Excused Absent SUBJECT DISCUSSION ACTION Call To Order Chair Nebre called the meeting to order at 9:20 p.m. Approval of Notice of Meeting and Agenda— March 19, 2010. Commissioner Grady moved to Agenda approve the agenda, seconded by Vice-Chair Iona, and unanimously carried, 7:0 Public None Testimony Approval of Regular meeting minutes— February 26, 2010. Vice-Chair Iona moved to approve Minutes the minutes, seconded by Commissioner Grady, and unanimously carried. 7:0 Recognition & Officer of the month for March—Officer Jason Matsuoka Commendation Recognition Assistant Acting Chief and Patrol Services Bureau Commander Alejandre Quibilan stated that during the early morning hours of February 12th, 2010, Officer Jason Matsuoka responded to the KPD cell block to assist with a detainee who refused to comply with the cell block personnel. The detainee was initially arrested on four(4) outstanding warrants. Officer Matsuoka ordered the detainee to stop and discontinue all phone calls; the detainee appeared to be in a state of despair, insisting to the person that he was speaking to on the phone, go and get his personal belongings from his vehicle which was parked at a business establishment in Lihu'e, and move the vehicle to another secure location. The conversation was overheard by Officer Jason Matsuoka and Officer David Banquel who gathered enough information to locate the vehicle. On February 13th, 2010, Officer Matsuoka initiated a search warrant which allowed him to enter the vehicle and recover drug paraphernalia, a 9 mm semi-automatic pistol, ammunition for the pistol, knives, a slim Jim and .38 caliber ammunition. By taking the weapons and drugs off of the street and the is now facing suspect facing multiple criminal offenses, ACC Quibilan stated for his continued outstanding work in the Llhu'e district Officer Matsuoka is deserving of the Kaua'i Police Commission Open Session March 19, 2010 Page 2 SUBJECT DISCUSSION ACTION recognition of the Officer of the month. Chief Perry presented Officer Jason Matsuoka with a certificate for"Outstanding Exemplary Service" in the community. Commendation Report There was 1 memorandum of commendation and thanks received involving 3 employees. These letters will be forwarded to the employees with Chief Perry's personal thanks, sent to the Mayor and filed in each employee's personnel jacket. Recipients: Officer's Clyde Caires, Kenneth Cummings and Randall Nero. Commended by: Lt. Sherwin for a job well done in the apprehension of a wanted felon who had resisted arrest by getting into a physical struggle with officers. Their efforts kept a male felon from fleeing back into the community. Additional commendations went to Lt. Michael Contrades, from Mr. Charlie Bass, North Shore Council and Detective Carl Olivier from Ms. Diana Gausepohl-White, Prosecuting Office. Chair's Report Chair Nebre welcomed New Commissioner James O'Connor to the Police Commission. Chief's Monthly Reports include: & Quarterly Reports Administrative &Technical Services: Training Report/Orders Fiscal Report Patrol Services Bureau & Traffic Report March COP Reports for the Districts of: Lihu'e, Hanalei and Waimea Investigative Service Bureau Report Administrative Notices Personnel Orders General Orders Chief's announcements Commissioner Grady questioned if the department is in the process of providing each officer with a taser and are they receiving the proper training. Chief Perry reported that the department is purchasing the tasers as the funds become available. Chief Perry stated that the department is waiting to receive Kaua'i Police Commission Open Session March 19, 2010 Page 3 SUBJECT DISCUSSION ACTION 16 more tasers and as the department moves forward each patrol officer should be equipped with their own taser. Commissioner lannucci commented on the Investigative Service Bureau Report/ Homicide/Suicide. He stated that he was disappointed when he read an article in the newspaper stating that"The Kauai Police Department did not provide enough information" He asked how much more information does the newspaper need; he believes that the department has done a great job investigating the crime and has provided the newspaper with the sufficient information and that they should leave well enough alone. Vice-Chair Iona stated that he agrees with Commissioner lannucci, and that he has also seen on numerous occasions certain articles that were printed in the newspaper, which created a feeding frenzy. He stressed to the viewing public to bear in mind that the department has highly trained professionals, and they are trained to get the facts. He also stated that the newspaper should only print the facts and "nothing but the facts". Commissioner Grady commented on the community activities happening around the island. He stated that he would like to commend the department, in particular the officers who have graciously volunteer in their spare time to train and work with the youth relating to educational organizations and various programs and community service. He wants the viewing public to be made aware of this and commends the officers for their outstanding service in the community. Chief Perry announced that for the last 3 days he has been on O'ahu attending several meetings with different organizations. The first meeting he attended was with an organization whose prime focus is to reduce drug trafficking throughout the State. The organization has a $3 million dollar budget and part that monies would be used to create a Fusion Center, which would be used in combination for major disaster's (terrorism)and to reduce drug trafficking in the State of Hawai'i. Chief Perry stated that he and along with the other Police Chief's has visited some of the Legislators to oppose the medical marijuana bill that would allow the creation of dispensaries within the counties. Discussion on the Hawaii State Police Commission Conference scheduled for May 20-21, 2010, at the Marriott Waikoloa in the Big Island, Kona. Public Announcement for KPC 10-07, dated 02/26/2010. The Police Commission has completed its review and deliberation of the aforementioned complaint filed against an officer of the Kaua'i Police Department. The complaint alleges unprofessional conduct of a police officer. Based on the information provided, the Commission has determined that the complaint did not have sufficient information to uphold. The Commission has forwarded the complaint to the Office of the Chief for further review and or to investigate if deem necessary. This officially concludes the Commission's review of complaint KPC 10-07. Next Meeting Friday, April 23, 2010, Open Session to begin at 9:00 a.m.., Executive Session to follow. Meeting will be held at the Mo'ikeha Building— Meeting Rooms 2 A&B. Executive Taking the meeting into Executive Session Vice-Chair Iona cites the Hawai'i Revised Statues. Session Pursuant to the Hawai'i Revised Statues §92-4 and §92-5 (a) (4), the purpose of this Executive Session is to approve the following Executive Session minutes and to consider and evaluate charges brought against an officer or employee where consideration of matters affecting privacy will be involved; provided that if the individual concerned requests an open meeting; an open meeting shall be held. The further purpose of this Executive Session is to allow the Commission to consult with its Attorney on questions and issues pertaining to the Commission's powers, duties, privileges, immunities and liabilities as they may relate to these items, and to deliberate or make a decision the Commission deems appropriate.
