NOTICE IS HEREBY GIVEN, of a public hearing to be held by the County
of Kauai Planning Commission's Hearing Officer at the Lihu'e Civic Center,
Moikeha Building, Meeting Room 2A-2B, 4444 Rice Street, Lihu'e, Kaua'i on
Tuesday, November 29, 2011, starting at 9:00 a.m., or soon thereafter to
consider under the provisions of State Land Use Commission Rules and
Regulations and Chapter 13 of the Planning Commission's Rules of Practice
and Procedures, the following:
1. Special Permit SP-2011-33 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihikai ('Anini), Kaua'i, mauka of and adjacent
to 'Anini Road, approx. 870 ft. east of the 'Anini Beach Park, further identified
as Tax Map Key 5-3-4: 30, and containing an area of 28,680 sq. ft.
2. Special Permit SP-2011-29 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kilauea, Kaua'i, approx. 3,100 ft. west of the
Kauapea Road and Kilauea Lighthouse Road intersection, further identified as
Tax Map Key 5-2-5: 29 (Unit A), and containing a unit size of 3.041 acres of a
5.041 acre parcel.
3. Special Permit SP-2011-15 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kilauea, Kaua'i, approx. 2,800 ft. north of the
Waiakalua Street and Kuhi`o Highway intersection, further identified as Tax
Map Key 5-1-5: 47 (Unit C), and containing a unit size of 2.69 acres of a 10.902
acre parcel.
4. Special Permit SP-2011-24 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihikai ('Anini), Kaua'i, mauka of and adjacent
to 'Anini Road, approx. 430 ft. east of the 'Anini Beach Park, further identified
as Tax Map Key 5-3-4: 20 and containing an overall size of .25 acre.
5. Special Permit SP-2012-34 to permit use of an existing single family
residence (ADU) for Transient Vacation Rental purposes as permitted by
County of Kaua'i Ordinance No. 904, in Kalihikai ('Anini), Kaua'i, mauka of and
adjacent to 'Anini Road, approx. 430 ft. east of the 'Anini Beach Park, further
identified as Tax Map Key 5-3-4: 20 and containing an overall size of.25 acre.
6. Special Permit SP-2012-1 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihiwai, Kaua'i, approx. 500 ft. west of the Old
Kuhi`6 Highway and Anini Road intersection, further identified as Tax Map Key
5-3-3: 45, and containing an overall size of 1.720 acre.
7. Special Permit SP-2012-33 to permit use of an existing single family
residence (ADU) for Transient Vacation Rental purposes as permitted by
County of Kaua'i Ordinance No. 904, in Kalihiwai, Kaua'i, approx. 500 ft. west
of the Old Kuhi`6 Highway and Anini Road intersection, further identified as
Tax Map Key 5-3-3: 45, and containing an overall size of 1.720 acre.
8. Special Permit SP-2012-3 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in East Waiakalua, Kaua'i, approx. 1,100 ft. south of
the Waiakalua Street and Kuhi`o Highway intersection, further identified as
Tax Map Key 5-1-5: 28 (Unit 1), and comprised of a unit size of 2.983 acres of a
10.006 acre parcel.
9. Special Permit SP-2012-4 to permit use of an existing single family
residence #1 (aka "Longhouse") for Transient Vacation Rental purposes as
permitted by County of Kaua'i Ordinance No. 904, in Kalaheo Homesteads,
Kaua'i, approx. 700 ft. southeast of the intersection of Puulima Road and
Puuwai Road, further identified as Tax Map Key 2-4-3: 26, and comprised of
11.423 acres.
10. Special Permit SP-2012-5 to permit use of an existing single family
residence #2 (aka "Barn") for Transient Vacation Rental purposes as permitted
by County of Kaua'i Ordinance No. 904, in Kalaheo Homesteads, Kaua'i,
approx. 700 ft. southeast of the intersection of Puulima Road and Puuwai Road,
further identified as Tax Map Key 2-4-3: 26, and comprised of 11.423 acres.
11. Special Permit SP-2012-6 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihiwai, Kauai, approx. 500 ft. west of the Old
Kuhi`6 Highway and Anini Road intersection, further identified as Tax Map Key
5-3-9: 8 (Unit C), with a unit size of 2.967 acres of a 17.732 acre parcel.
12. Special Permit SP-2012-7 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kilauea, Kaua'i, approx. 1,500 ft. west of the
Kilauea Lighthouse Road and Kauapea Road intersection, further identified as
Tax Map Key 5-2-4: 63, with a parcel size of 9.084 acres.
13. Special Permit SP-2012-8 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Seacliff Plantation, Kilauea, Kaua'i, approx. 2,700
ft. east of the Iwalani Land and Palimoana Road intersection, further identified
as Tax Map Key 5-2-4: 96 (Unit A), with a unit size of 3.0 acres of a 11.0 acre
parcel.
14. Special Permit SP-2012-9 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihiwai, Kaua'i, approx. 200 ft. east of the Old
Kuhi`6 Highway and Anini Road intersection, further identified as Tax Map Key
5-3-3: 43, with a parcel size of 5.0 acres.
15. Special Permit SP-2012-10 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kilauea, Kaua'i, within 50 ft. of the western
terminus of Kauapea Road, on the makai side, further identified as Tax Map
Key 5-2-5: 34, with a parcel size of 5.06 acres.
16. Special Permit SP-2012-11 to permit use of an existing single family
residence #2 for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kilauea, Kaua'i, within 50 ft. of the western
terminus of Kauapea Road, on the makai side, further identified as Tax Map
Key 5-2-5: 34, with a parcel size of 5.06 acres.
17. Special Permit SP-2012-12 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihiwai, Kaua'i, approx. 1,850 ft. northwest of
the Old Kuhi`6 Highway (aka Kalihiwai Road) and Kuhi`6 Highway intersection,
further identified as Tax Map Key 5-2-10: 21 (Unit B), with a unit size of 2.0
acres of a 5.050 acre parcel.
18. Special Permit SP-2012-14 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in West Waiakalua, Kaua'i, approx. 3,000 ft. south of
the Wailapa Road and Kuhi`6 Highway intersection, further identified as Tax
Map Key 5-1-5: 122 (Unit A), with a unit size of 1.33 acres of a 7.050 acre
parcel.
19. Special Permit SP-2012-26 to permit use of an existing single family
residence for Transient Vacation Rental purposes as permitted by County of
Kaua'i Ordinance No. 904, in Kalihiwai Ridge, Kaua'i, approx. 2,000 ft.
southwest of the Kaliliholo Road and Kuhi`o Highway intersection, further
identified as Tax Map Key 5-2-17: 24 (Unit B), with a unit size of 4.896 acres of
a 25.951 acre parcel.
All interested persons may present testimony for or against any
application as public witnesses. Such testimony should be made in writing and
presented to the Commission prior to the public hearing. Late written
testimony may be submitted up to seven (7) days after the close of the public
hearing in cases where the Commission does not take action on the same day
the hearing was held.
Any party may be represented by counsel if he or she so desires. In
addition, individuals may appear on their own behalf, a member of a
partnership may represent the partnership, and an officer or authorized
employee of a corporation or trust or association may represent the
corporation, trust or association.
Petitions for intervenor status must be submitted to the Commission and
the applicant at least seven (7) days prior to the date of the hearing advertised
herein and shall be in conformance with Chapter 4 of the Rules of Practice and
Procedure of the Planning Commission.
Proposed plans and the Rules of Practice and Procedure of the Planning
Commission are available for inspection at the Planning Department which is
located at 4444 Rice Street, Lihue, Kauai.
