Deputy Chief Mark Begley presented Officer Relacion with a certificate in recognition of his exemplary and outstanding service to the community on behalf of the citizens of Kaua'i and the members of the Kaua'i Police Department. • 2010 HSLEOA(Hawai'i State Law Enforcement Officers Association)of the Year—Sgt. Karen Kapua Sgt. Karen Kapua was recognized by Lt. Kaleo Perez, On September 26, 2010, Officer Kapua was promoted to the rank of Sergeant. Sgt. Kapua is an eleven year(11)veteran of the Kaua'i Police Department, who also served as a 911 dispatcher for the department for five (5)years, prior to becoming a police officer. Sergeant Kapua many roles included being the officer in charge of her squad for a number of years for the Uhu'e district. Sgt. Kapua is also a notary public and a certified hostage negotiator with the department and is called upon on numerous occasions to de-escalate confrontations. She was also recognized for her work as a volunteer parent with the Kapa'a"Rancheros"4H Club and has assisted with numerous fund raisers and for her work with the Special Olympics. She is married to the former police Sergeant Irvil Kapua, they have four(4) children, Pohaku, Nalu, Makani and Naele. • 2010 TOP COP—Officer Colin Nesbitt. Lt. Kaleo Perez announced the 2010 Kaua'i Police Department's"Top Cop" of the Year, was Officer Colin Nesbitt. Officer Nesbitt was recognized for his work ethics and productivity, and he was also honored among the many officers throughout the State at the 26th Annual Top Cop Law Enforcement Appreciation Banquet held on Oahu. In addition to the presentation Deputy Mark Begley announced that during the application process for officers for the department, he found that Officer Colin Nesbitt put his personal business aside to assist with the recovery efforts after the devastation of Hurricane Katrina in Orleans. Officer Nesbitt donated his time and his own finances to help the people rebuild their homes. Deputy Chief Begley stated that with this deed, Officer Nesbitt showed true character and is also an outstanding performer for the department. ■ Officer of month for October—Christian Jenkins was presently on vacation, a request was made to defer the presentation to the next Commission's meeting in November by Deputy Chief Mark Begley. Commendation Report The Kauai Police Department received a memorandum of commendation and thanks were received involving 6 employees. The letters were forwarded to the employees with the Chief's personal thanks, sent to the Mayor, and filed in each emPloyee's_personneljacket: Kauai Police Commission Open Session October 2 , 2010 Page 3 SUBJECT _— _ ------- — —_—_ —_- DISCUSSION ..__ ACTION Employees commended were Lt. Michael Contrades, Sgt. Darren Rose, Officers Elliott Ke, Ginny Pia, Brian Silva and Daniel Oliveria. They were commended by Ms. Florence Nakakuni, United States Attorney District of Hawai'i, for their work with other government agencies in a joint investigation of methamphetamine trafficking. Their team effort resulted in the apprehension and conviction of numerous suspects located in Hawaii and California. _.__.._._ ____ _...______ .___.._______. _ —_.--- Chief's Monthly Reports include: .--__�_m____---------- —_.__ and Quarterly — Report Administrative and Technical Services and Training Report/Orders: Commissioner Grady questioned who designates personnel to attend the Grant Writing workshop. Deputy Chief Begley stated that the majority of training opportunities are offered to all of the employees and sometimes it comes though a recommendation by their supervisors with the approval of Chief Perry. Commissioner Tachibana asked how many officers within the department have been trained to use the taser. Deputy Chief Begley referred the question to Acting Chief Scott Yagihara. AC Yagihara stated that roughly there are forty (40) officers that are trained to use the tasers, and the department will be issuing new tasers that will require additional training for the officers. Vice-Chair Iona stated that HPD received a very generous donation of tasers, with the help of former Chief Lee Donahue, he asked if the Kauai Police Department would be receptive to any entity from the community coming forth to donate tasers to the department. Deputy Chief Begley said absolutely, noting that any donations must have the approval of the County Council. After deliberation and decision making, the Commission found that based on the nature of the complaint, it is out of the Commission's jurisdiction and therefore, has forwarded the complaint to the Office of the Chief for further review and to investigate. CRIME TRENDS (as of October 31, 2010) There were 3,164 calls for service, compared to 3,017 the previous month, for an increase of 147 calls for service or+4.870/o. 2,485 incidents were reported to the Records Management System, compared to 2,295 incidents the previous month, for an increase of 190 incidents or+8.28010. There were 310 adult bookings with 505 charges filed. There were also 72 juvenile detainments with 81 charges filed. There were 291 Part I crimes, compared to 229 the previous month, for an increase of 62 Part I crimes or+27.071/o. There were 664 Part H crimes, compared to 650 the previous month, for an increase of 14 Part H crimes or+2.15010. There were 193 Traffic Collisions, compared to 221 the previous month, for a decrease of 28 Traffic Collisions, or-12.67% There were 170 new warrants issued in October 2010. 86 warrants were served, with the remaining being recalled, cancelled or returned as non-service leaving 502 outstanding warrants. Of the outstanding warrants, 81 of the warrants are felony warrants and 421 are misdemeanor warrants. H. POLICY: It is the policy of the Kauai Police Department to authorize and provide, as necessary, non-sworn personnel to serve as adult school crossing guards. M. AUTHORITY: Hawaii Revised Statutes §52D-7, Traffic control surrounding school premises (a) The chief of police shall have charge, direction, and control of all matters relating to preserving and protecting the public health, safety, and welfare on and about the streets surrounding any school. To perform this function, the chief of police shall appoint, train, and compensate traffic monitors to perform such duties as the chief directs. Nothing contained in this section shall be construed to diminish the role now performed by the junior police officer program. (b) The traffic monitors of the respective counties shall be provided with suitable badges or insignia of office, and shall have the duty to assist police officers throughout the State in all matters relating to the enforcement of traffic regulations on and about the streets surrounding any public school premises. (c) The term "traffic monitor" means all persons over the age of eighteen who are appointed, trained and compensated by the chief of police of each county to perform duties under this section whether called traffic monitors or by any other name or title. IV. ADMINISTRATION OF PROGRAM A. The Patrol Services Bureau Traffic Safety Unit shall be responsible for administration of the following: KPD 202 GENERAL ORDER#2010-12 Page 2 ADULT SCHOOL CROSSING GUARD PROGRAM, I Training in traffic control, as scheduled in conjunction with Administrative and Technical Bureau. 2. Issuance of uniforms and equipment, 3. Identifying an appropriate school crossing point at each school with an assigned crossing guard(s). 