EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4 and §92-5(a) (2) (4), the purpose of this
Executive Session is to consider and evaluate charges brought against an officer or employee
where consideration of matters affecting privacy will be involved; provided that if the
individual concerned requests an open meeting, an open meeting shall be held, and to consult
with its Attorney on questions and issues pertaining to the Commission's powers, duties,
privileges, immunities, and liabilities as they may relate to the following issues:
ES-45 Review of the Kaua'i Police Department's dispositions of complaints filed by
citizens with the Kaua'i Police Commission from January I to October I. 20 10.
ES-46 KPC 10-34, new notarized complaint received on 9/30110, against the Kaua'i Police
Department.
ES-47 KPC 10-35, new notarized complaint received on 10117,110, against an on duty police
officer.
Pursuant to H.R.S. §92-5 (a), the Commission may, when deemed necessary, hold an
Executive Session on any agenda item without-written public notice if the Executive Session
was not anticipated in advance. Any such Executive Session shall be held Pursuant to H.R.S.
§92-4, and shall be limited to those items described in 92-5 (a).

Justin Kollar, Deputy County Attorney Justin Kollar provided an update on the Kaua'i Police Department's Accreditation
Deputy County process,
Attorney.
In his presentation Mr. Kollar stated that the department is in phase I of the accreditation process, and with the
recent promotion of Jon Takamura to Administrative Lieutenant, he will be facilitating the process and the
liaison to the Commission on Accreditation for Law Enforcement Agencies (CALEA). Mr, Kollar provided a list
of the benefits for achieving accreditation from CALEA: 1) Credibility; 2)Greater accountability within an
agency; 3) Reduced risk and liability exposure; 4) Support from government officials; 5) Increase in community
advocacy.
Mr. Kollar further explained that CALEA's primary program is Law Enforcement Accreditation, and the key to
this program is the Standards for Law Enforcement Agencies Manual. Mr. Kollar stated that there are
currently, 463 standards that addresses nine major law enforcement subjects: 1) role responsibilities and
relationships with other agencies; 2)organization, management and administration; 3) personnel structure; 4)
personnel process; 5) law enforcement operations; 6)operations support; 7) traffic operations; 8) detainee and
court-related services; and 9) auxiliary and technical services.
Mr. Kollar stated that the Department is currently at the beginning of the self-assessment process, and that this
phase is meant to have strict time limits. Adding that the department has not formally enrolled as of this date.
Mr. Kollar explained that once the department is enrolled into one of CALEA's programs, it enters into the self-
assessment phase and depending on the program; the department has either 36 or 24 months from the date
the CALEA representative signs the Accreditation Agreement to complete the self-assessment.
Once the department notifies CALEA Of its completion of the self-assessment phase, the department will then
schedule the initial on-site assessment. A team of CALEA-trained assessors will visit the department to
determine its compliance with standards, views agency operations, conducts a public information session, and
reports its findings to the Commission for final determination of Accreditation status.
Mr. Kollar stated that this process is a long-term priority for Chief Perry, and as a small mid-size department,
the obstacles faced are primarily staff related. As the Commission is well acquainted with the seemingly
intractable staffing issues the department faces.
In addition, initialing the Policy Development is time consuming and delicate work, which requires the
cooperation from multiple agencies and Unions. Mr. Kollar credits the assistance of Deputy Chief Mark Begley
and the Administrative Technical Bureau, as a truly management team committed to a Professional Law
Enforcement Agency,

