Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of
the Mayor and the powers of the Police Commission (On- going)
ES -020:
Pursuant to Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a communication dated May 2, 2013 from Deputy
Chief of Police Michael Contrades to Chair James R. O'Connor and Members of the Kauai Police
Commission, regarding a request to conduct an Investigation for Departmental Transparency.
ES -021:
Pursuant to Hawai'i Revised Statutes §92 -4, §92 -5 (a) (4), §92 -9 (a) (1 -4) and (b), the purpose of
this Executive Session is to receive and approve the following Executive Session minutes and to
consult with the Commission's legal counsel on issues pertaining to the Commission's and the
County's powers, duties, privileges, immunities, and/or liabilities as they may relate to these
items, and to deliberate and take such actions deemed appropriate:

Complaint filed on April 16, 2013 alleges that the conduct of an officer of the County was
unprofessional by unnecessary use of force.

Complaint filed on April 19, 2013 alleges conflict of interest on part of the officer who wrote the
police report that involved the complainant and two of the officer's family members.
ES -024: KPC 2013 -008
Complaint filed on April 22, 2013 alleges that an officer of the County was disrespectful, rude
and failed to obtain the complainant's statement of what occurred.

Pursuant to Hawaii Revised Statutes, ( "H.R.S. ") §92 -7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall beheld
pursuant to H.R.S. §92 -4 and shall be limited to those items described in H.R.S. §92 -5(a).

Recognition
Employee of the month for April: Detective James J. Miller
Detective James Miller was recognized by Acting Captain Randolph
Chong Tim for his leadership in the investigation of a murder that took
place in December 2010. A/C Chong Tim stated that with no prior
investigative experience, Detective Miller continued to work many long
days and nights pushing for the truth while facing many obstacles. In
March 2013, the jury found the defendant guilty of murder in the first -
degree and now faces a life sentence.

Chief Perry presented Detective Miller with a Certificate of Recognition
for his outstanding and exemplary service as the lead investigator in a
murder investigation that resulted in a guilty conviction of the defendant.
Commendation
There was three letters of commendations received involving four

personnel in the Kauai Police Department.
Ms. Fern Rosenstiel of Ohana O' Kauai wrote in appreciation for the
assistance they received in response to questions and concerns in
preparation for a demonstration in Poipu.
Mr. and Mrs. Glenn Akina wrote in gratitude for the effort, comfort and
support that was received during a difficult time.
Ms. Stephanie Angignoli wrote commending Acting Captain Dan
Miyamoto and Mr. Yamaguchi for their diligence and expediency in which
they handled their request.

• Kauai Police Department's 411 Tip Program gives the public the
opportunity to view where crimes are taking place and that they can
submit the information directly to KPD via the website. In
addition, KPD has a website where the public can report a

• For the month of April KPD will be enforcing its distracted driving
campaign
• The month of April is the campaign for the National Prescription
Drug Take Back. The public is encouraged to drop of any illegal
drugs or prescription drugs on Saturday, April 27h from 10:00 a.m.
to 2:00 p.m. at the Kauai Police Department.
Communications
KPC 2013 -06 Copy of a communication dated March 19, 2013 from
Council Jay Furfaro to County AttoMey Alfred Castillo Jr., regarding a
request for a status report as to the hiring of a Deputy County Attorney for
the Kauai Police Department.
Ms. Winn had the pleasure of introducing Nicholas Courson as the new
Deputy County attorney assigned to the Police Department. Mr. Courson
shared with the Commission that he was born in Waimea and raised in
Kalaheo until the age of ten, he moved to the mid -west where he received
his education at Michigan State University and John Marshall Law School
in Chicago where he lived and worked for eight years before moving to
Oahu in April 2012. Mr. Courson stated how excited he was to be working
for the Kauai County Attorney's office and his assignment to KPD.
Commissioner Francisco thanked Mr. Courson for being part of the team
but mostly because he has chosen to return to Kauai which only affirms the
message that with college education goals can be achieved.
Vice -Chair Iona asked Mr. Courson whether his previous work experience
in Chicago dealt with any type of law enforcement issues. Mr. Courson
stated that he was involved in a different kind of practice that dealt with the
government but from the private side.

Chair O'Connor pointed that one of top priorities of the Chief is the on-
going process for accreditation in the Kauai Police Department. He noted
that the Police Commission fully supports the department's efforts and is
anticipating his full support as well.