4. Job Performance Evaluations. B. The Administrative& Technical Bureau Research&Development Section shall be responsible for administration of the following: 1. Background Investigation. 2. Scheduling of Training and Maintaining Records of Training. 3. Employee Orientation. Employee Orientation shall include but is not limited to General Order and Standard of Conduct review, as well as Workplace Violence and Sexual Harassment training. 4, Assignment. V. CROSSING GUARD AUTHORITY AND RESPONSIBILITY: A. Adult School Crossing Guards shall be authorized and responsible for ensuring the safe passage of school children to and from school on school days. The guards shall direct the children across the street at a safe moment or by temporarily stopping traffic to allow for their safe passage, B. Adult School Crossing Guards shall not have arrest powers, C. Adult School Crossing Guards shall not carry weapons of any type. D. Adult School Crossing Guards shall conduct themselves in a professional manner. E. Adult School Crossing Guards shall not be under the influence of an intoxicant while on duty, VL SELECTION CRITERIA: A. Persons who desire a position as a school crossing guard shall file an application with the County of Kauai Department of Personnel Services, KPD 202 GENERAL ORDER#2010-12 Page 3 ADULT SCHOOL CROSSING GUARD PROGRAM 1. All applicants shall be over the age of eighteen. 2. All applicants shall be physically able to perform the duties and responsibilities as set forth for school crossing guards. 3. All applicants shall furnish any documents required for employment. 4. All applicants shall be checked through the Sex Offender Registry and Criminal History databases of the State of Hawaii Criminal Justice Data Center and National Crime Information Center. Fingerprints of applicants shall be cleared through the Federal Bureau of Investigation. V11. CROSSING GUARD UNIFORMS: A. Adult School Crossing Guards shall be provided with uniforms to include, but is not limited to: 1. Traffic Vest with Crossing Guard insignia 2, Rain Wear 3. Whistle 4. Stop Paddle B. All uniforms and equipment provided to Adult School Crossing Guards will remain property of the Kauai Police Department. C. Adult School Crossing Guards shall return all issued uniforms and equipment to the Kauai Police Department upon separation from service. VIII. CRITERIA FOR DETERMINING CROSSING GUARD LOCATIONS: A. The Traffic Safety Unit shall determine crossing guard locations based on the following: 1. Traffic volume/speed; 1 Number of turning movements; 3 Width of intersectionlroadway; 4. Physical terrain, 5. Existence or absence of traffic control devices-, N',PD 2102 GENERAL ORDER#2010-12 Page 4 ADULT SCHOOL CROSSING GUARD PROGRAM & Number and age of children utilizing the crossing; 7, Requests or observations made by Traffic Safety Unit officers, school officials, or concerned parents; or 8. An annual analysis shall be conducted by the Traffic Safety Unit in conjunction with the County of Kauai Department of Public Works Engineering Division and school authorities in order to provide data to form the basis for establishing or maintaining school crossing points. PURPOSE: To set forth the structure and responsibilities of the Kauai Police Department's Administrative Review Board(ARB). H. ADMINISTRATIVE REVIEW BOARD: A. POLICY I The ARB shall be responsible for hearing and reviewing administrative charges against police department employees involving violation of standards of conduct, rules and regulations, General Orders, or any other directive to determine the validity of the charges, and to recommend appropriate disciplinary action to the Chief of Police. 2. The ARB shall recommend the appropriate disposition of charges made against department employees. This recommendation will be based upon the administrative investigative reports, statements, documents, and such other evidence that it deems appropriate. 3. All discussions, documents, investigative reports and material pertaining to the ARB proceedings are confidential unless otherwise determined by the Hawaii Revised Statutes, Kauai County Code, or collective bargaining agreement. 4. The ARB is also responsible for hearing, reviewing, and making recommendations for approval to the Chief of Police regarding the creation and modification of General Orders. B. ADMINISTRATIVE REVIEW BOARD COMPOSITION AND PROCEDURES: I The ARB shall consist of a. The Deputy Chief of Police(Chair), the Assistant (or Acting Assistant) Chief of Police from each of the three bureaus, and the Captain from each of the three bureaus. Unless otherwise authorized, the ARB shall conduct a hearing within thirty (30) days of receipt of the investigative report. f In rendering a recommendation, members of the ARB shall have the opportunity to review the employee's personnel file. A majority opinion of the ARB shall hold. A unanimous opinion is not required. 2. Presentation of Administrative Investigation to the ARB a. The employee's designated district, section, or unit commander of the rank of lieutenant or acting lieutenant—but not of a rank lower than a sergeant or detective—who is not directly involved in the investigation, shall present the facts of the case to the ARB and: 1. Make recommendations to the ARB; and 2. Hold all discussions confidential. b. Should the employee's presenter be ineligible, the presenter shall assign an alternate from the designated district, section, or unit. The assigned presenter shall be of the rank of sergeant, detective, or higher. c. A copy of the administrative investigation shall be made available to the designated presenter a minimum often (10) working days prior to convening the ARB. & All documents relating to the presentation shall be confidential and not subject to disclosure except through statutory and other regulatory mandates. e. At the conclusion of the presentation, all copies of the administrative investigation shall be immediately returned to the Office of the Chief of Police. KPD 202 GENERAL ORDER# 2010-13 Page 3 ADMINISTRATIVE REVIEW BOARD 1, No other duplications of the administrative investigation shall be made other than copies provided to the ARB, 1 Chairperson a. The Deputy Chief of Police shall preside over the ARB proceedings and decide any questions of procedure, admissibility of evidence, and all related matters. I. In the absence of the Deputy Chief of Police, the designated ARB Chair shall be assigned in the following order : a. Assistant Chief(or designee), Administrative& Technical Services Bureau b. Assistant Chief(or designee), Investigative Services Bureau C. Assistant Chief(or designee), Patrol Services Bureau b. The Deputy Chief of Police shall vote only in case of a tie. C. Employees subject to the ARB hearing shall be notified in writing of the charges and date of the hearing, b. Employees will have the option of appearing before the ARB to make any statement directly related to their disciplinary case or cases. C. Employees will be permitted to have a Union Representative present with them to offer advice, counsel, and may speak on behalf of the employee for a maximum of five(5) minutes, d. Members of the ARB will be permitted to ask the employee questions relating to the incident for the purpose of clarification. e. Only members of the ARB shall be present during the deliberation period. VPD 2(," GENERAL ORDER#2010-13 Page 4 ADMMSTRATIVE REVIEW BOARD f Employees who are excluded from collective bargaining units may appeal disciplinary actions as provided by appropriate rules and regulations of the County of Kauai. 