HomeMy WebLinkAboutSUB Nov 22 2011 minutes KAUAI PLANNING COMMISSION SUBDIVISION COMMITTEE MEETING November 22, 2011 The regular meeting of the Planning Commission Subdivision Committee was called to order by Chair Jan Kimura, at 8:35 a.m. at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room 2A-213. The following Committee members were present: Ms. Camilla Matsumoto Mr. Jan Kimura Absent and excused: Mr. Hartwell Blake Discussion of the meeting, in effect, ensued: APPROVAL OF THE AGENDA On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve the agenda, motion carried unanimously by voice vote. MINUTES On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve meeting minutes of 8/9/11, 8/30/11, 10/11/11 & 10/25/11, motion carried unanimously by voice vote. GENERAL BUSINESS MATTERS There were no general business matters. COMMUNICATIONS There were no communications. U NFINISHED BUSINESS There was no unfinished business. NEW BUSINESS Tentative Subdivision Extension Request, S-2005-39, Visionary LL C., 40-Lot Subdivision, TMK: 3-6-002:00 1(Portion), Li-hu`e, Kauai. Staff Planner Dale Cua: Thank you Mr. Chair. Just for your information the two applications that you have on the agenda is for the same project area in a sense that it is part of the original AMFAC/Lihu`e/Hanama`ulu Master Plan. Chair: Should I do two at once? Staff. Not necessarily but I am just letting you know that this was part of the Lihu`e Master Plan area that received entitlements back in 1995. So the first project is for the area that is adjacent to the existing Molokoa residential subdivision, it is that vacant area that is adjacent to Molokoa III and by the stadium. So this project I think is known as or in the subdivision report I call it the Molokoa Village. Part of the entitlements,just some background, one of the requirements relating to the entitlements for the Lihu`e Master Plan is required the applicant to obtain infrastructure approval for both the area in Hanama`ulu as well as this area, Molokoa and the other two project areas, Ahukini Makai and... Chair: So they are all... Staff. They are all integrated together, they are all connected together. I think last year or earlier this year the applicant came back before you folks for the acceptance of the final infrastructure master plan. That was pretty much the biggest hang up for these two projects was just trying to identify the infrastructure and try to coordinate at what point and time the infrastructure will be put in. So for this application as noted it is a 40-lot subdivision that is adjacent to Molokoa Subdivision. They are in for their fourth extension request. The department has routed the extension request to the reviewing agencies and they didn't have any problems with the extension request. We are recommending an extension for this application. I believe it is to July of 2013. Chair: So that is why it is taking so long, understandable, any questions for the planner? Ms. Matsumoto: I don't know if it is appropriate to ask this but I noticed there are two different dates. Staff. Yes, what I have been trying to do is prior to the revision of the next application they all had the same extension dates because they involve three distinct project areas. What I tried to do was coordinate all three projects so that they have all the same dates so then that way I don't have to worry about one expiring before the other so I try to have it all together. So as far as the next one is concerned if you want to amend the date so that it is consistent with the previous one. It is easier for staff to monitor. Chair: You want us to amend the date? Staff- When we get to the second one, yes. Chair: Is the applicant here, any questions for the applicant? Do you agree with the staff report? Subdivision Committee Minutes November 22,2011 2 Mr. Clyde Kodani: Well you guys were just mentioning about keeping the two dates the same, yes, we have no problem them both being July, 12, 2013. But that would be on the next... Chair: So if we change the dates on both to all the same, this one here there are no more extensions... Staff. Unless you feel like they...if you want to give them another extension opportunity you are more than welcome to do so. In the past I have included statements that if they want further extension requests they have to provide an updated status report. Chair: You are not going to need any more extension requests on this one, right? Mr. Kodani: I would like to say no I don't think we need it but I have learned in my 60 plus years never say never. Chair: Well I am not that experienced so I can say never. Mr. Kodani: If it causes any concern on the Commissioner's or Committee's position we have no problem however we really would like to just keep it because a lot of this is not within our prevue. We have no control over the agency's review. And just on this project we have basically 11 different agencies that we need to go and get our construction plans reviewed and because of the amount of agencies that we have to work with that is the one that is taking time. We have on Molokoa, the latest submittal planner Cua said we have the approval of the water master plan in July of 2009 and so after that we submitted all the construction plans for approval. The latest re-submittal to the agencies have been in August, 2010 and since last year we haven't received any comments from 4 of the agencies yet. So it's kind of hard because until we get their comments back we cannot do anything. Chair: Well you know my reasons for not extending any requests for extensions is I like to get these projects up and running as soon as possible to create jobs for the Union workers and stuff just to keep people working. That is my reason why I am kind of against extensions. But in this situation it is a little different. Staff. As far as amending it to include for further extension requests provide status reports? Mr. Kodani: We have no problem with that. If we have to provide an updated status report we are more than willing to do that. Staff. So the recommendation will be similar to the next application which is to provide...the date, and then the language, additional language afterwards that if they require additional extension requests they need to submit a status report 60 days prior to the expiration date. Subdivision Committee Minutes November 22,2011 3 Chair: Yes because this is a unique situation. Staff. It is a continuing project. Ms. Matsumoto: I am just going to read this now, move to approve tentative subdivision extension request for 5-2005-39, Visionary LLC, TMK: 3-6-002:00 1(portion), Lihu`e, Kauai, with the added condition to the recommendation that the extension until July 2012 be granted with added language, "However the applicant is made aware that an updated status report on the subdivision with a detailed time chronology on the progress on the tentative approval requirements shall be submitted to the Planning Department for review for further extension requests. The status report shall be submitted to the Planning Department no later than 60 days prior to the expiration date." Chair: So moved. Ms. Matsumoto: Excuse me, 2013, July 12, 2013. Chair: All in favor say aye. Tentative Subdivision Extension Request, 5-2005-41, Visionary LL C, 45-Lot Subdivision, TMK: 3-7-002:00 1(Portion), Lihu`e, Kauai. Staff: Thank you Mr. Chair. As noted before this project area is immediately adjacent to the heliport area by the airport. This project contains industrial zoning. Like the previous project they have been trying to coordinate the infrastructure for this project and I think two years ago the tentative subdivision approval was amended so therefore the date was different from the previous one. Like the previous project the applicant is continuing to work on completing this project and we have no problems with the extension request. In the subdivision report we are recommending an extension to April, 2013. And for further extension request the applicant is required to submit a status report. Chair: Any questions for the planner? Is the applicant here? Mr. Clyde Kodani: For the record, Clyde Kodani. Along with me are the Grove Farm representatives Mike Tressler, next to him is Sean Shimabukuro and behind is Dave Hinazumi. No questions the only thing is, are we going to change the date from April to July 12, 2013? Chair: Yes we are.
