Approval of January 17, 2012 Minutes Action: Ms. Bell moved to approve the minutes of January 17, 2012, as circulated. Ms. Manriquez seconded the motion. Motion carried 10:0 Business o Presentation on Complete Streets by Bev Brody from Get Fit Kaua'i Ms. Brody's power point presentation started simply with the first slide stating: "All I really needed to know about Complete Streets I learned in kindergarten". What was learned then was to share everything, to play fair, to not hit people and when you went out into the world to watch for traffic, hold hands and stick together. Complete Streets are for everyone and includes pedestrians, bicyclists, motorists, transit users, movers of goods and deliverers of service and persons of all ages and abilities. The State of Hawaii adopted Act 54 as a Complete Streets ordinance in May of 2009. The County of Kaua'i adopted their Complete Streets resolution in September of 2010. During the slide presentation, Ms. Pilkington provided narration to describe the details shown in each picture which enabled all members to be able to participate in the Complete Streets presentation. MACFEA- March 20, 2012 Page 1 Ms. Brody pointed out that Kauai was so very fortunate to have two incredible men from the Public Works Department as the driving forces behind the Complete Streets. They are the County Engineer Larry Dill and the Deputy County Engineer Lyle Tabata. Wrapping up the presentation, Ms. Brody referred back to what was learned in kindergarten and pointed out that Complete Streets is the opportunity to share the streets among all users, to make the streets safer for people of all ages and abilities and to practice sharing the only world we have with one another and thus to make our society a better one for all of us. Ms. Glass pointed out that with the aging population, these people may not be able to drive cars, ride a bike or walk distances and yet they still want to be as independent as possible. We need to take a serious look at options like mopeds, scooters, electric wheelchairs and small electric vehicles such as golf carts and to plan paths and routes for them now. Ms. Glass further urged everyone involved with Complete Streets to think in terms of the proper mix such as slow speed vehicles with bicycles but not with automobiles. Even mixing bicycles with pedestrians walking dogs has not been completely successful. Asked if the Complete Streets was just for certain portions of Kauai or would it be for the entire island, Ms. Brody said there is a Complete Streets checklist which will be applied to all new projects and to retrofitting any old projects. There is no intention of making every street on Kaua'i complete tomorrow but as they retrofit or build new streets, they will apply the Complete Streets principles to these different projects. Ms. Brody completed her presentation by pointing out that Complete Streets will accommodate all users and help to capture and capitalize on fitness. Ms. Brody noted again how very, very fortunate we were to have people such as the Mayor, Larry Dill, Lyle Tabata and Michael Dahilig in full support of the Complete Streets and asked the MACFEA members to tell them how much it is appreciate what they are doing for us. o Discussion to change meeting time to accommodate paratransit riders (Deferred to 3120112) Chair Nuland-Ames suggested that to assist with keeping the meeting moving in a timely manner, members should highlight a few of the details for their announcement or meeting in writing and forward to the Secretary to include with the meeting packet. Ms. Bell said that the paratransit ridership is up and to accommodate her schedule that morning she had to catch a bus at 9:00 am, which came 20 minutes early, in order to be at the MACFEA meeting at 12:00 p.m. Ms. Bell felt lucky to have the paratransit bus system and understood that the economics were very significant. She announced that the Transportation Department had a new phone number which is 246-8110. Ms. Glass offered to call the Transportation Department to see if there were better windows of opportunity for the meeting time so that members would not have to spend 3 hours getting there. MACFEA- March 20, 2012 Page 2 Ms. Bell said the Transportation Department did have statistics of how many riders they have and from what area, which is significant to the changes made in the times of pickup. Chair Nuland-Ames said she would take Ms. Glass up on her offer to work with the Transportation Department and to bring that data to the next meeting for further discussion. Action: Ms. Glass moved to defer discussion of changing the meeting time to the May meeting. Ms. Bell seconded the motion. Motion carried 10:0 o Election of Vice-chair Action: Ms. Bell moved to defer the election of a Vice-chair to the May meeting. Ms. Glass seconded the motion. Chair Nuland-Ames asked that members who may be interested in serving as the Vice- chair or wishing to nominate someone to that position to send the information to Christina or Barbara by May 1. Motion carried 10:0 Reports o DCAB reports for February and March, 2012 and Legislative Update as of 2/21/12 Dr. Lucy reported that the U.S. Access Board is updating the electronic and access standards for