Chong Tim; Sergeants Chris Calio and Colin Nesbitt; Officer Hanson Hsu Excused Commissioner Donald Okami Sr. Absent SUBJECT DISCUSSION ACTION Call To Order Chair O'Connor called the meeting to order at 9:15 a.m. Approval of Regular Open Session Minutes of July 26, 2013 Commissioner Kanekoa moved to approve the Minutes meeting minutes as circulated. Commissioner Chair O'Connor called for a motion to approve the minutes as circulated. Chiba seconded the motion. Motion carried 6:0 Employee Reading the recognition for Officer Hansen Hsu was Sergeant Colin Recognition Nesbitt Sergeant Nesbitt stated that during the month of June, Officer Hsu issued a total of 159 citations of which 81 were moving violations. In addition, Officer Hsu initiated 12 investigations related to individuals operating a vehicle under the influence of a toxicant. The investigation resulted in the arrest of 12 individuals on a total of 20 related charges. Reading the recognition for Sergeant Chris Calio was Deputy Chief of Police Michael Contrades. Deputy Chief Contrades stated that from December 31, 2012, to July 12, 2013, Sergeant Calio was tasked with the position of Acting Lieutenant in the training and management of the Kauai Police Commission Regular Meeting Minutes -Open Session August 23, 2013 Page 2 SUBJECT DISCUSSION ACTION largest recruit class in the history of the Kauai Police Department. Sergeant Calio's leadership skills and can -do attitude resulted in one of the best graduation recruit classes to date. And with the implementation of several progressive programs, Sergeant Calio was able to create a higher level of professionalism, which will become the new standardized practice for future recruit classes. Chief Perry presented the officers with a Certificate of outstanding and exemplary service to the community on behalf of the citizens of Kauai and members of the Kaua'i Police Department. Commendation There were a three letters of commendation involving one officer and the Report entire Kauai Police Department. Lt. Zach Perron from the City of Palo Alto Police Department wrote to thank Detective Shane Sokei for his assistance and support in a parental abduction case. Ms. Amy Sterry from Make a Wish Foundation wrote to thank Chief Perry and the Kauai Police Department for providing an incredible experience to help make a child's wish come true. County Clerk Ricky Watanabe wrote in appreciation and gratitude to Chief Perry and the Kauai Police Department for providing assistance during the Public Hearing on Bill No. 2491. Chiefs Monthly 1. Personnel Orders 7. Chief Announcements and Pertinent Updates • Chief Perry announced the retirement of 911 Dispatcher Nancy Tanabe at the end of the month. Ms. Tanabe was a great contributor with over 25 plus years of service in the Kauai Police Department. • The Waimea substation will be having its grand opening on Monday, August 26, 2013. Chief Perry encouraged the Commissioners to attend. • Chief Perry stated that due to the high volume of traffic he advised the public to exercise caution and patience when going to the County of Kaua'i Farm Bureau Fair. • Chief Perry announced that the HIDTA (High Drug Trafficking Area Agency) wanted the public to be aware of a deadly new synthetic drug that is out in the market called "Crazy Clown ". He stated that in Brunswick, New Jersey, eight people were sent to the hospital with life threatening symptoms which included nausea, vomiting, dry mouth, weakness and cardiac problems. Communications KPC 2013 -13 Invitation from the Kauai Police Department to attend a dedication of the New Waimea sub - station (Old Waimea Dispensary on Commissioner Kanekoa moved to receive item Monday, August 26, 2013 at 1:00 p.m. KPC 2013 -13 for the record. Commissioner Francisco seconded the motion. Chair O'Connor called for the motion to receive item KPC 2013 -13. Motion carried 6:0 KPC 2013 -14 Copy of a communication dated August 2, 2013 from County Clerk Ricky Watanabe to Chief Darryl Perry, thanking the Police Department for providing g ecurity and support during the County Council's Public Hearing on Bill No. 2491. Chair O'Connor called for the motion to receive