5. Additional and Amended Charges a. Should the ARB decide to amend or add charges, the employee shall be notified in writing and given the opportunity to respond in writing within seven(7) calendar days from the date of receipt. b. The essence of"due process" is the employee's right to be given notice and with that, the opportunity to be heard. C. ADMMSTRATIEVE REVIEW BOARD PROCEEDINGS I Power and Authorization: a. The ARB, through its Chairperson, is authorized to summon any employee of the Department to provide testimony relating to the case under review. b. The ARB, through its Chairperson is authorized to require that additional investigations be conducted. C. Members of the ARB shall not testify on any matter they vote on. 2. Closed Session and Deliberation a. All deliberations and any determination of disciplinary action shall be in "Closed Session" (Chairperson and Board members only). b. All ARB hearings are closed to everyone except those summoned, or as authorized by the Chairperson. 3. Voting a. Each member of the ARB shall have an equal voice and voting privilege. b. In rendering a recommendation, a majority opinion of the ARB will hold, and a unanimous opinion is not required. c, The Deputy Chief shall only vote in the case of a tie, and shall be the deciding vote. 4. Classification of Charge: The ARB, after considering all pertinent reports and testimony, shall assign one of the following classifications to each complaint: 1,JP D 02 GENERAL ORDER#2010-13 Page 5 ADMINISTRATIVE REVIEW BOARD a. Complaint Unfounded.- The complaint is not based on facts or the incident upon which the complaint is based did not occur. b. Complaint Not Sustained: There exists insufficient evidence to prove or disprove the allegation. C. Employee Exonerated: The incident upon which the complaint is based occurred but the employee's actions were lawful and proper. d. Complaint Sustained There exists sufficient evidence of misconduct to sustain the allegation or justify disciplinary action. 5. Recommendation: a. When a complaint is sustained, the ARB's findings shall include a recommendation for appropriate disciplinary or non-disciplinary action, such as: 1. Counseling—oral or written; 2. Training or Fitness for Duty Evaluation; 3. Written reprimand; 4. Suspension for a specific number of days; 5. Demotion; or, 6. Separation from police service(voluntary resignation, dismissal, or termination of initial probationary appointment). b. The ARB shall submit its findings and recommendation in writing to the Chief of Police. c. The Chief of Police shall make a determination on the final action to be taken. I The Chief may request in writing more information from the ARB and/or investigator for clarification purposes before imposing KPD 202 disciplinary action. GENERAL ORDER#2010-13 Page 6 ADMINISTRATIVE REVIEW BOARD 1 A copy of imposed disciplinary action shall be placed in the employee's personnel file. D. REJECTION OF ARB RECOMMENDATION/MOVE FOR DISMISSAL: 1. Should the Chief of Police decide to reject the recommendation(s) of the ARB and impose a more severe disciplinary action of dismissal, the Chief of Police shall direct the Chair to reconvene the ARB. 2. The Chief of Police will then explain the reasons for the action of dismissal. Following discussions, the ARB may make additional recommendations(s). 3. If the action against the employee is dismissal, the employee shall be given written notification of the reasons for the decision, to include the employee's right to a predetermination hearing. 4. The Chief of Police shall decide on the final action following the predetermination hearing. 5, Notification of dismissal shall be made at least ten(10) days prior to the effective date. P Date C ief 4of Poli e K P D 2012 KAUAI POLICE DEPARTMENT GENERAL ORDER DATE OF ISSUE EFFECTIVE DATE NO. 111812010 Immediately 12010-14 REFERENCE RESCINDS, INDEX AS: WORKING BEYOND NORMAL WORKING HOURS L PURPOSE: The purpose of this policy is to provide a structure for monitoring, managing and controlling the use of personnel overtime. H. POLICY: All personnel of the department must be mindful of and exercise fiscal responsibility in the use of public funds and resources. Overtime pay requires particular attention because it constitutes a sizeable expenditure of department funds that are provided at premium rates. Without adequate controls, unplanned expenditures can create budget overruns and divert resources from key operational areas. Therefore, it is the policy of this department to effectively manage the use of overtime and that of each employee to use overtime in a responsible and judicious manner. III. GENERAL GUIDELINES: A. Before any work duties are performed outside of a department employee's normal work hours, the employee must first request and obtain authorization from his/her immediate supervisor or the on-duty supervisor. B. In the event that an employee is unable to first obtain such authorization, the employee shall contact his/her immediate supervisor or the on-duty supervisor as soon as possible following the start of the work duties in order to obtain authorization to continue to perform their work duties outside of the employee's normal work hours. A failure to request and obtain authorization in a timely manner may result in disciplinary action. C. All work duties that are performed outside of an employee's normal work hours, whether authorized or not shall be reported by the employee on the day the work is performed to the employee's immediate supervisor or to the on-duty supervisor. The employee shall review his/her timesheet for accuracy prior to its submittal. If the employee becomes aware of an error on his/her timesheet after he/she has signed the timesheet, he/she shall inform the on-duty supervisor or clerk of the error. The on-duty supervisor shall ensure that appropriate corrections are made to the timesheet, D. If work is verified as actually performed, the employee will be paid for the time worked, as required by law. If an employee fails to obtain authorization to perform work outside of the employee's normal work hours or fails to follow these required reporting KPD 20-2 GENERAL ORDER#2010-14 Page 2 WORKING BEYOND NORMAL WORKING HOURS procedures,the employee may be subject to disciplinary action for violation of this order, E. These general guidelines shall apply to all work circumstances covered by this General Order. IV. PROCEDURES A. ATTENDING—NIEDICAL. PHYSICAL OR PSYCHOLOGICAL EXAMS The scheduling of department required employee medical or physical examinations shall be the responsibility of the Administrative& Technical Bureau Commander or designee. Every effort shall be made to schedule Department required medical or physical exams during normal work hours. Psychological evaluations shall be scheduled by the Administrative& Technical Bureau at the direction of the Chief's Office. If it is not possible to schedule an examination or evaluation during an employee's normal work hours, the employee shall be scheduled for examination during the employee's off-duty hours. Absent appropriate approval, employees shall not schedule their own department required physical and/or psychological examinations. Examinations and evaluations that occur during an employee's off-duty hours shall