SUBDIVISION COMMITTEE MEETING
February 28, 2012
The regular meeting of the Planning Commission Subdivision Committee was called to order by
Chair, Herman Texeira, at 8:32 a.m., at the Lihue Civic Center, Mo'ikeha Building, in Meeting
Room 2A-213. The following Committee members were present:
Ms. Camilla Matsumoto
Mr. Hartwell Blake
Mr. Herman Texeira
Discussion of the meeting, in effect, ensued:
APPROVAL OF THE AGENDA
Chair: Before I have an approval of the agenda I would just like to mention that we will
changing the order of the agenda and that is item D.Lc, S-2012-09,will be the first item of
business on the agenda. And item, this the tentative subdivision extension request, that item S-
99-49 will be deferred until the next meeting.
Staff Dale Cua: It is being deferred indefinitely.
Chair: Correction, it will be deferred indefinitely. With that in mind I would like to have
an approval of the agenda.
Ms. Matsumoto: Move to approve with the changes.
Chair: Seconded, any question, all those in favor say aye, motion carried.
On motion made by Camilla Matsumoto and seconded by Herman Texeira, to
approve the agenda as amended, motion carried unanimously by voice vote.
MINUTES
On motion made by Camilla Matsumoto and seconded by Herman Texeira,to
approve subdivision meeting minutes of 1/10/12 and 1/24/12, motion carried unanimously
by voice vote.

Tentative Subdivision Action, 5-2012-09, Gail Shimokawa/Lori Shimokawa
Caporus/Gordon Kireto, 2-lot Subdivision, TMK: 1-9-010:013, Hanapepe, Kauai.
Staff Planner Dale Cua: Thank you Mr. Chair. What I have posted on the board behind
me is a copy of the preliminary subdivision map. What I am going to do is go up to the board
and identify the property. Just to let you know this property is in Hanapepe Town along the
main highway and it's on the makai side of the highway in Hanapepe Town. It is right at the
highway/Puolo Road intersection. This is the highway here on this map, Puolo Road is on the
western side of the property, Wong's restaurant is situated right across the street. This is the
Pupu Factory here and you have a single family residence towards the rear side of the property.
Chair: Where is the Hanapepe Stream? It would be on the Lihue end?
Staff. Yes, the river is on this side. So the subdivision, I just wanted to let you now that
the proposal consolidates three existing lots and re-subdivides into two lots. The preliminary
subdivision map has been routed to the various reviewing agencies and their requirements have
been incorporated into the subdivision report. As a result the department is recommending
tentative subdivision approval of this application.
Ms. Matsumoto: Just the concerns, the road access and then the property being near the
sewer system.
Staff- Right. Prior to final subdivision approval the applicant would have to resolve
these requirements directly with those affected agencies. So before the applicant can obtain final
subdivision approval the applicant would have to comply with these requirements that you see
before you.
Chair: What is the purpose of this request?
Staff: From what I understand the applicant is trying to separate interests in the property.
Chair: The property is zoned R-6, open, how much of the property is open?
Staff: The western corner of the property is zoned open so all of the existing
developments occurs within the residential zoning district, especially the commercial operation,
it actually existed prior to the establishment of the zoning ordinance.

Chair: So they have that opportunity to do commercial on an R-6.
Staff. Yes, it is a nonconforming use, grandfathered use.
Chair: Okay so that option is there. Concerning the R-6 zoning what is the maximum of
lots that can be cut out from that parcel?
Staff. I think the applicant is kind of limited to the space limitations that occur there now
and if they can squeeze in another residential unit they would probably have to go vertical.
Chair: The applicant could come back at any time then and request a change,right?
Staff. Absolutely.
Chair: Good morning Mr. Blake. We have modified the agenda and we are on, the first
item on the agenda is the last one, the second to the last one, item D.1.e., and that is 5-2012-09
and that is the subdivision request in Hapapepe. And we have pasted on the board, would you
like a further description as to where the property is located?
Mr. Blake: That is Shimokawa?
Staff. Yes, it is right across the street from Wong's restaurant.
Chair: Do you have any comments Mr. Blake?
Mr. Blake: None.
Chair: There being none I would like to call on the applicant please.
Mr. Wayne Wada: Wayne Wada with Esaki Surveying and Mapping.
Chair: Good morning, do you have any questions of the applicant? My question was
about why were you consolidating from three lots to two lots and as I said in the report it states
that it is a family...this is how you want to cut up the property.
Mr. Wada: Yes, there are two families involved and they are splitting it up.
Chair: So the proposed split will be right down the middle?
Mr. Wada: No. I think one family owns the house on the right and the other family owns
the Pupu Factory and that other structure.
Chair: Mr. Blake, do you have any questions sir? Fortunately there are no further
questions, thank you. I would like to call for the question please.