Commissioner lannucci asked if the department would be reimbursed for fees incurred during the accreditation
process. Deputy County Attorney Kollar stated that essentially, the department would recoup the benefits
through reduced liability insurance premiums, and other associated liability costs. Mr. Kollar further explained
that there are some agency's that have been reimbursed of the annual fees paid to CALEA to maintain the
accreditation.
Commissioner lannucci asked whether Chief Perry is supporting the process. Mr. Kollar stated that Chief Perry
is driving the process forward and has made it a major priority.
Chair Nebre asked because the Kaua'i Police Department is not 100 percent staffed, will it affect the
accreditation process for the department, Mr. Kollar said no, because it is not a requirement of CALEA that the
department be 100 percent staffed, although that would be a great benefit for the department.
Commissioner Grady questioned whether the annual cost of four to five thousand dollars is a set amount. Mr.
Kollar explained that the amount is an approximate cost, and that it will probably increase, noting that the cost
does include the man hours and labor that goes into the process. Commissioner Grady questioned whether a
timeframe has been established? Mr. Kollar stated that during the on-site assessment, CALEA will determine
whether or not the facilities meet its standards, if not CALEA will decline to accredit the department at that time.
Mr. Kollar also noted that the time to ask the pertinent questions is during the self-assessment process.
Vice-Chair Iona asked Mr. Kollar, whether the size of the Kaua'i Police Department, based on the standards of
CALEA, have floating variables that are indicated in the manual, which distinguishes between the size of a
department and the financial constraints that a department of this size faces, as opposed to a larger agency
like the Honolulu Police Department, Vice-Chair Iona then asked whether the Kauai Police Department has a
good chance of achieving the accreditation as opposed to holding a steadfast rule whereas, Kaua'i doesn't
stand a chance of being accredited.
Mr, Kollar explained that the standards are not the same for every department. The Kaua'i Police Department
will not be held up to the same standards and requirements as the Honolulu Police Department, but be mindful
that CALEA will not allow the Kaua'i Police Department to cut corners and be less professional, however, they
would be flexible to the facilities when required. Mr. Kollar stated that the goal of the Kauai Police Department
is to get all 463 mandatory requirements, BUT if we can get the ones that are mandatory while maintaining as a
professional operation in other areas, is an option that is open to us.
Vice-Chair Iona asked if there is such a thing as a partial accreditation. Mr. Kollar clarified that CALEA does
not offer partial accreditation, we either get accredited or we don't.

Commissioner O'Connor asked if the department has a target date on the official enrollment. Mr. Kollar stated
that due to the amount of variables that may affect the size of the department, a target date seems unrealistic
at this point.
Recognition and Officer of the month for September: Officer Aaron Relacion
Commendation
Report Deputy Chief Mark Begley reported that Officer Relacion was attending certification training and will not be
available; he then requested to the Commission to postpone this item until the Commission's meeting in
October.
Commissioner lannucci suggested inviting the Officer of the Year to the Commission's meeting next month to
be recognized. D/C Begley noted that Sergeant Karen Kapua was selected as the 2010 HSLEOA Officer of the
Year, which was announced at conference held at the Kaua'i Marriott Resort.

There was (1) memorandum of commendation and thanks received involving Detective Carl Oliver, from Ms,
Joyce Nishimura, Ms, Arlene Yamada and Mr, Wayne Okimoto, thanking Detective Oliver for assisting their
family with an important matter. The letter was forwarded to the employee with the Chief s personal thanks,
sent to the Mayor, and filed in the employees' personal jacket.

Referring to the Uhu'e District COP Report, under Neighborhood Checks, Commissioner Grady asked what
kind complaints were reported, Acting Assistant Chief Alejandre Quibilan reported that there has been a rash of
burglaries occurring in the Pua Loke, Ulu Mahi and Ulu Ko subdivisions and the department set-up an
enforcement task force to monitor the area.

Kapa'a districts,

D/C Begley reported that Lt. Mike Contrades is leading the efforts in Kapa'a, and with the help of the
Administration we are trying to secure a location near the Mahelona Hospital (which is on State property). D/C
Begley noted that assisting with the process is Solette Perry,
With regards to the Waimea Sub-Station, D/C Begley called upon Acting Assistant Chief Quibilan to give a brief
update,
AAC Quibilan reported that the Old Waimea Dispensary remains the target location, and the department is
working with Easter Seals and the Mayor's Office to secure a portion of the building for use as the sub-station,
ACC Quibilan stated that after satisfying the requirements through a grant process, the Easter Seals Society
was granted the use of the building, and through communication with the department, has offered the use of a
portion of the building for the sub-station, ACC Quibilan stated that the renovation of the building will be done by
Easter Seals, and the County will responsible for the interior work. ACC Quibilan stated that there is no set
timeframe, and just recently Lt. Richard Rosa has been assigned to lead the efforts and he is tasked to work
with Easter Seals on setting a timeframe for the completion of the project,
Vice-Chair Iona stated that there are concerns within the community regarding the removal of the lead and
asbestos materials from the interior portion of the building, asking if any consideration is being taken with
regards to retrofitting the interior portions of the building.
ACC Quibilan said not to his knowledge, noting that the department is totally depending on Easter Seals who
has taken the lead on the refurbishing of the building and to address health issues and other concerns.

