Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of
the Mayor and the powers of the Police Commission (On- going)

Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (2) and (4), the purpose of this
Executive Session is for the Commission to consult with its attorney as they relate to the hire,
evaluation, dismissal, or discipline of an officer or employee of charges brought against the
officer or employee, where consideration of matters affecting privacy will be involved; provided
that if the individual concerned requests an open meeting, an open meeting shall be held; and to
consult with its attorney on matters relating to a hearing procedure for Report of Investigation on

ACTION
Commissioner Francisco asked whether there will be an overall tally of the
activities that had occurred in 2012. In addition, Commissioner Francisco
asked whether it was possible to put the information in charts and graphs for
public consumption.
Chair Perry stated that although the department is a little behind in
summarizing its reports, the information would eventually be available in
the Police Department Annual Report and the County's website.
Commissioner Francisco stated that in preparation for the budget
discussions, he felt that from a visual standpoint and for public support and
discussion it would help to have the data harvested in a manner that is much
more consumable.
Commissioner Iona asked whether the department is anticipating any type
of supplement or plan that would help the department reach its goals
knowing that funding for the Police Department might be a little tighter in
the upcoming fiscal year with the looming possibility of the State taking
away the County's share of the TAT (Transient Accommodation Tax).
Chief Perry stated that it has been very difficult because, on one hand, the
department is still trying to fill some of its vacant positions; however, a
directive came from Budget Director Ernest Barreira that all hiring shall
cease immediately until further notice. He shared with the Commission that
the department is trying to be fiscally responsible by taking proactive
measures to reduce cost in regard to overtime and by looking at other
resources such as federal and state grants.

Commissioner Iona stated that the reason he brought the issue to the table
was because he felt that the public must be made aware of the issues the
Police Department are faced with and that he does not want the department
to be slighted or short changed just because certain things could not be
accomplished, especially when it's beyond one's control.
Commissioner Francisco shared with the Commission that he recently
attended a County Council meeting where the Chief and his team were
addressing the council on the Police Department's goals and needs. He
thanked the County Council for their unequivocal support of additional
positions in the Police Department. He noted that there needs to be an
execution of a budget that is not only fiscally sound, but in alignment to the
department's mission statement and goals.
Chief Perry informed the Commission that the department has hired two (2)
new Radio Dispatchers that are currently in training. He also shared with
the Commission information on House Bill No. 77 which basically would
transfer department jurisdiction concerning medical marijuana from public
safety law enforcement department to the Health Department.
Commissioner Francisco asked what position the department is taking
regarding House Bill No. 77. Ms. Winn advised the Commission that this
issue is not on the agenda and the Commission cannot discuss and make any
type of determination unless it's on the agenda.
Chief Perry noted that the department does have a position on House Bill
No. 77, which goes in alignment with the current Drug Enforcement
decision with respect to the recent decision of the New York Court of
Appeals in the District of Columbia concerning medical marijuana.

Chief Perry informed the Commission of an e -mail he received from the
Attorney General regarding HRS 92 -F and a request for public records that
contain the names and addresses of all hand gun and rifle permit holders in
the State of Hawaii as well as all names and addresses of all citizens with
registered fire arms. Chief Perry expressed his concerns that the issue may
place gun owners (in his opinion) in harm's way because of the exposure.
He indicated that if someone wanted to get a gun, the addresses would be
available and the gun owners have the potential of becoming victims
themselves.
Chief Perry announced that the department is continually working with
Easter Seals on the Waimea Dispensary but have hit a snag along the way
and are now trying to work out the issues. He noted that a meeting has been
set to discuss the problems. Lastly, the Police Department is working with
the Prosecuting Attorney's office on issues related to the decline to
prosecute cases involving 65 defendants. He indicated that the court's
standard of proving a case beyond a reasonable doubt is higher than the
standard to make an arrest. Commissioner Iona commented that a lot of
times a police officer is required to make split second decisions and from
what the Chief is saying it looks like the officer would now have to go
through a check list before an arrest can be made. He indicated that this
would delay the process and may place the officer in harm's way.

