administrator Paula Morikami; Administrative Aide Teresa Tamura; and Support Clerk Mercedes Youn. CALL TO ORDER: Chair: I would like to call the meeting to order, good afternoon everybody. Mr. Francisco: Aloha. Chair: The time is 1:02 p.m. since there is no one in the public ready to make any statements I'll ask Vice-Chair to take us into Executive Session. At 1:03 p.m. Vice-Chair O'Connor cited the Hawaii Revised Statutes to bring the meeting into Executive Session. Mr. O'Connor: ES-46: Pursuant to the Hawaii Revised Statutes §92-4, §92-5 (a) (2) (4) this executive session is to obtain clarification and/or further information regarding events as described by Report of Investigation on Issues in the Kauai Police Department for the County of Kauai, dated June 28, 2012 written by G. Todd Withy, Esq., and take such action the Commission deems appropriate. The purpose of this Executive Session is to consider the hire, evaluation, dismissal, or discipline of an officer or employee or of charges brought against the officer or employee, where consideration of matters affecting privacy will be involved, provided that the individual concerned request an open meeting, an open meeting shall held. The further purpose of this executive session is for the Commission to consult with the Commission's attorney on Page 1 of 3 questions and issues pertaining to the Commission's and the County's powers, duties,privileges, immunities, and liabilities as they may relate to this agenda item. ES-33 Pursuant to the Hawaii Revised Statutes §92-4 and §92-5 (a) (4), the purpose of this Executive Session is for the Commission to consult with its attorney as to the powers, duties, privileges, immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of the Mayor and the powers of the Police Commission. (On-going) Chair: Thank you. Ms. Winn: You need to move to go into Executive Session. Mr. Chiba: I'll make a motion to go into Executive Session. Mr.Nebre: Second. Chair: All those in favor signify by saying aye, motion passes. On a motion made by Mr. Chiba and seconded by Mr. Nebre,to enter into Executive Session, motion carried unanimously by voice vote. At 1:04 p.m. the meeting entered in Executive Session. RETURN TO OPEN SESSION TO RATIFY THE ACTIONS TAKEN IN EXECUTIVE SESSION FOR ITEMS ES-33 AND ES-46. At 2:25 p.m. the meeting reconvened in Open Session. Chair: I need a motion to ratify the actions taken in Executive Session. Mr. O'Connor: I make the motion to ratify the actions taken in Executive Session. Mr. Okami: Second. Chair: All those in favor signify by saying aye, motion passes. On a motion made by Mr. O'Connor and seconded by Mr. Okami,to ratify the actions taken in Executive Session, motion carried unanimously by voice vote. ADJOURNMENT Chair: I need a motion to adjourn. On a motion made by Mr. Iona and seconded by Mr. O'Connor, to adjourn the meeting, motion carried unanimously by voice vote. At 2:25 p.m. the meeting adjourned.