be regarded as compensable work time. B. CLEANING AND/OR MAINTAINING OF POLICE SERVICE FIREARMS Employees shall clean and maintain their issued and authorized firearm during normal work hours in the station or at the department's firing range. This shall be done following department authorized firearms training or qualifications or as the need arises. Supervisors shall be responsible for ensuring that employees are provided adequate time to perform this task during normal work hours. Employees shall be allowed adequate time to clean their firearms after firearms qualifications. C. PREPARDiG FOR COURT An employee who needs to prepare for court shall do so during his/her normal work hours. If it is not possible for an employee to prepare for court during his/her normal work hours,the employee shall request and obtain authorization from his/her immediate supervisor or the on-duty supervisor prior to performing any work to prepare for court during his/her off duty hours. This shall include all communications with the prosecutor including, but not limited to consultative calls and meetings. KPD -202) GENERAL ORDER#2010-14 Page 3 WORKING BEYOND NORMAL WORKING HOURS Court preparation work that occurs during an employee's off-duty hours shall be regarded as compensable work time. D. PERFQR STAKEOUTS/SURVEILLANCE Stakeouts or surveillance work shall only occur with authorization from an employee's immediate supervisor and the supervisor in charge of the assignment or investigation. Employees do not have the discretion to engage in stakeout or surveillance work without such prior authorization. Stakeouts or surveillance work that occurs outside an employee's normal work hours shall be regarded as compensable work time, regardless of whether the stakeout or surveillance was successful. E. WASHING AND/OR MAINTAINING DEpARINMNT VEHICLES Employees shall maintain and wash department vehicles only during the employee's normal work hours. Employees are not authorized to wash or maintain a department vehicle at home or during their off-duty hours. For further details on the take home vehicle program, refer to General Order 98-04, TAKE HOME VEHICLE-OPERATION PROCEDURE. The employee must obtain prior authorization from their immediate supervisor for maintenance and/or washing of a department vehicle that occurs outside an employee's normal work hours. Such work shall be regarded as compensable work time. F. RESPONDING TO CALLS THAT RUN OVER NORMAL WORK HOURS Unless the situation precludes an employee from doing so, an employee shall inform his/her immediate supervisor or the on-duty supervisor prior to responding to or rendering service for a post-shift call. Where the situation precludes obtaining prior approval the employee shall contact his/her immediate supervisor or the on-duty supervisor as soon as practical after he/she has responded to the call and the situation has been stabilized. The immediate supervisor or the on-duty supervisor shall then decide whether the employee will continue with the post-shift call or turn over the responsibility to other employees. An employee who has been relieved of such post-shift duties does not have any discretion to continue the post- shift work. All time spent responding to calls that run over normal work hours shall be regarded as compensable work time. G. COW—LEDNQ PAPERWQM QRQ11JER.–SIMILAR DUTIES BEFORE OR AFAR S KPD 292 GENERAL ORDER#2010-14 Page 4 WORKING BEYOND NORMAL WORKING HOURS An employee who is unable to complete his/her paperwork or reports during his/her normal work shift shall request authorization from his/her immediate supervisor or the on-duty supervisor before performing any work outside his/her normal work hours to complete such paperwork or reports. When it is not necessary that paperwork or a report be completed that day, authorization shall be denied by the immediate supervisor or the on-duty supervisor. No employee shall perform any work outside his/her normal work hours or take any work home to complete without first obtaining authorization to do so from his/her immediate supervisor or the on-duty supervisor. All time spent performing paperwork and/or completing of reports that occurs outside an employee's normal work hours shall be regarded as compensable work time. H. PREPARING FOR ROLL CALL An employee shall perform all roll-call related work duties during the course of his/her regular work hours. Supervisors shall establish schedules that will allow employees adequate paid time to prepare for roll-call. (For example, a supervisor may provide an employee with time during his/her normal work hours to prepare paperwork needed for roll-call.) All roll-call related work duties that occur outside an employee's normal work hours shall be regarded as compensable work time. 1. FIELD TRAINING OFFICERS An FTO with an assigned probationary officer shall complete a Daily Observation Report at the end of every scheduled work day. The FTO should normally be able to complete the Daily Observation Report within .5 hours, An FTO with an assigned probationary officer shall also complete a Weekly Observation report. The FTO should normally be able to complete the Weekly Observation Report within I hour. Any other work relating to the training of a probationary officer shall be done during the FTO's scheduled work day. To the extent an FTO believes that he/she must work additional time beyond the FTO's scheduled work day in order to properly train or complete work related to an assigned probationary officer, the FTO shall first request and obtain prior authorization from the FTO's immediate supervisor or the on-duty supervisor before engaging in work beyond the FTO scheduled work day. All time spent by an FTO relating to the training of probationary officers that occurs outside a FTO's normal work hours shall be regarded as compensable work time. KPD 202 GENERAL ORDER#2010-14 Page 5 WORKING BEYOND NORMAL WORKING HOURS J. SPECIAL DETAILS For purposes of this subsection, a Special Detail shall include, but is not limited to the service of search warrants, outside assist arrest warrants, legal document details and other enforcement projects. An employee shall only be involved in a special detail with authorization from his/her immediate supervisor or supervisor-in-charge of the assignment or operation. Unless otherwise required, employees who have been authorized to be involved in the special detail shall be paid from the time they report to duty until they are relieved of duty. All time spent by an employee in the special detail that occurs outside an employee's normal work hours shall be regarded as compensable work time. K. LOCATING WITNESSES An officer who is locating a witness shall do so during his/her normal work hours. If an officer believes that working outside of normal work hours is necessary to locate a witness, the officer shall first request and obtain permission from his/her immediate supervisor or the on-duty supervisor before engaging in any work outside of normal work hours. All time spent by an employee in locating a witness that occurs outside an employee's normal work hours shall be regarded as compensable work time regardless of whether the employee successfully located the witness. L. MAKING TRAFFIC STOPS An officer who conducts an off-duty traffic stop shall follow normal traffic stop procedures. The officer shall immediately notify dispatch once the decision has been made to