Commissioner Okami asked Chief Perry whether he considered making one
of the goals where the department is more proactive in an attempt to lower

overtime in the department. Chief Perry explained that he has decided to
make that an internal goal in which each Bureau will take ownership of
reaching that goal.

KPC 2012 -52 Discussion on the logistics of the State of Hawaii Police
Commissioners Conference hosted by the Kauai Police Commission in May

Ms. Winn reminded the planning committee that they are permitted to
discuss official business outside of a regular meeting and that all findings
and recommendations should be presented to the Commission at its next
meeting, in which the Commission as a whole will then discuss and vote on
its motions.
Commissioner Iona commented that it would help the Commission if the
planning committee contacted the other Police Commissions to see what
they would want as a topic for discussion. He indicated that he would not
want to have a conference where nobody shows so the Commission needs
make sure to make it worthwhile for them to attend.
Commissioner Francisco pointed out that it would help the planning
committee to see previous programs on what the topics were.
Public announcements for a notarized complaint that was filed with the
Police Commission against an officer of the County. ES -59: KPC 2012 -28.
Complaint filed on October 19, 2012 alleges that the conduct of an officer
of the County was unprofessional by use of intimidation tactics, abuse of
authority, and threatening remarks. Based on the findings contained in the
information, the Commission found that there was insufficient evidence to
rove the material allegations of the complaint and the complaint was

therefore not sustained. The complaint has been forwarded to the Office of
the Chief of Police for further review and investigation if deemed
necessary.

Notes to Budget Summary
For the Period December 2012
The Budget Status Report for December 2012 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2013 is currently at 49% at the 50%
of year lapsed point.
The year -to -date expenditures for the Chief s Office is currently at SO %. Administrative and
Technical Bureau is reflecting 33% investigative Service Bureau is reflecting 31% and Patrol
Service Bureau is reflecting 71% of budget expended.
From the start of the fiscal year, the department acknowledged that the overtime budget
would not be sufficient to cover operations. However, understood that the drastic reduction in
our payroll accounts were due to our vacancies. Therefore, KPD to monitor operations and
ensure sufficient funding is available.
KPD's recruitment was placed at a very high priority for the department and meeting our goal
of filling sworn officer vacancies also meant ensuring our ability to fund the positions and
associated overtime to train the new recruits. As KPD celebrates the successful recruitment, we
also struggle with the loss in momentum due to financial restrictions and recent reductions to
our current operating budget.
In addition to the current year operating cost reductions, supplemental budget guidance for our
FY 2014 Budget submission has been issued. KPD's Budget Proposal meeting was scheduled for
Monday, January 28'' 2013. KPD was tasked with ensuring travel was reduced by the directed
amount of 50%. KPD's Budget Follow up meeting is scheduled for March 1, 2013.

