EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4 and §92-5(a) (2) (4)the purpose of this
Executive Session is to consider and evaluate charges brought against an officer or employee
where consideration of matters affecting privacy will be involved; provided that if the
individual concern requests an open meeting, an open meeting shall be held. The further
purpose of this Executive Session is to allow the Commission to consult with its Attorney on
questions and issues pertaining to the Commission's powers, duties, privileges, immunities,
and liabilities as they may relate to these items, and to deliberate and make a decision the
Commission deems appropriate:

Pursuant to H.R.S. §922-7 (a), the Commission may, when deemed necessary, hold an
Executive Session on any agenda item without written public notice if the Executive Session
was not anticipated in advance. Any such Executive Session shall be held Pursuant to H.R.S.
§92-4, and shall be limited to those items described in 95-5 (a).

Representative
Commissioner lannucci requested that Officer Guirao give an overview of the SHOPO Organization and
his role as the Kaua'i Chapter Chairman.
Officer Jesse Guirao began by acknowledging the other members of SHOPO Board who were not able
to attend today's meeting. They are Vice-Chair James Rodriguez, Secretary Damain Loo and
Treasurer Mark Ozaki.

ACTION
Cont'd-from Officer Guirao explained that SHOPO is the labor union representing the police officers from each
page I different county. SHOPO's mission is to promote the Professionalization and Specialization of the police
service, specifically to:
• Improve the economic, social and civil status of the members of SHOPO;
• Represent and act on behalf of its members in matters affecting and/or arising out of their
employment relationships;
• Improve efficiency in the police departments;
• Serve as the exclusive bargaining representative for the membership of SHOPO on all
collective bargaining with management as authorized by ACT 171, Session Laws of Hawai'i,
1970, State of Hawaii
• Achieve the purposes and objectives of SHOPO through legislation, legal and other appropriate
means; and
• Support any other purpose which would be beneficial to the collective membership of SHOPO.
Commissioner lannucci stated that it is important that the Police Commission have a good relationship
with SHOPO.
Commissioner Grady asked where the SHOPO Office located is. Officer Guirao answered that the
SHOPO Office is located in Uhu'e at 3146 Akahi Street, Commissioner Grady then asked how long
Officer Guirao's term as the Kaua'i Chapter Chairman is, Officer Guirao replied that his term is for four
(4)years and that the Chapter meetings are held once a month, unless there is an issue that needs to
be addressed sooner he stated that the State Board meetings are held on the 3rd Friday of each month
on O'ahu.
Vice-Chair Iona asked under the State Board level, is your interaction with the other County Chairs
equal? Officer Guirao said yes.
Commissioner Tachibana asked if his position is compensated. Officer Guirao said no because it's
voluntary position.
As part of the conversation Chief Perry added that the department has a special relationship with
SHOPO and they hold standing meetings on a regular basis. The goal of the department is to continue
its service to the community and to help its officers because the job they hold can be very stressful and
the department does not want to add to their stress level.
Officer Guirao stated that he supports Chief Perry and will help him in every way that he can. He
understands that the Chief's term is coming up again and informed the Commission that he will support
the Chief in his next term adding that the Chief needs to continue his work with the department.

