Executive Session: Pursuant to Hawaii Revised Statutes Sections 92-4
and 92-5(a)(4), the purpose of this executive session is to consult with the
County's legal counsel on questions and issues relating to the above item.
This consultation involves consideration of the Commission's powers,
duties, privileges, immunities, and/or liabilities with regard to this agenda
item.
E. Update and discussion of the 2010 public input process pursuant to
Ordinance No. 812 for developing an annual list of priority projects to be
reported (2010 Report) to the Kaua'i County Council and the Mayor.

EXECUTIVE SESSION: The Commission may go into an executive session on an agenda item for
one of the permitted purposes listed in section 92-5(a), HRS, without noticing the executive session
on the agenda where the executive session was not anticipated in advance. Haw. Rev. Stat. § 92-
7(a). The executive session may only be held, however, upon an affirmative vote of two-thirds of
the members present, which must also be the majority of the members to which the board is
entitled. Haw. Rev. Stat. § 92-4. The reason for holding the executive session shall be publicly
announced.

Open Space Commission conducts annual survey
LIHU'E —The County of Kauai Public Access, Open Space and Natural Resources
Preservation Fund Commission (known as the Open Space Commission) is encouraging the
public to suggest lands or property entitlements (like public access-ways) that the County
should consider purchasing or otherwise acquiring.
The Open Space Commission makes annual recommendations to the Kauai County
Council on possible sites to acquire using the Open Space Fund (as established by County
Charter). The fund receives one-half of one percent of the County's real property tax revenues.
In 2009, the County Council approved the use of$1.85 million from the open space fund for
acquisition of a parcel on Hanalei Bay for expansion of the County's Black Pot Park.
The Open Space Commission urges Kauai residents to participate in the 2010 site
recommendation process. Public input can be given in several ways. A survey can be accessed
and completed online at www.kauai.gov/OpenSpaceSurvey. Paper copies of the survey are
also available at public libraries, county neighborhood centers or at the Planning Department
counter in the county annex.
Completed surveys can be submitted online, faxed to the Commission in care of the
Planning Department at 241-6699, dropped off or mailed to the County of Kauai Planning
Department, Open Space Commission, 4444 Rice Street, Suite 473A, Lihu'e, HI 96766. The
last day that surveys will be accepted is INSERT DATE.
Public testimony is also welcomed at Open Space Commission meetings which are
generally scheduled on the 2"d and 4'h Thursday of every month. The Commission will discuss
its 2010 recommendations throughout the summer. The Open Space Commission was created
in 2003 by the County Council following an overwhelming vote by Kaua'i residents to establish
the Open Space Fund in the 2002 elections. To qualify for purchase or acquisition using the
Open Space Fund, sites must meet at lease one of the following purposes:
• Outdoor recreation/education, including access to beaches and mountains.
• Preservation of historically or culturally important lands and sites.
• Protection of significant habitats or ecosystems, including buffer zones.
• Preserving forests, beaches, coastal areas and agricultural lands.
• Protecting and watershed lands to preserve water quality and water supply.
• Conserving land in order to reduce erosion, floods, landslides and runoff.
• Improving disabled and public access to, and enjoyment of, public land.
• Acquiring disabled and public access to public land and open space.