INVESTIGATIONS
BURGLARY:
71yr old victim reported his home burglarized by unknown suspect(s) whereby 8
handguns were stolen. Through further investigation by Detectives and Patrol Officers, 2
of the stolen handguns have been recovered and a possible suspect identified. No arrests
have been made at this time. The investigation is ongoing.
FAMILY ABUSE:
22yr old female victim was choked by her 22yr old husband. Male suspect was arrested
and charged with Felony Family Abuse.
30yr. old female reported being choked and threatened with a handgun by her 33yr. old
live -in boyfriend. Male suspect was arrested for Felony Family Abuse, Terroristic
Threatening 1t degree, and Gun Permit violation. A.357 revolver handgun and a 30 -06
bolt action rifle were recovered as evidence.
MISSING PERSON:
42yr old male subject from California reported missing from Kalalau Valley by a male
subject who had met the missing person days prior. The male witness turned in the
missing person's wallet to police and filed a missing person's report. An extensive
search of the Kalalau Valley and beach area was made by the Department of Land &
Natural Resource Officers with negative results. Missing person not located at this time.
KPD SENSITIVE
CRIlVIINAL PROPERTY DAMAGE:
58yr. old male subject arrested for Criminal Property Damage 2nd degree after causing
$8,000.00 dollars worth of damage to a computer Ticket -Kiosk at the Lihue Airport.
Male suspect used his fists in damaging the kiosk.
TERRORISTIC THREAT:
21yr old female reported being threatened with a knife by her 31yr old boyfriend while a
passenger in a car. Female and suspect were located in a secluded area on the ocean side
of Lihue Airport by Detectives and Patrol Officers. Male suspect was arrested and
charged with Terroristic Threatening 1St degree. A hunting knife was recovered from the
vehicle. Search incident to an arrest revealed subject in possession of a glass pipe
containing residue believed to be that of Crystal Methamphetamine. Suspect also
charged with Promoting Dangerous Drug 3rd degree. Vehicle recovered as evidence and
awaiting a search warrant.
UCPV/UEMV:
23yr old male subject was arrested by the Hawaii Fugitive Task Force (HFTF). Male
subject was wanted on auto thefts and multiple break -in to vehicles in the Anahola area.
Male suspect arrested and charged with Unauthorized Control of a Propelled Vehicle and
Unauthorized Entry into a Motor Vehicle 1St degree.
CUSTODIAL INTERFERENCE:
27yr. old female reported her estranged husband may have left the state of Hawaii to
American Samoa with their lyr old child. Incident occurred on Oahu. Case forwarded to
the Honolulu Police Department.

Kapa'a Hawaii 96746, a parcel destined for that said address was intercepted by
DEA on 012513. On 012813, members of the Kauai Police Departments Vice -
Narcotics Unit participated in the controlled delivery investigation of a half pound
of crystal methamphetamine being sent to a Matthew TAMNIE at an address of
5212 Sokei Rd. Kapa'a Hawaii 96746. Resulting from this investigation,
Matthew TAMME was arrested and charged by DEA for trafficking
methamphetamine.

II. SPECIAL OPERATIONS
A. No Operations for the month of January.
B. Training:
1. 1/09— Members of TSS attended a Firearms re- qualification training.
2. 1/15 -16 —TSS Officer Hanna attended the Reid Interview Training which was
held here on island.
111. MEETINGS
A. 1/03 —TSS Commander attended the Child Passenger Safety meeting on Oahu.
B. 1/09 —TSS attended a case conference with the Office of the Prosecuting Attorney
regarding pending traffic collision investigations.
C. 1/17—TSS Commander attended the Traffic Records Committee meeting on Oahu.

D. 1/28 -30 –TSS members attended a three day Laser Instructor Training hereon
island.

V. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. 1/14 – TSS Officer Hanna conducted a training for the Koloa Elementary School
regarding Active Shooter.
B. 1/31 –TSS Commander and Sergeant attended a County Council workshop
regarding the traffic and parking issues in the Koloa/Poipu area.

ES- 56: Complaint KPC 2012 -27
Complaint filed on 10/19/12, 2012, alleges that an Officer of the County improperly
handled a report of an assault which resulted in the complainant's wrongful arrest.
Based on the information received, the Commission found that there was insufficient
information to sustain the complaint and has forwarded the complaint to the Office of the
Chief for further review and investigation if deemed necessary.
This officially concludes the Commission's revie of complaint KPC 2012 -27.

ES- 61: Complaint KPC 2012 -29
Complaint filed on December 3, 2012, alleging that the conduct of an Officer of the
County was unprofessional by the way he directed his remarks to the complainant in
denying that he never saw the complainant's car insurance papers.
Based on the information received, the Commission found that there was insufficient
evidence to sustain the material allegation of the complaint and therefore the complaint
was not sustained, The complaint has been forwarded to the Office of the Chief fbr
further review and investigation if deemed necessary.

to protect the complainant when a neighbor threatened the complainant and a family
member.
Based on the findings in the Police Report, the Commission found that there was
insufficient evidence to prove the material allegations of the complaint and therefore the
complaint is not sustained. The complaint has been forwarded to the Office of the Chief
for further review and investigation if deemed necessary.