Business
KPC 2012 -52 Discussion on the logistics of the State of Hawaii Police
Commissioners Conference hosted by the Kauai Police Commission in
May 2013. (On-going)
Commissioner Francisco stated that forty participates is confirmed to
attend the State conference in May. He indicated that at its last meeting,
the subcommittee was working on finalizing the conference theme and
once that was settled they would be able to pinpoint the individuals to lead
certain discussions. Commissioner Francisco informed the Commission
that he had suggested including in the program a panel consisting of
Commissioners that have attended a NACOLE conference. He explained
that the session would be an open discussion on the types of issues that
each County Commissions as well as other Commissions across the
country face within their respective police departments and how to
effectively address them.
Commissioner Francisco stated that the accommodations for conference
are confirmed at the Aston Aloha Beach Hotel and that he was informed by
Staff that for those Commissioners who wanted to stay at the hotel for the
duration of the conference that their rooms would not be covered.

Commissioner Francisco informed the Commissioner's that the
subcommittee is working on obtaining gifts items for each of the
conference attendees and that he had secured a sponsor to cover a portion
of the cost for the welcome reception and will work on securing others
sponsors as well. He indicated that most of the organizations that he had
contacted felt especially challenged because there are eleven fundraisers
taking place in May. He suggested that the Commission allocate a portion
of the funds in the budget to cover the reception cost.
Chair O'Connor stated that because of budgetary constraints everything has
scaled down. He thanked Commissioner Francisco for the report noting
that it was not an easy task. He indicated that there was a spot open for one
more guest speaker and that they are working diligently to fill that spot as
soon as possible.
KPC 2013 -04 Review of the Kauai Police Department's policies and
procedures. (On- going)
Vice Chair Iona reported that the subcommittee held several meetings with
Deputy Chief Contrades in reviewing the policies and procedures in the
Kauai Police Department. He stated that with the on -going accreditation
process it was found that the policies and procedures that is currently in
place is within law enforcement industry standards and that there was
nothing to alter from what the other departments are doing. He indicated
that majority of the policies is based on the size of the police department
and in reviewing the policies they seemed pretty solid.
Vice Chair Iona stated that as the department continues with the
accreditation process there maybe changes made to further what the
requirements of CALEA would be but as of now, he doesn't see anything

that would cause him to have grave concerns or expediency to change the
current policies and procedures.
Commissioner Francisco asked Chief Perry if he had additional comments
to as it relates to the policies and procedures as the department continues to
undergo the accreditation process.
Chief Perry commented that he agrees with Vice Chair Iona that the
policies and procedures are in sync with County standards and based on his
preliminary research, CALEA has certain requirements in which the Kauai
Police Department is within compliance but it's a matter of having it
reviewed by Deputy County Attorney Courson before they can move
forward. He also indicated that based on his research he does not see any
issues concerning the department's policies and procedures in terms of
EEOC, hostile work environment, and discrimination.
Commissioner Francisco asked whether there is a cycle that occurs with the
accreditation process and whether that would become a standard practice.
Chief Perry stated that the practice is based on an as needed basis and
prioritizing changes along the way because the law enforcement industry is
fluid and always changing. He indicated that KPD does not have a set
timeframe or a system in place to review old policies but is looking into
installing a new program that would bring up red flags to indicate that a
review is needed and should the industry standards change, the department
would be notified by CALEA to review those changes and be reconfirmed
by the Deputy County Attorney.
Commissioner Francisco acknowledged and extended his appreciation to
Chief Perry and members of his senior staff for their attendance at the
Kauai Chamber of Commerce Annual Law Seminar last fall.

He mentioned that the Chief s presence shows his commitment and desire
to ensure (especially in the field of employment law) that the department is
current with its affairs even while faced with continuous challenges.
Vice Chair Iona commented that if all things were made in heaven the
police department could put out as many policies as it needs to address
every issue but when it comes to law enforcement one cannot anticipate
how things will happen and as time goes by issues can be brought to the
forefront which would call for old policies to be deleted and new policies
added. But right now, everything seems to be pretty solid and that he could
foresee changes taking place further down the road.
Chair O'Connor stated that it is anticipated that the subcommittee will have
to meet at least a few more times with the department on this matter so
rather than having this as an on -going agenda item he's been advised by
counsel that it would not be necessary to keep this as an on -going item and
that the Commission could wait for the final report from the subcommittee
and place it on the agenda as a new item.

Complaint filed on March 13, 2013 alleges that the conduct of an officer of
the County was unprofessional by mistreating the complaint during an
arrest.