item KPC 2013 -14 for the Kauai Police Commission Regular Meeting Minutes -Open Session August 23, 2013 Page 4 SUBJECT DISCUSSION ACTION record. Commissioner Kanekoa moved to receive item KPC 2013 -14 for the record. Commissioner Nebre seconded the motion. Motion carried 6:0 Business KPC 2013 -16 Public announcements for a Police Commission notarized complaint KPC 2013 -010 that was filed against an officer of the Count. For the record, Chair O'Connor read the public announcement for complaint KPC No. 2013 -010. Complaint filed on June 24, 2013 alleges that an officer of the County disregarded the law by refusing to accept the complainant's Discharge of Sureties. The complaint also alleges that the Officer prevented the complainant from obtaining warrant information from the cell block. Based on its findings, the Commission found that the complaint alleging that the officer's disregard of the law has been resolved internally and the complaint was not sustained. In the matter of preventing the complainant from obtaining warrant information by contacting the cell block, the Commission has forwarded the matter to the Office of the Chief for further review and investigation if deemed necessary. This officially concluded the Commission's review of complaint KPC No. 2013 -010. Announcements Next meeting — September 27, 2013, at 9:00 a.m. at the Mo'ikeha Building, in Meeting Room 2A /213 followed by Executive Session. Executive At 9:40 a.m. Vice Chair Iona cited the Hawaii Revised Statutes to bring Session the meeting into Executive Session. ES -33: Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive Session is for the Commission to consult with its attorney as to the powers, duties, privileges, immunities, and liabilities as Kauai Police Commission Regular Meeting Minutes -Open Session August 23, 2013 Page 5 SUBJECT DISCUSSION ACTION they may relate to a Declaratory Action to determine the powers of the Mayor and the powers of the Police Commission. (On- going) ES -031: Pursuant to the Hawai'i Revised Statutes §92 -4, §92 -5 (a) (4), §92 -9 (a) (1- 4) and (b), the purpose of this Executive Session is to receive and approve the following Executive Session minutes and to consult with its attorney as to the powers, duties, privileges, immunities, and liabilities of the Commission as they may relate to this item, and to deliberate and take such actions deemed appropriate. ES -032: Pursuant to the Hawai'i Revised Statutes §92 -4 and §92 -5 (a) (2) and (4), the purpose of this Executive Session is to consider the evaluation, dismissal or discipline of an employee or officer of the County relating to a complaint filed against and employee or officer and to consult with the Commission's legal counsel on issues pertaining to the Commission's and the County's powers, duties, privileges, immunities, and /or liabilities as they may relate to action taken, resolution or further steps required concerning a Report of Investigation on Issues in the Kaua'i Police Department for the County of Kaua'i dated June 28, 2012. Chair O'Connor called for a motion to enter into Executive Session. Commissioner Kanekoa moved to enter into Executive Session. Commissioner Nebre seconded the motion. Motion carried 6:0 At 9:43 a.m. the Commission entered into Executive Session. Kauai Police Commission Regular Meeting Minutes -Open Session August 23, 2013 Page 6 SUBJECT DISCUSSION ACTION Return to Open At 10:30 a.m. the meeting reconvened in Open Session. Chair O'Connor Commissioner Kanekoa moved to ratify the Session to ratify called for a motion to ratify the actions taken in Executive Session. actions taken in Executive Session for items ES- the actions taken 33, ES -031, and ES -032. Commissioner Chiba in Executive seconded the motion. Session Motion carried 6:0 ES -33. On -going ES -031: Motion carried 6:0 to approve the Executive Session minutes as circulated. ES -032: Motion carried 6:0 to receive the item for the record. Adjournment Chair O'Connor called for a motion to adjourn the meeting. Vice Chair Iona moved to adjourn the meeting. Commissioner Kanekoa seconded the motion. Motion carried 6:0 At 10:30 a.m. the meeting adjourned.