Recognition and o Recognition of Officers who received an award for outstanding OVUII enforcement from MADD
Commendation (Mothers Against Drunk Driving)
Report
Chief Perry noted that the respective supervisors are here today to speak on behalf of the Officers.
Speaking on behalf of Officer Jason Overmyer was Acting Sergeant James Miller.
Acting Sgt. Miller stated that Officer Overmyer has many responsibilities, he is assigned as the
departments lead Investigator for all fatal and serious injury traffic collision; Drug Recognition Expert in
which he is the coordinator for all of the drug recognition events that are held on island; he is also an
Instructor in the Standardized Field Sobriety Test that is responsible for the training of the new recruits.
A/S Miller stated that with all of the responsibilities that Officer Overmyer over sees he still manages to
make fifteen (15) DUI arrests. With respect to all of that, A/S Miller commended Officer Overmyer for
his outstanding enforcement performance and is well deserving of the MADD award for OVUII
enforcement.
Speaking on behalf of Officer Colin Nesbitt was Sgt. Vicki Fonoimoana, Acting District Commander for
the Waimea District.
Sgt. Fonoimoana stated that she selected Officer Nesbitt for the Waimea District because of his
outstanding performance relating to OVUII arrests. Officer Nesbitt was responsible for six (6) OVUII
arrest last year and has issued five hundred (500) traffic citations, twenty-one (21)of which was for
speeding violations, one hundred and twenty-nine (129)was for other related traffic moving violations
and sixty-one (61) for seat belt violations. Sgt. Fonoimoana believes that Officer Nesbitt deserving of
the award because he was a top contributor and performer for his district.
Speaking on behalf of Officer Rolland Peahu was Ron Green, Acting Sergeant for the 1St Platoon
Hanalei District. (Filling in for Lt. Michael Contrades)
Acting Sergeant Green stated that by the year 2009, Officer Peahu made a total of two hundred (200)
OVUII arrests. He also wrote a total of one-thousand eight-seven (1087) citations of which fifty-eight
(58)was for seat belt violations and eighteen (18) for speeding violations. So far for this year, Officer
Peahu has made three(3) OVUII arrests as well as issuing a total of six-hundred and thirty-five (635)
citations. Remarkably, he issued three-hundred and nine (309) seat belt violations for this year alone,
of which one-hundred and slx-_(1601was moving violations and out of the hundred and sixty-two

(182), twenty-one (21)was for speeding citations. In closing, A/Sgt. Green commended Officer Peahu

Speaking on behalf of Officer Scott Williamson was Officer Jesse Guirao.
Officer Guirao commended Officer Williamson for his outstanding enforcement efforts and credits him
for the high number of citations that he issued throughout the year, he is well deserving of MADD 2010
Law Enforcement Award.
Adding to the recognition, Chief Perry commended the Officers who received the MADD Award, stating
that the work that these officers perform truly saves lives on the highways, especially the lives of
innocent people who are just driving along and getting hit by a drunk driver. Chief Perry gave
recognition to the other Officers who are out in the community protecting the citizens of this island.

o Chief Perry introduced Justin Kollar, Deputy County Attorney assigned to the Kaua'i Police
Department,
o Chief Perry announced that he along with four(4) of the departments civilian employees
attended a one-day Disney Institute Seminar workshop. The seminar focused four(4) primary
areas such as quality management training, safety issues, creativity and efficiency, with safety
being the number one priority for the department and its employees.

o KPC 2010-6 Recap of the 2010 Hawaii State Commissioner's Conference held on the Big
Island Kona from May 20-21 2010
Commissioner Grady reported that the conference was a success and that he liked how they
adjusted the time of the conference to start at 12 noon, allowing the outer island
Commissioners to fly in the day of the conference—a real cost savings all around. As for the
speakers they were basically from the Big Island with various backgrounds. Commissioner
Grady commended Commissioner Kanekoa(who was a guest speaker)for a great
presentation.
Commissioner Kanekoa stated that he was glad that he got to meet and converse with the
other Commissioner's about issues that the Police Commission face.
Chair Nebre reported that one of the topics that were discussed at the conference was the
Medicinal Marijuana conseveryr.
o KPC 2010-7 Discussion and deliberate on the Commissions' position relating to the
Accreditation process for the Kaua'i Police Department.
Chair Nebre stated reason why he had this item placed on the agenda is to inform the
Administration that the Commission is continuing its support of the department's quest to
become an Accredited Agency. He then suggested that the Commission send a memo to the
Administration reinforcing the Commissions commitment to follow through with the
Accreditation process.
Vice-Chair Iona asked about the status on the Accreditation process. Chief Perry reported that
the department is moving forward and that Acting AC Scott Yagihara has been working on the
peripheral. Currently the department is waiting for the promotions to be completed; and once
that is done we able to proceed to assign an individual too specifically work full time on the
Accreditation process, and with the help of legal advisor Justin Kollar who has been busy
changing and updating the department's policy and procedures in preparation for the
Accreditation Manager position. Chief Perry stated that promotion process should be
completed by August or September of this year.

