Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of
the Mayor and the powers of the Police Commission (On- going)

Reading the recognition for Officer Hansen Hsu was Sergeant Colin
Recognition
Nesbitt
Sergeant Nesbitt stated that during the month of June, Officer Hsu issued a
total of 159 citations of which 81 were moving violations. In addition,
Officer Hsu initiated 12 investigations related to individuals operating a
vehicle under the influence of a toxicant. The investigation resulted in the
arrest of 12 individuals on a total of 20 related charges.
Reading the recognition for Sergeant Chris Calio was Deputy Chief of
Police Michael Contrades. Deputy Chief Contrades stated that from
December 31, 2012, to July 12, 2013, Sergeant Calio was tasked with the

position of Acting Lieutenant in the training and management of the
largest recruit class in the history of the Kauai Police Department.
Sergeant Calio's leadership skills and can -do attitude resulted in one of the
best graduation recruit classes to date. And with the implementation of
several progressive programs, Sergeant Calio was able to create a higher
level of professionalism, which will become the new standardized practice
for future recruit classes.
Chief Perry presented the officers with a Certificate of outstanding and
exemplary service to the community on behalf of the citizens of Kauai and
members of the Kauai Police Department.
Commendation
There were a three letters of commendation involving one officer and the

entire Kauai Police Departrnent.
Lt. Zach Penn from the City of Palo Alto Police Department wrote to
thank Detective Shane Sokei for his assistance and support in a parental
abduction case.
Ms. Amy Sterry from Make a Wish Foundation wrote to thank Chief Perry
and the Kauai Police Department for providing an incredible experience to
help make a child's wish come true.
County Clerk Ricky Watanabe wrote in appreciation and gratitude to Chief
Perry and the Kauai Police Department for providing assistance during the
Public Hearing on Bill No. 2491.

• Chief Perry announced the retirement of 911 Dispatcher Nancy
Tanabe at the end of the month. Ms. Tanabe was a great
contributor with over 25 plus years of service in the Kaua' i Police
Department.
• The Waimea substation will be having its grand opening on
Monday, August 26, 2013. Chief Perry encouraged the
Commissioners to attend.
• Chief Perry stated that due to the high volume of traffic he advised
the public to exercise caution and patience when going to the
County of Kauai Farm Bureau Fair.
• Chief Perry announced that the HIDTA (High Drug Trafficking
Area Agency) wanted the public to be aware of a deadly new
synthetic drug that is out in the market called "Crazy Clown ". He
stated that in Brunswick, New Jersey, eight people were sent to the
hospital with life threatening symptoms which included nausea,
vomiting, dry mouth, weakness and cardiac problems.

Business
KPC 2013 -16 Public announcements for a Police Commission notarized
complaint KPC 2013 -010 that was filed ag_zinst an officer of the County.
For the record, Chair O'Connor read the public announcement for
complaint KPC No. 2013 -010.
Complaint filed on June 24, 2013 alleges that an officer of the County
disregarded the law by refusing to accept the complainant's Discharge of
Sureties. The complaint also alleges that the Officer prevented the
complainant from obtaining warrant information from the cell block. Based
on its findings, the Commission found that the complaint alleging that the
officer's disregard of the law has been resolved internally and the
complaint was not sustained. In the matter of preventing the complainant
from obtaining warrant information by contacting the cell block, the
Commission has forwarded the matter to the Office of the Chief for further
review and investigation if deemed necessary. This officially concluded
the Commission's review of complaint KPC No. 2013 -010.

Notes to Budget Summary
For the Period July 2013
The Budget Status Report for July 2013 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2014 is currently at 11`Yo at the 8% of
year lapsed point,
The year -to -date expenditures for the Chiefs Office is currently at 10%. Administrative and
Technical Bureau is reflecting 21 %, Investigative Service Bureau is reflecting 15% and Patrol
Service Bureau is reflecting 25% of budget expended.
For the most part, the department's first month of activities are encumbrances that rolled over
from last fiscal year to be completed in this fiscal year. The main expenditures to date are
payroll, overtime and associated fringe benefits. Chief's Office expenditure to date is
2,081,197.82 of which 2,077,119.34 is Salaries, Overtime, Premium Pay and Fringe Benefits.
The department acknowledged the drastic reduction in overtime requested due to budgetary
constraints in FY 14, therefore, KPD is monitoring all payroll spending each pay period and
making changes in operations to minimize costs without a lot of disruption to services to the
community. This is an on -going challenge for the department this fiscal year.

