HomeMy WebLinkAboutSUB July 26 2011 minutes KAUAI PLANNING COMMISSION SUBDIVISION COMMITTEE MEETING July 26, 2011 The regular meeting of the Planning Commission Subdivision Committee was called to order by Chair Jan Kimura, at 8:35 a.m. at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room 2A-213. The following Committee members were present: Ms. Camilla Matsumoto Mr. Jan Kimura Mr. Hartwell Blake Discussion of the meeting, in effect, ensued: APPROVAL OF THE AGENDA On motion made by Hartwell Blake and seconded by Camilla Matsumoto, to approve the agenda, motion carried unanimously by voice vote. GENERAL BUSINESS Letter(7/12/11) from Max W. J. Graham, Jr., Esq., providing a status report on the Conditions of Tentative Approval, relating to a 3-lot boundga adjustment within the Agriculture (A) zoning district, Subdivision Application No. S-2010-06, Tax Map Key: (4) 4-4-004:003, 038 & 053, Kapa`a, Homesteads =Patriek L. Ibbs & Stephanie A. Ibbs, et. al. Staff Planner Dale Cua: What you have before you is a correspondence and essentially it is a status report on the subdivision as it relates to the conditions of tentative approval. It is basically just for your information. Chair: Any questions for the planner? Good morning. Mr. Max Graham: Good morning, I am Max Graham representing the Ibbs. I submitted the letter with the documents we need for final approval and just to bring you up to date on the status we need to have the Water Board accept the water conveyances so that document has been submitted. As soon as that happens we should be ready. I think we have fulfilled all the other requirements and once this subdivision is complete that will allow us to do the exchange of the road parcel with the County in exchange for a railroad parcel that is being consolidated into these properties and we will have completed this exchange that has been going on for several years now, at least 3 years. COMMUNICATIONS There were no communications. UNFINISHED BUSINESS There was no unfinished business. NEW BUSINESS Tentative Subdivision Extension Request, S-2008-04=Niu Pia Land Company, Ltd., 23-lot Subdivision, TMK: 4-4-002:012, 013, 015, 088, Wailua Homesteads, Kauai. Staff: Thank you Mr. Chair, what you have before you is it is the applicant's second extension request for this subdivision. As noted in the staff report the previous extension was approved and granted to January 22, 2011. The proposal involves a 23-lot subdivision within the Agriculture and Open zoning districts. The property is situated in Wailua Homesteads. The applicant is still trying to comply with the requirements of tentative approval; they are still working on the construction plans for this project. Essentially if you look at the subdivision map there will be an internal roadway that will be connecting the two roadways, one would be coming from Kamalu Road and then connecting to Puupae. Because the project involves substantial infrastructure requirements the department is granting another extension to January 22, 2012, one year extension. The applicant however is required to submit a status report as far as the progress of the subdivision for their next extension request. Chair: When? Subdivision Committee Minutes July 26,2011 2 Staff. The status report should be submitted no later than 60 days prior to the expiration date. Chair: Okay, any questions for the planner? Mr. Blake: Niu Pia Farms which has been going on for years and then this one we think will happen in the next within the next six months or so. What is the difference with the way Water treats these? Staff. Water has been pretty consistent as far as imposing requirements for subdivisions. Mr. Blake: Say that again. Staff. The Water Department has been pretty consistent in imposing requirements for subdivision developments. Mr. Blake: So why does Niu Pia Farms take years and others don't? Staff. I guess it depends on the source and what the requirements are. Mr. Blake: If you can answer that I would be very happy. Chair: I guess the applicant is here? Mr. Clyde Kodani: For the record, Clyde Kodani and with me is Sam Pratt from Niu Pia Lands. We really don't have anything to say expect if questions by any of the Commissioners. Chair: Do you think with this year extension the project will be a go? Mr. Kodani: Pardon me? Chair: With this one year extension will the project be up and running? Mr. Kodani: It is up and running right now, whether it will be completed by January 2012,we are not sure because there are still a lot of uncertainties. And the reason just to give you a quick history of what has been going on that first we had to kind of negotiate or discuss at length with the Department of Public Works as to where the connection on the Puuopae side, that is the western connection,because that one land bridge, that Kiapapa Bridge. So that took some time. And then we worked with the Water Department to try to establish what their requirements are and as Commissioner Hartwell Blake asked, the Department of Water has been consistent, the water system serves Kauai by regions and so you have Kapa`a region, Lihu`e region. So some regions have adequate supply, others don't, and on this Wailua one they weren't quite sure at that time so we were working with them to see what improvements needed to be done. Subdivision Committee Minutes July 26,2011 3 Unfortunately, I think it was last year, the housing requirement came into play, about 30%r whatever it is or 10%had to be for affordable housing so that required us to revisit the layout to see was it feasible, how can we change it to make it at least more palatable for both County as well as developers. And most recently now we think we are okay but we have spoken to Attorney Ian Jung something about this right-of-way, the stream right-of-way, we that this is separate right-of-ways but Mr. Jung said that he can't opine on that until he reviews everything. So all of these little things are just taking up some time but hopefully we would like to, we are in the midst of our work and for them they would like to have me finish by the end of this year but it involves County review time so we need to be fair and we are trying. Chair: What does the Commission want to do? Tentative Subdivision Extension Request, 5-2009-13 = Grove Farm Properties, Inc., 99- lot Subdivision, TMK: 3-3-003:041 (por.), Llhu`e, Kauai. Tentative Subdivision Extension Request, 5-2009-14= Grove Farm Properties, Inc., 20- lot Subdivision, TMK: 3-3-003:041 (por.), Lhu`e, Kauai. Tentative Subdivision Extension Request, 5-2009-14= Grove Farm Properties, Inc., 109-lot Subdivision, TMK: 3-3-003:041 (por.), Lihu`e, Kauai. Chair: Dale, because these are all the same company, all the same subdivision, can we just read all of these off and go through it one time? Staff. What we can do is we can consider the project as one whole but when we take action because it involves three separate subdivision applications we would read the action... Chair: We have to read them one at a time? Staff. When we take action but as far as considering it now we can do it as a whole. Chair: Is that acceptable to you Hartwell? These next three applications on the subdivision agenda involves one project by Grove Farm, it is the Waiola Residential Subdivision. The three subdivision applications represent the three different phases of the project. So the first one, 2009-13 represents Phase one, the second application represents Phase II, and the third application represents Phase III. Basically the challenge with this particular project is trying to coordinate the infrastructure improvements because they are all tied into one another and it is further noted in the subdivision report. The infrastructure related to this subdivision involves the construction of the continuation of Nuhou Road, the internal roadways within these projects and the water infrastructure that will be serving these developments. Because it is quite extensive, the applicant therefore requesting an extension of time to proceed towards the completion of the subdivision. Our recommendation is to grant the extension to the March 10, 2012 date. Chair: Any questions for the planner? Is the applicant here? Mr. David Hinazumi: Good morning Commissioners, David Hinazumi on behalf of Grove Farm. Chair: Any questions for the applicant? I have a question; do you plan on using local contractors for this project? Mr. Hinazumi: Yes, historically we have and we will continue to look towards using local contractors. Chair: Thank you, anymore questions, what does the Commission want to do? Ms. Matsumoto: We are going to approve each one separately so move to approve tentative subdivision extension request for S-2009-13, Grove Farm Properties, Inc., TMK: 3-3- 003:041 (por.). Mr. Blake: Second. Chair: All in favor.