CREME TRENDS (as of September 30, 2010)
There were 3,017 calls for service, compared to 3,021 the previous month, for a decrease of 4
calls for service or-4.13%.
2,295 incidents were reported to the Records Management System, compared to 2,363 incidents
the previous month, for a decrease of 68 incidents or-2.88%.
There were 257 adult bookings with 372 charges filed. There were also 95 juvenile detainments
with 142 charges filed.
There were 229 Part I crimes, compared to 253 the previous month, for a decrease of 24 Part I
crimes or-9.49%.
There were 650 Part 11 crimes, compared to 655 the previous month, for a decrease of 5 Part 11
crimes or-0.76%.
There were 221 Traffic Collisions, compared to 180 the previous month, for an increase of 41
Traffic Collisions, or+22.78%.
There were 134 new warrants issued in September 2010. 74 warrants were served, with the
remaining being recalled, cancelled or returned as non-service leaving 485 outstanding warrants.
Of the outstanding warrants, 73 of the warrants are felony warrants and 412 are misdemeanor
warrants.

the month out of 2518 for the entire island. This amounts to
47% of all cases, island wide.
ABANDONED/DERELECT VEHICLES: 11 vehicles posted abandoned or
derelict.
II. SPECIAL OPERATIONS AND PROJECT
"Kauali' s Most Wanted" Bench Warrant Program: 5 of the monthly
featured "most wanted" from September and previous months were
arrested in August. To date, 137 of the 215 featured weekly
most wanted were arrested; several have been reported to have

moved out of state, and some are incarcerated on O'ahu and out
of state.

NAWILIWILI AND NIUMALU CHECKS:
Continued checks and monitoring made by on-duty officers during
the night at Nawiliwili and Niumalu areas, especially on
Thursday nights when the NCL Cruise Line is docked overnight.
NEIGHBORHOOD CHECKS:
Pua Loke, Ulu Mahi, and Ulu Ko subdivisions have been checked
and monitored due to complaints made to the Mayor' s and Chief' s
office. No criminal activity observed or reported.
TRAFFIC ENFORCEMENT:
Special Project: National Child Safety Week project, Sept. 20-
24, Llhu' e officers spent a week of pre and post shift
enforcement at the different schools in the Lihule District.

• Traffic Enforcement on Kekaha Road begun the last week
of September. Statistics will be reported during the
next period.
• Complaints received concerning businesses advertising
on State and County Property. Officers warned all
businesses that were advertising in this manner to
cease this practice and gave them flyers of the
section of the Hawaii Revised Statues that they were
violating. One (1) business owner has been cited thus
far for not complying with the warning.
Child Restraint Project in School Zones resulted in
fifteen child restraint citations and one cell phone
citation was issued by Squad 1.