INVESTIGATIONS
TERRORISTIC THREATENING
To prevent death or serious bodily injury, KPD patrol officers fired their weapons at a 21
year old Kalaheo man. This incident occurred in-the vicinity of the Nawiliwibi sea wall
during a confrontation with four police officers in which the male subject pointed a
firearm toward the officers and did not comply with the officer's demands to drop his
weapon. The man died following the shooting. The officers involved in this incident
were placed on a mandatory three day administrative leave but has since returned to work
in a non - uniformed capacity as this investigation continues.
SEXUAL ASSAULT
A 32 year old female was arrested and charged with 7 counts of sexual assault in the first
degree after investigation revealed that the female engaged in sexual acts with a male
juvenile. The female was arrested and booked and is currently being held at KCCC.
A 19 ,year old male subject was arrested and charged with 12 counts of sexual assault in
the 1 degree after investigation revealed that the male subject sexually assaulted a 13
year old female acquaintance. The male subject is currently being held at KCCC.
BURGLARY
A 31 year old male subject from Kalaheo was arrested for burglarizing a vacation rental
in Poipu. During this investigation several search warrants were prepared and executed.
The male subject was later released pending further investigation.
KPD SENSITIVE
UCPV / ABUSE OF FAMILY &/OR HOUSEHOLD MEMBER
A 28 year old male subject from Princeville was arrested for UCPV and Abuse of a
Family and/or Household member after investigation revealed that the male subject
operated his girlfriend's vehicle without permission and later assaulted his girlfriend
during a confrontation about the unauthorized use of her vehicle. The male subject was
released after posting bail.

A 48 year old male subject from Lihue was arrested for Theft in the 2na Degree after
investigation revealed that the subject was posting items for sale on Craig's List, .
receiving money for the posted items but never delivering and making good to potential
buyers. The male subject was released pending further investigation.
PROMOTING MINOR PRODUCED SEXUAL IMAGES 1ST DEGREE
Female juvenile brought up a concern regarding an adult male having her take
nude photographs and message them to him via Face Book. This investigation resulted in
the search warrant of a home in Anahola, and the seizure of an iphone, a computer, and
several SD cards from that home. There may be other victims. The investigation is still
ongoing.
SAFE KEEPING:
It is alleged that a 46yr old male suspect shipped in guns without registering them,
via placing them in with a crated Motorcycle. This case is still under investigation.
PROMOTING CHILD PORNOGRAPHY (CYBER TIP1842498):
Per a cyber -tip, it appears that someone is viewing, and posting Child porn via
tumbler on Kauai. The investigation is ongoing.

A. 08105113: Lihue District Officers assigned to monitor protestors in support of
and against Bill 2491 at the Historic County Building.
B. 08106113: Officers from Plt. 1 conducted Operation " Hanamaulu Squeaky
Clean". Officers made a sweep on the Moody properly .adjacent to the
Hanamaulu Beach Park for illegal squatters and to issue written warnings to
vacate the property.
C. 08113/13: Officers from Plt. 1 conducted the second phase of Operation
" Hanamaulu Squeaky Clean ". Another sweep was done on the Moody property
to try and locate illegal squatters. No one was located.

II. SPECIAL OPERATIONS
A. During this month, officers on all shifts were tasked to
address complaints of trespassers near and around
Kamehameha pre - school and adjacent church. This was
possibly associated to homeless concerns and possible
drug dealing. The continuous checks resulted in no
further calls or complaints.
B. Another area of concern was the Hanalei Pavilion and
usage by homeless making a home out of the facility.
Officers towed away cars, made checks during all shifts
and arrested anyone in violation or wanted for warrants.
After continued efforts, less homeless are congregating
there, but area will need continued attention.
C. "Operation Second ", an Impaired Driver project was
conducted on August 27, 2013 between 1900 -2200 hours
fronting Princeville Airport. 5- Officers participated
and 21 citations for traffic violations were issued; no
OVUII arrests were made during the operation.

D. officers continue to monitor the parking on Lehua Street
for violations that cause unsafe travel, especially near
the Huluili road junction.

B.O.L.O. or "Be On the Look Out" is a method used to notify police personnel of an outstanding
want for arrest or to help with locating a missing person. The following shall be adhered to:
1. A B.O.L.O. for arrest shall be initiated the same day probable cause is established for an
arrest and shall be submitted by the investigating officer for approval prior to completion
of his or her shift.
2. No arrest shall be made on a B.O.L.O. that is older than 10 calendar days from the day
the B.O.L.O. is initiated (The day that it is initiated counts as day 1).
3. Prior to the I CP calendar day, if the suspect is not located and arrested, the investigating
officer shall complete a warrant of arrest.
4. All B.O.LO. for arrest shall automatically expire on the 10th day.
5. If an arrest is made, the arresting officer shall be responsible for the closure of the
B.O.LO.
6. A B.O.L.O. shall not be used as a follow up request.
7. A B.O.L.O. may be used to locate a missing person.
8. A missing person B.O.L.O. shall not have an expiration date.
9. When a missing person is located, the officer who verifies the location of the missing
person shall be responsible for the closure of the B.O.L.O.