conduct a stop and request that an on-duty supervisor within the sector be notified of the stop. The on-duty supervisor shall then decide whether the employee will be allowed to continue to handle the incident or whether the incident will be turned over to another employee. An employee who has been relieved from duty and has been instructed to leave the scene does not have any discretion to continue the off-duty work. All time spent by an employee in an off-duty traffic stop shall be regarded as compensable work time. A RESPQ TO RADIO CALLS Employees on a scheduled meal period shall not respond to radio calls assigned to other officers. If an employee believes that additional assistance may be needed for a radio call KPD 202 GENERAL ORDER#2010-14 Page 6 WORKING BEYOND NORMAL WORKING HOURS assigned to other officers, the employee is required to first request and obtain authorization from his/her immediate supervisor or the on-duty supervisor before ending his/her scheduled meal period to provide assistance. Without such authorization, the employee shall remain on his or her scheduled meal period and shall not return to duty until the scheduled meal period has ended. Where an on duty employee assists other officers during his/her scheduled meal period the provisions of section 11, O. of this General Order should be followed. All time spent by an employee responding to radio calls outside of the employee's normal work hours shall be regarded as compensable work time. This section does not apply to officers and employees whose work schedule includes a running lunch period. (For example, patrol officers on the nine/five schedule, traffic officers on the four/ten schedule and dispatchers working through their shift.) N. TRANSPORTING EMPLOYEES OR EQUIPMENT Employees shall only transport employees or equipment during their normal work hours. If an employee believes that transporting employees or equipment outside the employee's normal work hours is necessary the employee is required to first request and obtain authorization from his/her immediate supervisor or the on-duty supervisor before engaging in any work related to the transporting of employees or equipment outside the employee's normal work hours. All time spent by an employee in performing transportation of employees or equipment outside of the employee's normal work hours shall be regarded as compensable work time. Nothing in this section shall preclude employees from car pooling to and from work for their personal benefit and convenience. Q. )KQRKING THROUGH A MEAL PERIOD An employee shall not perform any work including but not limited to working on reports or other paperwork, answering the telephone or responding to radio calls during his/her meal period unless the employee first requests and obtains authorization from his/her immediate supervisor or the on-duty supervisor. If an employee is not provided at least 30 consecutive minutes during which he/she is free from work related interruptions for his/her meal period, the employee shall 1. inform his/her immediate supervisor or the supervisor on duty that his/her meal period was less than 30 minutes; and I&D 202 GENERAL ORDER #2010-14 Page 7 WORKING BEYOND NORMAL WORKING HOURS 2. shall report an additional .75 hours of work for the missed or interrupted meal on his/her timesheet. If an employee is given at least 30 consecutive minutes during which he/she is free from work related interruptions for his/her meal period but less than 45 consecutive minutes for the meal period the employee shall (a) inform his/her immediate supervisor or the on-duty supervisor of the length of time his/her meal; and (b) shall record the amount of time he/she spent working during his/her meal period on his/her timesheet. All time worked during a meal period shall be regarded as compensable work time. P. VOLUNTEER TDJE The Department is currently drafting a policy regarding CIVIC AND CHARITABLE WORK. Please refer to the policy when completed. Q. TRAVELING ON REGULARLY SCHEDULED DAYS OFF FOR WORK RELATED BUSINESS Employees traveling inter-island or out-of-state for work related business on a regularly scheduled day off will normally not be paid for their travel time except for the time they are actually performing work during the travel. However, where the travel keeps the employees away from home over night, the travel shall be regarded as work time if the travel time on a regularly scheduled day off occurs during the hours that would correspond to normal work hours if the travel occurred on a regular work days. For example: 1. If an employee is normally scheduled to work from 0745 to 1630 and the employee travels for 8.0 hours from 0745 to 1545 on an overnight stay, the 8,0 hours of travel time will be considered compensable because it cuts across the employee's normal work hours. 1 On the other hand if an employee is normally scheduled to work from 0745 to 1630 and the employee travel for 8.0 hours during the hours of 2230 to 0630 the 8.0 hours of travel time is not compensable unless the employee actually worked during the travel time(e.g. if the employee was escorting a prisoner, writing a report, or preparing for court)because the travel time does not cut across the employee's normal work hours. K, PD 202 GENERAL ORDER#2010-14 Page 8 WORKING BEYOND NORMAL WORKING HOURS 3. Further, if an employee is normally scheduled to work from 0745 to 1630 and the employee travels for 7.5 hours during the hours of 1300 to 2030 the 3.5 hours of travel time from 1300 to 1630(which cuts across the employee's normal work hours)would be compensable but the 4 hours of travel time from 1630 to 2030 (which does not cut across the employee's normal work hours)would not be compensable unless the employee actually worked during the travel time. All travel time that meets the terms of this policy shall be regarded as compensable work time. R. PREPARING FOR A POLICE TRAINING COURSE OR PRESENTATION Employees who are required to prepare for a police training course or presentation shall do so during their normal work hours. Employees shall provide advance notice to their immediate supervisor or the on-duty supervisor of their need for regular work time to prepare for a police training course or presentation. No employee shall perform or engage in any preparation for a police training course or presentation outside his/her normal work shift without first requesting and obtaining authorization to do so from his/her immediate supervisor or on-duty supervisor. All off duty time spent performing or engaging in preparation for a police training course or presentation shall be regarded as compensable work.time. S. ASSISTING MOTORISTS Officers traveling to/from work in a departmental vehicle shall only provide assistance to a motorist if there is an apparent emergency or hazardous condition. In these circumstances, officers shall follow normal traffic stop procedures. The officer shall contact the Communications Center as soon as possible to request that an on-duty supervisor be notified of the assistance that is being provided to the motorist. The on-duty supervisor shall determine whether the ofd duty officer shall remain and continue to provide assistance to the motorist or whether an on-duty officer will take over and provide assistance. An employee who has been relieved from duty and has been instructed to leave the scene does not have any discretion to continue to provide