LABOR-MANAGEMENT DISPUTES
L PURPOSE
A- To outline the policy of the Kauai Police Department (KPD) concerning labor-
management disputes.
B. To specify the responsibilities of particular departmental elements and personnel in these
disputes.
C. To provide KPD Officers with general guidelines to observe in dealing with disputes.
H. POLICY
KPD policy is to fairly and neutrally protect life and property and keep the peace in all situations
arising out of disputes between organized labor and management. Negotiation and collective
bargaining are legally recognized methods of settling labor disputes. KPD does not take sides in
labor disputes; rather the police role is to be unbiased, reasonable and impartial while protecting
the civil rights of the general public and the parties involved.
III. DEFINITIONS
A. Strikes: Disputes in which six (6) or more workers strike, or will strike, for a period of
one day or longer. Strikes may or may not involve workplace picketing or organized
demonstrations or rallies at or near the employer's premises.
B. Labor Disturbances: Labor disturbances consist of fewer than six(6) workers and may or
may not involve workplace picketing, secondary picketing, or other organized
demonstrations or rallies.
C Wildcat Strikes or Walkouts: A wildcat strike or walkout is a strike or labor disturbance
initiated by workers without formal sanction of union officials. This type of strike can
occur with suddenness or extreme volatility.
D. Jurisdictional Disputes: Jurisdictional disputes occur when more than one union
simultaneously attempts to organize the same work unit, or where more than one union is
the elected representatives within the same work unit.
IV. PROCEDURES

A. The objectives of the Kaua'i Police Department:
1. To maintain an attitude of neutrality and impartiality as to the merits of the labor
dispute or strike.
1 To protect life and property.
1 To protect the civil rights of the public and all parties to the dispute.
4. It is essential that KPD personnel not be drawn into taking a particular side in any
labor dispute,
B. Role of the Deputy Chief of Police:
I Shall be responsible to assess intelligence received and make the decision to
implement operations at the site of the strike or labor disturbance.
1 Shall maintain administrative control of any operation covered by this directive.
C. Role of the Assistant Chief of the Patrol Services Bureau:
I Shall report to the Deputy Chief of Police and act as Strike Commander. As
Strike Commander, shall maintain operational control of operations arising under
this directive.
2. Shall be responsible to serve as liaison with the labor and management
representatives during any strike or labor disturbance,
3. Shall ensure that lines of communication are maintained between KPD, labor and
management during all phases of the strike or labor disturbance. Shall ensure, to
the maximum extent possible, the cooperation of labor and management in
establishing the parameters for labor and management activities at the site of the
strike or labor disturbance during relevant times.
4. Shall be responsible to inform all parties that force and violence will not be
tolerated.
5. Shall inform all parties that the right to peaceful and orderly picketing shall be
upheld.
6. Shall inform the parties that the right of the public to pass over the public
sidewalks and roadways will be upheld.
T Shall be responsible to ensure that all P personnel are appropriately trained and
equipped to successfully carry out operations at the site of any strike or labor
disturbance,

& Shall ensure that a log is maintained of the number of pickets on each day at each
location, and the length of picketing activity on each day at each location.
9. Shall report periodically to the Deputy Chief of Police on activities at the site of
the strike or labor disturbance.
10. Shall ensure that an adequate command post is established as necessary.
D. Role of the Assistant Chief of the Investigative Services Bureau:
I Shall provide investigative assistance and support as directed by the Deputy Chief
of Police.
E. Role of the Assistant Chief of the Administrative& Technical Bureau:
Shall provide logistical assistance and support as directed by the Deputy Chief of
Police.
F. Role of the District Commander:
I District Commanders shall be present at and supervise field operations concerning
labor disputes in their respective districts. When the District Commander is off-
shift, the platoon Sergeant/OIC shall fulfill this role.
1 Shall coordinate and control planning and operations involving personnel under
their command.
3. Shall be responsible for notifying labor and management of police presence upon
arrival at the site of the strike or labor disturbance.
4. Shall be responsible to report on activities at the site of any strike or labor
disturbance.
5. Shall be responsible to inform, via chain-of-command, significant events
requiring immediate attention or support from other bureaus or supplementary
personnel.
G. Role of the on-scene officer:
1. Shall diligently execute all commands from supervisory personnel. If none given
directly, shall inquire as to ascertain specific duties and/or responsibilities.
2. Shall maintain a fair and impartial attitude at all times towards all participants.
3. Shall ensure public access to public property. Shall prevent any person from
being restrained unlawfully.