Section 508, which DCAB is strongly supporting. When passed, it will require all States to comply by updating and keeping pace with emerging information technology to ensure that communication access is available for all disabilities including deaf, hard of hearing, blind, and deaf-blind. This law would affect all federal agencies, manufacturers, computer hardware and software. Ms. Pilkington said that Section 508 does not address Wi-Fi and asked if the new law would address Title 2 facilities. Dr. Lucy said very definitely. o ADA Coordinator's report No Report o Updates/Announcements Ms. Bell reported that a 5th year pharmacy student and a clinical pharmacist from the hospital addressed the National Federation of the Blind. It was helpful to understand MACFEA- March 20, 2012 Page 3 that a pharmacist is required by law to consult, read labels and answer questions for everyone and this could be very helpful to persons with other disabilities. Ms. Manriquez reported her involvement in opening a shelter during the flooding and the positive responses they received. Ms. Manriquez also attended the Brain Injury Association Conference which was geared towards the caregivers and family members and included discussion of traumatic brain injuries experienced by our military and veterans. Ms. Doi said the next Developmental Disabilities Committee meeting is scheduled for Tuesday, April 3 at 12:30 p.m. The Autism Awareness signing is scheduled for Wednesday, April 4 at 12:00 noon at the Civic Center where the Mayor will be doing a proclamation. Also the first legislative planning meeting is set for Thursday, April 5 at 10:00 a.m. in the Boards and Commissions' conference room. Ms. Cummings said she attended the first transition event for high school students put on by Kauai Development Disabilities and the Department of Education and wanted to encourage more parents to attend because they were provided with excellent information. Ms. Costales said the Hawaii Center for Independent Living would be meeting at the Parish Hall on March 27, April 10 and April 27 from 10:00 a.m. to 11:00 a.m. Chair Nuland-Ames reported on the great success of Tropic Care Kaua'i. With National Volunteer Week coming up in mid-April, her office will be announcing the launch of Share the Care on Kaua'i which is a community and family support program for people with short and long-term needs. Legislative Update As the Legislature enters into its last month, DCAB regrets to announce that its bill to fund the parking program for persons with disabilities with a $1 addition to the motor vehicle registration fee, H13 25521SB 2814 has died for this session. HB 2553, DCAB's other significant bill, which would permit charging a fee for its blueprint review function is still alive. We will keep you posted as to the progress of the bill. Special Parent Information Network Conference Coming Up -April 21, 2012 The Special Parent Information Network (SPIN) announces the 26th Annual SPIN Conference, titled SPIN the Case for Evidence-Based, will be held on Saturday, April 21, 2012 from 8:30 a.m. to 3:30 p.m. at the University of Hawaii at Manoa Campus Center. The conference will showcase sixteen (16)workshops on topics including: universal design for learning, positive behavioral supports, the Individualized Education Program (IEP), transition, autism, sensory integration, social skills, positive behavioral supports and much more. State Department of Education Superintendent Kathryn Matayoshi, will give the opening remarks. In addition, there will be table displays showcasing agencies and programs that provide support to children and youth with disabilities and their families. The registration fee is $25 per parent (or$35 for two (2) family members attending together), or$35 per professional. Limited airfare scholarships for neighbor island parents are available, so attendees are urged to reserve their seats early by contacting SPIN at (808) 586-8126. Functional Assessment Service Team (FAST) Training FAST consists of trained government and non-government personnel ready to respond to disaster areas to work in emergency shelters. FAST members must be willing and able to work under stressful conditions for long hours with emergency response personnel to conduct assessments of people with access and functional needs in emergency shelters. A fully staffed FAST consists of members with experience in aging, chronic health needs, developmental and other cognitive disabilities, hearing loss, mental health, physical disabilities, and substance abuse. DCAB believes that it would be beneficial to include people with disabilities in this effort. In order to be considered for the FAST team, interested persons must be willing to complete a two (2) day course, tentatively scheduled to be held in the third week of June 2012, on Oahu. DCAB is coordinating with other emergency management agencies to bring the FAST training to Hawaii and is willing to sponsor several persons with disabilities from the neighbor islands in terms of airfare, hotel, etc., and a nominal honorarium. Individuals who are interested must commit to the training on Oahu and participation back on their island after the training. New State Disability Employment