assistance. All time spent by an off-duty officer to provide assistance to a motorist shall be regarded as compensable work time. The ECD is considered an intermediate weapon in the use of force continuum. H. DEFINITIONS: A. Active Agaression: A threat or overt act of an assault (through physical or verbal means), coupled with the present ability to carry out the threat or assault, which reasonably indicates that an assault or injury to any person is imminent. B. Actively Resisting: Physically forcible movements threatening the safety of the Officer and rising above the level of defensive resistance or mere non-submission. C. Air Cartridge: A replaceable cartridge for the electric gun which uses compressed nitrogen to fire two probes attached to connecting wires that send an electrical current into a subject. D. Displa : The electric gun is removed from its holster and/or is activated to demonstrate its ability to discharge electricity. E. Drive Stun: A contact application of the electric gun when it is pressed into the body or a subject and activated. F Electronic Control Device(ECD): A non-lethal electric gun(also known as a conducted energy device) designed to incapacitate by discharging an electric current into a subject that disrupts the ability to communicate messages from the brain to the muscles causing temporary motor skill dysfunction. The TASER0 Electronic Control Device is currently the only electric gun authorized for use by the department TASER is a registered trademark of Taser International, Inc. G. Neuromuscular Incapacitation TASER technology uses electrical impulses to cause stimulation that affects the sensory and motor nerves. Neuromuscular KPD 202 GENERAL ORDER#2010-15 Page 2 ELECTRONIC CONTROL DEVICE Incapacitation (NMI) occurs when a device is able to cause involuntary stimulation of both the sensory nerves and the motor nerves. It is not dependent on pain and is effective on subjects with a high level of pain tolerance. H, Passive Resistance: Physical actions that do not rise to the level of a threat to the safety of an officer. I. Serious Bodily Inju : Bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ. J. Spark Test: To test the operation of the electric gun. The air cartridge is removed from the electric gun and activated between one and five seconds. An electrical arc emitted from the electric gun indicates that it is operating properly. K Substantial Bodily Injujy: means bodily injury which causes: (1) A major avulsion, laceration, or penetration of the skin; (2) A bum of at least second degree severity; (3) A bone fracture; (4) A serious concussion; or (5) A tearing, rupture, or corrosive damage to the esophagus, viscera, or other internal organs. L. Taser Cam: The Taser Cam is an audio-video recording device integrated into a rechargeable Taser X26C power supply. 1111. AUTHORITY: Hawaii Revised Statutes, §134.16, Restriction on possession, sale, gift, or delivery of electric guns, (c)states that "This section shall not apply to law enforcement officers of county police and sheriff departments of this State, or vendors providing electric guns to those entities; provided that electric guns shall at all times remain in the custody and control of the county police or sheriff departments" and (d) states that "The county police and sheriff departments of this State shall maintain records regarding every electric gun in their custody and control. Such records shall report every instance of usage of the electric guns; in particular, records shall be maintained in a similar manner for those of discharging of firearms. The county police and sheriff departments shall annually report to the legislature regarding these records twenty days before the beginning of each session." IV. TRAINING AND CERTIFICATION: A. Only Officers who have successfully completed Departmental training in the use of the ECD and Use of Force policy are authorized to carry and use the ECD. KPD 202 GENERAL ORDER# 2010-15 Page 3 ELECTRONIC CONTROL DEVICE B. Training shall consist of at least sixteen hours of training in the use, handling, and appropriate deployment of the ECD. Training shall address physical competency, device retention, changes in agency policy(if any), technology changes and reviews of local and national trends in ECD use. C. Training protocols should emphasize that multiple activations and continuous cycling of the ECD appear to increase the risk of death or serious injury and should be avoided where prudent. D. Officers should be trained that the ECD's optimum range is fifteen (15) feet, E. Once trained, officers must successfully complete annual retraining, F. Only certified instructors shall be authorized to provide instruction on the ECD. G. Supervisors and command staff shall receive ECD awareness training so they can make educated decisions about the administrative investigations they review. H. The training curriculum shall be developed by the Administrative& Technical Bureau and shall integrate current ECD warnings, instructions, and information provided to law enforcement by Taser International, Inc. I. Once certified, instructors must successfully complete biennial recertification training. V. ASSIGNMENT OF TASERS: A. The Research &Development Section shall coordinate the assignment of the ECD and ECD accessories to officers authorized to carry and use the Taser. B. The Research& Development Section shall establish a uniform format for reports used to monitor ECD assignment. I The report shall identify each officer assigned an ECD, related equipment, and accessories. a. The report shall be updated as necessary. b, Each Bureau Commander shall be provided with a copy of the most current list of officers assigned an ECD, related equipment, and accessories. VI. AUTHORIZED EQUIPMENT: KPD 202 GENERAL ORDER# 2010-15 Page 4 ELECTRONIC CONTROL DEVICE A. Officers are authorized to carry and use only the department-issued ECD and related equipment such as batteries, accessories, cartridges and holsters, VII. STORAGE, CARRYING,AND HANDLING OF THE TASER.- A. The ECD device shall be secured at all times, except: 1. To perform authorized testing; 2. During inspections or maintenance; 3. While participating in authorized training; 4. While transferring the device to another officer or exchanging of the device; or, 5. When deployment is imminent. B. Officers shall carry the ECD in a department-issued holster with the safety engaged. The ECD shall be worn on the opposite side of the duty firearm. C. Officers should avoid dropping the ECD. D. Officers should avoid exposing the ECD cartridges to significant moisture, dust, dirt or lint, E. Officers shall carry the ECD replacement cartridges in Department approved cases, VIH. USE OF THE X26 TASER: A. General Maintenance Guidelines: I All testing and/or inspection of the ECD shall be performed during work hours, in a safe location, outside the view of any members of the public, unless specifically authorized by a Bureau Commander. 