4. Shall observe the rights of labor to picket in a legal manner.
5. Shall apprise their supervisors of any incidents or changes in the local situation.
6. Shall report all incidents.
7. Shall maintain a courteous and professional demeanor at all times.
8. Shall not fraternize with labor or management personnel.
9. Shall not enter the property of the company involved in the strike or labor
disturbance except to perform law enforcement activities. Use of company
facilities, vending machines, etc., is generally discouraged.
10. Shall not accept any gratuities, gifts, or items(i.e. food and/or drink) of any kind
from any person while at the site of the strike or labor disturbance,
ll. Shall avoid physical contact with all parties to the maximum extent possible.
12. Shall avoid the use of confrontational language and tone of voice at all times,
V. GENERAL PRINCIPLES
A. Media contact
1. All media inquiries shall be directed to the County's Public information Officer.
2. KPD personnel shall maintain the utmost courtesy towards all media personnel
while maintaining the position that any media contact must be handled through
the Public Information Officer.
3. KPD personnel below the rank of Assistant Chief shall not offer any statements or
comments whatsoever to media personnel or members of the press. Even light
conversation or friendly comments can make it into print or be taken out of
context;therefore strict compliance with this provision is required.
B. Minor disputes
I Efforts shall be made at all times to resolve minor arguments and disputes in a
peaceful and non-confrontational manner, subject to maintenance of the peace and
the safety and welfare of the general public.
2. For non-violent offenses not constituting a felony, or for offenses not constituting
breach of the peace or endangering the safety or welfare of the public, citation
shall be preferred over physical arrest.

3. Consumption of alcohol by strikers or protesters at the site should be brought
immediately to the attention of the strike or protest organizers and the organizer
given the opportunity to resolve the situation without further police intervention.
C. Picket signs and strike perimeters
1. Generally, Police cannot prohibit nor limit the size nor the quantity of placards
used by pickets, However, Police may prevent the placement of signs and
banners if there is a valid public safety reason for doing so (for example,
interference with safe sight lines on a public street),
2. Police cannot establish strike perimeters, but shall work in a cooperative spirit
with all patties involved to ensure that public inconvenience shall be minimized
and public safety is maintained.
D. Public access
I. Pickets may delay the ingress or egress of persons from public roadways and
places where picket activity is being conducted; however, pickets may NOT
prohibit access.
2. Use of arm gestures shall be discouraged in directing vehicles across picket lines.
KPD personnel should not make any gesture which could be interpreted as an
order for any vehicle or person to cross any picket line. Officers performing
traffic control functions shall use their discretion in ensuring the safe and efficient
movement of vehicles.
E. Private security personnel
1. Private security personnel shall not carry on any activities on public property,
2. Private security personnel shall not assist KPD personnel in any KPD activity.
F. KPD vehicles
I KPD vehicles should not be parked on the premises of the company involved in
the strike or labor disturbance unless there is no operationally feasible alternative.
2. KPD vehicles shall not be situated so as to interfere with any lawful picketing.
G. Collective Bargaining Agreement Between County of Kaua'i and the State of Hawai'i
Organization of Police Officers(SHOPO)
I All personnel shall adhere to any provisions of the County's contract with
SHOPO concerning the prohibition of SHOPO members in supporting, aiding, or
assisting any other labor organizations or its members in any labor dispute
(reference CBA Article 38 or current).

