SUBDIVISION COMMITTEE MEETING
October 11, 2011
The regular meeting of the Planning Commission Subdivision Committee was called to order by
Chair Jan Kimura, at 8:34 a.m. at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room
2A-213. The following Committee members were present:
Ms. Camilla Matsumoto
Mr. Jan Kimura
Absent and excused:
Mr. Hartwell Blake
Discussion of the meeting, in effect, ensued:
APPROVAL OF THE AGENDA
On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve
the agenda, motion carried unanimously by voice vote.
MINUTES
On motion made by Camilla Matsumoto and seconded by Jan Kimura, to approve
the minutes of September 13, 2011, motion carried unanimously by voice vote.
GENERAL BUSINESS MATTERS
There were no general business matters.
COMMUNICATIONS
There were no communications.
UNFINISHED BUSINESS
There was no unfinished business.
NEW BUSINESS
Final Subdivision Action, S-2002-21, O`ma`o Ranch Lands, LLC., 5-lot Subdivision,
TMK: 2-7-003:005, Koloa, Kauai.
Staff Planner Dale Cua: Thank you Mr. Chair. What you have before you is a 5-lot
subdivision; essentially the proposal consolidates 4 existing lots and re-subdivides into a total of
5 lots. The property is situated in Koloa along the mauka side of Koloa Road, it is the property
between Koloa Town and Lawa`i Town. The final subdivision map has been routed to the
various reviewing agencies for their review and approval. There is a provision at the very
bottom of the staff report that the applicant needed to obtain final subdivision approval from the
Department of Public Works. As of yesterday the department has received all of the approval
letters, as a result we are recommending final subdivision approval of this application.
Chair: Any questions for the planner? Seeing none is the applicant here, any questions
for the applicant? Seeing none what does the committee want to do?
Ms. Matsumoto: Move to approve final subdivision action for S-2002-21, O`ma`o Ranch
Lands, LLC., TMK: 2-7-003:005, Koloa, Kauai.
Chair: Second, all in favor say aye, so moved.
On motion made by Camilla Matsumoto and seconded by Jan Kimura, to grant
final subdivision approval for S-2002-21, motion carried unanimously by voice vote.
Final Subdivision Action, S-2011-17,Buff U. Toulon Trust/A.J. Toulon Trust, 2-lot
Boundary Adjustment, TMK: 2-3-015:117, 118, Kalaheo, Kauai.
Staff. Thank you Mr. Chair. The proposal involves a boundary adjustment between two
existing parcels in Kalaheo. As you can see on the subdivision map I provided the proposal
involves resolving and encroachment situation between the two properties. The final subdivision
map has been routed to the various reviewing agencies and we have received all the approval
letters. As a result we are recommending final subdivision approval of this application.
Ms. Matsumoto: On the map the encroachment area is...
Staff. That retaining wall between lot 22.b.Ld and 22.b.2, right in the middle. The old
property line was that dashed line.
Ms. Matsumoto: So the wall was...
Staff. Encroaching on to sibling's property.
Ms. Matsumoto: Lot 22.b.2.b?
Staff: Yes.
Ms. Matsumoto: By how many feet?

Staff. From what I can see it looks like about maybe 20 feet into the property.
Ms. Matsumoto: And how old is the wall?
Staff. I am not sure the age of the wall.
Chair: Any more questions for the planner?
Ms. Matsumoto: So that is not going to affect anything like the driveway?
Staff: Not at all.
Ms. Matsumoto: It's just the movement of the...
Staff. Property line, yes.
Ms. Matsumoto: And this is just, it looks like this is a walkway in lot 22.b-1-b, a
walkway leading up to the house?
Staff. Yes. It is the driveway. Oh, you mean by the retaining wall?
Ms. Matsumoto: So there is another wall there.
Staff. Right so I guess to the left of the driveway it would lead to the main entrance of
the house.
Chair: Any more questions for staff? Seeing none what does the committee want to do?

Toulon Trust/A.J. Toulon Trust, TMK: 2-3-015:117, 118, Kalaheo, Kauai.