Ms. Matsumoto: Move to approve tentative subdivision action for 5-2012-09, Gail
Shimokawa and Lori Shimokawa Caporus/Gordon Kireto, at TMK 1-9-010:013, Hanapepe,
Kauai.
Mr. Blake: Second.
Chair: Any discussion, seeing none all those in favor say aye, those opposed, motion

tentative subdivision approval for 5-2012-09, motion carried unanimously by voice vote.
Tentative Subdivision Action, 5-2012-06,Lindsay Crawford/KukuPula Development
Co. (Hawaii), LL C, 4-lot Subdivision, TMK: 2-6-014:026, 043; 2-6-015:005, Koloa, Kauai.
Staff: The property is actually located within the Koloa Estates subdivision and as noted
in the subdivision report the proposal consolidates a total of three lots and re-subdivides into a
total of four lots. Actually there is only one additional lot being created with this application.
The preliminary subdivision was routed to the various reviewing agencies and the requirements
of these agencies have been incorporated into the subdivision report. As a result the department
is recommending tentative subdivision approval of this application.
Ms. Matsumoto: So again there is road access and the ditch.
Staff: Yes. So the applicant has been made aware of these requirements in regards to the
access to these lots to address the drainage easement.
Mr. Blake: So the access to lot C will be off of Paipa Road?
Staff: Yes.
Chair: The applicant will be required to do all of the conditional...prior to...
Staff: Prior to subdivision approval and obtaining approval from these agencies the
applicant would have to comply with all of these requirements.
Chair: Will the applicant please come forward?
Mr. Lindsay Crawford: Good morning Commissioners, Lindsay Crawford. Let me
clarify just one thing real quick. This is a map that is for Lindsay Crawford, me, this is my
personal residence and it just so happens that Kukui'ula, my employer, is involved only to the
sense that I am purchasing a small piece of land from them to add on to my personal residence.
So in essence this is really not a Kukui'ula map per say but on in the fact that I am just
purchasing a small remnant of land because I happen to live adjacent to the project.

Chair: What are the respective square footages of each lot?
Mr. Crawford: When it is done, what I am doing is I am taking my existing residential
lot, I am adding 5,000 square feet of area from Kukui'ula, that is what I am purchasing, and then
I am subsequently subdividing my residential lot into two new residential lots, one will be
approximately a half acre and the other will be approximately a third of an acre. And it creates
in essence one new net lot in the Koloa Estate subdivision.
Mr. Blake: So the main house is half an acre?
Mr. Crawford: Yes, the house that is existing will be on a half-acre lot.
Mr. Blake: And how big is lot D?
Mr. Crawford: Lot D is the existing sewer pump station lot and it is and will be in its
final configuration approximately a tenth of an acre. It is not a residential lot it is just solely for
the purpose of this existing sewer pump station that is there. And I might clarify why this lot is
involved in this subdivision, as sort of a byproduct we noticed a long time ago that the existing
sewer pump station does not exactly fall in the existing lot that the improvements on the ground
actually fell outside of the lot by about six feet. So we are just correcting that issue with this
map to kind of clean up some old business.

Tentative Subdivision Action, 5-2012-07,Lindsay Crawford, Kukui'ula Development
Co. (Hawaii), LL C, 9-lot Subdivision, TMK: 2-6-017:004, 005; 2-6-018:001-067, Kukui'ula,
Kauai.
Staff: Thank you Mr. Chair. I am going to go up to the board to identify the project site.
In this upper right hand corner is a vicinity map of the project site. This is the main bypass road
Ala Kalani Kaumaka which goes down to the commercial core. This residential subdivision was
previously approved by the Planning Commission back in 2006. Through this application what
the applicant is intending to do is consolidate a total of twenty lots and re-subdividing into a total

of nine lots. The primary intent is basically to increase the size of these residential parcels. The
preliminary subdivision map has been routed to the various reviewing agencies; all of the
requirements of the agencies have been attached to the subdivision report. As a result we are
recommending tentative subdivision approval of this application.
Mr. Blake: So generally the square footages go from what to what?
Staff. I think the average size of the lot and the applicant can correct me but was
approximately 10,000 acres, square feet, sorry. And then I think many of them are being
increased to anywhere from twenty to thirty thousand square feet. Anywhere half to three
quarters of an acre.
Chair: Is this to enhance the marketability of these lots? I would assume it would put
these lots in a different stratum in terms of the...
Staff: As far as the tax it still remains the same. The only benefit is now that the
applicant has a bit more buildable area for each of these residential lots as opposed to being
confined to smaller lots. Now it has a little bit more design flexibility.
Ms. Matsumoto: And they are going to have to resolve the sewer issues.
Staff. Yes.
Mr. Blake: I like less density.
Chair: Less density is always better. If there are no further questions would the applicant
please come forward? Good morning again, Lindsay Crawford, this time representing Kukui'ula.
Chair: I forgot to ask you, you have seen the staff report, do you have any concerns or
problems or recommendations in regards to that report?
Mr. Crawford: There is one typo we could fix but I will get to that in a second. Let me
just address the one question that you asked. Yes it is for marketability. The smaller lots which
were about, we will call them one third acres lots are now going to full one acres or one acre plus
lots so it is quite a large increase in the lot size and it was for marketability of the lots.
Chair: So this would make a more exclusive subdivision I would assume.
Mr. Crawford: I wouldn't call it more exclusive. As you know the whole property is
open, there are no gates; there is nothing that keeps people from coming into the property. But
this size lots can be considered more estate lots if you will, less roof tops looking down onto the
project. The only correction I have Dale, I noted on conditions of approval, I think this is just a
typo or perhaps Wally misprinted on here. On condition 2.a, he references the easement
description, SD.1. I believe what he mean to say was S, not SD. That is the only correction I
can see.

Mr. Blake: I have one question,when do you expect to be completed? When do you
expect this subdivision to be done?
Mr. Crawford: This particular subdivision is completed. It is part of our M parcel, we
have M, 1, 2, 3, and 4, and this is taking a portion of M.2, taking some as Dale said some twenty
lots and reconsolidating and subdividing in to nine lots. All of the improvements are in, all of
the roadways, all the infrastructure; it is now a matter of just removing a needed additional sewer
and water connections. And that we will do with the agencies.
