HomeMy WebLinkAbout2010-03-11 Open Space Commission Minutes COUNTY OF KAUAI PUBLIC ACCESS, OPEN SPACE, & NATURAL RESOURCES PRESERVATION FUND COMMISSION Lihue Civic Center, Moikeha Building, Meeting Room 2A/213 MINUTES A regular meeting of the County of Kaua'i Public Access, Open Space & Natural Resources Preservation Fund Commission of the County of Kauai was held on March 11, 2010, in the Lihue Civic Center, Moikeha Building Meeting Room 2A/2B. The following Commissioners were present: Jean Souza, Chairperson, Tessie Kinnaman, Vice Chairperson, Beryl Blaich, Eugene Punzal, and Johanna Ventura. The following Commissioners were absent: Puna Dawson, Linda Dela Cruz, and two (2) vacancies. The following staff members were present: Nani Sadora, Duke Nakamatsu, Les Milnes, Lisa Ellen Smith, and Deputy County Attorney Michael Dahilig. CALL TO ORDER Chair Souza called the meeting to order at 8:15 a.m. APPROVAL OF AGENDA MOTION: It was moved by Johanna Ventura and seconded by Beryl Blaich to approve the agenda. All were in favor by unanimous voice vote — motion passed. ANNOUNCEMENTS There were no announcements. COMMISSION SITE VISITS Recess and continuation of meeting for excursion to the North Shore area to view areas of community interest identified through the community input process as well as to become familiar with coastal and cultural resources in this area. The excursion left the Liliu'e Civic Center at approximately 8:30 a.m. and proceeded to the following locations. 1 • Moloa'a Bay • Ka'aka'aniu Beach via Moloa'a Road • Kahili Bay • Fish & Wildlife Service Overlook at Seacliff Plantation • Princeville at Kapi`olani Road • Princeville at Ka Haku Road Deputy County Attorney Dahilig reminded the Commission that they should not accept public testimony while on the excursion, but members of the public should be advised to come to a meeting if they wish to testify. Chair Souza stated that members of the public wishing to testify should be encouraged to either submit their testimony in writing or to come to the March 25th meeting. Public members Jim Kallai and Hope Kallai met the Commission at Moloa'a Bay. Regarding Moloa'a Bay, Inspector Milnes stated that the only public parking is along the side of the road. He pointed out a lot to the left that is being used, but it is not a designated public parking area. He stated that the land owner left it open to accommodate parking, but that may change in the future. He pointed out the two public accesses to the beach. Public members Rayne Regush, Jim Kallai, and Hope Kallai met the Commission at Ka'aka'aniu Beach. County surveyor Oscar Portugal led the Commission along the 10 foot wide County recorded legal access to Ka'aka'aniu Beach. Inspector Milnes stated that the trail the Commission was on was cleared by someone prior to the County survey and that no additional clearing had been done to expose the trail access. He pointed out the southern trail from the Moloa'a Ranch. Commissioner Blaich pointed out that the Commission has been told by the public that access to Ka'aka'aniu was very important for traditional limu gathering. Chair Souza questioned how any of the proposed changes would affect the landscape of the area. Inspector Milnes stated the conservation district use permit was for a fence from the makai side of the roadway to the ironwood tree, along the west boundary of the easement to the parking area. He stated that the work that was done was addressed through a conservation enforcement action prior to the approved plans. He said that the proposed fence line is 110 feet mauka of the shoreline as would be presented for certification. 2 Public members asked to comment. Deputy County Attorney Dahilig advised the Commission to abstain from public comment while on the excursion. He advised the public that if they had questions for staff, they could have a private conversation with staff at a later time, or that public testimony could be given at a meeting to present clarifying information. Commissioner Ventura stated that the public can submit written testimony or attend the meeting on the 25tH Chair Souza questioned vegetation along the shoreline. Inspector Milnes stated that the actual shoreline may be 20' or 30' inland of the vegetation line. He stated that the application was accompanied by a shoreline survey which depicts where they believe the shoreline to be. He pointed out the proposed improvement areas. At Kahili Bay, Commissioner Blaich pointed out parcels that were acquired by the Kaua'i Public Land Trust and parcels that are in the process of being acquired. Reconvened meeting at Liliu'e Civic Center at 3:45 p.m. There were no public members in attendance when the meeting reconvened. ADJOURNMENT MOTION: It was moved by Tessie Kinnaman and seconded by Eugene Punzal to adjourn the meeting. All were in favor by unanimous voice vote — motion passed.