2. Officers should avoid pointing the laser beam at the eye(s) of a person or animal, 3. Officers shall not attempt to open, modify, or tamper with the ECD or cartridges. B. Visual Inspection- I. Officers shall, at the beginning of each shift, inspect the ECD for damage and cleanliness and replace the power source and/or cartridges when required. KPH 202 GENERAL ORDER# 2010-15 Page 5 ELECTRONIC CONTROL DEVICE C. Function Test: I The operational performance of the ECD shall be checked at the beginning of each shift by performing a spark test. Any deficiencies shall be immediately reported to the immediate supervisor. a. The spark test shall be performed outside the view of the public. b. The air cartridge shall be removed from the ECD. A visual inspection of the weapon shall be conducted to assure that the air cartridge has been properly removed. The weapon shall be pointed in a safe direction before disengaging the safety switch. The Central Information Display shall be observed to determine the remaining battery life. Officers shall then activate the weapon between one and five seconds and stop the activation by re-engaging the safety switch. C. An immediate, loud and uninterrupted spark being emitted during the one to five second function test should be observed, d. The spark test shall not constitute a deployment of the ECD and is not subject to deployment reporting procedures. e. The ECD shall not be utilized for duty with less than 20%battery life, f The ECD shall not be utilized for duty when a diminished or intermittent spark is being emitted during the function test. 9. The Research&Development Section shall be contacted for a replacement ECD or repairs. D Deployment Guidelines: 1. The ECD shall not be cycled for longer than necessary to achieve compliance from the suspect. Reasonable efforts should be made to minimize the number of ECD cycles. Officers should reassess the subject's resistance level before initiating or continuing the ECD cycle(s). 1 The ECD's optimum range is fifteen(15)feet. 1 When possible, Officers shall avoid intentionally targeting the ECD on sensitive areas of the body such as the head, eyes, genitalia, throat; chest/breast, or known pre-existing injury areas without legal justification. The preferred target areas are the lower center mass(below chest) for front shots and below the neck area for back shots. 4. All deployments of the ECD shall conform to the principles outlined in KPD 202 GENERAL ORDER# 2010-15 Page 6 ELECTRONIC CONTROL DEVICE KPD's training and certification program and be consistent with GENERAL ORDER 06-01 (or current), USE OF FORCE. 5. Officers should be prepared to transition to other force options should the ECD fail to operate or fail to have the desired effect. 6. Prior to ECD deployment, the officer shall to the extent possible consider whether less intrusive means would be enough to obtain compliance from the subject. 7. At the earliest opportunity and unless exigent circumstances exist, the Officer should provide a loud verbal warning to the subject and any other officer before deploying the ECD. S. The ECD shall only be used against persons who pose an immediate threat to the offlicer(s) or another person. 9. The ECD shall not be used in the following situations: a. The ECD shall not be used to punish an individual. b. When the officer knows that the subject has come in contact with flammable substances, flammable liquids or is in a flammable environment; C. When the subject is situated at a height or location where a fall poses an unusual risk of substantial bodily injury, serious bodily injury or death; d. When the subject is known to be or is visibly pregnant, unless a higher level of force is the only other option; e. When a person is displaying resistance not rising to the level of an immediate threat to the officer(s) or another person; 10. Unless exigent circumstances exist, the ECD should no be used in the following situations: a. When the subject is operating a moving motor vehicle, any vehicle with less than four wheels, or bicycles; b. When the subject is physically disabled or is visibly frail; C. When a prisoner is handcuffed; d. When the subject is elderly or a young child; or KPD 202 GENERAL ORDER#2010-15 Page 7 ELECTRONIC CONTROL DEVICE e. When the subject is fleeing. 11. The ECD should not be activated against a subject by more than one officer at the same time. 11 The ECD may be used against an aggressive animal which poses an immediate threat to the Officer or another person, subject to the other deployment guidelines in this directive. 13 When activating the ECD, the officer should use it for one standard cycle and stop to evaluate the situation. An officer shall use the minimum amount of activations necessary to take a subject into custody. 14. Officers should be aware that there is a higher risk of sudden death in people under the influence of drugs and/or symptoms associated with excited delirium and take this into account when deploying the ECD against an individual who appears to be under the influence of drugs or displays symptoms associated with excited delirium, 15. No more than one officer should activate the ECD. Deployment of more than one ECD against the same suspect must be justified and articulated in the Incident Report, Use of Force Report form and Use of ECD Report form. 16. Following ECD deployment, officers should use a restraint technique that does not impair respiration, E. Deployment Methods: 1. Display: The display method may be used, when afforded the opportunity to have a subject comply with a lawful order and when the use of the ECD is imminent. 2. Probe: The probe method is the most effective contact application of the ECD when the probes are fired from an air cartridge and makes contact with a subject. Proper application will result in temporary immobilization that will provide the officer with an opportunity to take control of the subject, 3. Drive Stun.- The drive stun method of deployment should not be utilized unless: I an officer or another is physically confronted, and: KPD 202 GENERAL ORDER# 2010-15 Page 8 ELECTRONIC CONTROL DEVICE a. Serious bodily injury is imminent, or b. It is not feasible or tactically appropriate to deploy the probes. F. Audio-Video Recording Feature: I Whenever practical, the audio-video recording feature of the ECD shall be used in circumstances when deployment is imminent. 2. When tactically sound, the audio-video recording feature should be used to record aggressive behavior. 3. The ECD shall not be used without a functional audio-video recorder. 4. Officers shall notify their supervisor as soon as practical, but no later than the end of shift to report a damaged or malfunctioning audio-video recorder. 5. The Research& Development Section shall be contacted for a replacement audio- video recorder. 6. No other use of the audio-video recording feature is authorized. IX. RESPONSIBILITIES: A. Training Section responsibilities: I Coordinate and provide training and certification for officers in the proper use of the ECD. 2, Maintain training and certification records of all departmental personnel. B. Research&Development Responsibilities: 1. Maintain a record of the department's inventory and issuance of the ECD and related equipment. 2. Issue ECD and related equipment/supplies such as cartridges, holsters, and biohazard containers. 3. Submit an annual report to the legislature regarding every ECD in the Department's custody and control and every instance of usage of the ECD. 4. All other duties as may become necessary for the department's ECD program. KPD 202 GENERAL ORDER# 2010-15 Page 9 ELECTRONIC CONTROL DEVICE 5. Maintenance, service, and/or replacement of any ECD, C Immediate Super-visor Responsibilities: I Respond to the scene when the ECD has been deployed either accidentally or intentionally. 