Complaint dated on March 21, 2013 alleges that while trying to obtain a
status report on a theft case an officer of the County told the complainant
that there was no status to report.
ES -019: KPC 2013 -005
Complaint filed April 1, 2013 alleges that an officer of the County failed to
serve court documents to a defendant that resulted in a continuance of a
court hearing that could have been avoided.

Notes to Budget Summary
For the Period March 2013
The Budget Status Report for March 2013 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for Fiscal Year (FY) 2013 is currently at
73% at the 75% of year lapsed point.
The year -to -date expenditures for the Chief's Office is currently at 75 %. Administrative and
Technical Bureau is reflecting 56 %, Investigative Service Bureau is reflecting 39% and Patrol
Service Bureau is reflecting 77% of budget expended. Kauai Police Department (KPD)
continues to operate within budget and will continue to monitor all expenditures closely through
the fiscal year.
The County of Kaua'i FY2014 budget process began back in September 2012 and the current
draft budget for KPD and its comparison to our current FY2013 budget is as follows:

false appearance of an increased budget for the upcoming fiscal year. Although the draft budget
increased by 1 %, many reductions to operating expenditures were sacrificed so basic necessities
such as replacing aged vehicles could be considered for the FY2014 budget.

INVESTIGATIONS
CRIMINAL PROPERTY DAMAGE:
MISSING PERSON
A 57 year old male, homeless of Kapaa was reported missing. He had left
Kauai to Oahu and was to return in couple of days after leaving. He was
filling a prescription for pain medications. Phone calls to his cell go straight
to voice mail. The reporting person believes that he might have been
robbed. He has no family in the State and has not made contact since the
report was filed.
BURGLARIES
There were fourteen residential burglaries and six non - residential burglaries
reported for the Kalaheo/Lawai areas; five residential burglaries and five
non - residential burglaries for the Koloa/Poipu areas. Jewelry, money,
electronics, coins/collectables and other items had been stolen. There are
several persons of interest being looked at as possible suspects involved in
these crimes.
Operation Spring Cleanup was executed between April 24 -25, 2013.
Although no arrests were made, six (6) possible suspects were identified to
be responsible for over a dozen business Burglaries in the Kapaa - Lihue -Puhi
areas.
KPD SENSITIVE
HOAUCIDE
KAPAA — On Friday April 261 2013, Detectives investigated a suspicious
death of a 21- year -old Kapa`a woman. The woman was found in her room
at the Kawaihau Sorts Villa condominium at around 2:30 p.m. Friday. On
Saturday April 27 , Detectives arrested Steven Michael Wilson, age 26 of
Kapaa for 2nd Degree Murder. An Autopsy conducted on Monday April 291h
revealed that the woman, identified as Kendra Lewis, died as a result of
stabs wounds. Steven Michael Wilson was living with Lewis at the time of
her death, as both subjects relocated to Kauai from Alaska in the beginning
of the year. Wilson was charged with 2nd Degree murder and is being held
in lieu of $1 million bail.
SEX ASSAULTS
On Thursday, April 11, 2013, I was assigned to investigate the sexual assault
of a 4 year old female. The suspect is alleged to be her 9 year old step
brother who was visiting them from the mainland. I interviewed the victim
at the children's Justice Center, but was not able to interview the suspect as
he had already returned to the mainland.
ELEELE:
On Sunday, April 14, 2013, detectives investigated sexual assault of a 6 year
old female who reported that her mother's boyfriend touched her vagina.
The child and her brother were interviewed at the Children's Justice Center
and they had different accounts of happened on that day. The case was
forwarded to the Prosecutor's Office for review.
DEATH RELATED REPORT
On Monday, April 29, 2013, Report of an unattended death of a 60 year
local male who lived alone in his residence. The subject had been dead for
several days and was in the advance stages of decomposition. He was
identified by his fingerprints and the autopsy found that he died from a
stroke.

