HEARINGS AND PUBLIC COMMENT Individuals may orally testify on items on this agenda during the Public Comment Period. Please call the Planning Department prior to the meeting or notify Commission Staff at the meeting site. Testimony may also be accepted when the agenda item is taken up by the Commission at the discretion of the Chair. Testifiers shall limit their testimony to three (3) minutes, but may be extended longer at the discretion of the Chair. Written testimony is also accepted. An original and twelve (12) copies of written testimony can be hand delivered to the Planning Department or submitted to Commission Staff at the meeting site. 1. Continued Agency Hearing: (NONE) 2. New Agency Hearing: a. Class IV Zoning Permit Z-IV-2012-16, Use Permit U-2012-13, and Special Permit SP-2012-37 to allow construction of a new permanent maintenance facility and expansion of the existing cemetery and associated uses within the Special Treatment District-Public Facility (ST-P) at the Kaua'i Veteran's Cemetery facility in Hanapepe, and Variance Permit V-2012-07 to deviate from the requirements noted in Section 8-5.5(a) of the Kaua'i County Code (1987) relating to the maximum land coverage requirements within the Open (0) Zoning District, on property situated on the west side of Lele Road, approx. 400 ft. south of its intersection with Kaumuali`i Highway, further identified as Tax Map Key (4) 1-8-008: 038, and containing a total area of 11.447 acres = State of Hawai'i, Department of Accounting and General Services (DAGS) and County of Kauai, Department of Parks and Recreation (DPR). Dyer Revocable Trust. POSTPONED. 3. Continued Public Hearing: a. Zoning Amendment ZA-2012-5 to amend Chapter 8, Article 27 of the Kaua'i County Code, 1987 (as amended) to incorporate the shoreline change data produced by The University of Hawai'i Coastal Geology Group in the Kaua'i Coastal Erosion Study and other amendments relating to setback calculations (public review document will be made available beginning March 7, 2012) _ County of Kaua'i, Department of Planning. Letter (4/15/12) from Carl Young, for Request of Time Extension for Variance Permit V-2011-1 and Class IV Zoning Permit Z-IV-2011-6, Tax Map Key 3-4-001: 003, relating to Condition No. 6 of the approval requiring completion of construction in 12 months or by May 11, 2012 for the proposed Sprint cellular antenna sites near Halfway Bridge. 1. The following scheduled Planning Commission meeting will be held at 9:00 a.m., or shortly thereafter at the Li-hu'e Civic Center, Moikeha Building, Meeting Room 2A- 2B,4444 Rice Street, Lihu'e, Kaua'i,Hawai'i 96766 on Tuesday,May 22,2012. O. ADJOURNMENT EXECUTIVE SESSION: The Commission may go into an executive session on an agenda item for one of the permitted purposes listed in Section 92-5(a) Hawaii Revised Statutes ("H.R.S."),without noticing the executive session on the agenda where the executive session was not anticipated in advance. HRS Section 92-7(a). The executive session may only be held, however, upon an affirmative vote of two-thirds of the members present, which must also be the majority of the members to which the board is entitled. HRS Section 92-4. The reason for holding the executive session shall be publicly announced.
