LIHUE, KAUAI
NOTICE IS HEREBY GIVEN, of a public hearing to be held by the
Planning Commission of the County of Kauai at its regular meeting at the
Lihue Civic Center, Mo'ikeha Building, Meeting Rooms 2A-2B, 4444 Rice
Street, Lihue, Kaua'i on Tuesday, July 24, 2012 starting at 9:00 a.m., or soon
thereafter to consider under the provisions of Chapter 8 of the Kauai County
Code 1987, as amended, the following:
1. Request to amend Ordinance No. PM-175-88 (Zoning Amendment ZA-
88-7) to utilize additional income requirements for employee housing
and reduce the number of employee housing units required for the
original rezoning and expansion of the Princeville Shopping Center on
a property located on the makai side of Kuhi`6 Highway, approx. 1,500
ft. east of the Kuhi`6 Highway and Hanalei Plantation Road
intersection and approx. 500 ft. east of the Kuhi`6 Highway and
Kahaku Road intersection, Princeville, Kaua'i, further identified as
Tax Map Key 5-4-005: 031, 048, 049 and 5-4-006: 014 and containing a
parcel area of 17.9 acres.
2. Zoning Amendment ZA-2012-6, Change from Open District (0) to
Residential District (R-1)/Special Treatment-Public (ST-P), located
immediately adjacent to the Department of Water office/baseyard
facility in Li-hu'e, along its western boundary, at the Hala
Road/Kaumuali`i Highway intersection, further identified as Tax Map
Key 3-8-005: Por., and containing a total area of 2.585 acres.
All interested persons may present testimony for or against any application
as public witnesses. Such testimony should be made in writing and presented
to the Department of Planning prior to the public hearing. Late written
testimony may be submitted up to seven (7) days after the close of the public
hearing in cases where the Planning Commission does not take action on the
same day the hearing was held.
Any party may be represented by counsel if he or she so desires. In
addition, individuals may appear on their own behalf, a member of a
partnership may represent the partnership, and an officer or authorized
employee of a corporation or trust or association may represent the corporation,
trust or association.
Petitions for intervenor status must be submitted to the Commission and
the applicant at least seven (7) days prior to the date of the hearing advertised
herein and shall be in conformance with Chapter 4 of the Rules of Practice and
Procedure of the Planning Commission. Chapter 4 of the Rules of Practice and
Procedure of the Planning Commission relating to intervention does not apply
to General Plan, Zoning or State Land Use District Boundary Amendments and
Rule Making Procedures before the Commission.
Proposed plans and the Rules of Practice and Procedure of the Planning
Commission are available for inspection at the Planning Department which is
located at 4444 Rice Street, Lihu'e, Kaua'i.