Vice-Chair Iona asked about the timeframe and is the department looking to accredit each
department one at a time or as a whole. Chief Perry said department as whole, as for the time
frame the process should be completed by the year 2014 or by 2015.
Commissioner O'Connor asked if the department is facing any budgetary issues right now.
Chief Perry said no.
With no further discussion, Chair Nebre called for a motion to send a memo to the
Administration on behalf of the Kaua'i Police Department quest for Accreditation and to
encourage the Administration to continue its support in the process.
Discussion
Commissioner lannucci stated that he doesn't feel that it is necessary for the Commission to
send a memo, stating that it's pretty straight forward.
Vice-Chair Iona stated that he thinks it would be worth it for the Commission to send the memo
because would be kept on a record. He then said that the process may become a problem
down the line because of certain criteria's that needs to be met and if the Administration feels
otherwise it may just hinder the Accreditation process. Letting the Administration know that the
Police Commission is in full support of the Accreditation process is the way to go.
Commissioner lannucci disagrees stating that he thinks it's a waste of time and effort, although
he is for the Accreditation process. He asks to call for the vote.

• KPC 2010-8 The Police Commission has completed its review of the following complaints and

issued a public announcement for KPC 10-08, KPC 10-09, KPC 10-10, KPC 10-11, KPC 10-
11 KPC 10-12 and KPC 10-13.
• KPC 2010-9 Discussion and deliberation for possible approval of the Commissions revised
meetin schedule. Vice-Chair moved to accept the
revised 2010 Police Commission

• KPC 2010-10 Discussion and deliberation on the Commissions' position relating to the Vice- Chair moved to defer this

There were 2,901 calls for service, compared to 2,638 the previous month, for an increase of 1-63
calls for service or+9.971/o.
2,211 incidents were reported to the Records Management System, compared to 2,025 incidents
the previous month, for an increase of 186 incidents or+9.19*/o.
There were 234 adult bookings with 364 charges filed. There were also 71 juvenile detairiments,
with 84 charges filed.
There were 247 Part I crimes, compared to 241 the previous month, for an increase of 6 Pan I
crimes or-2,49%.
There were 563 Part R crimes, compared to 477 the previous month., for an increase of 86 Part 11
crimes or+18.03%
There were 174 Traffic Collisions, compared to 178 the previous month, for a decrease of 4
Traffic Collisions, or-2.25%,
There were 160 new warrants issued in May 2010. 83 warrants were served, with the remaining
being recalled, cancelled or returned as non-service leaving 630 outstanding waaants. Of the
outstanding w-wTants, 67 ofthe warrants are felony warrants and 563 are misdemeanor warrants.

Continued checks and monitoring made by on-duty officers during

B. Officer Christian Jenkins issued 61 citations, including 10
moving violations, and made 1 felony and 8 misdemeanor
arrests, and 13 legal services.
C. Officer Chad Cataluna issued 45 citations, including 25
moving violations, and made 1 felony, 12 misdemeanor and 2

D. Cfficer Scott Williamson issued 82 citations, including 44
moving violations, and made 9 misdemeanor and 3 OIJUII

E. Officer Daniel Milloy was commended for the recovery of a
.22 caliber rifle, methamphetamine, paraphernalia, and Ive

ammunition. On May 3, 2010, officer Milloy made a traffic
stop for a seathelt violation and observed more violations
including Driving Without T$icense, No insurance, and false
certificates. nuring the arrest of the violator, Officer
Milloy observed an ammo box on -:he floor of the vehicle.
Officer Milloy seized the vehicle and initiated a search
warrant. The subsequent search t,,.zrned up the items aamed
above. officer Milloy' s diligence and persistence paid
off, as another weapon, ammunition, and meth were taken off
the street. For the month, officer M�.Iloy also issued 25
citations, including 'n moving and 2 seat belt violations,
and made 4 felony and I misdemeanor arrests.

seatbelt enforcement as part of the "Click it or
Ticket" campaign. The Hanalei Station officers issued
328 seatbelt citations for the month. Hanalei Station
issued a total of 798 citations for the month overall .

111. SPECIAL OPERATIONS
From 05-23-10 to 05-31-10, 18 citations for Mobile Electronic Device were
issued.
On 05-26-10, Officer Colin NESBITT conducted enforcement on a Seatbelt Grant
and issued nine citations on Kaumuali'i Hwy., vicinity of State Mile Marker#23.
He also issued one citation for Mobile Electronic Device.
On 05-28-10 and 05-29-10, officers of the third Watch were held over to conduct
traffic enforcement, to disburse gatherings and enforce underage drinking of
other observed violations. Officers D. Lorita, M. Stulpe, D. Miyao, A. Caberto, C.
Okamoto, C. Nesbitt, W. Mccallurn and S/Sgt. D. MENDIOLA participated on one
or both nights. Two OVUII investigations, two General Prohibition Parks/Rec's
violations and two prohibition involving minors' investigations were generated
and resulted in four adults being arrested and one juvenile detained. In addition,
two speeding citations, one disregarding stop sign citation, two defective
headlight citations and one defective tail light citation was issued to motorists.

IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
On 05-05-10, Officer D. frimata and Officer A. Caberto participated in the Kaloa
School Health and Career Day, showing their police vehicles and other
equipment and speaking to four classes of second graders.
On 05-15-10, Sgt. Vicki Fonoimoana participated in the Visitor Industry Charity
Walk and was supported by donations from fellow officers and civilian staff. She
raised $124 for Kaua'i Charities. She also gave her time in assisting with the set-
up of tables and chairs for the Police Week Display at the Kukui Grove Shopping
Center, after the Charity Walk.
On 05-17-10, 05-18-10, 05-20-10, and 05-21-10, Officers D. Miyao, C. Nesbitt,
D. Lorita, A. Abalos, W. Mccallum and Sgt. V. Fonoimoana participated in a
Vehicle Window Tint Inspection that was provided free to the public, at the
Hanap6p6 Army Guard Armory. The inspection was to offer education to
motorists on the legal installation and use of vehicle window tint.
On 05-21-10, Officer Colin Nesbitt participated in the Waimea High School
Project Graduation without incident.
On 05-31-10, Sgt Bernard Purisima, on his own time, assisted the Filipino

Officer J. Bonachita is currently coaching for the Kaua'i High School JV football

Sgt. Bernard Purisima has been volunteering at the Puhi Self Help Housing
performing construction work on homes.
Mr. J. Watanabe coached for the Waimea High School Girl's Softball Team.
V. INDIVIDUAL PERFORMANCE
Officers C. Nesbitt and M. Stulpe are recognized for their outstanding
performance in traffic enforcement during the month of May. Officer C. Nesbitt
issued 93 traffic citations, 23 were for seatbelt violation and Officer M. Stulpe
issued 63 traffic citations, 52 were for speeding violation. Officer Nesbitt also
had two O.V.U.I.I. arrests.

I. PURPOSE:
The purpose of this policy is to set forth guidelines for Kauai Police Department (KPD)
personnel that are responsible for the shipping of narcotics to the State of Hawaii Narcotics
Enforcement Division (NED) certified laboratory for chemical analysis for furtherance of drug-
related investigations and prosecutions initiated and conducted by the Kauai Police Department.
U. POLICY:
It is KPD policy to ensure that all drug and suspected drug evidence seized pursuant to criminal
investigations in the County of Kauai is handled, packaged, shipped, tested and returned in such
a manner as to maintain secure chain of custody and effectuate successful prosecution of drug
offenders.
III. DEFINITIONS:
A. Illegal Narcotics—Any scheduled substance or suspected scheduled substance as set forth
in the Hawaii Revised Statutes (HRS), Chapters 329 and/or 712. "Illegal narcotics" shall
also be defined to include any actual or apparent substance believed to be a detrimental,
harmful, or dangerous drug as those terms are defined in the HRS.
B. KPD Personnel— Any Sworn or Unsworn person employed by the Kauai Police
Department (KPD).
C. Request for Chemical Analysis (RCFA) —Form initiated by the Office of the Prosecuting
Attorney.
D. Chief to Chief(CTC) —Letter initiated by the KPD Assistant Chief of the Administrative
& Technical Bureau and signed by the KPD Chief of Police addressed to the
administrator of the Narcotics Enforcement Division.
E. Narcotics Enforcement Division(NED)—the Narcotics Enforcement Division of the