2. Ensure that the subject who comes in contact with the ECD receives appropriate medical treatment. 3. Ensure that appropriate Incident Reports; Use of Force Report, Use of ECD Report, are completed and submitted and copies forwarded to the Bureau Commander. The Bureau Commander or designee is responsible for ensuring that a copy of this report is forwarded to the Administrative& Technical Bureau Commander. 4, Notify the District Commander verbally and in writing whenever an ECD has been deployed by probes or drive stun. 5. Secure the ECD for transfer to the Commander or designee of the Internal Affairs Unit. & Ensure that a copy of the ECD firing data and video data for intentional discharges are submitted into evidence. 7. Immediately notifying the Commander or designee of the Internal Affairs Unit regarding the incident and circumstances requiring use of the ECD. D. Deploying Officer responsibilities: 1. Observe all deployment considerations set forth in this directive. 1 Immediately notify a supervisor of a deployment of the ECD. 3. Ensure that the expended probes, cartridges, and wires used for deployment are submitted into evidence. 4. Complete and submit all appropriate incident reports, Use of Force Report and, Use of ECD Report. a. The incident report shall include, but is not limited to the following: I. Location and interview of witnesses; 2. Photographs of subject and officer injuries; KPD 202 GENERAL ORDER# 2010-15 Page 10 ELECTRONIC CONTROL DEVICE a. Photographs shall not be taken in cases where the probes contacted genitals or a female's breast, etc. 3. Photographs of cartridges/darts; 4. Facts regarding use of the ECD. S. The make, model, and serial number of the unit used. 6. The serial number of the cartridge used. E. Internal Affairs Unit: The Commander or designee of the Internal Affairs Unit shall: 1. Recover any ECD that has been discharged in any situation other than during Department-sanctioned training. 2. Perform a download of the ECD firing data and video data onto non-rewritable digital video disc or non-rewritable compact disc. 3. Review each incident and submit an administrative report of the findings to the Chief of Police. 4. Persons conducting administrative investigations into ECD usage should be aware that ECD download data may be unreliable. Investigators should be able to articulate the difference between the actual duration of an ECD activation on a person and the total time of discharge registered on an ECD device. X. PROBE REMOVAL AND MEDICAL TREATMENT: A. When reasonably possible, only officers who have received proper training in the removal of probes or qualified medical personnel shall remove the probes from a person. B. When probes penetrate sensitive areas of a subject such as the face, head, genitals, or female breasts, the subject shall be transported to an emergency medical facility for treatment and removal of the probes. C. The officer who is assigned to this case shall recover the probes from the hospital personnel who removed the probes and shall submit the probes into evidence following proper chain of custody procedures. D. Officers shall use biohazard precautions when handling ECD probes removed from a KPD 202 GENERAL ORDER#2010-15 Page 11 ELECTRONIC CONTROL DEVICE person. The expended probes shall be handled in a manner similar to handling contaminated needles and sharps, E. An individual exposed to an application of the ECD shall be transported to a medical facility for examination by a physician. F. If any individual refuses to be examined by a physician, this shall be noted on the medical facility's patient report by hospital personnel. G. All persons in custody who have been exposed to an application of the ECD shall be monitored regularly while in police custody even if they have received medical care. XL ACCIDENTAL DISCHARGE: A. Whenever an ECD cartridge is expended unintentionally in any situation other than during Department-sanctioned training, the deploying officer shall immediately notify his or her supervisor. B. The deploying officer shall complete and submit a memorandum to their Bureau Commander documenting the accidental discharge of the ECD cartridge. The expended probes, cartridges, and wires shall be placed in an envelope or other suitable container and submitted along with the memorandum. The supervisor shall ensure that copies of the memorandum and expended probes, cartridges, and wires are forwarded to the Internal Affairs Unit. XIL ECD DATA: A. The ECD data consists of two types of digital files (firing data and video data captured by the ECD recording system). B. The designated supervisor shall submit the associated unaltered digital files (firing data log and video files captured by the ECD)into evidence for cases where a ECD is deployed, C. The designated supervisor shall perform the data download of the ECD. The officer shall view the data on the optical media to ensure that the data is complete before being submitted into evidence by the supervisor, D. Data shall be downloaded from the ECD using the software provided by the manufacturer and recorded onto non-rewriteable optical media(e.g. CD-R, DVD-R), The media shall be finalized (no additional data can be written to the media)and marked for identification. KPD 202 GENERAL ORDER# 2010-15 Page 12 ELECTRONIC CONTROL DEVICE I Care shall be exercised when marking and packaging the media to ensure against damage and degradation. Optical discs shall be marked directly on the label side of the disc with a non-solvent based felt-tip permanent marker. Ballpoint pens or other hard-tipped writing instruments shall not be used. 2. If multiple ECD are deployed during the same incident, each ECD's data shall be recorded onto separate media. E. Additionally, the firing data log shall be printed and submitted as an attachment to the Use of ECD Report. F. ECD data files are official police records and shall be secured and handled appropriately. Reproduction and/or release of ECD data files is strictly prohibited unless approved in writing by the Chief of Police. This does not apply to release of ECD data files as part of an official criminal proceeding. G. If no data is recorded during a deployment of the ECD or if there is a failure in the data downloads process, an explanation shall be provided in the Use of ECD Report. On Wednesday, November 10, 2010 Sergeant Applegate with the assistance of Officer Darla Higa met with several staff and Administrators of KVMH to develop a plan of Safety. Due to recent incidents at the hospital, the KVMH staff and clinics that it operates felt unsafe. Although policies and procedures (P&Ps) are in place within our HHSC facilities, we recognized within ten minutes of our meeting with Sergeant Applegate and Officer Higa, a need to revisit those P&Ps and develop retraining for our staff. Often you will have a presenter from an organization speak to a group and nothing gets done. Or, as we did, you can have knowledgably, experienced and skilled facilitators like Sergeant Applegate and Officer Higa speak to "seasoned" hospital staff and administrators and within minutes following the meeting — form a sub-committee; propose an action plan with a layout of KVMH and proposed locations for camera's and additional lighting. Sergeant Applegate's expertise, vast experience and knowledge were evident; his excellent communication skills readily applied this vast information into a "language" understood through "hospital eyes and ears".