DRUG BUYS
Controlled purchase of 3.5 grams of cocaine from a known target in the
Lihue District.
Controlled purchase of .7 grams of crystal methamphetamine from a
known target in the Lihue District.
Controlled purchase of .5 grams of crystal methamphetamine from a
known target in the Lihue District.
Controlled purchase of 2.1 grams of crystal methamphetamine from a
known target in the Waimea District.
Controlled purchase of 5.9 grams of crystal methamphetamine from a
known target in the Waimea District.
Controlled purchase of 3.1 grams of cocaine from a known target in the
Lihue District.
Controlled purchase of .8 grams of crystal methamphetamine from a
known target in the Waimea District.
Controlled purchase of 9.0 grams of marijuana from a know target in the
Waimea District.
SPECIAL PROJECTS:
+ Members of the narcotics vice unit conducted a special project in the for drug
activities reported in Kalaheo. Surveillance was conducted and it appears that there is a
significant amount of drug activity arriving to and from the target residence as I I
vehicles and two subjects were observed arriving and / or leaving the target residence
Two traffic stops were initiated_ During these two traffic stops none of the subjects
were suspected to be involved in drug activities, as a result no Citations were issued and
warnings were given.
Two other traffic stops were attempted. The first vehicle (unknown license plate)
made elusive maneuvers and the vehicle was able to flee prior to a traffic stop being
initiated. The second vehicle, the main target, was observed leaving the target residence

and traveling east on Kaumualii Hwy. While "loosely" following the vehicle to gain
probable cause for a traffic stop on the vehicle, surveillance on the vehicle was lost.
Surveillance was conducted in the area for several more hours during which time
no sightings of the target vehicle was observed. Based on the lack of activity from the
main target vehicle, lack of activity at the target house due to the target not being home,
and inclement weather, the project was terminated at around 0115 hours.
During this operation, no injuries were reported or observed. Based on the totality of
the operation it is suspected that heavy drug trafficking is occurring and that contraband
is being dealt from the residence in Kalaheo.. Follow Up for a future project forthcoming.

II. SPECIAL OPERATIONS
A. On 04/11/13, Platoon 2 officers participated in post
shift operation `School Zone" from 0700 -0900 hours on
Kawaihau Rd, fronting the Kapaa Elementary School.
B. On 04/17/2013, Platoon 3 Officers participated in
operation "Buckle Up ", in the Kapaa area. The operation
was conducted between 1500 -1700 hours and 19 citations
were issued during this time.
C. On 04/23/13, Platcon•1 Officers conducted an OVUII
project from 2300 -0230 hours at an Anahola and Kapaa
location. A total of 79 vehicles were screened, 16
citations were issued, no OVUII arrests were necessary.
D. On 04- 25 -13, Platoon 3, 2nd watch Officers participated
in a speed enforcement operation in the Kapaa area. The
operation was conducted between 1500 -1700 hours and 22
citations were issued during this time.
E. On 04/26/13, Platoon 1, 3rd watch Officers conducted a
Pre -shift Distracted Driver project in Kapaa to cite

drivers using an electronic mobile device while driving..
A total of 12 citations were issued during the hours of
1200 -1400.
III. MEETINGS
NONE
IV. COWNWITY ACTIVITIES AND INVOLVEMNT
A. On 04/09/13, Platoon 1 Officers visited the Alcohol
Awareness Meeting at the Kapaa High school during their
3rd watch shift and met with all the sponsors and
representatives of the meeting.
B. Between 04/22/13 and 04/26/13, Platoon 1 Officers held
their pre -shift briefing fronting the Kapaa Elementary
School to be more visible and deter any criminal or
suspicious behavior near and around the school.
C. 04 -23 -13 - a platoon 3 Officer provided a ride -along to
a member of the community to give him a chance to
observe the daily activities an officer encounters
during their shift.
D. The current Platoon 2 acting Sergeant is presently
serving on the Kawaihau Community Little League Board of
Directors. He is also a Head Coach in the Majors
Division, which will run through June, 2013.

DUTIES
Reviews the full range and variety of police reports from the simple to the most difficult and complex.
Conducts first and second reading reviews of police reports. May, for training purposes, supervise others in

MINIMUM QUALIFICATION REQUIREMENT
Training and Experience: A combination of education and experience substantially equivalent to
graduation from high school and one (1) year of experience in central police reports follow -up work.
Knowledge of: departmental rules and regulations, and report reviewing policies and procedures 'of the
Kauai Police Department's Records section; pertinent laws and ordinances of the State and County; crime
classification and coding; office practices and procedures; police records filing methods and systems; the
purposes and uses of standard office equipment, including typewriters, personal computers and peripherals,
calculators and copiers; principles and practices of supervision.
Ability to: independently review the police reports to assure their accuracy and completeness; deal and
communicate effectively with police personnel and others; operate computer teleprocessing and standard
office equipment; follow and give oral and written instructions.
Firearms Requirement: As applicable to the position, must be qualified to carry and/or [possess firearms or
ammunition in accordance with State and Federal laws, e.g. no misdemeanor or felony domestic violence
conviction.