F. Request for Laboratory Services(RLS) —NED-required form used to initiated laboratory
services.

PROCEDURES FOR LABORATORY SERVICES (NARCOTICS)
W. PROCEDURE:
A. Upon determining that laboratory testing of contraband drug evidence is desirable, the
Office of the Prosecuting Attorney will submit a"Request for Chemical Analysis'
(RFCA) addressed to the Chief of Police indicating the report number and items to be
tested. The information in the RFCA shall correspond to the correct report number and
the items as indicated on the property and evidence receipt filed under that report
number. The RFCA shall be sent to the Chief of Police via the Records Section of the
Administrative& Technical Bureau of the Kauai Police Department.
B. The Records Section will insure that the report number and item numbers being requested
to be analyzed are correct and clarify any questions arising from the RFCA. Once this
has been done, the request will be forwarded to the Assistant Chief of the Administrative
& Technical Bureau for initiation of a formal request to the NED Chief.
C. The Evidence Custodian will complete NED Form"Request for Chemical Analysis"
(RLS)-
D. The Evidence Custodian will submit the RFCA, Chief to Chief letter(CTC), and the RLS
letter to NED.
E. NED will contact the Evidence Custodian and authorize shipment of the evidence to be
tested.
F. The Evidence Custodian and Evidence Clerk will package each item number separately
and properly, label each package by report number, item number, and type of drug and
sealed with tamper proof evidence tape. These packages will be placed into a cardboard
box. The cardboard box will be wrapped with brown wrapping paper and taped at every
point of entry. The original Property&Evidence Receipt (P&E)will be placed within a
sealed envelope and attached to the exterior of the parcel in a manner to prevent
tampering.
G. The parcel will hand carried by the Evidence Custodian and Evidence Clerk directly to
the Purchasing Department for postage. NOTE: ALL NARCOTICS SHIPPED WILL
BE REGISTERED MAIL REQUIRING A RETURN RECEIPT.
H Once postage is stamped on the parcel, the Evidence Custodian and Evidence Clerk will
proceed directly to the Lihue Post Office in which the Evidence Custodian and Evidence
Clerk will visually observe the Postal Clerk stamp every end of the package tape to
prevent tampering.
I. The Evidence Custodian will ensure that copies of the P&E, RFCA, CTC and RLS letter
are appropriately filed with the appropriate report,indicating that the evidence was
shipped to NED. Records section personnel shall ensure that all documentation sent to
and received from NED is scanned and entered into the Records Management System
(RMS).

J. The Evidence Custodian shall provide the NED Analyst with KPD's mail courier service
for return postage of the evidence back to KPD. KPD shall be responsible for all
shipping costs.
K. Upon return of the parcel from NED, the Evidence Custodian shall ensure that all
necessary items and documentation has been returned with the evidence parcel. KPD
Evidence Custodian shall ensure that NED has provided a report of its findings in
writing, accompanying said evidence parcel. The Evidence Custodian shall review the
P&E form and ensure that the original P&E from has been appropriately completed and
returned to KPD by NED and that secure chain-of-custody has been maintained at all
times.
L. The Evidence Custodian shall also review the contents of evidence parcels returned by
NED to KPD and ensure that all items shipped to NED are returned to KPD in
appropriate packaging and that the accompanying documentation corresponds to the
contents of the evidence parcel.
M. The Evidence Custodian shall ensure that the NED report and updated P&E are scanned
and entered into RMS, and shall ensure that appropriate copies of all documents are
routed to OPA via Records.
N. At all stages of the procedures set forth herein, concerning the packing and transportation
of evidence parcels, either to be shipped to NED or being returned from NED, the"two
person integrity" rule will apply.
0. If either the Evidence Custodian or the Evidence Clerk is not available for the
packing/return of evidence parcels to and from NED, and with approval of the Records
Section supervisor, suitable KPD personnel may assist with packaging and/or shipping.
In no instance shall evidence parcels be packaged or shipped when neither the Evidence
Custodian nor the Evidence Clerk are available to assist.
EMPLOYEES OF THE KAUAI POLICE DEPARTMENT SHALL ADHERE TO THE PROVISIONS
OF THIS DIRECTIVE.

Aloha, and thank you for your continued service to the County and the people of Kaua'i.
In my letter dated May 17, 2010, I requested that you consider reducing the salary of the Chief of
Police by 9.23%to be in line with the salary reductions being taken by me and other County
department heads pursuant to our fiscal year 2011 furlough plan.
Since that time. I have learned that in the other Counties, the Police Chief is not being subject to
furloughs or commensurate salary reductions.
Therefore, after careful consideration and discussions with my staff, I have reconsidered my
earlier request and I am withdrawing it. In the alternative, I ask that in the spirit of solidarity and
support that you hold the salary of Chief at the current level while our furlough program is in
place.
Your cooperation in this matter would be greatly appreciated.
