HomeMy WebLinkAboutResolution No. 2009-42COUNTY COUNCIL COUNTY OF KAUAI e~oCutiort ~.~z RESOLUTION TO ADOPT THE FINAL `ELE`ELE FACILITY PLAN DATED JULY 2008 PREPARED FOR THE COUNTY OF KAUAI DEPARTMENT OF PUBLIC WORKS WASTEWATER MANAGEMENT DIVISION AS THE WASTEWATER SYSTEM FACILITY PLAN FOR THE HANAPEPE AND ELE`ELE COMMUNITIES BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII:WHEREAS, the. County of Kauai Department of Public Works Wastewater Management Division owns and operates the `Ele`ele Wastewater Treatment Plant WWTP) and the associated sewage collection system and sewage pump stations,collectively known as the Hanapepe-`Ele`ele Wastewater System, that collects,treats and disposes of domestic and commercial wastewater from the Hanapepe and Ele`ele communities; and WHEREAS, the operation of a Wastewater System in Hawaii is subject to the provisions of Chapter 62 of Title 11, Hawaii Administrative Rules (HAR); and WHEREAS, pursuant to HAR §11-62-23.1 Specific requirements for wastewater treatment works., (i) "For public wastewater treatment works a facility plan shall be initiated when the actual wastewater flow reaches 75 percent of the design capacity of the wastewater treatment works"; and WHEREAS, the design capacity of the `Ele`ele WWTP is 0.8 million gallons per day (mgd), and the actual wastewater flow has reached 0.6 mgd, which is 75 percent of the design capacity of the WWTP; and WHEREAS, in 2005 the County executed Contract No. 7244 with the engineering consulting firm of Fukunaga & Associates, Inc. for purposes of preparation of a Wastewater Facility Plan for the `Ele`ele WWTP; and WHEREAS, the engineering study performed under Contract No. 7244 has been completed, and a final report titled "Final `Ele`ele Facility Plan", dated July 2008 has been prepared; and WHEREAS, as part of the preparation of the Facility Plan the consultant prepared and publicized an Environmental Assessment for the Facility Plan project via the State of Hawaii Office of Environmental Quality Control's bulletin "The Environmental Notice"; and