1 All personnel shall adhere to any provisions of the County's contract with
SHOPO concerning the consequences of refusal to cross any picket line by a
SHOPO member in the performance of duty(reference CBA Article 38 or
current),
V1. MOVEMENT OF PEDESTRIANS AND VEHICLES CROSSING PICKET LINES
A. KPD personnel shall ensure the freedom of movement of persons and vehicles at the site
of the strike or labor disturbance. Persons and vehicles shall be permitted to enter and
leave in a reasonable manner, within the confines of the law.
B. The at-scene Sergeant or OIC shall request picket captains open picket lines to permit
access by persons or vehicles, and shall not use physical force to open a picket line unless
the picket captain refuses to accede to the request.
C. The Strike Commander, as liaison, may establish reasonable time periods or intervals, in
the Commander's discretion, for opening and closing of the picket lines, provided that no
person is unlawfully restrained and the peace is maintained.
D. KPD personnel shall not provide advice to any person as to whether that person should or
should not cross any picket line.
VII. INJUNCTIONS
A. In any strike or labor disturbance, various courts may issue injunctions setting forth
various court directives to either side. Injunctions are most often civil in nature and do
not require any police action.
B. In the event an injunction or court order is directed towards KPD or KPD personnel, said
injunction or order shall be brought to the attention of the Deputy Chief of Police,
through chain-of-command, and routed to the KID Legal Advisor. Any questions
concerning any injunction or court order shall be routed to the KPD Legal Advisor
through the Deputy Chief of Police,
C, Injunctions or court orders directed to KPD or KPD personnel shall be complied with
strictly.
D. Injunctions or court orders that are only directed to labor and/or management and are not
directed to KPD or KPD personnel shall be considered civil matters not requiring KPD
action. If the injunction or court order specifies that KPD shall enforce the injunction or
order, then KPD shall strictly comply with that injunction or order,
VIIL ARREST
A. As set forth above, use of physical arrest procedures shall be discouraged except as
concerns violent or felony offenses, unless circumstances require otherwise. The purpose

of this provision is to avoid escalation of volatile situations. Arrest warrants may be
generated at a later date, or a citation issued if appropriate. Offenses may be reported and
referred to the Office of the Prosecuting Attorney for issuance of complaint and summons
as well.
B. If a physical arrest at the site of the strike or labor disturbance is necessary, KPD
personnel shall ensure that adequate backup is at the site to ensure the safety of KPD
personnel. Officer safety is paramount.
C. Mass arrests should be made only as a last resort and after consultation with chain-of-
command. Mass arrests should be made only after consultation with the Deputy Chief of
Police unless exigent circumstances dictate otherwise. KPD personnel shall ensure that
probable cause exists for every single person arrested in the course of a mass arrest.

L PURPOSE:
To establish a policy for the timely, effective, and just processing of complaints alleging
violations of federal nondiscrimination requirements,
M POLICY:
It is the policy of the Kauai Police Department(KPD)to strictly observe and comply with all
federal nondiscrimination requirements. It is also KPD policy to timely and fairly address,
process, and resolve complaints alleging violations of those requirements.
M. PROCEDURES
A. The Deputy Chief of Police(or designee) shall be responsible for overseeing the
complaint process.
B. All KPD employees shall be informed, by copy of this directive, that in addition to the
ability to file a complaint of discrimination through the County of Kaua'i, State of
Hawaii Civil Rights Commission, or Federal EEOC office, they may also complain of
discrimination directly to the Deputy Chief of Police(or designee),to the State of Hawaii
Department of the Attorney General, or to the United States Department of Justice,
Office of Justice Programs, Office for Civil Rights (OCR).
C. The Deputy Chief of Police(or designee), upon receipt of a complaint of discrimination,
shall initiate an internal investigation. The Deputy Chief of Police(or designee) may
enlist the assistance of the Criminal Intelligence Unit or any other appropriate internal or
external personnel in conducting the investigation. The Deputy Chief of Police(or
designee), in his or her discretion, may also choose to forward the complaint to the State
of Hawaii Department of the Attorney General, the OCR, or another appropriate external
agency.
D. The Deputy Chief of Police(or designee) shall notify the Department of the Attorney
General, Crime Prevention and Justice Assistance Division(CPJAD) of the complaint.
E. The Deputy Chief of Police (or designee) shall notify the Department of the Attorney
General of the findings of the investigation.

DISCRIMINATION COMPLAINT PROCEDURES
F. In the event that a Federal or State court or Federal or State administrative agency makes
a finding of discrimination after a due process hearing, on the grounds of race, color,
religion, national origin, sex, age or disability against KPD, the Deputy Chief of Police
(or designee) shall be responsible to forward a copy of the finding to the OCR and the
CPJAD.
G. Any individual or group who believes that it is aggrieved by KPD can file a complaint
with the OCR, which investigates all individual complaints of discrimination filed against
recipients of funding from the Office of Justice Programs and its component
organizations, Office on Violence Against Women, and the Community Oriented
Policing Services Office.
