SUBDIVISION COMMITTEE MEETING
January 11, 2011
The regular meeting of the Planning Commission Subdivision Committee was called to order by
Chair, James Nishida at 8:49 a.m., at the Lihue Civic Center, Mo'ikeha Building, in Meeting
Room 2A-213. The following Committee members were present:
Mr. James Nishida
Mr. Jan Kimura
Absent and excused:
Ms. Camilla Matsumoto
Discussion of the meeting, in effect, ensued:
APPROVAL OF THE AGENDA
On motion made by Jan Kimura and seconded by,James Nishida to approve the
agenda, motion carried unanimously by voice vote.
GENERAL BUSINESS MATTERS
There were no general business matters.

There were no communications.

NEW BUSINESS
Tentative Subdivision Action, S-2011-13,Judith C. Page Trustee, et. al., 2-lot
Consolidation, TMK: 1-9-002:025, Hanapepe, Kauai.
Staff Planner Dale Cua: Thank you Mr. Chair. As noted in the subdivision report the
proposal consolidates 2 existing lots into a single lot for a property situated in Hanapepe Valley.
As noted the intent of the proposal is to satisfy a requirement of the State DLNR. The applicant
is looking to purchase this road right-of-way from the State and as a condition of the purchase
the applicant is required to submit a subdivision application to the County for a formal
consolidation. The subdivision map has been routed to the various reviewing agencies for
comment. We have received the agency comments and the requirements have been incorporated
into the subdivision report. The department is recommending a tentative subdivision approval of
this application.
Chair: Dale, this 10 foot roadway, the Department of Public Works is recommending
that that be a named roadway?
Staff. Right. It is an interesting scenario because Awawa Road in this location kind of
splits off. Awawa Road continues on into the valley but there is a leg that provides access to
some of the homes in this area. The application is being encouraged to name that roadway so
that it is a way to identify these homes off Awawa Road.
Chair: So it is not related to this 10 foot acquisition?
Staff. No.
Chair: It is a separate...
Staff. It is a separate right-of-way. If you look at the subdivision map the roadway is
indentified on the left side of the map, it's that area where it is identified as edge of pavement.
Mr. Nishida: So did they put that as a condition to this applicant?
Staff. They are encouraged to name the roadway.
Chair: Do you have anything to add?
Mr. Allen Hironaka: Good morning Commissioners, Allen Hironaka, Hironaka
Surveying and Mapping. At this time no. I have read the comments and I have no objections. I
had the same question though that Jimmy asked about the 10 foot road.
Chair: So Jan, do you have any questions for Allen?
Mr. Kimura: No. Move to approve tentative subdivision action for 5-2011-13, Judith C.
Page Trustee, et. al., TMK 1-9-002:025, Hanapepe, Kauai.
Chair: Second, all those in favor say aye, opposed, motion carried.
On motion made by Jan Kimura and seconded by James Nishida, to grant tentative
subdivision approval for 5-2011-13, motion carried unanimously by voice vote.
Final Subdivision Action, 5-2006-17,Robinson Family Partners, 3-lot Subdivision,
TMK: 1-2-006:002, Waimea, Kauai.

Staff. As noted in the subdivision report the proposal establishes 3 lots in Open District.
For your information the property is situated above Waimea Town right next to the water tank
facility overlooking the town. As you are going up Waimea Canyon Drive the water tank will be
on your right side and the property is situated right after that. As a condition of final approval
the applicant needed to obtain final subdivision approval from the Department of Water. As of
yesterday we have received the approval letter from the Department of Water and as such we are
recommending final subdivision approval of this application.
Mr. Kimura: So all the discrepancy has been taken care of already?
Staff: Yes.
Chair: Is the applicant here, Clyde, any additions or comments?
Mr. Clyde Kodani: No, for the record Clyde Kodani, no objections.
Chair: Questions for Clyde? What do you want to do?
Mr. Kimura: Move to approve final subdivision action for S-2006-17, Robinson Family
Partners, TMK: 1-2-006:002, Waimea, Kauai.
Chair: Second, all those in favor say aye, motion carried.
On motion made by Jan Kimura and seconded by James Nishida, to grant final
subdivision approval for S-2006-17, motion carried unanimously by voice vote.
Final Subdivision Action, S-2006-47, Opaekaa Falls Land Company, 3-lot Boundary
Adjustment, TMK: 4-2-003:012, 065, 066, Wailua Homesteads, Kauai.
Staff. Thank you Mr. Chair. As noted in the subdivision report the proposal redefines the
boundaries between 3 existing lots. The property is situated along the mauka side of Kuamoo
Road in Wailua Homesteads. The property is situated right after the, once you pass the waterfall
site the property is immediately to your right, it contains an existing house. The final subdivision
map has been routed to the various reviewing agencies for their final approval. We have
received all of the approval letters. As a result the department is recommending final subdivision
approval of this application.
Chair: Questions for Dale?
Mr. Kimura: They don't plan on building across the stream do they?
Staff: Not at this time, no.
Mr. Kimura: They could.

Staff. They have but they have physical challenges to get...they have to obtain necessary
approvals to cross the stream not only from the State but possibly from the Army Core as well.
Chair: That easement that everybody uses is on their land? That is an easement on their
property and that will remain?
Staff. Yes, that will remain.
Chair: Can the applicant come forward.
Mr. Max Graham: Good morning Subdivision Committee members, I am Max Graham
and I represent the applicant. We have no objections to the approval obviously. The
development is all going to be on the roadside of the property. Right now the side on the
opposite side of the river is under our Ag. plan for pasture purposes. So we would have to come
back to the Subdivision Committee to change the Ag. plan if anybody wanted to try to develop
across there. And you would have to cross the stream and it would be way to difficult but in any
event we would have to come back.
Mr. Kimura: Move to approve final subdivision action on S-2006-47, Opaekaa Falls
Land Company, TMK 4-2-003:012, 065, 066, Wailua Homesteads, Kauai.
Chair: Second, all those in favor say aye, motion carried.
On motion made by Jan Kimura and seconded by James Nishida, to grant final
subdivision approval for S-2006-47, motion carried unanimously by voice vote.
