The following Commissioners were present:t Mr. Jan Kimura Mr. Hartwell Blake (8:43 a.m.) Mr. Herman Texeira Discussion of the meeting, in effect, ensued: CALL TO ORDER Chair Kimura called the meeting to order at 8:38 a.m. ROLL CALL Staff Planner Kenneth Estes noted two Committee members were present. APPROVAL OF AGENDA On the motion by Herman Texeira and seconded by Jan Kimura to approve the agenda, the motion carried by unanimous voice vote. MINUTES of the meetine(s) of the Subdivision Committee Minutes of April 9, 2013 & May 14, 2013 On the motion by Herman Texeira and seconded by Jan Kimura to accept the minutes of April 9, 2013 and May 14, 2013,the motion carried by unanimous voice vote. RECEIPT OF ITEMS FOR THE RECORD (NONE) 1 VA2013 Master Files\Commissions\Subdivis'ions\2013-6-12 Subdivision Conunittee Minutes JUL Z 3 2013 HEARINGS AND PUBLIC COMMENT There was no public testimony. GENERAL BUSINESS MATTERS Transmittal of Agriculture Master Plan, pursuant to Condition No. l.j. of the Tentative Approval Letter dated March 11, 2009 relating to a 7-lot subdivision within the Open (0) zoning district Subdivision Application No S-2009-17 Tax Map Keys: 2-8-012.001 011 Koloa=Aukahi Farm, LLC Mr. Estes read the background information into the record(on file). The applicant has transmitted for the Committee's review an acceptance and copy of the agricultural master plan related to the proposed development in conformance to Condition No. I j. of the tentative approval letter. Staff Planner Dale Cua noted that the property is on the western side of Hapa Road on the way to St. Rafael Church. Chair Kimura questioned the Koloa Community Association's feelings about the subdivision. Mr. Cua noted this is one of the few rural areas in Koloa town. It is reflected in the State land use designation because the area is still in agricultural district. At some point,properties would move into the urban district, but since it is still within the agricultural district this requirement was imposed. Max Graham representing the applicant stated this is a part of Koloa that is Class E soils, basically lava. With the right care, it could be used for agricultural purposes; mango, phnmeria flower growing. The area is in the Kauai General Plan residential community classification. The County's long term goal is that it would be used as part of the residential core. At this point, it seems to be a fair use of the property, pending any future changes into the urban district. On the motion by Herman Texeira and seconded by Jan Kimura to accept the transmittal of the agriculture master plan the motion carried by unanimous voice vote. (Commissioner Blake arrived at the meeting at 8:43 a.m.) UNFINISHED BUSINESS (NONE) NEW BUSINESS (For Action) Tentative Subdivision Action: 2 V:A2013 Master FilesV Commissions\Subdivisions\2013-6-12 Subdivision Committee Minutes Subdivision Application No. S-2013-17, COUNTY OF KAUAI. DEPARTMENT OF WATER Applicant Proposed 2-lot Subdivision TMK• 1-2-002.001 Kekaha Waimea Kauai Mr. Estes read the staff report into the record(on file). Commissioner Texeira questioned how ownership of the parcel was transferred to the County. Mr. Cua stated the way the County typically receives property from the State especially to accommodate existing utility facilities is through an executive order. Kevin Gooding, representing the Department of Water stated that he has not read the Director's report. He noted the executive order was done in 1980. Chair Kimura stated they will allow Mr. Gooding time to review the Director's report while they take up the next agenda items. Subdivision Application No. 5-2013-18, COUNTY OF KAUAI, DEPARTMENT OF WATER AND MARTY HOFFMAN Applicant Proposed 2-lot subdivision TMK• 2-4-006 007, 008, Kalaheo, Homesteads, Kauai. Mr. Estes read the Director's report into the record(on file). Brian Hennessy representing the Department of Water stated most of the conditions are ones they would find acceptable. It is basically a utility subdivision and the Department isn't malting them improve the road. He thinks the Department of Water would find it acceptable that they have a reserve established along the road frontage. Deputy County Attorney Jung stated there was an issue with how the lot was created. They are basically creating a new lot where the Water Department is going to establish a water tank. Mr. Hennessy stated there was basically a tax map parcel and it was assumed that it was a lot,but it was never fonnally designated. Commissioner Texeira questioned Condition E and who would be responsible for expanding the roadway. Mr. Hennessy stated they are only asking to establish the reserve and if there is any future development in that area that the pavement be widened. Corn missioner Texeira stated the Water Department will be putting up a tank but they are not going to be coming back for subdivision approval. 3 V:A2013 Master FilesA Commissions\Subdivisions\2013-6-12 Subdivision Committee Minutes Mr. Cua noted it would be the responsibility of the other owner. On the motion by Herman Texeira and seconded by Hartwell Blake to approve subdivision S-2013-18, the motion carried by unanimous voice vote. Subdivision Application No. S-2013-17 COUNTY OF KAUAI DEPARTMENT OF WATER Applicant Proposed 2-lot Subdivision TMK• 1-2-002.001 Kekaha Waimea Kauai (Continued) Mr. Gooding stated that the conditions were fine. There was no public testimony. On the motion by Herman Texeira and seconded by Hartwell Blake to approve S- 2013-17, the motion carried by unanimous voice vote. Subdivisoin Application No S-2013-19 COUNTY OF KAUAI ONE DIVA LLC (AVI ZADOK), Applicant Proposed 2-lot subdivision TMK• 2-5-003.001 Lawai Koloa Kauai Mr. Estes read the Director's report into the record(on file). Oscar Portugal, representing the applicant, stated he read the Director's report and had no comments. There was no public testimony. On the motion by Herman Texeira and seconded by Hartwell Blake to approve S- 2013-19, the motion carried by unanimous voice vote. Final Subdivision Action Subdivision Application No S-2013-03, JAMES E NISHIDA JR. ET AL Applicant Proposed 2-lot Subdivision, TMK: 4-2-0-22:015, Wailua Kauai Mr. Estes read the Director's report into the file (on record). Clyde Kodani, representing the applicant, stated they have read the Director's report. Commissioner Blake questioned the access. Mr. Kodani stated one access is going to be from Puupilo Road and one from the easement from the back lots. 4 V12013 Master FilesV Commissions\SubdivisionsA2013-6-12 Subdivision Committee Minutes Mr. Cua stated the way the condition was crafted, access to the one lot in the back would be taken through the easement, whereas the lot with the two existing homes would continue to use their existing driveway. Commissioner Blake asked for clarification that all access comes off the one easement. Mr. Cua clarified for the back lot only. Commissioner Blake questioned the existing driveway. Mr. Cua stated the current driveway comes off of Puupilo Road. There was no public testimony. On the motion by Herman Texcira and seconded by Hartwell Blake to approve 5- 2013-03, the motion carried by unanimous voice vote. Modification of Requirement Condition Action Subdivision Application No. S-2003-12, OYAMA PARTNERS/MICHAEL M CASTILLO, Applicant Proposed 2-lot Subdivision TMK: 2-3-002.003 2-3-020.109 Kalaheo Kauai. Mr. Estes read the Director's report into the record (on file). Michael Castillo, applicant, stated he has seen the Director's report a while ago and indicated he has no problem with the report. On the motion by Herman Texeira and seconded by Hartwell Blake to approve S- 2003-12, the motion carried by unanimous voice vote.