FBI NATIONAL ACADEMY RECRUITMENT
The FBI National Academy (FBINA) is a professional course of study for U.S. and international
law enforcement leaders that serves to improve the administration of justice in police
departments and agencies at home and abroad and to raise law enforcement standards,
knowledge, and cooperation worldwide.
Its mission is "to support, promote, and enhance the personal and professional development of
law enforcement leaders by preparing them for complex, dynamic, and contemporary challenges
through innovative techniques, facilitating excellence in education and research, and forging
partnerships throughout the world."
For 10 classroom -hour weeks, four times a year, classes of some 250 officers take undergraduate
and/or graduate college courses at our Quantico, Virginia, campus in the following areas: law,
behavioral science, forensic science, understanding terrorism/terrorist mindsets, leadership
development, communication, and health/fitness. Officers participate in a wide range of
leadership and specialized training, and they share ideas, techniques, and experiences with each
other, creating lifelong partnerships that span state and national lines.
The Kauai Police Department will send one candidate in 2014/2015 of the rank of Lieutenant
and above. The candidate must be willing to serve a minimum of three more years within the
department and meet the FBI's National Academy Selection Criteria (refer to attached).
Lieutenants and above who are interested in attended the FBINA shall submit a memorandum
via the chain of command, stating their interest, to the Chief of Police by October 1st, 2013. In
the memorandum applicants must describe the reason for their desire to attend and what they
hope to gain from attending.

FBI National Academy Selection Criteria
Candidates must:
Be at least 25 years of age (no maximum age),
2. Be a high school graduate or have equivalency (approximately 213 of NA attendees have
some college experience),
3. Have at least 5 years "substantially continuous" experience as a full -tame, sworn police
officer,
4. Be nominated by the current head of his/her law enforcement agency (an elected sheriff
may be self- nominated; chief of police may be nominated by city /town manager or other
authority to whore he reports),
5: Be of good character and reputation and pass a background investigation conducted by
the local FBI field office,
6. Pass a medical/fitness exam and be certified by the FBI Academy Health Services office
as being fit for strenuous pbysical activity (weight must fall within standards set out on
thebeiebt/Weieht chart and body fat standards must bagM,
7. Hold a rank that makes the candidate a "policy maker" in his/her department or agency
(usually lieutenant or above, unless unusual circumstances warrant a sergeant being
nominated),
8. Not be a member of a foreign intelligence agency,
9. Be proficient in English,
10. Have medical insurance coverage,
11. Agree to continue in law enforcement a minimum of 3 years following graduation from
the NA.
12. Intend to remain active in the NA Associates, the membership of which is composed of
NA graduates,
13. Apply through an FBI field office or Legat.

I am recommending that the Police Commission explore the possibilities of salary adjustments for both
the Chief and Deputy Chiefs position to off -set current and future inversion pay discrepancies. As you
know SHOPO, through arbitration, was awarded salary increases, coupled with increases in Standard of
Conduct Differential, Firearm Allowance, and Uniform Allowance (exact amounts are pending).
SHOPO's awards are normally piggy- backed by Police Excluded Managerial positions (Assistant Chiefs
and Captains) to create a reasonable separation of rank - compensation and to stop the negative effects
of salary inversion for upper management. Below are the projected percentage pay raises for Assistant
Chiefs and Captains:

RESOLUTION AMENDING RESOLUTION NO. 2012-1 RELATING TO THE SALARIES
OF CERTAIN OFFICERS AND EMPLOYEM OP THE COUNTY OF KAUAI
WHEREAS, the Salary Commission wishes to balance the need for fiscal responsibility
with concerns for public safety; now therefore,
BE IT RESOLVED by the Salary Commission of the County of Kauai, State of Hawaii,
that the Salary Commission hereby resolves to amend Resolution No. 2012 -1 as follows:
L Article 1, Salaries of certain Administrative Officers and Employees, subsection (b) is
amended to increase the maximum salaries payable to the officers listed below effective
7/1/2012:

2. Except as expressly amended herein, Salary Resolution 2012 -1 shall remain in full
force and effect.
BE IT FINALLY RESOLVED, the County Cleric shall transmit to the Salary
Commission, Mayor, Finance Director, and Personnel Director a final approved copy of
the resolution and note any amendments thereto within duty (30) days after the effective
date of this resolution.
