HomeMy WebLinkAboutMinutes SUB 5-8-12 LA KAUAI PLANNING COMMISSION SUBDIVISION COMMITTEE MEETING May 8, 2012 The regular meeting of the Planning Commission Subdivision Committee was called to order by Chair, Herman Texeira, at 8:35 a.m., at the Lihue Civic Center, Mo'ikeha Building, in Meeting Room 2A-2B. The following Committee members were present: Ms. Camilla Matsumoto Mr. Herman Texeira Mr. Hartwell Blake Discussion of the meeting, in effect, ensued: APPROVAL OF THE AGENDA On motion made by Camilla Matsumoto and seconded by Hartwell Blake, to approve the agenda, motion carried unanimously by voice vote. GENERAL BUSINESS MATTERS (NONE) COMMUNICATIONS (NONE) UNFINISHED BUSINESS (NONE) NEW BUSINESS Tentative Subdivision Extension Request, S-2008-16,Melvin Soong/Clarence Soong, 2- lot Subdivision, TMK: 4-6-015:048, Kapa`a, Kauai. Staff Planner Dale Cua: As noted in the department's report this is the fourth extension request for this particular subdivision. Also supplementing your subdivision packet I passed out that one packet in regards to this particular project, it is a status report coming from then applicant's attorney. It is a detailed status report on the progress of the subdivision. In reviewing the file the last correspondence I received was a couple weeks ago from Public Works, it relates to the condition regarding improvements to the roadway. What has been holding up this project is actually the infrastructure requirements both from water and from public works and more particularly the roadway for this subdivision. The applicant has been progressing with this subdivision and it has been taking some time as you noticed. So we are recommending an extension to March 25, 2013 with the condition that they continue to provide a status report and the status report is due no later than sixty days prior to the expiration date. They were negotiating...the applicant has been negotiating both Public Works and Water in regards to the extent of the infrastructure improvements. With this particular project if you look at the map the project in its self is at this intersection of Nunu Road and Haua`ala Road. On paper you see an intersection but physically the question was whether to provide this connecting roadway and there is a big topographical constraint. Mr. Blake: Connecting roadway from where? Staff. If you look at the property, the property is at that intersection involving Paleihu Road,Nunu Road and Haua`ala, and Haua`ala is along its western boundary. So physically there is no physical connection between Haua`ala and Nunn Road so it is actually Nunu is here, Haua`ala is down. So it is actually a hillside. Mr. Blake: So they are negotiating. Staff. Whether to actually make a connecting roadway or not. I think they finally found some resolution. I think Public Works has agreed to back off. Ms. Matsumoto: It is hilly. How about going up, did they consider going up? I see a road... Staff: So right now the primary access is coming off of Paleihu and onto Nunu. Chair: Paleihu comes from Kawaihau Road across from the high school. Staff. Yes. Chair: And then you turn right but it has been like that a long time. Staff: Historically it has been there. Chair: I used to walk over there as a kid. It would be very dangerous to end up on Haua`ala, that is a bad place to have a stop sign and then...cars are flying down over there. Ms. Matsumoto: It is heavily used? Chair: Heavily used. Ms. Matsumoto: People speed down the hill? Chair: People race down and take the back road. It is kind of a dangerous place to have a stop sign and take a left or right over there. Mr. Blake: So whether this intersection fit in that place or not (inaudible). 2 VA2012 Master Files\Commissions\Subdivisions\Minutes\Minutes SUB 5-8-12 LA.docx Staff: Yes, in the event should the County ever decide to widen that roadway that reserve is there. Ms. Matsumoto: And this, I see on the map there is a curve. Staff: That is Haua`ala Road. Ms. Matsumoto: No, this one here looks like abandoned railroad. Staff: Yes. Ms. Matsumoto: So that is just... Staff: That is just on paper but physically it is not there. Chair: Any other questions of Dale? If not I would like to call on the applicant please, the applicant's rep. Staff: I know Max was on his way... Ms. Matsumoto: I have a question. What does deferred dedication...? Staff: Basically the dedication is that at some time should the County want that reserve the applicant is willing to dedicate it to them. So it is an agreement to dedicate at a later date basically. Chair: Since the applicant's rep. is not here is there anyone from the public wishing to testify on this application? Seeing none... Mr. Blake: Move to approve staff's recommendation and grant the extension subject to the condition to make a current status report. Ms. Matsumoto: Second. Chair: Any discussion, all those in favor say aye, those opposed, motion carried. On motion made by Hartwell Blake and seconded by Camilla Matsumoto,to grant tentative subdivision extension for 5-2008-16, motion carried unanimously by voice vote. Tentative Subdivision Extension Request, 5-2011-16= Cameron K. Burgess, et.al., 4-lot Subdivision, TMK: 4-1-008:013, Wailua, Kauai. Staff: Thank you Mr. Chair. Again the applicant in this application is requesting additional time to comply with the requirements of tentative approval. Similar to the previous one the applicant is working with both Public Works and Water regarding the infrastructure improvements relating to this subdivision. This is the applicant's first extension request. As a result the department is recommending an extension to February 22, 2013. Chair: This is in Wailua Houselots? Staff: Yes. It is at the intersection of Eggerking and Haleilio Road. This is on the northern side of Haleilio Road. Chair: Not too far from the park? Staff. Yes. I think it is a couple blocks. Chair: The surrounding properties are all...? Staff. Residential with the exception of the property to the north which is the Bett Midler Trust property. Chair: Any questions of Dale? Is the applicant's rep. here? Mr. Alan Hironaka: Good Commissioners, Alan Hironaka, Hironaka Surveying and Mapping. I am representing my clients. Chair: You have seen the status report by the Planning Department. Do you have any comments in regards to the status report? Do you feel fine about that? Okay, any questions of the applicant's rep.? Mr. Blake: Are they going to be submitting status reports also? Staff: Usually what we have done historically is the first...we usually give applicants about two years to resolve the requirements of tentative approval. At the third extension request it has been the historic practice of this committee to start asking for status reports to make sure that the subdivider is progressing with the project. Chair: Any other questions of the applicant's rep.? Seeing none, thank you Alan, anyone from the public wishing to testify on this application? Seeing none what are the wishes of this committee? Ms. Matsumoto: Move to approve tentative subdivision extension request for 5-2011-16, Cameron K. Burgess, et.al., TMK 4-1-008:013, Wailua, Kauai. Mr. Blake: Second.