Before the Kauai County Council
On May 1, 2013
On proposed 2013 Kauai County budget
Kauai Police Department
After viewing the Kauai Police Department's 2013 budget verbal and written presentation to the Council it became
clear that the proposed budget lacks specific cost information that needs to be included in order for anyone to
know how and why taxes are being spent by the Kauai Police Department.
In the verbal presentation by Michael Contrades, Deputy Chief, he explained the need to build a training facility and
the funds that will be used to pay for the facility. Contrades did not explain that KPD is moving the Kapaa sub-
station to the Kapaa Armory which contains the space and facilities to train every county employee at once
therefore the funds could be used for other necessary matters.
Other cost information not included is as follows:
1. KPD Internal Affairs Investigations:
KPD has specific officers assigned to conduct internal investigations on complaints from KPD officers and
the public. The investigations are eventually submitted to the Administrative Review Board (ARB) for
decision and recommendation that is submitted to the chief for his final determination. The costs of the
investigations that include salaries, overtime and other related cost for officers involved during and after
the investigations and the ARB are not included in the budget. Cost of officers from patrol assigned to
conduct investigations and the officers assigned to present the completed investigation to the ARB who did
not conduct the investigation are not included and are probably charged to patrol which presents a false
believe in the amount spent on patrol. The importance of accurate details of the cost of investigations and
hearings is amplified by examples such as:
a. A complaint filed against an officer by Chief Perry in 2008 for having hair one inch too long in violation
of a general order that Perry knew the entire KPD believed was not in existence.
The investigation lasted four (4) years and was submitted to the ARB in 2012.
➢ The ARB made a decision in 2012 -
➢ The ARB sustained the complaint against the officer for violating the non - existent general order
even though the officer complied with the non - existent general order.
➢ The officer grieved and the disciplined was reversed in step III by the Employer.
➢ Chief Perry and Deputy Chief Contrades refused to comply with Employers decision and legal
action is pending.
b. A complaint filed against an officer by Chief Perry in 2008 because the officer assisted the parents in
resolving a child custody dispute without incident. Perry filed the complaint against the officer after a
previous complaint was filed by the father of the child because Captain Quibilan now Assistant Chief
interfered in the matter because Quibilan knew a person involved in the dispute. The investigation on
Perry's complaint lasted 1 year and was submitted to the ARB in 2009.
➢ The ARB made a decision in 2009.
➢ The officer was found in violation of a general order and disciplined even though Perry
acknowledged that the officer resolved the situation.
2. Legal:
KPD has pending legal cases that are not included in the budget such as:
➢ Case between Chief Perry and Mayor.
Other pending cases.
3. Salaries:
➢ Page 80 of the budget preparation worksheet indicates three Police Inspector positions that don't
exist. Titles and pay were changed to Assistant Chiefs.
4. Patrol programs such as:
➢ Performance ratings of patrol officers are based on the amount of tickets issued and arrest made.
The program is based on a formula that awards points to officers for each ticket issued and arrest in
which more points for issuing a ticket than making an arrest Officers that do not reach a specific
point level are disciplined even though the officers while performing their patrol duties did not find
violations for issuing tickets.
➢ Special overtime assignments for issuing tickets to meet specific quotas.
5. Workers Compensation:
➢ Workers compensation cost are not specific. KPD uses a private contractor to assist in workers
compensation cases. The cost of the contractor and KPD is not identified. KPD also duplicates
workers compensation requirements and cost by requiring injured employees to be medically
evaluated by a physician selected by KPD in addition to the physician selected by the private
contractor.
➢ In at least one case KPD denied the claim and about one -hour before the hearing before the Dept. of
Labor the employee was notified that KPD reversed its decision to deny the claim. The employee
filed a fraud charge against KPD and the contractor. The cost for the entire process is not identified
in the budget.
6. Time Sheets:
KPD requires patrol officers to complete their time sheets. The cost of preparing the time sheets by officers
is not identified. The cost is more for officers than if clerical employees who are paid much less than
officers prepared the time sheets which is normal for other departments.
7. Police Commission:
➢ The cost of KPD and other employees including the county attorney that are required to attend
police commission meetings including during periods that the commission is pontificating is not
identified.
➢ The cost of time spent in executive session including conducting investigations, making
decisions on complaints and pending legal issued is not identified. The cost of investigations
and whether officers assist in conducting the investigations or is a party to the investigation and
if private investigators are used is not identified.

theft complaint, the complainant was told that there was no status to report so the
complainant had to go over his jurisdiction and contacted his superior officer.