Rules Adopted Governor Abercrombie signed into law the amended rules, Hawaii Administrative Rules Title 12, Chapter 46, Subchapter 9 of the Hawaii Civil Rights Commission relating to disability employment discrimination. The rules were amended due to the passage of the ADA Amendments Act. For information, contact the Hawaii Civil Rights Commission at 586-8636 or visit their web site at www.hawaii.gov/labor/hcrc. 5. Accessibility and Swimming Pools On March 15, 2012, the Department of Justice (DOJ) issued a sixty (60) day delay in the implementation of the design guidelines for swimming pools based upon a request from the American Hotel, Motel, and Lodging Association. The request was granted based upon the stated need to clarify misunderstandings about the need to retrofit existing pools. DOJ also issued a Notice of Proposed Rulemaking asking for comment as to whether the extension should be for six (6) months, rather than sixty(60) days. DCAB is monitoring this notice and is concerned particularly in hotels and other public accommodations that are affected in Hawaii. Recent DCAB Technical Assistance and Training • DCAB staff is providing technical assistance to the State Department of Transportation and the Department of the Attorney General regarding the accessibility of shuttle vans at the airport(s). For more information, contact Charlotte Townsend at char lotte.townsend@doh.hawaii.gov. • DCAB staff is providing technical assistance to the State Department of Human Resources Development in an ongoing project to update state position descriptions to reflect essential functions of the job and minimum qualifications of positions. For more information, contact Francine Wai at franc ine.wai(c'D-do h.hawaii.go . • DCAB staff is providing technical assistance to the State Department of Land and Natural Resources to modifying a boating policy relating to berthing of small boats to permit boarding of passengers with disabilities. DCAB took a position in support of this change in policy. For more information, contact Francine Wai at francine.wai(a)-doh.hawaii.go . • DCAB is providing technical assistance to the State Department of Business, Economic Development, and Tourism as they develop guidelines for the installation of electric vehicle (EV) charging stations and stalls. DCAB is not commenting on the number of EV stalls that a parking facility should install. However, DCAB wants to ensure that EV stalls, when required and installed, are accessible to a person with a disability who might be driving an electric vehicle and needs charging. DCAB's recommendations include specific design specifications for the stall and the charging controls and operating mechanisms. Since most entities will only have one (1) EV parking stall and charger, DCAB recommends that they be designed to be accessible, but not reserved for a person with a disability. The Legislature is winding down The Hawaii State Legislature is set to adjourn the first week of May. Disability, human services, and civil rights issues have faced a tough time with the economy still not up to par. Here is a re-cap of key legislation affecting people with disabilities. DCAB introduced three (3) pieces of legislation this year as part of the Govemor's package: - A bill to obtain $1 on the motor vehicle registration fee has died. - A bill to establish a fee schedule for our blueprint review process has passed both houses of the Legislature. We are awaiting further action. - A bill to change the use of our Special Fund to receive monies, such as fees, has passed the Legislature and will be on its way to the Governor for signature. The following are several other disability-related bills that are still alive: - Relating to Parking for Electric Vehicles (which clarifies the relationship to accessible parking)was signed by the Governor as Act 89; - Relating to Information Access (Newsline reading service for people who are blind or visually impaired); - Relating to Public Meetings (which would allow certain modifications under the Sunshine Law for board members with disabilities); - Relating to Electronic Information (regarding posting notices, including accessible formats, on the web); - Relating to the Medicaid Buy-In Program; - Relating to Domestic Services for Persons with Developmental Disabilities; - Relating to funding for the Aging and Disability Resource Centers was funded at $1.4 million and an Omnibus Aging Bill was funded for $4.2 million for Kupuna Care, $426,722 for Healthy Aging Partnerships, $285,000 for Senior Centers, and $50,000 for a Wanderer's Registry. Funding bills are still subject to the Govemor's approval and release of funds. " AyA 15 vp IWVT 2. Disability Etiquette Brochure - DCAB has completed a pocket-size brochure on disability etiquette tips to be used in disability awareness training sessions. New Staff Member DCAB welcomes Geraldine (Gerrie) Kealoha to our office. Gerrie has been a very valuable asset to the DCAB office for almost three (3) years, part-time, through the senior employment program of the Honolulu Community Action Program processing renewal placards in the parking program for persons with disabilities. We are pleased to have her on board now as a regular full time employee.
